Morning Links: Police investigate as Corona del Mar bully says he’s sorry; Canadian cyclist loses all in theft

Newport Beach police are investigating the video we linked to yesterday showing a bully motorist berating a bike rider in a profanity-laced, homophobic tirade, for the crime of riding on the sharrows.

And yes, they’re now taking it very seriously, after the rider was initially blown off when he tried to file a report.

Let’s hope he likes the way he looks on the screen; the Facebook video has been seen over 400,000 times in just the first 24 hours.

KCBS-2 caught up to the driver, who apologized for the language he used, and said he was embarrassed by the whole thing.

“I’m just an old surfer, knucklehead, and I do apologize for using the words that I used,” Lewis told CBS2 reporter Michelle Gile.

However, you’ll note that he didn’t apologize for threatening the victim. Or for clipping him with his mirror, or for the brake check that forced the victim into the left lane to go around him.

And we’re still left to wonder whether even that apology was sincere, or if it was just the result of adverse publicity from a video that went viral.

We’ll have to wait for the NBPD to complete their investigation to learn what charges will be filed, if any. Although there’s a good case to be made for assault with a deadly weapon and hit-and-run if it can be shown that he really did clip the victim with his mirror.

However, LAPD officers have explained in the past that the mere act of getting out of a vehicle to confront someone is enough for an assault charge.

Let alone threatening to kill him.

Meanwhile, the whole thing just shows how far we have to go in educating drivers about sharrows.

And just about every other aspect of sharing the road with people on bicycles.

Morning Links: Cop gets slap on wrist for beating bike rider, and road raging driver threatens CdM cyclist

Once again, the Los Angeles District Attorney let a cop accused of wrong doing off the hook.

And once again, it involved someone riding a bicycle.

The LA Times got wind of a plea deal reached earlier this year in the case of LAPD officer Richard Garcia, who was captured on security video beating and kicking a bike rider after he voluntarily surrendered and was already restrained by other officers.

Then-22-year old Clinton Alford Jr. was riding his bike on the sidewalk along Avalon Blvd in South LA when a police car pulled up behind him and ordered him to stop. According Alford, the officers failed to identify themselves, and fearing for his safety, he tried to get away, fleeing first by bike and then on foot.

After a brief pursuit, he stopped on his own and laid down on the ground, and was taken into custody without resistance.

That is, until an officer identified as Richard Garcia arrived on the scene, and immediately began beating and kicking Alford; one police official said he kicked the man’s head like he was kicking a field goal.

This is how the Times described the brutal attack.

The officer then dropped to the ground and delivered a series of strikes with his elbows to the back of Alford’s head and upper body, sources said. Alford’s head can be seen on the video hitting the pavement from the force of the strikes, two sources recounted. Afterward, the officer leaned his knee into the small of Alford’s back and, for a prolonged period, rocked or bounced with his body weight on Alford’s back, the sources said. At one point, the officer put his other knee on Alford’s neck, a source said.

Afterwards, several officers can reportedly be seen on the unreleased video carrying his limp body into a patrol car.

Yet despite that, and despite the determination by LAPD Chief Beck and the Police Commission that Garcia and another unnamed officer violated the department’s use of force policies, DA Jackie Lacey quietly negotiated a plea that lets Garcia off without a single day behind bars. Let alone the three years he faced if the case had gone to trial.

And possibly, without even a felony conviction.

Garcia pled no contest to felony assault in exchange for a sentence of community service and a paltry $500 fine to be paid an unnamed charity. After he completes the terms, he will be allowed to enter a new plea to a misdemeanor charge, which would replace the original conviction, and be placed on two years probation.

That’s it.

According to the Times, Lacey thinks that was a tough sentence.

Lacey said that she believed filing the felony charge against Garcia signaled to both police officers and residents that “people will be held accountable.”

“I do think it sends a strong message to any law enforcement officer who is thinking about violating the law,” she said. “If you talk to any officer about a felony on their record gotten in the course of their job, I don’t think anyone would see this as light at all.”

She’s right, it does send a strong message.

It tells every officer on the street that you can nearly kill a man for no valid reason, and walk away without even a felony conviction on your record.

Which is exactly the same message she sent in refusing to file charges against the LA County sheriff’s deputy who killed cyclist Milt Olin while typing on his onboard computer instead watching out for the man who was legally riding his bike in the bike lane on Mulholland Highway — just moments after the deputy texted his wife while driving, something that could have landed anyone else in jail.

And the same message she sent in refusing to indict the three Gardena police officers who killed an unarmed man who was simply trying to tell them they had stopped the wrong men after his brother’s bicycle was stolen, in a shooting captured on dashcam video.

Let’s be clear. Alford is no saint.

He was originally booked on possession and resisting arrest, charges that were quickly dropped when news of the beating came to light. And he faces new charges of pimping, rape and assault with a deadly weapon.

But even the worst criminal deserves protection from rogue cops who take the law into their own hands.

And from a DA who doesn’t seem to give a damn.

One time might be explainable. But three times is evidence of a pattern, and an apparent policy of refusing to hold even the worst police officers accountable for their actions.

Or maybe it’s just the people on bicycles she doesn’t like.

A cyclist in Corona del Mar receives a death threat from a road raging motorist who calls him a pussy and a queer, among many other things, and says he’s just lucky there are witnesses around. All because the rider had the audacity to ride his bicycle on the sharrows, exactly where he’s supposed to be.

They need to get this asshole off the streets before he kills someone. On purpose.

A Santa Monica writer notes that bike theft was up 30% in the city in 2015, and guesses that the trend has continued this year. And wonders if the Expo Line is to blame.

Never mind that the Expo Line didn’t even reach SaMo until May of this year.

The Wall Street Journal calls Armstrong the comeback queen.

The US women’s pursuit team begins its pursuit of a gold medal today with new left-side drive Felt track bikes that promise to shave three seconds off their time.

The world’s top pro cycling teams have voted to boycott the time trial at October’s world championships in Qatar in a protest against cycling’s governing body.

The LA2050 Challenge Grants are back for another year; applications are being accepted between September 6th and October 4th.

A Los Angeles triathlete’s bike was stolen while she was training with her team in Long Beach; her bike was missing when she came back from a swim. As of this writing, a gofundme account to replace it has raised $1895 of the $3,000 goal.

There’s no reason to believe it would have prevented this tragedy, but maybe it will help prevent the next one.

Dozens of Encinitas streets could get bike lanes or sharrows, depending on the width of the street.

A San Diego man teams up with a cop in an unsuccessful effort to recover his stolen bike, though they did catch the suspected thief with a stolen truck and two other hot bikes. Note to ABC 10: $900 does not a pricey bike make.

Morning Links: PVE locals attack 12-year old girl online, spoiler-free Rio bike news, and interstate police bike chase

Proving that some people have no shame, Cycling in the South Bay’s Seth Davidson writes that some Palos Verdes Estates residents are attacking a 12-year old girl online.

Because she had the audacity to speak up in front of the city council to support bicycle safety.

Not unlike the truly offensive bikelash that rose up in the Silver Lake area when 11-year old Matlock Grossman dared to say he didn’t want to get run over when he rides his bike.

As Davidson puts it,

We teach our kids that sometimes the right thing is the hard thing, but maybe we’ve lied to them a little bit: The right thing is always the hard thing. The right thing is the Gandhi thing, the MLK thing, the Lincoln thing. It’s the path everyone wants to take until they note it’s overgrown with weeds, and each blade of grass is the serrated edge of a knife.

It shouldn’t be that way.

Whether or not you agree with them, kids should earn our respect just because they have the courage to get up there and say something.

They deserve to be listened to simply because they have something to say.

And if the haters of the world would just pause long enough to hear them, they might actually learn something.

ESPN profiles Kristin Armstrong, who goes for her third straight Olympic gold in the time trial today, just one day shy of her 43rd birthday.

Now that Robertson Blvd is no longer trendy, LA Magazine suggests four streets that could take its place, and considers the bike and transit options for each.

West Hollywood officially unveils the first four stations for its new WeHo Pedals bikeshare. Which, if it follows the pattern of other bikeshare systems, will cost taxpayers little or nothing.

No, seriously; protected bike lanes are as bad as, say, racism, or attacking a 12-year old girl online, or any other morally reprehensible thing you might come up with.

Only 19 drivers have been charged under Ontario, Canada’s equivalent to the three-foot passing law. Which is 19 more than most places.

Montreal will reopen a bridge after two years of reconstruction, with a shiny new bike path that disappears halfway across.

Finally…

If you’re going to flee after trying to steal a bike, try not to leave your shoes behind. Don’t lead police on a six-mile bicycle chase across state lines on an Interstate highway — and fall down when they tase you, dammit.

And, no, really. We should all feel sorry for those poor drivers who are forced to kill scofflaw cyclists through no fault of their own.

David Drexler strikes a cautionary note in warning about the dangers of even the best cable locks. Even when firmly attached to your car in public spaces.

They almost had my bike yesterday.

Parked in the In-N-Out Burger on Beach Blvd in Huntington Beach for 30 min.  Parked right in front in a high traffic area at the entrance .

My hybrid bike was on the hitch rack with the tires and the downtube clamped in.  For added security I wrapped the pictured thickest Kryptonite cable through the tires and the rack frame.

In the time I was in the store, thieves unlatched the two tire clamps and cut the cable pictured, in one more minute they could have had the bike but something scared them off?

Brazen for them to be working in such a high profile visible location.

He added this in a follow-up email.

Sunday was a real wake up call—I let my guard down and left my hybrid bike on a rack unattended twice for more than 30 minutes each time with just a cable lock on it.  I would never do that if it was not on a car rack. I felt comfortable in Huntington Beach in a high profile parking space and cable locked. I did not believe that someone would approach my car with tools and attempt to take a bike in a busy parking lot with me close by inside.  The rack is new—just got it three weeks ago and I will adjust my security accordingly.  The bike will be both cable locked and u-locked on the rack if I need to leave the bike unattended–same as I do when locking it up around LA and the OC to go in stores.

It seems like overkill sometimes, but I try to keep my bike with me whenever I can.

If not, I field strip my bike, removing anything that can be easily stolen. Then take off my front wheel, and lock it to my rear wheel with a heavy U-lock through the frame, then wrap the whole thing with a cable lock.

And never, ever leave it unattended on a car.

It’s a pain in the ass, but it’s worked so far.

Knock on wood.

And don’t forget to register your bike, just in case.

The head of UCI, bike racing’s governing body, says don’t blame us for the dangerous road course in Rio, blame all those injured bike riders for screwing up, although others may beg to differ. Then again, safe courses reduce the risk of rider error. Not to mention it couldn’t hurt to allow a few practice runs on the course without having to share the roads with vehicular traffic.

Cycling Weekly questions whether Peter Sagan did the right thing in dropping out of Saturday’s road race. Greg Van Avermaet’s victory says no, while the injuries to van Vleuten, Geraint Thomas and Vincenzo Nibali, et al, say yes.

Bike lawyer and BikinginLA sponsor Josh Cohen uncovers an insurance loophole that victimizes hit-and-run victims a second time.

In a piece he penned for a law journal, Cohen points out that insurance companies aren’t required to pay for hit-and-run crashes caused by drivers if the car doesn’t actually make contact with the victim.

He illustrates it with the story of a bike rider who was forced into a stopped car by an inattentive driver.

The client pulled into the number two lane behind the last car stopped. He intended to pass the bus and vehicles stopped behind it in the number one lane once the traffic light turned green. The light turned green. Suddenly the client heard a car accelerate toward him from behind. The driver behind him did not notice him and was bearing down on him. The driver’s car came within inches of the client. The client took his last clear chance and veered back into the lane to his right. He got injured when he crashed into the stopped car to his right.

The driver of the car that caused the crash recognized he was at fault. He pulled over, took out his driver’s license and insurance card, and waited. An ambulance came and took the client away. The police never came. The offending driver left the scene, rendering the case a hit and run. But not exactly: there was no hit. It was a near-miss and run.

The victim’s insurance company denied his claim under the uninsured motored coverage on his policy, which requires actual physical contact — despite the state’s three-foot passing law.

Cohen says the easy and obvious solution is to remove the physical contact clause from the state’s uninsured motorist statute, saying it places an undue burden on vulnerable users.

Sounds right to me.

Belgian cyclist Greg van Avermaet took the gold in the men’s race after leaders Vincenzo Nibali and Sergio Henao hit the pavement less than seven and a half miles from the finish line on the road course’s crappy pavement.

Australian Ritchie Porte is out of the time trial after breaking his shoulder in Saturday’s race, while Italy’s Vincenzo Nibali will have surgery for a broken collarbone. Rwandan team captain Adrien Niyonshuti failed to finish, blaming his bike for the early exit.

Meanwhile, American Andrew Talansky entered the final stage of the Tour of Utah with the lead, but ended up losing the race to Aussie Lachlan Morton.

Morning Links: Surprising stats on CA bike crashes, and unarmed bike rider shot by sheriff’s deputies in Castaic

LA County is by far the most dangerous place in California to ride a bicycle.

Or maybe not.

Following up on his brief look at national bicycling crash stats, Ed Ryder is back with a more detailed look at bicycle injuries and fatalities on a countywide basis in California, from 2004 to 2016. And the results are both exactly what you might expect, and very surprising, depending on how you look at the data.

The good news is, bicycling fatalities dropped slightly in 2014, following a steady upward climb from 2009 to 2013, while injuries continue a gradual decline from a peak in 2012.

Not surprisingly, Los Angeles, as the state’s most populous county, led the way with 41% of bicycling injuries, followed by Orange and San Diego Counties.

The same held true for bicycling fatalities, as Southern California counties dominate the stats, led by Los Angeles at 30%, followed by Orange, Riverside, San Diego and San Bernardino.

However, the surprise comes when you look at injuries and fatalities on a per capita basis.

When Ryder examined the rate of injuries per one million population, he found that Los Angeles County barely made the top ten, coming in just above the state average. Santa Cruz County led the way, followed by San Francisco, Santa Barbara, Marin and Yolo.

When he looked at the rate of fatalities per one million population, Los Angeles didn’t even make the top ten. It turns out that Stanislaus County is actually California’s deadliest place to ride a bicycle, followed by Tulare, Sacramento and San Joaquin Counties. However, Southern California was still well represented with Riverside, Ventura, San Bernardino and Orange Counties making the list.

So what exactly does this mean?

It could be more evidence of the safety in numbers effect, as you’re more likely to be injured in less populated counties.

Or the low death rate could be evidence of lower average speeds and better access to emergency care in Los Angeles County.

But the main thing it shows it that too many people are still getting injured or killed on our streets.

And we need to keep fighting until the last person killed riding a bicycle in California really is the last person killed riding a bike.

Questions are being raised after LA sheriff’s deputies shot an unarmed bike rider in Castaic Tuesday night.

The victim, a homeless man named William Bowers, reportedly jumped off his bike and tried to flee on foot as the officers chased him. He was shot when he allegedly reached for something in his waistband.

However, a witness says he was just walking down the street, after crashing his bike when deputies ordered him to stop, and had his hands down at his side when they opened fire.

The Times says it was unclear why the officers tried to stop him in the first place.

Local residents said the victim was well-known in the area. And despite suffering from drug problems, he never caused any trouble, though he did have a habit of trying to get away from deputies on his bike.

It wasn’t that long ago that shooting an unarmed man was enough to cost an officer his badge.

Now the accusation that someone reached for his waistband is enough to exonerate a cop.

Even if the victim was just trying to hold up his pants.

Maybe we’re not quite as bad as it seems.

It’s been reported that California leads the nation in bicycling fatalities, with Florida a close second.

That doesn’t take into account the difference in population, though; as the nation’s largest state, it’s not surprising we lead in this most unwelcome category.

But if you look at the rate of bicycling deaths on a per capita basis, you get a very different picture. Stats man Ed Ryder created a graph to put things in better perspective, showing the Golden State ranks sixth in deaths per one million population.

As his next chart clearly shows, California has exceeded the national average every year since 2004. And probably before that.

Which leaves us with the question what are we doing wrong?

And what are we going to do about it?

Caltrans and UCLA offer a detailed study of bike crashes in Los Angeles County based on the CHP’s SWITRS data, correlated with ridership based on local bike counts.

Both of which can be problematic; SWITRS relies on voluntary reporting of crashes by local police agencies, not all of whom provide accurate or timely data.

And bike counts only offer a snapshot of who is riding in a given area at a given time. Unfortunately though, it’s the only data available for many areas, since both the city and county of Los Angeles have long failed in their responsibility to collect accurate ridership data.

Without accurate data, it’s impossible to make the informed choices necessary to meet save lives and meet the needs of bike riders.

I haven’t had a chance to dig into the study yet. However, Richard Masoner of Cyclelicious called out a few key points.

  • Right turn only lanes double the risk for cyclists
  • LA Metro Rapid bus lines have a higher risk of bicycle crashes when compared to other primary roads without rapid bus lines
  • Locations with the highest crash risk tend to have below-average bicycle ridership
  • Roads with vehicle volumes over 20,000 have significantly higher average crash counts and crash rates for bike riders
  • There is a higher number of crashes and crash rates in poorer, non-white neighborhoods than higher income, white neighborhoods
  • People of color have higher risk of bike crashes than whites
  • If you ride your bike in high income neighborhood, you’re less likely to crash your bicycle
  • Vehicle speeds above 30 mph are associated with about 30-40% more crashes, but about 200-300% higher crash risk per cyclist
  • Lower-hanging fruit in terms of safety interventions is where ridership is moderate but risk is high

The California legislature could be taking your life in its hands.

Brenda Miller, founder of the PEDal advocacy group, writes that a new bill currently flying under the radar would legalize the California stop at red lights. According to her, SB 986 jeopardizes the safety of cyclists and pedestrians by eliminating the requirement that drivers remain stopped until they check for traffic before making a right turn on the red.

The result, she says, is that most drivers will simply roll through the intersection without stopping. Or looking.

Caught on video: An Atlantic City woman is under arrest for smashing her car into several parked cars in a deliberate attempt to run down a bike rider, who is shown throwing his bike at her car multiple times; police are looking for another suspect, presumably the man on the bike. The driver should be charged with attempted murder; the bike rider with bicycle abuse, if nothing else.

A Florida cyclist’s cross-county dream came to an abrupt end in Alabama when a road raging driver first threatened him with a knife, then ran over ran over his bicycle; the driver faces charges of reckless endangerment and second-degree criminal mischief.

Caught on video too: An Aussie truck driver is now under investigation after he posted video of himself deliberately drenching a group of riders with water, while cackling that he wishes he could run them over instead. It’s bad enough to pull crap like this, but what kind of idiot posts video online of himself doing it?

Now, someone has upped the ante by illegally painting it on the wall where she died.

A Toronto columnist says why not build Pokemon Go lanes, since he’s convinced there are more Pokemon Go players than there are bike riders.

A London father uses security camera footage and Facebook to track down the teenage thieves who stole his daughter’s bicycle.

 

Finally…

Throw away your sports drinks; soon you’ll be quaffing nasty-tasting ketones, while you ride a $3,000 entry-level bike. Singing while you ride is one thing, playing a cello is another.

And parking in a bike lane is bad enough without using it as a staging area to climb a tower on the Bay Bridge.

Over the weekend we shared a photo forwarded by Jim Lyle showing the new signs promoting the three-foot passing law that went up in formerly bike-unwelcoming Palos Verdes Estates last week, replacing bike-unfriendly signs warning that bike laws are fully enforced in the city.

Now local residents have already taken to social media to bemoan the “ugly” signs besmirching their streets. And of course, complaining that bike riders never stop for stop signs.

Which, apparently, makes it okay to pass at less than three feet and run them off the road. Or worse.

However, since the complaining is being done on a website exclusively for residents of the exclusive Rolling Hills Estates, Lyle was kind enough to forward a sample of the comments.

Meanwhile, Cycling in the South Bay’s Seth Davidson posts multiple pages of the same anti-bike and anti-bike-friendly-signs vitriol, while reminding readers that the small victory represented by the signs only resulted from bike riders willing to turn out in force to ask for change.
