Unsafe at any speed

Just one day after I got back in the saddle, I found myself sitting in an L.A. courthouse, a winner — or loser, depending on your perspective — in the annual jury duty lottery.

It quickly became clear I wouldn’t be serving on the case for which I was called.

It was a simple traffic case, resulting in injury. And I was just a little too knowledgeable about traffic issues, and too open in expressing my opinions, for the comfort of either attorney.

What struck me, though, was when the judge asked if anyone in the jury pool, or a close friend or relative, had ever been involved in a collision resulting in significant injury. Almost every hand shot up; the only one that didn’t belonged to the only person in the room who had never held a drivers license.

What followed was a litany of auto-involved mayhem. A grandfather killed while bicycling, a neighbor who died behind the wheel just last week. Others spoke of undergoing years of physical therapy, while some were still undergoing treatment.

I told about the time my car was rear-ended while waiting at a red light, resulting in recurring back problems that continue two decades later. Yet somehow, I forgot about the injuries from the road rage incident that happened while I was riding.

I purposely left out the childhood case in which my cousin fell, or tried to escape, a car driven by her intoxicated father, landing in directly in front of the rear wheel and resulting in a death no one in her family ever recovered from.

Or another incident my senior year of high school, when a lifelong friend was killed after a drunk driver crossed a 20’ wide highway median to hit his car head on.

As a cyclist, I’ve never been anti-car. The truth is, I love to drive; the only thing that approaches the joy I feel on a good ride is cruising down an open road in the middle of the night with the radio playing and the dark filled with endless possibilities.

Yet yesterday’s experience drove home, once and for all, just how extensive the harm caused by cars truly is, touching virtually everyone in our society.

We’ve spent half a century making safety improvements that increase the survivability of the auto occupants, yet have done virtually nothing to reduce the frequency of collisions or the risk to those outside the vehicle.

The focus always seems to be on making the car safer, even though the overwhelming majority of collisions are caused, as my dad liked to say, by the loose nut behind the wheel.

As a society, we’ve become far too comfortable in our cars, losing the sense that the vehicles we rely on every day are dangerous machines.

We text and talk on cell phones, believing we can still drive safely even while acknowledging that others can’t. And routinely ignore laws designed for everyone’s safety — including our own — to the point that a gas company decides it’s a good marketing position to insist they’re on the drivers’ side by creating an app to get out of tickets.

Yes, it’s a joke.

But the problem is that violating the law is so commonplace that we’re all in on the joke.

And did you notice the disclaimer — in white on a light colored background — that says the best way to avoid a ticket is not to speed? I didn’t until I watched it online several times, despite seeing this same spot on TV countless times each day.

The problem is, as traffic-meister Tom Vanderbilt noted the other day, that a drivers license is too easy to get and too hard to lose.

Yet stiffer penalties that would get bad drivers off the road — or cause most drivers to change their behavior behind the wheel — are unlikely to pass anytime soon because most people don’t see a problem, or any viable alternatives to driving.

And instead of focusing on the harm caused by dangerous drivers, auto organizations have a knee-jerk reaction to any loss of pavement that creates space for other road users.

But we have to do something.

Because we’ve reached the point where 40,000 +/- deaths each year is considered an acceptable cost just to get from here to there.

Finally, it has nothing to do with bicycling — other than being my favorite epithet for rude drivers — but this article from the Yale Law Review, by way of LA Observed, is one of the funniest things I’ve read in years.

Today’s ride, on which I was so not invisible, for a change

There are days when I feel like I must be invisible, as one driver after another fails to see me. And too often, tries to drive right through me as if I wasn’t there.

Today was not one of those days.

Not a single car in the bike lane, for as far as you can see. Or ride, for that matter.

In fact, it was just the opposite, as one driver after another noticed my presence on the road, waving me through intersections and patiently waiting for me to pass. And I found myself doing the same, signaling drivers to go ahead, and waving my thanks so often that I felt like a beauty queen in a homecoming parade.

And they waived back in return. Like the guy I gave a small nod to, indicating that he should go ahead and make his turn while I waited at the stop sign. Not only did he notice, but gave me a smile and a wave of thanks as he rolled by.

Even pedestrians got into the act.

Like the guy who stood waiting at a crosswalk on a corner, despite having the green light. Maybe he was waiting for a walk signal that never came. Or maybe he was just waiting.

Either way, he finally began sauntering across just before the light changed, forcing everyone else to wait through the green until he eventually made it to the other side.

“Late start,” I grumbled as he walked by. But instead of getting annoyed, he laughed out loud and gave me a friendly wave for waiting.

Don’t ask me why.

Maybe everyone was just in a good mood. Or maybe the DWP spilled a few cases of Prozac in the city’s drinking water. Except no one drinks tap water in L.A.

Or unfiltered tap water, anyway.

Usually when I ride, I make a point of reminding myself to focus on the hundreds, if not thousands, of drivers who share the road safely, rather than the one or two jerks who don’t.

This time, I didn’t have do that.

Because there weren’t any.

Not one right hook. No left crosses. No close passes, rude gestures, insults, honks or near misses.

The closest I came to any kind of incident was the SUV-driving woman who darted out from a side street when she found a brief gap in traffic, only to spot me directly in her path. So she stopped where she was and waited for me to pass, blocking traffic in both directions until I was safely out of her way.

And yes, I waved my thanks to her, too.

Frankly, I’m grateful to anyone who doesn’t kill me. And unlike yesterday, if there was anyone driving dangerously or illegally, I didn’t notice.

It was a very good day.

Which just goes to show that, yes, we do have them. And more often than you might think.

Even in L.A.

Evidently, we should be glad there’s such a low turnout in local elections

Back when I was in college, one of my Political Science professors gave a lecture about low voter turnout in the U.S.

He pointed out that far more people turn out to vote in formerly totalitarian countries, because they understand the true value of the freedom we take for granted.

Then he flipped through a few surveys, highlighting the percentages of people who hate blacks, Jews, gays and other assorted minorities. As well as those who believe the moon landing was fake and the Earth is flat.

His point was that a lot of people don’t vote.

And maybe we’re better off for it.

Case in point, the 91 and counting comments that followed the brief story on the Times website about the proposed bicyclist anti-harassment ordinance. The overwhelming majority of which were of the standard “I’ll respect bikes when they (choose one or more of the following): respect the law, stop for red lights and stop signs, signal, stay on the sidewalk, stay off the sidewalk, get out of the lane, get out of my way, get a life, grow a pair, and/or stop wearing those ugly clothes.”

I read ’em so you won’t have to. You can thank me later.

Take these two, for example, which pretty much sum up the tone of today’s conversation (and yes, I’ve left the spelling and punctuation exactly the way I found it):

Bicyclists are full of it. There are legally obligated to follow the motor vehicle code. However, I see them run stops signs, run redlights, and make sudden lane changes without signaling all the time.

If bicyclists want respect, they need to follow the rules of the road.

Then there was this one:

Here’s some ideas how to get people to be more vehicle friendly with cyclists;
1.Get cyclists to be more courteous with vehicles & pedestrians
2.Get cyclists to start opeying all driving laws
2. Require all cyclists to install I.D. licence plates on their bike’s so they can be identified when they either break a law, cause an accident, or start somesort of road rage.

Cyclists are known to be rude, obnoxious, law breaking jerks for the most part. They use strong profanity, they spit, they flip you the bird, and they provoke fights, knowing that they can easily get away because they can’t be identified. They seem to have all City Officials on their side, and since they are not wasting gas or polluting the air, they get away with just about anything. What’s it going to take to get Officials to wake up and realize that the root of the problem is the cyclists themselves.

Dave, have you ever considered that if you’re running into so many rude, obnoxious, swearing, spitting, finger-flipping, fight-provoking, law-breaking jerks, that maybe, just maybe, the cyclists aren’t the problem?

Just a thought.

Anyway, after reading all those comments, I was truly shamed, realizing for the first time what dangerous scofflaws we cyclists must be. And understanding that, yes, these people are right to harass us because we pose such a risk to their two+ tons of glass and steel.

I mean, I might actually dent the bumper and get blood on their shiny paint and stuff.

So when I set out to ride today, I took notice of the drivers around me, hoping to learn from their example how to properly assume my place on the road.

Imagine my surprise.

Three of the first four drivers I saw ran stop signs. Not just a rolling stop, mind you — that’s what the fourth one did — but full blown, not slowing down don’t care if you’re in the way I’m coming through anyway stop sign running.

And for the first 1.83 miles, I didn’t see a single driver use a turn signal — and yes, I did make a note of it, because it was so surprising when someone finally did. And no, he wasn’t the first one to turn or make a lane change.

Far from it.

Then there were these four rocket scientists of the road.

I encountered the first two as I sat waiting at the front of the intersection for a light to change, just to left of the right turn lane. Next to me was a small utility truck, which kept inching forward. So I gestured to the driver, pointing out the “No right turn” sign directly ahead of him. Evidently, though, it doesn’t apply to small utility trucks, because he made his turn anyway.

Then the SUV behind him pulled up to the light. Unlike the previous driver, she waited patiently in the right turn lane until the light changed. Then went straight, nearly forcing me into the car on my left before she cut in front of both of us and sped off down the road.

But not before giving me the finger.

Although, to be fair, that was after I called her a jackass. Which I thought showed remarkable restraint, given the circumstances.

Then there was the driver in the Escalade, who saw me signal to move left into the traffic lane. And responded by speeding up to cut me, forcing me to jam on my brakes to avoid rear-ending the parked car ahead of me. Because there just wasn’t room for a massive Escalade and a bike in the same lane at the same time.

The real winner, though, came when I pulled up behind a car that was stopped at a stop sign, waiting patiently for a woman to cross the road. So the driver behind me crossed the yellow line onto the wrong side of the road, passing us both, then blew through the stop without slowing down — forcing the pedestrian to dodge out of his way.

So yes, I can easily see why all these people think we’re such dangerous, law-flaunting outlaws, undeserving of equal protection from law enforcement, since that right is reserved for real, law-abiding, gas-guzzling Americans.

I take comfort, though, in knowing that most of these self-proclaimed traffic law experts probably won’t be voting in the next election.

Oh, and Dave?

“Licence” is usually spelled with an “s.”

I’ll let you figure out where to put it.

I’d know that look anywhere

I grew up in Colorado, where men are men and sheep run scared. Or so the saying goes.

In fact, I grew up right in the heart of sheep country. My high school football team was even called — I kid you not — the Lambkins. Not exactly a name to strike fear the heart of opposing teams.

So I know that look.

The same one I saw in the face of the woman driving the BMW this afternoon.

I was cruising down a side street in Brentwood, making my way home from today’s ride when I saw her car waiting at a stop sign up ahead. I watched closely as she looked to her right and waited. And waited.

And waited.

Even though I knew better, I decided to ride past her, since I had the right of way and there was no way of knowing how long she was going to sit there. Besides, she still hadn’t cast a single glance to her left.

But sure enough, that was exactly when she started to turn left — without ever looking my direction.

So I yelled “Look out!” and jammed on my brakes; she hit hers and we both skidded to a stop, ending up with me directly in front of her. And as I looked at her, she gazed back with the same uncomprehending expression I normally associate with wool-wrapped ruminants.

I was tempted to say something, but it was clear it would just be a waste breath. So I shook my head and rode on, leaving her sitting there with that same blank look on her face.

Then there was the earlier incident, as I was just starting my ride, when I pulled away from a stop sign about the same time as an SUV going in the other direction — only to have her brake angrily as I blocked her from making the left she hadn’t signaled for.

Seeing her window open, I shouted, “Turn signal would be nice.”

And as I went by, I heard a woman in the crosswalk next to me say, “Yeah, good luck with that!”

What to do when the road rages and bumpers bite — part 2

I thought I knew what to do if I was ever in a cycling collision.

I was wrong.

Yesterday I wrote about defusing a road rage incident, based on what I learned as a result of my own run in with a raging driver. A case in which I did just about everything wrong, costing me any chance of a settlement — as well as blowing any shot at a criminal prosecution.

Hopefully, it’s something you’ll never run into. But if you ever find yourself sprawled on the pavement looking up a looming bumper, maybe you can avoid making the same mistakes I did.

After all, it’s so much more fun to make your own.

Let the driver leave.

No, seriously. After knocking me to the pavement, the driver who hit me started to flee the scene. So I jumped up and blocked her from driving off until she finally turned off the engine and got out of the car.

Wrong move. Not only did I put myself at risk of getting hit a second time, it might have been better if she had run away. Police usually take a hit-and-run far more seriously than they do a mere traffic accident, even if you say it was road rage. Hopefully, any driver would have enough decency to stick around, but if not, just note the license number and get out of the way.

Don’t move anything until you have to.

First, make sure you’re out of traffic or that someone is directing cars around you. Then ignore the people who tell you to move it, and leave your bike exactly where it is. And try to keep the driver from moving his car, as well.

Both are now evidence, and the relative positions between them could help show what really happened. Move either one before the police tell you to, and you’ve eliminated a key part of the puzzle. Or at the very least, pull out your camera phone and take photos of everything before anyone moves anything. Trust me, you’ll need them once the lawyers get involved.

Shut the hell up.

This isn’t a bike ride anymore; it’s a legal case. Who was at fault has yet to be determined — and you are just as likely to be blamed as the driver who hit you, if not more. So remember that anything you say can, and probably will, be used against you.

In my case, I tried to attract attention and keep the driver from fleeing the scene by yelling that she’d tried to kill me. But someone told the police that I’d threatened to kill her, instead. As a result, they refused to give me her contact information — and threatened me with arrest if I tried.

So make sure everyone else is okay. Exchange information. Get the names and phone numbers of any witnesses. Listen closely if the driver or passengers say anything, and write it down if you can find a pen and paper. But keep your own lips zipped until it’s time to talk with the investigating officer.

You’re the victim. So act like it.

As soon as the driver got out of her car, she screamed that it was my fault for being in her way. So I found myself yelling back to defend myself against my attacker. Or at least, that’s how it felt from my perspective.

But as bystanders began to arrive, what they saw was a grown man yelling at a middle-aged woman — with no knowledge that she had just used her car as a weapon to run me down. So guess which one they felt sorry for?

I’m not suggesting that you lie or exaggerate. But how sympathetic you seem to the bystanders will determine whose side they’re on — and could influence what they tell the police.

Never refuse medical care

The fact is, you probably are hurt. But you may not know it yet, as the adrenalin and endorphins flooding your brain mask any pain.

So when the paramedics ask if you want to go to the hospital, the answer is always yes. The charges the driver may face will depend largely on the severity of your injuries, as will any future settlement you might receive. And the police will take the case more seriously if they know you’ve been injured.

I refused transportation to the hospital, so the official police report said I was uninjured. And that never changed, even after I was diagnosed with a broken arm and permanent vascular damage.

Be prepared for bias

As I waited for the police to arrive, I was surprised to hear bystanders, who had no idea what happened, say it was my fault because those aggressive, arrogant cyclists never obey the law.

But I was shocked to hear similar comments come from the supposedly impartial officer conducting the investigation. Even though I was stopped at a stop sign when she hit me, the driver claimed I’d run the stop sign and fell over while turning onto the cross street. The investigating officer said he believed her because “all you guys run stop signs.”

Expect to explain the evidence

The simple fact is, many, if not most, police officers don’t receive adequate training in investigating bike accidents. So chances are, they may miss or misinterpret key evidence proving who was really at fault.

In my case, the officers didn’t understand that it wasn’t possible to fall to my left while making a high-speed right turn, as the driver had claimed. And they didn’t grasp that the imprint of the chainwheel on my calf could only have occurred if my foot was firmly planted on the ground at the time of impact. So be prepared to walk them through the evidence. But don’t be surprised if they don’t believe you.

Don’t take no for an answer

This was probably the biggest mistake I made. After conducting their investigation, the lead officer said it was a “he said, she said” situation, and let the driver go without a ticket or charges — then tried to intimidate me by saying I could be charged with filing a false police report if I continued to argue with their decision.

It worked.

So I settled for an incomplete and inconclusive police report that virtually eliminated any chance of justice, financial or otherwise. What I should have done — and what you should do in a similar situation — was insist on talking to a supervisor and demanding a fair and unbiased examination of the evidence.

Those of us in Los Angeles have one more option. If you still don’t get satisfaction, you can call Lt. Andre Dawson, who has been appointed by new LAPD Chief Beck to look into complaints from cyclists, at 213/792-3551.

And maybe if enough of us call, things will start to change.

What to do when the road rages and bumpers bite — part 1

On a good day, nothing beats a good ride.

Days when the sun is shining and traffic effortlessly parts to let you glide by. And you find yourself offering a nod and a wave to express your gratitude for the courtesy of others on the road.

And there are the other days.

Days when traffic snarls and tempers flare. When horns become curses and cars are brandished like threats.

In most cases, that’s as far as it goes.

But when steel and glass impact flesh and bone — intentionally or otherwise — how you respond in the first few minutes before and after can go a long way in determining whether you finish your ride. Or whether you have a case.

I was the victim of a road rage attack a few years back, and in retrospect, I did almost everything wrong. Over the next couple days, I’d like to share some of the painful lessons I learned so you’ll know what to do if, God forbid, it ever happens to you.

Maybe you’ll be smarter than I was and find a way out that doesn’t pass through the emergency room. Or lose your case before it starts.

Let’s start with those precious few minutes before the impact, when there’s still time to de-escalate and find an exit strategy — or at least find a way to protect yourself and your legal rights.

Ride courteously

Let’s face it. There are hotheads on the road. A driver might be mad because he had a fight with his significant other. Maybe he’s an aggressive driver who doesn’t want to share the road. Or maybe he — or in this case, she — is just a bike-hating jerk. How you react to them can go a long way in determining whether that anger gets directed towards you. So always ride courteously. And if you see signs that a driver may be angry or acting in an aggressive manner, try to give them a very wide berth.

Ride legally

I won’t to tell you how to ride. But I will make one simple point: As Bob Mionske observed, whether or not you obey traffic laws could determine whether you have a legal case in the event of a collision or road rage incident. Simply put, if you run a stop sign or red light, or fail to signal a turn or lane change, chances are, you will be found at least partially at fault regardless of what the driver may have done.

And not just during the incident; police and lawyers will look for anyone who may have seen you riding in the miles and weeks leading up to the incident. So the red light you blew through half an hour before, or even last week, may be used to show that you probably didn’t stop at the stop sign when you got hit — even if, as in my case, the physical evidence shows you did. It may not be fair, but that’s the world we live in.

Keep your fingers to yourself

It’s a bad habit, one I’ve struggled to break with limited success. Unlike drivers, we don’t have horns to express our fear and anger, so it only seems natural to flip off someone who’s just cut you off or threatened your safety in some way. The problem is, it doesn’t work. I’ve never seen anyone respond to a rude gesture with an apology; instead, it only escalates the situation. At best, they may ignore you or respond in kind; at worst, it gives an angry driver a reason to retaliate.

And never, ever flip off a driver behind you.

Let dangerous drivers pass

You have a right to the road, no less than anyone with a motor and four wheels. And you have every right to take the lane when the situation warrants it; drivers are legally required to follow or pass safely. But just because it’s the law doesn’t mean that’s what they’re going to do. So the question becomes whether it’s better to stay where you are and fight for your right to the road, or pull over and let the driver — and the situation — pass.

Before my road rage incident, I would have stayed right where I was and held the lane. But I’ve learned the hard way that cars are bigger than I am, and they hurt. So when you find an angry driver on your ass, pull over and let the jerk pass. Then take down the license number, pull out your cell phone and call the police.

Snap a photo

Your camera phone may be one of the most important safety tools you own; I keep mine within easy reach in a Topeak case attached just behind my handlebars. When tempers flare, simply pull it out and snap a photo of the other person, as well as the license of their vehicle. Instantly, you’ve established a record of the incident and documented the identity of the driver — destroying the sense of anonymity that allows most violent acts to occur.

I’ve used mine on a number of occasions. And in every case, the driver has backed down and driven away.
