Our government in action: Encouraging drivers to park in bike lanes

It’s against the law to drive in a bike lane. But not, apparently, to park in one.

At least, not here in the late great Golden State.

I found that out this morning as I was reading through the California Driver Handbook, looking for ways it could help educated drivers about the rights of cyclists, and how to drive safely and courteously around bikes. And there it was, on page 26, in the section on Bicycle Lanes.

You may park in a bike lane unless a “No Parking” sign is posted.

Evidently, the DMV thinks drivers should have the right to park here.

That set me off on a daylong search of the California Vehicle Code. And unbelievably, I couldn’t find a single word prohibiting parking in bike lane. Or any specifically permitting it, for that matter.

A Class 1 off-road bike path, yes.

In fact, you’re not allowed to sit, stand, block, park, or otherwise obstruct an off-road bike path in any way. Which would no doubt come as a surprise to the many people who sit, stand, block and otherwise obstruct the beachfront bike path through Santa Monica and Venice.

But while that can be a major pain in the butt when you’re out for a ride, it’s not likely to result in serious injury.

On the other hand, blocking a bike lane could, by forcing cyclists out into the traffic lane where drivers aren’t likely to be looking for them — especially if there’s a bike lane present.

As noted above, there are restrictions against driving in a bike lane, except to turn or park. There are restrictions against parking on a sidewalk, in a crosswalk, within 15 feet of the driveway of a fire station, or next to an obstruction or excavation if it would block a traffic lane.

But parking in the only lane on the street specifically devoted to bikes?

No problem.

Cyclists are actually required to use the bike lane if there’s one available on the street they’re riding, although they are allowed to leave it to pass, turn or avoid an obstruction. Such as a car parked in their way, for instance.

The only good news is, it is against the law to double park. And as Enci points out, most bike lanes in L.A. — and throughout California — run adjacent to the parking lane.

So there actually is a benefit to all those bike lanes that force you to ride in the door zone.

At least it keeps cars from parking there.

Try it yourself. Take a look at the DMV’s list of traffic infractions, and see if you can find a single one for parking in or blocking an on-street bike lane.

Update: Stephen Box, L.A.’s leading bike activist, points out that parking in a bike lane is prohibited in Los Angeles under the city’s Municipal Code, under a revision passed just three years ago — and which was, not surprisingly, opposed by LADOT. There’s also an argument to be made that CVC 21211 prohibits parking in on-street (Class II) bike lanes; however, since it refers specifically to Class I bikeways, that’s a grey area at best. And it does nothing to address a state Drivers Handbook that tells motorists they can park in any bike lane they want, unless there’s signage specifically prohibiting it.

From the high of the TranspoComm, to the low of the Public Safety Committee

Last month, cyclists stormed the bike-only Transportation Committee meeting. And left feeling we like were finally getting somewhere.

That was then.

Today, the Public Safety Committee took up the proposed anti-harassment ordinance, and it couldn’t have been more different.

These bikes, and the riders on them, were nowhere to be seen at yesterday's committee meeting.

It started out in front, where the line of bikes that had been chained to the City Hall railings last month were noticeably missing. And continued into the lobby, where the guard at the front desk noted that I was only the 4th visitor to arrive for the meeting.

Aside from LADOT Bicycle Coordinator Michelle Mowery, there were only three people there to speak in support of the measure — Aurisha Smolarski and Allison Mannos from the LACBC, and myself.

As it turned out, we were vastly outnumbered by the four council members. Jan Perry and Tony Cardenas seemed open-minded, although Cardenas commented that it’s so dangerous to bike in L.A. that he won’t let his children ride on the streets.

What does it say about this city when even members of our own government say it’s too dangerous to conduct such a benign and legal activity as riding a bicycle?

However, Cardenas offered to work with us and use his contacts in the state legislature to address some matters on the state level, such as increasing the amount of bike-related content in the state driver’s handbook.

After talking with Aurisha and Allison afterwards, we have every intention of taking him up on his offer. Although, as usual, I intend to push my luck and try to get more bike-related questions on the drivers test, as well.

Dennis Zine, a former police officer, and committee chair Greig Smith were a different matter. Despite their assertions to the contrary, if either of them support cycling, they did a damn good job of hiding it.

When Perry brought up the increasing popularity of late night group rides, Zine shot back “And they break every law in the book.” Which, of course, had nothing to do with the topic of conversation.

Smith also questioned whether there was anything the city could do about banning harassment, since many of these things are already against the law and most traffic laws are regulated by the state. And Zine stressed that no enforcement of such an ordinance would be possible unless a police officer actually saw the infraction.

Sort of like the situation right now, in other words.

As Zach Behrens noted on LAist, Zine made the point that L.A. is now, and probably always will be, a city dominated by car traffic at the expense of other modes of transportation.

To which Aurisha boldy shot back, despite Smith’s repeated attempts to cut her off, that we can’t continue to follow the same old car-centric model. And that this is an opportunity for much needed change.

The end result, though, was that the matter was referred to the City Attorney’s office for a report on what was possible — rather than simply coming back with a recommendation for an ordinance. Or as Damien Newton put it on Streetsblog, adding an unnecessary third step to a simple two-step process.

And blowing an easy chance to support the riding community.

Below is the text of my statement to the committee, taken from my notes:

Good morning. I’m Ted Rogers, and I write the blog Biking In LA.

In 30 years as an adult cyclist in cities across the U.S., Los Angeles is by far the most dangerous city I’ve ever ridden in, due to a lack of adequate infrastructure and a minority of dangerous drivers.

In the short time I’ve been writing this blog, I’ve heard from hundreds of cyclists who’ve been harassed and intimidated by drivers. This includes passing too close; lurching towards cyclists; honking to startle or intimidate; throwing objects; touching, pushing or hitting cyclists; and yelling things such as “get off the road.”

These are most likely to happen to less experienced — and therefore, more vulnerable — riders who lack the skills and confidence to assertively take the lane, as well women who may not feel safe on riding less populated side streets alone, and so prefer to ride on busier main streets.

However, it can happen to anyone. Ask any cyclist, and they will have a story to tell about being harassed on the roads; I myself have been a victim of a road rage assault.

At a minimum, this ordinance should ban all forms of harassment; establish a minimum three-foot passing distance; give cyclists unquestioned right-of-way in bike lanes, just as pedestrians enjoy in crosswalks; ban short-stopping, lurching towards or deliberately cutting in front of a cyclist; and require LADOT to educate drivers about the rights of cyclists.

Finally, in conclusion, I would like to read an email that was received by a friend of mine following the Thompson sentencing on Friday.

“I live in L.A. and it really irritates me to see you people riding all over the right hand lane in traffic. I often imagine running you over and speeding away. I think if I ever have the chance to hit one of you on Sepulevda Blvd; you know, that long stretch of road near Skirball Center where it sometimes gets lonely? If I ever have the chance to hit one of you and get away with it — I’m gonna do it.”

KABC Channel 7’s Gene Gleason reported on the committee meeting, including a brief comment from yours truly at the end. And that friend who received the threat was the much-respected Will Campbell.

After the road rage case, a Monday hearing on the anti-harassment ordinance

In sentencing the soon-to-be ex-doctor Christopher Thompson for the road rage assault on two cyclists in Mandeville Canyon, Judge Scott Millington called the case a wake-up call for motorists and cyclists. And said that people on bikes are particularly vulnerable on the streets of L.A.

A few members of the City Council already knew that.

Transportation Committee Chair Bill Rosendahl and Ed Reyes, Chair of the Planning and Land-Use Management committee, co-sponsored a resolution requesting that the City Attorney work with LADOT to craft an ordinance that would prohibit harassment of bicyclists in Los Angeles.

A motion in favor of the ordinance was approved by the Transportation Committee last month, with the support of Rosendahl and Paul Koretz (CD5) — the only two members still present when it came up for a vote.

Now it’s scheduled for a hearing before the Public Safety Committee this Monday.

As Dr. Alex Thompson notes on Westside Bikeside, attendance by bicyclists probably isn’t necessary at this point.

On the other hand, this is your chance to take a stand in front of a committee that has yet to demonstrate its support for the bicycling community the way Rosendahl and the Transportation Committee have — and to make your suggestions about what should be included in a new law designed to protect cyclists.

And maybe help make us just a little less vulnerable in the years to come.

The hearing will take place Monday, January 11 at 9:30 am  in room 1010 of the Los Angeles City Hall, 200 N. Spring St. The motion — 09-2895 — is #4 on the agenda.

Speaking of the road rage doctor, Bob Mionske offers his own insights on the sentencing, as well as what it really does — and doesn’t — mean for drivers and the cycling community. Including this:

And just as cyclists notice—and remember—the occasional dangerous motorist, it is the occasional rude cyclist that motorists notice and remember. It is these minority of bad actors on the road that lead to much of the resentment towards each other. However, the real issue here is not “scofflaw cyclists,” or “motorists hell-bent on killing cyclists,” it is competition for the limited resource of space on the road. And for that, motorists owe a debt of gratitude to cyclists. First, every cyclist on the road represents one less car contributing to congestion. Yes, sometimes motorists will be slowed for a few seconds, but in the larger picture, those few seconds will be offset by the time they save for every car that is not on the road ahead of them. Second, every cyclist on the road represents one less car consuming gasoline, and one less car contributing to air pollution and climate change. Finally, every cyclist on the road represents less wear and tear on the roads. These are benefits that accrue directly to all motorists in the form of less demand for limited resources, less demand for regulation of driving, and less demand for our limited tax dollars. Instead of attempting to harass cyclists off the road and back into their cars, motorists should be thanking cyclists for the benefits they provide — and they can do that by simply respecting cyclists’ need for a safe space on the road.

On the final day to submit comment on the proposed bike plan, LACBC receives strong support for a better bike plan. Travelin’ Local guides you to the best views in Los Angeles. Bicycle Fixation enjoys a used-tire sculpture at Hel-Mel. Long Beach’s cycling expats take a photo tour of Tucson, including the beautiful Bike Church. Bike San Diego reports that carelessly killing a well-lighted, bike lane-riding cyclist isn’t worth a single day in behind bars. But S.D. traffic signals are finally starting to respond to bikes. Is this our Howard Beale moment?

Sometimes I think I’m too political. Then there are times when I don’t think I’m political enough.

This is one of those times. Though which one, I’m not quite sure.

You see, I was always one to fight for my right to the road. A driver cuts me off or passes to close and he was going to hear about it, and I was never reluctant to give an unfriendly driver a friendly wave. Except I usually used just one finger. And it usually wasn’t that friendly.

Then one day I gave that one finger wave to the wrong woman, and she tried to shove her car up my ass. And nearly succeeded.

I had a lot of time to think as I recovered from a broken arm, and the 18 months my mangled bike was tied up as evidence in a civil case — which got me a settlement of a whopping $2500, most of which went for attorney fees.

I realized that, justified or not, things like that were counter productive, at best. All my ranting and raving never convinced a single driver that I was right, or they were wrong. Just that I was an obnoxious jerk. So now I try to keep my mouth closed, with hands firmly planted on the handlebars — though sometimes I fail, as this post from last week would suggest.

But now it seems like maybe it’s time to fight. To throw open a metaphorical window, and like the Howard Beale character from the movie Network, scream “I’m mad as hell, and I’m not going to take this anymore.”

Seems like every time I check the news online, I find another article like this one from Winston-Salem, describing the hit-and-run accident suffered by a local bicycling doctor. Another cyclist was killed by hit-and-run in Hawaii, but the prime suspect gets released. Michigan riders fighting for a piece of the road. Or this one from Forth Worth, that says cycling in Texas is more dangerous than it need to be — although chances are, you could change the location to anywhere else in the U.S. and it would be just as appropriate.

And that’s just from this weekend.

Even the more positive pieces, like the recent Times editorial, or  this one from Carson City, Nevada, ask drivers to share the road — and stop harassing riders or running us off the road.

Then there are the recent stories that tell us what we already know, that the police — whether here in L.A., Seattle or across the country — don’t seem to take our safety seriously. And too often, the local press doesn’t dig any deeper than the first page of the police report.

To their credit, L.A.’s finest and the local press come through for us in the wake of the good doctor’s Mandeville Canyon brake test. Whether the D.A.’s office and the court system will do the same remains to be determined.

But what happens next time, when it’s you — or me — writhing on the asphalt?

And yes, there was a lot of talk from local politicians about moving forward with the Cyclists’ Bill of Rights following the good doctor’s arrest. But now we can’t even get the Mayor and the rest of the MTA board to devote a lousy 1% each from their proposed sales tax increase to help keep cyclists and pedestrians alive. And after a brief flurry of coverage of cycling issues, the local press has moved on to more important issues, like whether Lindsey is or isn’t gay.

So I find myself getting fed up with it all, and like Howard Beale, feeling mad as hell and ready to do something about it.

And I wonder if it’s just me, or is this, finally, our moment — the time when we join together and scream at the top of our lungs, we’re not going to take it anymore. When we finally take action as a group to demand the respect of drivers, politicians and law enforcement. To insist on our rights as cyclists and as Americans. And ensure the safety of every rider, here in L.A. and around the country.

Or are we just going to get back on our bikes and let this moment — and our anger — pass forever, like all the other such moments before?

 

Streetsblog covers the exceptional police protection at last Friday’s Critical Mass in Santa Monica. The stupidest bike lane in America has been discovered right here in Westwood (though personally, I’d vote for the bike lanes on the new Santa Monica Blvd. that end without warning in Century City, leaving riders to fight for space on an over crowded, high speed thoroughfare). A student at Humbolt State may or may not have been fatally injured in a traffic accident. As if road rage wasn’t enough to worry about, someone is shooting cyclists on Long Island. Riders in New Jersey share our complaints about crowded and inadequate roadways. Finally, a writer for the Concorde Monitor suggests cyclists and drivers can all get along if we just use a little common sense and think more like fishermen.

Stop the presses! And blame the bikers!

Today’s Streetsblog picks up the story of the Seattle Critical Mass incident we discussed yesterday. And zooms right in on the fact that there are two sides to this story — except where the police and local press are concerned.

Now, I should mention right up front that I’m no fan of Critical Mass. I understand, and share, many of the philosophies expressed by CM riders, and there are riders whose opinions I respect who are active participants.

I simply think it’s counterproductive.

At a time when we’re struggling to get the respect and courtesy we deserve, CM reinforces the attitudes that many drivers already have — that cyclists are aggressive, arrogant, rude and inconsiderate, and have no respect for other users of the road. Let alone the law.

However, the blogosphere has been active in the wake of the Seattle incident, so I’ll let other writers address the questions of whether CM is right or wrong, and how — or whether — it can be fixed.

For me, the more interesting topic is the fact that, as the Streetsblog article points out, the local authorities and press immediately went into the standard blame bikers first mode. Instead of listening to the many bikers who said the driver was angry and aggressive and instigated the incident, they immediately assumed that he was the innocent victim. Or at the very least, justified in his actions.

Like the Colorado sheriff who decided the problem was bikers who ride two abreast, rather than careless and impatient drivers who can’t be bothered to pass them safely — even on nearly empty back country roads — the bias of law enforcement is almost always that the rider is at fault.

The simple fact is, if there is an accident, the police will assume that the rider did something to cause it, unless there is clear and compelling evidence to the contrary, as in the Mandeville Canyon brake check. And in most cases, even if the rider was blameless, the press will jump in with stories about riders who run red lights and flaunt traffic laws.

If we report a road rage incident, the police investigate it as a simple traffic altercation, rather than a violent crime — as they did when I was the victim of road rage, and ended up being threatened with arrest myself. If someone runs us off the road, it’s blamed on a momentarily distracted driver who just didn’t see us. If we report a driver or passenger throwing something at us, they call it littering. If they bother to call it anything at all.

Even in the well-publicized New York police v. CM rider case, it was the rider who spend 26 hours in jail, rather than the cop who assaulted him.

So unless and until the police — and the press that keeps them honest — stop automatically blaming the victim whenever cyclists and cars collide, and start treating assaults against cyclists as the violent crimes they are, we will never experience the equal protection we are guaranteed under the constitution.

And we will never be safe on the streets.

And let’s face it. It’s a dangerous world out there.

The ugly side of an ugly incident

It was a shocking, disturbing and hideous case of road rage that sent two local cyclists to the Emergency Room — one made worse by the realization it could just as easily have happened to any of us.

But surprisingly, some good has come out of the good doctor’s Mandeville Canyon brake test. The Cyclist’s Bill of Rights has gained some traction as a result, in the hope that we can keep things like this from happening in the future. A real dialogue has finally begun between cyclists and Canyon residents. And for the first time, we saw an overwhelming response from our new-found biking community.

Unfortunately, we also saw how ugly that community can be.

As you may have noticed, I go out of my way not to name of the doctor who cause the injuries to those riders — and who reportedly refused to offer any medical assistance afterwards.

There’s a reason for that.

It’s not like it’s hard to find his name online. And as outraged as I was when I read about the incident, I was just as  sickened to read on LAist’s followup to the incident: *Note: There are other Dr. (name deleted)s in the Los Angeles area who work in medicine and unfortunately some are being wrongly threatened.

And this from the moderator of the Socal Bike Forum’s thread on the Mandeville Incident:

Just to clarify on the “name” issue. We all know who the guy is now, where he lives and where he works… but there is no good reason for posting his personal information on a public board. On another bike site, his name and phone number was displayed and some yokels thought it would be fun to start systematic harassment. Turns out, they posted the number of the wrong guy. (EDIT: LAist just closed their “Comments” feature because a number of men with the same name have been threatened.) Similarly, the hospital where the doctor works undoubtedly has more pressing issues than dealing with phone calls from a bunch of angry cyclists. That is why we do not want such information posted. The two riders have asked that no one take matters into their own hands, and to let the police do their job…

As my friend, and author of the excellent Altadena Blog that covers life in Pasadena’s less pretentious northern neighbor, put it, “…but it’s OK the threaten the RIGHT one? Anonymous phone calls to HIS mailbox are OK? I’m with the bikers on this one, but…let the cops do the threatening! That’s what they’re paid for!”

I wonder what the doctors who were mistakenly threatened think about cyclists now? Our public perception is bad enough in this town without going around threatening innocent people.

If you’ve been following the story online, like I have, you’ve undoubtedly seen countless comments threatening the doctor, or vowing retaliation against other drivers — just as there have been comments that the riders had it coming. And countless others vowing mass traffic disruptions if the charges are dropped, or if the good doctor should somehow be acquitted.

This isn’t the time for violence — as if there ever is a right time — or aggressive civil disobedience. That would only undo the progress our community has made over the past two weeks.

No, this is a time for action.

Contact the mayor’s office and your local council member to support passage of the Cyclist’s Bill of Rights, and demand prosecution of all violent acts against cyclists, as well as an end to police bias in favor of motorists. Contact the governor’s office, as well as your local representatives in the state legislature, and ask them to take real action to protect cyclists and encourage safe cycling everywhere in California.

And while you’re at it, remind them that you bike.

And you vote.

L.A. has a bicycling community? Who knew?

Imagine my surprise. Here I’ve pictured myself a lonely voice crying in the bicycle wilderness, and it turns out I may not be so lonely after all.

As part of the continuing coverage of the July 4th Mandeville Canyon incident, KABC-7 did a follow-up report on yesterday’s evening news (thanks to laist.com for posting the link — if KABC has it online, they’re doing a damn good job of hiding it). As part of that report, they mentioned that L.A. city council member Bill Rosendahl has endorsed the Cyclist’s Bill of Rights.

Say what?

That sent my little fingers running to the Google, as our fearless leader calls it, which told me I could read all about it here. Not only did I discover an effort by my fellow cyclists to help keep us all safe and alive, I found out there is actually a community of writers focused on bicycling.

Obviously, I’ve got some reading to do. For instance, here’s a good post on California bike laws and road safety.

Meanwhile, this Cyclist’s Bill of Rights seems to make a lot of sense, and it beats the heck out of my best idea, which was to wear a jersey reading “Thank you for not killing me today.”

Personally, I’m fond of Nos. 3 & 4, based on my own personal experience (see my post from July 8, Road rage against the machine).  But the whole thing makes a great platform for future city planning, as well as giving cyclists a voice in the community, and — finally — the equal protection under the law even, yes, bicyclists are promised under the Constitution.

Frankly, I thought my rabble-rousing days were long over, but it looks like we’ve all got some politicking to do. And if you ride Mandeville Canyon, don’t forget to attend Rosendahl’s Town Hall meeting on Monday, July 14 starting at 6:30p to discuss how bicyclists and residents can co-exist in the canyon. So here’s the problem.

Here’s the problem with bicycling in L.A. (Okay, one of the problems.) Unlike other places I’ve lived, there’s really no great place to ride here.

What should be L.A.’s crown jewel – the beachfront bike path that runs from Will Rogers State Beach in Pacific Palisades down past Redondo Beach – is so clogged with pedestrians and drunken tourists (is that redundant?) that it’s almost impassible at times. The lower section, below the marina, is usually better. But the upper section, through Santa Monica and Venice, is so bad that it’s not even worth riding if you can’t get there before noon. And most riders just avoid it entirely from Memorial Day and Labor Day.

Even if you wanted to ride it, the problem is getting there.

Some people try riding the major streets like Santa Monica, Wilshire or Olympic Boulevards, which is akin to playing Russian Roulette with five live rounds.

The Ballona Creek bike trail, which runs from Culver City all the way to the coast, should be a freeway for the velo crowd. But the need to swerve around all the homeless encampments and drunks passed out in your pathway kind of limits its ride-ability. As does the fact that it runs through some of the most dangerous, crime and gang-infested neighborhoods in the city. (Evidently, I’m not the only one to notice this sort of problem.) So if a nice young man with facial tattoos stops to admire your bike, I’d suggest giving it to him. Seriously.

You can get to the beach by taking the bike lanes on Colorado, if you don’t mind stopping every few blocks and dodging buses once you get below 4th. Or you can try avoiding all the oblivious drivers with their surgically attached cell phones on Montana.

But the best, and most popular, route to the coast is the bike lanes along San Vicente Blvd. Unlike most of L.A., the drivers on San Vicente are used to seeing bicyclists, so they usually drive safely, and there are no stops signs, and only two stop lights, giving you a safe, fast ride. But even here you can have problems, like when a construction or film crew takes over the bike lane for no apparent reason, forcing you to compete with drivers for the limited space remaining in the traffic lanes.

And don’t even get me started on riding PCH through Malibu.

Sure, it’s flat and scenic, making it one of the area’s most popular rides. But with narrow – or sometimes no – shoulders on the road, high speed traffic, countless cars turning right in or out of driveways, and frequent construction sites that force riders into traffic lanes – which resulted in the death of two riders a couple years ago – it’s often more demolition derby than relaxing ride.

Sure, I used to ride it anyway, like everyone else. But these days, my wife insists that I come home in one piece.

Go figure.
