Morning Links: Glendora cyclists buzzed by CHP officer; LA Times maps the most dangerous intersection

I received the following email from cyclist Ken Adams Sunday night, relating a dangerous encounter with a CHP officer who buzzed their bikes, then came back to argue his apparent misunderstanding of California bike law.

I’m trying to spread the word of my experience yesterday as far and wide as possible, because it was quite unbelievable and extremely dangerous.

I don’t know if you’re familiar with the roads I mentioned, but they are very popular cycling routes, especially for Saturday morning rides.  I was riding with a friend, starting from his house in Glendora.  There was another training ride with about 9 people starting from a coffee shop in Glendora that I was aware of because of an event invite on Facebook.

We started our ride just after 8 am.  We started the climb on GMR at about 8:15. At approximately 8:30, about 2-3 miles North of Sierra Madre, a CHP SUV passed us dangerously close – probably about 2 feet away. Neither of us gave the incident much thought, as it happens frequently, although it is unexpected from law enforcement.  A few miles later, the same CHP vehicle was stopped and the officer had exited the vehicle.  He was standing on the shoulder and commented something to the effect “watch out, there are cars coming up”.  We turned and looked, but saw nothing.  We assumed he was referring to some type of event that was occurring, so we were extra vigilant.  We never saw any unusual vehicle traffic – in fact, traffic was unusually light for a weekend.

We continued riding, past East Fork road, where GMR becomes GRR.  Approximately 13 miles from the previous incident, the same CHP SUV passed us again, this time much more closely.  He was no more than 1 – 1.5 feet from us.  At that point, the road was straight, there were clear sight lines for at least ½ mile, no oncoming traffic and we were riding single file on the white line.  There are also no lane demarcation lines painted on the road, as the road is less than 2 lanes wide at that point.

We both raised our arms as he passed in a “what the heck” gesture.  The officer continued down the road, but we could see that in the distance he was turning around.  My friend started recording as he returned.  I raised my arm again in a “what the heck” gesture and the officer slowed and started lowering his window.  We stopped our bikes and an animated conversation ensued.  I have included a link to that video on my FB page:

Subsequent to this incident, we continued our ride.  We encountered additional riders and described our experience with the CHP SUV.  Incredibly, they told us they had experienced the same thing.  When I returned home, I went to the FB event page I mentioned earlier and posted about my experience, asking if anyone else on that ride had experienced an issue with a CHP SUV.  I got a number of responses from cyclists who had either witnessed or experienced brushes from this same CHP officer.

It is my opinion that this officer had some type of agenda yesterday.  He either has some type of antipathy towards cyclists, was trying to prove a point, or was trying to provoke a confrontation that he hoped would escalate to the use of force.  Even in a best case scenario, as you can ascertain from viewing the video, he is woefully misinformed about cycling laws and vehicle interactions with cyclists.  Most troubling to me was his cavalier attitude about endangering my life and the life of my friend.  He seemed completely unconcerned, not to mention excessively arrogant.

I filed a complaint on the CHP website yesterday, but I hardly trust the CHP to police themselves with this matter.  In case you’d like to read the content of that complaint, here is what I wrote:

I was riding my bicycle on Glendora Mountain Road and Glendora Ridge Road on the morning of 7/11/2015. At approximately 8:30 am, on Glendora Mountain Road, about 2 miles north of Sierra Madre, a CHP SUV with license plate number 1365395 passed me and the cyclist with whom I was riding with significantly less than 3 feet (I’d estimate about 2 feet). We continued riding and at approximately 9:55 am, on Glendora Ridge Road, approximately 13 miles from the previous incident, the same CHP SUV passed us again, barely missing us, by approximately 1 foot. The officer continued on for some time, then turned around and returned. We flagged him down and had a conversation with him. We have a video of this interaction, which I would be happy to share with you. I would like to point out that Glendora Ridge Road is a very desolate spot with minimal vehicular traffic. The road is less than 2 lanes wide and has no lane demarcation lines painted on the road. At the point we were passed by the CHP vehicle, there was no oncoming traffic, the road was straight with clear sight lines for at least 1/4 – 1/2 mile and we were riding single file on the white line. During our conversation, the officer claimed that he must drive on the right half of the road and that he “cannot violate a law to follow a law” when asked about California’s 3-foot cycling law. He seemed completely unconcerned when I pointed out that he had just needlessly endangered my life. In the course of the rest of my ride and subsequently via social media, I learned that this same officer passed numerous other cyclists dangerously close during this same time period on the same stretch of road.

This officer endangered my life twice, the life of the person I was cycling with twice, at least 4 other cyclists that I’ve been in contact with and who knows how many others. I suspect this type of aggressive and unsafe driving behavior is not what you expect from your officers. This incident has significantly affected my trust in the professionalism of the CHP as an organization. Cycling on California’s roads is sufficiently dangerous without our law enforcement officers adding to the danger. I sincerely hope that this officer receives some additional training on correct and safe vehicular interaction with cyclists, because it is clear that he currently is lacking in this area.

I would very much like to get the dash cam video from his tour yesterday, as I’m sure it clearly shows his two assaults on us, as well as the numerous other assaults on other cyclists.

This officer is a menace to cyclists and needs to be dealt with, swiftly and harshly IMO.  It is bad enough when Joe Citizen behaves this way.  It is completely unacceptable when law enforcement does.

The LA Times crunches the numbers, and identifies LA County’s most dangerous intersections.

According to the story, just 1% of intersections account for 25% of pedestrian collisions; chances are, those same intersections are just as dangerous for people on bicycles. And bike lanes could be part of the solution, along with other traffic calming efforts.

They also report LA Mayor Eric Garcetti will announce a Vision Zero plan next month to eliminate traffic fatalities in the city within 10 years.

The question is whether the city is really willing to make the hard choices necessary to get there.

After all, they can’t even get bike lanes promised in the unanimously approved 2010 bike plan installed on Westwood, Lankershim and North Figueroa, thanks to roadblocks thrown up by a few councilmembers.

20-year old OC driver faces 10 years for 2014 DUI death of Dana Point cyclist

Ten years.

That’s what a 20-year old driver is facing for the drunken collateral damage death of a cyclist in April of last year.

Thirty-nine-year old Haitham Gamal was riding south on PCH in Dana Point when Dominic Devin Carratt lost control of his car at high speed, drifting 200 feet through a bend in the road before slamming into Gamal’s bike.

Carratt’s car continued to drag him another 500 feet — nearly twice the length of a football field — before hitting a curb and flipping over. Gamal was pronounced dead at the scene, simply because he was in the way.

Carratt and his passenger were taken to a hospital with slight injuries, where he was found to have a blood alcohol level of .15.

Normally, that would be almost twice the legal limit. But as an under-aged driver, the legal limit in this case would be zero.

According to the Orange County District Attorney’s office, Carratt will be arraigned today on felony counts of vehicular manslaughter with gross negligence while intoxicated, driving under the influence of alcohol causing bodily injury, and driving with a blood-alcohol level above the legal limit causing bodily injury, along with a sentencing enhancement for causing great bodily injury.

I’d call death great bodily injury, all right.

Unlike the LA County DA’s office, the OC DA tends to take cases like this seriously, and is more than willing to throw the book at killer drivers. And they seldom bargain away a case just to get a conviction.

That may be a product of a lighter case load, or more jail space to house convicted drivers.

Or maybe they just give a damn. And take traffic crime seriously.

Morning Links: Lawyer disputes unarmed, bike-fixing Hawaiian Gardens man reached for deputy’s gun

The unarmed man who was fatally shot by sheriffs deputies in Hawaiian Gardens Sunday night was allegedly reaching for the officer’s gun when he was shot.

Even though the family’s lawyer says he was 20 feet away.

According to the LA Times, 42-year old Johnny Ray Anderson was working on his bike when deputies arrived in response to a prowler call, as well as an earlier report that gang members were smoking crack in a vacant house.

His wife explained that he ran from the deputies because the couple was living illegally in an abandoned house, and he was on a gang injunction list.

Hopefully, forensics will determine who is telling the truth.

Race leader Tony Martin may have crashed out of the Tour de France on Thursday, as he limped across the finish line with a broken collarbone; no word on the condition of reigning champ Vincenzo Nibali, who was taken down by Martin’s crash.

Wednesday was another wet, crashed-filled day at the Tour, but the leading contenders managed to finish safely, although Australia’s Orica-GreenEdge team is on life support. “Break a leg” means good luck in the theater; in bike racing, not so much, as New Zealand’s Jack Bauer learned the hard way.

My bike-friendly hometown seems to be getting less safe for cyclists; no word on whether the recent increase in fatal bicycling crashes could be due to an increase in ridership, however. Meanwhile, the 18-year old driver who killed a cyclist by swerving into a bike lane to avoid hitting a boat trailer — and possibly dozed off behind the wheel — faces a measly misdemeanor.

It’s not just cities. Even Indiana’s Purdue University will have bikeshare before LA does.

An Ohio man gets three years for killing his bike-riding neighbor with a single punch as the man rode away following a dispute.

Kentucky cyclist Cherokee Schill was ticketed for riding in the traffic lane, while another man may have lost his life because he didn’t.

Finally…

When you’ve just stolen a bike while carrying two baggies of coke, maybe you should trying riding it instead of walking. If you’re going to just walk away from a collision after hitting a bike rider, don’t leave your ID behind in the car.

And when you’re an elected official, it’s probably not the best idea to flip off a group of riders after knocking two of them off their bikes.

Just a suggestion.

 

Morning Links: LA advocates sue over Glendale-Hyperion redesign; bike lanes and bikeshare dominate the news

For the first time in memory, LA bike and pedestrian advocates are taking to the courts.

According to LA Streetsblog, a coalition calling for Safe Streets 4 All has filed a lawsuit over the city council’s rushed vote to approve the ill-conceived and unsafe design for the coming rebuild of the Glendale-Hyperion Bridge.

The suit challenges the city’s declaration that the removal of a sidewalk from one side of the bridge would have no impact on the environment or public safety — even though it would force pedestrians to a) take an unsafe half-mile detour to use the sidewalk on the opposite side, b) walk in the bike lane, forcing riders out into traffic, or c) just give up and drive.

While LA is already overly litigious, with self-described community groups filing suit at the drop of a hat to halt any project that threatens their perceived interests or keep tourists from besmirching their streets, this is one that is both necessary and predictable, given the council’s failure to live up to their own calls for a safer and more livable community.

Then again, the suit might also have focused on the council’s apparent violation of the Brown Act, as demonstrated by once again unanimously approving a controversial project with little public discussion.

Which, unless the councilmembers share a hive mind, raises the question of just where that discussion is taking place and why the public isn’t allowed to participate, as the law requires.

Maybe the next lawsuit should be over the ability of individual councilmembers to halt bike lanes on Westwood Blvd and North Figueroa, even though they were previously approved by the full council with a similar unanimous vote.

There seems to be a common theme to today’s news.

Contra Costa County’s El Cerrito plans improvements for bicyclists and pedestrians, including bike boulevards. LA riders are still waiting for the first bike boulevard — aka bike friendly street — that actually goes somewhere. Anywhere.

A proposed Phoenix sales tax increase would fund an expansion of light rail, as well as over a thousand miles of new bike lanes.

Construction begins Monday on Boulder CO’s plan to right-size several major streets to make more room for bike lanes. Meanwhile, a DC-area street shows the long-term benefits of eliminating excess road capacity to make room for bikes and parking.

The Orlando Sentinel calls funding for bike trails the one bright spot in the state’s new budgets.

Looking north of the border, new protected bike lanes will open in Saskatoon next week.

Unfortunately, not all the work is going in the right direction, as Edmonton, Canada votes to undo a road diet and strip out a lightly used pair of bike lanes, much to the glee of a cranky local columnist.

The other theme to today’s news is bikeshare, as the Times’ Laura Nelson explains the state of bikeshare in the LA area, and it’s ability to solve the first mile/last mile problem.

Boise’s new bikeshare system suffers growing pains.

Chicago’s Divvy bikeshare offers a $5 annual membership for low income users, saying Divvy is for Everyone. Something operators of the upcoming bikeshare systems in LA, Long Beach and Santa Monica should seriously consider, since not everyone can afford a high annual membership or rental fees.

Like bicycling in general, New York’s Citi Bike bikeshare faces a gender gap.

Germany’s Tony Martin takes the yellow jersey with a solo win on the cobblestones in Tuesday’s stage of the Tour de France, while Andre Greipel takes stage five in another wet and crash-filled day.

Some of the leading competitors dealt with the cobbles by changing bikes, others with suspension systems. Am I the only one who thinks you should have to ride the whole race with the bike you started on?

Morning Links: DUI driver in Palos Verdes rampage gets three years; scofflaw cyclists no worse than drivers

The Torrance man who went on a drunken rampage through the Palos Verdes Peninsula won’t be driving anywhere anytime soon.

William Thomas Kelly was sentenced to three years in jail Monday after pleading no contest to felony counts of assault with a deadly weapon and driving under the influence causing injury.

Kelly had a BAC of .11 when he crashed into numerous cars, moving and otherwise, in September of 2013. Not to mention nearly hitting a pedestrian, and intentionally forcing a bicyclist off the road and into some bushes before repeatedly running over his bike.

According to the Daily Breeze, the rider, Doug Castile, was in the courtroom for the sentencing, hoping to see some sign of remorse from the man who tried to run him down. But didn’t get a single hit of it.

Maybe Kelly will finally show a little when he gets out in a few years

And hopefully, he’ll have to walk or bike anywhere he goes for the rest of his life.

Interesting interview from Science Friday, as a professor from the University of Colorado Denver says despite perceptions, bike riders break the law at about the same rate as drivers do. But we do it for perceived safety reasons, rather than convenience or time savings, like drivers do.

As if to emphasize the point, a Napa resident complains about those darn scofflaw, semi-suicidal cyclists ruining her drive. And a New York editorial says cyclists have to get on board with the city’s safety plans.

Funny how motorists can see bike riders breaking the law, but never seem to notice the far more dangerous law-breaking drivers they share the road with.

Sad news from Indio, as one of the founding fathers of BMX riding was found dead in a tent over the weekend.

A member of the BMX Hall of Fame, Scot Alexander Breithaupt had organized some of the first races while growing up in Long Beach in the 1970s, before going on to win a national championship and founding SE Racing bikes.

There was no sign of foul play.

He was featured in a 2005 documentary about the sport.

A Hawaiian Gardens man was shot and killed by sheriffs deputies reporting to a report of a prowler last night.

According to his wife, he was just fixing his bicycle when the officers arrived. Although she doesn’t explain why he jumped a fence in a apparent attempt to get away.

No weapon was found at the scene, and no reason was given for the shooting.

Meanwhile, the LA Times calls on Gardena to release the dashcam video of officers shooting the unarmed brother of a bike theft victim two years ago.

A Simi Valley woman was rescued Wednesday after her car went off the road in Latigo Canyon on Monday. She’d been missing for two days after driving to the beach for a run.

Her rescue came when a pair of unnamed cyclists heard her screams for help; something that anyone driving by would be unlikely to notice.

Motorists frequently complain about cyclists in the Malibu canyons.

But one owes them her thanks. If not her life.

Even bike cops are at risk on our streets.

Especially if they don’t maintain their bikes properly.

KTLA-5 reports an LAPD officer suffered an apparent head injury while riding in a residential Sherman Oaks neighborhood Wednesday afternoon.

According to KNBC-4, the officer was leaving the scene of a three-hour police standoff when the brakes failed on both his and his partner’s bikes as they rode down a steep hill. He touched wheels with his partner’s bike and was thrown to the pavement.

While his injury is described as serious, the department tweeted that it does not appear to be life threatening.

And yes, he was wearing a helmet.

However, brake failures on one bike — let alone both — raises serious maintenance issues. Let’s hope the department isn’t risking the safety of its officers by ignoring basic inspections and service on their bicycles.

And evidently, it was a bad day for bike-riding cops, as a St. Paul MN cop was right hooked by a driver looking the wrong way.

It gets worse.

Wednesday we linked to a story about three Sacramento-area cyclists injured by a hit-and-run driver in a stolen car, who was later arrested with the help of a police dog.

Now it turns out he may have done it on purpose.

Thirty-eight-year old Alamar Houston faces multiple felony counts of attempted murder, assault with a deadly weapon and DUI, as well as a host of other charges, for allegedly driving into the cyclists on purpose in two separate incidents, a quarter mile apart.

The Sacramento Bee reports he first swerved into a single rider, then plowed into two other cyclists from behind, leaving two teenage riders seriously injured, before fleeing the scene.

He pleaded not guilty to 17 separate charges on Thursday, while suggesting he needs mental health help.

No shit.

KCBS-2 managed to track down a hit-and-run driver who struck a 12-year old bike rider in a collision caught on stomach-churning security video.

Even though bystanders came to help, the woman never got out of her car or asked how the boy was doing before driving off.

According to the station, she said she assumed everything was okay after seeing the victim get up. Never mind that he could have had major injuries that might not have shown up until later. Or that every driver is required to stop, render aid and exchange information after any collision, no matter how slight.

Police have given her two weeks to respond to their investigation. Which is about 13 days, 23 hours and 59 minutes too long.

But regardless of whether charges are filed, anyone who’d drive off after hitting a kid doesn’t belong behind the wheel. Ever.

Period.

Sad news from the DC area, as a Brazilian police investigator was killed competing in a road race at the World Police and Fire Games. Reports indicate one rider blew a tire and crashed into two other cyclists; the other two victims are in critical condition.

No word on which rider had the blow-out.

According to KTLA-5, 19-year old Bryan Hernandez was riding his bike home from work when he was killed early Tuesday morning. His body was found around 2:50 am at the intersection of Eastern Avenue and Peachtree Street in Commerce.

KNBC-4 says police initially thought he was the victim of a hit-and-run.

Just 19 years old.

At least we only have to worry about LA drivers; six Florida cyclists were injured, one seriously, when his bike slipped on the remains of a roadkill gator. When you’re chasing a bike-riding suspect on foot, be sure to lock your patrol car first.

And when you’re riding with a digital scale, meth and heroin on your bike, put some damn lights on it. And don’t ride on the sidewalk.

And don’t crash into pole trying to get away.

Update: Arrest made in horrifying high-speed Highland Park fatal hit-and-run

North Figueroa was supposed to be safer by now.

Had LADOT been allowed to carry out it’s plans, the street would have undergone a road diet. Not just to install bike lanes, but to calm dangerous high-speed traffic.

Now a bike rider is dead, the victim of a speeding hit-and-run driver.

According to the LA Times, two bike riders were crossing Figueroa at Marmion Way in the crosswalk at 3:02 am when one was hit by car traveling at what police estimated as 80 mph, based on witness reports.

At that speed, there is virtually no chance of survival. Especially since the victim was dragged several hundred feet underneath the car as it sped away.

Witnesses say the driver never braked, before or after hitting the victim.

The second rider wasn’t struck. No word on whether they were riding or walking in the crosswalk.

The victim has not been publicly identified; he is described only as a man in his 20s.

The car’s bumper was left lying in the road, which should make the car easy to identify if it can be found. Police are looking for a small black sedan, possibly a Nissan Altima.

There should be an automatic $50,000 reward for information leading to the arrest and conviction of the driver, based on the hit-and-run reward program recently passed by the city council.

Despite overwhelming support in public meetings, plans for a road diet to improve safety on North Figueroa were halted by Councilmember Gil Cedillo.

Cedillo claimed he was canceling the plans for safety reasons, an argument this morning’s wreck has proven wrong.

Now he has to answer to the victim’s family. And the rest of us.

This is the 34th bicycling fatality in Southern California this year, and the 15th in LA County; it’s also the eighth in the City of Los Angeles.

Update: An arrest has been made in the case.

According to KTLA-5, a witness tipped police to the location of the abandoned vehicle, which had biological matter from the victim on it.

That led them to 21-year old Alexis Virto, who was found asleep in bed with his girlfriend at 7:15 am, roughly four hours after the collision.

Virto was still drunk when he was taken into custody. He insisted that he wasn’t the driver; however, he had injuries consistent with a crash, and windshield debris clinging to his hair.

He was booked on suspicion of second-degree murder and felony drunk driving with great bodily injury.

The LA Times reports the victim is a 33-year old man, whose identity is being withheld pending notification of his family.

The Times also says there were 68 collisions that resulted in severe injuries to bicyclists on that stretch of North Figueroa between 2002 and 2012; there were also nine pedestrians killed in that time period.

Meanwhile, anti-bike Figueroa activist and Boulevard Sentinel editor Tom Topping had this to say:

Why was this person on the street at 3am? Usually only meth-head criminals looking for something to steal are riding around on bikes at that hour.

Update 2: The LA District Attorney’s office has finally identified the victim as Jose Luna, also known as Bizzy.

According to the press release, his alleged killer, Alexis Virto, has been charged with one count each of gross vehicular manslaughter while intoxicated, driving under the influence of an alcoholic beverage causing injury, driving with a .08% blood alcohol content causing injury and hit and run driving resulting in death or serious injury to another person. Not surprisingly, he entered a plea of not guilty to each count.

Virto reported drove the length of two football fields with Luna on the hood of his car.
