Morning Links: New Santa Clarita bike safety campaign; Beverly Hills official calls you an organ donor wannabe

But they lose me with the illustration of a bike crashing into a car. And the last line that seems to put responsibility on riders to avoid getting killed, rather than on drivers to avoid killing someone.

Better Bike’s Mark Elliot quotes Beverly Krasne, city council member and former mayor of the Biking Black Hole, in justifying her adamant opposition to bike lanes on Santa Monica Blvd:

Cyclists are on a donor cycle mission – to give their organs to someone.

Somehow, though, her solution to our perceived recklessness is to keep the city as dangerous and anti-bike-friendly as possible.

Maybe someone should let her know most of us just want to get through her damn city without getting killed in the process.

Police are reviewing the $100 ticket a DC cyclist got for following too closely after he’s buzzed, then brake checked by an angry truck driver — despite riding on sharrows at the time — after bike cam video of the incident is released.

Something tells me the officer needs a little retraining. Or maybe a new job.

And the driver needs to be behind bars.

As long as we’re in DC, I somehow missed this one last week as the US Secretary of Labor says he just wants to ride his bike to work. And that the department is committed to making “cycling to work an affordable, easy and enjoyable option.”

Sounds good to me.

Morning Links: Still no end to Milton Olin investigation, US House committee goes after bike/ped funding

So what the hell is taking so long?

Nearly six months after cyclist and former Napster CEO Milt Olin was killed by a sheriff’s deputy while riding in a Mulholland bike lane, investigators still haven’t sent the case to the DA, claiming they’re just being thorough.

The sheriff’s department raised a lot of eyebrows by deciding to investigate their own officer in Olin’s death, rather than turn the investigation over to an independent agency such as the CHP; I’m told the CHP — which usually handles traffic fatalities in the area — was more than willing to step in but was never asked.

The endless delay just raises more questions about whether the department is leaving no stone unturned in a search for the truth, or simply trying to find a way to exonerate one of their own.

Or perhaps the department itself, since many have suggested that it’s department policy for deputies to use the patrol car’s onboard computer while driving, which would be illegal for anyone not in uniform. And dangerously distracting for anyone, regardless.

Then again, maybe they’re just hoping that once they finally release the results, no one will care anymore.

Not gonna happen.

Once again, small minded representatives in the US House Appropriations Committee vote to gut bike and pedestrian funding. The proposed appropriations bill would turn the popular TIGER grant program into just another roads bill.

More proof, as it it’s needed, that too many of our elected leaders know the cost of everything and the value of nothing.

In advance of tonight’s community meeting to discuss bike lanes vs sharrows on dangerous North Figueroa, Richard Risemberg says your life, health and prosperity are at stake. And astutely calls sharrows the junk-food of bicycle facilities.

In a case of man bites dog, a Hattiesburg, Mississippi cyclist is the victim of a hit-and-run — and witnesses identify the suspect vehicle as a marked police car.

Most Toronto residents — and Canadians in general — want to require licenses for bike riders.

Former Amgen Tour of California winner Robert Gesink has surgery to correct the cardiac arrhythmia that has kept him off his bike in recent months. No word on when or if he’ll race again.

Following our discussion of scofflaw cyclists the other day, Priceonomics says it’s drivers’ fault that cyclists run stop signs. No, really.

And after an auto-centric writer for MotorSport magazine said the problem with cyclists is they get in your damn way and interfere with your right to zoom dangerously around winding roads, wiser heads prevailed and the story was removed from the website. But nothing ever really disappears from the Internet.

Behind the warm and fuzzy jingles, the precocious animal mascots, and the deep-voiced spokespersons, insurance companies are faceless, heartless corporations whose one purpose is to increase premiums and to decrease payouts in order to make the biggest profits possible.

Simply put, THAT is why you need your own lawyer if you have a bike accident.

If insurance companies were “fair,” I’d be out of a job. I am pretty confident that unemployment due to insurance companies deciding to do the “right thing” is not something I have to worry about in my lifetime.

The reality is, after you have had a bike accident and the friendly insurance adjuster calls you, his (or her), goal is to come up with a reason not to pay you. If he can’t outright deny you compensation for your damages, he wants to diminish your case so the company has to pay you as little as possible.

Rest assured, everything you say to that nice insurance adjustor can and will be used against you in a court of law. That is why I – and every other personal injury lawyer – will tell you to refuse to speak to an insurance adjuster or insurance representative. Give the adjustor your lawyer’s name and phone number and hang up.

If you cooperate with the insurance adjuster and you are offered a settlement, it is likely that you are getting 10 cents on the dollar of the value of your case. I was once told by an adjuster that he received a bonus if he could settle a case within 48-hours.

Let me tell you about a case I handled. A client who had a Los Angeles bike accident injured his shoulder. He talked with the kindly insurance adjuster who sympathized and sent him to a doctor (an insurance company sending you to a doctor is a rare occurrence).

SURPRISE! The doctor recommended by the insurance company said my client’s shoulder was fine. The company offered my client $5,000 to settle his case.

My client’s shoulder really hurt. He finally engaged a lawyer (me), and I sent him to a doctor. The doctor I sent him to diagnosed a torn rotator cuff. He underwent surgery. We settled the case for $150,000.

Never forget that insurance companies have more knowledge than you do. They also employ an army of lawyers. They can throw more resources at your case than you even know exist. They have all the power, all the money, and the wherewithal to fight you when you are fighting alone.

You need an experienced personal injury lawyer to level the playing field. I have written here before about how to choose a lawyer, but it bears repeating to say you should look at how or where you got the referral, the lawyer’s experience in your type of case, and the results the lawyer has achieved.

Now go increase your uninsured motorist insurance to the maximum the insurance company will permit, and the next time you see an insurance company commercial, remember, they are not your friend.

Morning Links: Petition urges tougher hit-and-run penalties; an LA cyclist says you’re not above the law, either

A new petition urges tougher penalties for hit-and-run drivers who injure or kill bicyclists, runners or pedestrians, in the wake of the gentle wrist-caress plea deal given the drunken killer of cyclist Andy Garcia.

If you’ve been coming here for awhile, you know I’ve offered my own suggestions on how to put an end to hit-and-runs once and for all.

Meanwhile, another petition calls for an end to the common practice of driving — legally — without plates, which makes it virtually impossible to identify drivers who flee after injuring or killing someone. Although some people want to remove the requirement for a front plate entirely because it reduces aerodynamics and might get dinged during a car wash.

Seriously.

But if some driver takes off after running over my ass, I want the cops to be able to read the imprint of the jerk’s license plate embedded on my butt cheeks.

One way or another, though, something has to be done now to stop dangerous drivers from running away like the cowards they are after colliding with another person or vehicle.

And force them to take responsibility for their actions.

Willingly or not.

An LA bike blogger offers a word of advice to his fellow bike riders:

JUST QUIT BREAKING THE DAMN LAW, PEOPLE!

It’s a good read. And he’s got a point.

Though I might argue with the suggestion that the distain some drivers have for cyclists is justified by our own bad behavior.

But I’ve had the same experience he has of obeying the law only to watch another rider blow through the red light or stop sign I’ve stopped for. Or pausing to observe a motorist’s right-of-way only to have a cyclist swerve dangerously around me and cut the car off — then flip off the driver for the chaos he created.

And yes, it’s inevitably a he.

Granted, traffic laws were not written with cyclists in mind. And sometimes safety dictates observing the spirit, rather than the letter of the law.

But we can’t expect others on the roads to obey the laws we choose to flaunt.

There’s absolutely nothing that says traffic regulations don’t apply to you. Or me, for that matter.

And let’s not forget that if anything bad does happen, you’ll likely lose any chance of an insurance or legal settlement if it can be shown you were even partly in the wrong. Regardless of what the other party may or may not have done.

It may not be fair.

But that’s the world we live in these days.

A UK rider points out the indignities women have to put up with when she’s slapped on the ass from a passing motorcycle. Unfortunately, that’s a story I’ve heard too often from other women, as well.

Now that’s more like it. British drivers who kill while driving with a suspended license will now face 10 years in prison. Then again, I’d vote for prison time for anyone who continues to drive after their license has been revoked.

BOLO for Mission Hills hit-and-run driver who seriously injured bike rider

This morning we linked to a brief item about a bike rider who was seriously injured in a Mission Hills hit-and-run on Sunday.

Now more details have been added to the story.

According to the Daily News, the victim, identified only as a 53-year old North Hollywood resident, was riding west on Devonshire around 9:44 am when he attempted to cross Sepulveda Blvd on the green light. A white car headed north on Sepulveda stopped briefly at the red light before accelerating and crashing into the rider directly in front of him.

The paper reports he rolled onto the hood, smashing into the windshield, before being thrown to the ground when the driver braked before fleeing the scene. He was taken to a nearby hospital with broken bones, but no life threatening injuries.

The story also notes that the victim wasn’t wearing a helmet.

Since he does not appear to have suffered a head injury, the Daily News is apparently under the impression that a bike helmet somehow would have prevented the collision or made a rider impervious to any injury, including broken bones in other parts of the body.

An alert from the LAPD’s Valley Traffic Division describes the vehicle as a white four-door Jaguar, no model given, with black rims. The driver is described as Hispanic male with dark hair, around 30–40 years old.

Anyone with information is urged to contact Valley Traffic Division Detectives at 818/644-8020; anonymous tips can be called into Crimestoppers at 1-800-222-TIPS (800/222-8477).

Keep your eyes open for a white Jag with front-end damage, especially if you ride in the North San Fernando Valley. Let’s help the LAPD bring this heartless SOB to justice.

Congratulations to the Los Angeles Bicycle Coalition’s Team LACBC on exceeding their fundraising goal for this year’s California Climate Ride.

But several of the team members are still short of the money they need to raise to participate in the ride.

I can personally vouch for everyone on the list, all of whom deserve to go on the bike adventure of a lifetime. And each of whom deserves your support for all they do to support your right to ride safely and enjoyably in the City and County of Angels.

In fact, I have never known a more committed and hardworking group of staff and volunteers, and as a board member for the past five years, I’m honored for the small part I play in supporting their work. Which is something I don’t say nearly enough.

But I’d like to call your attention to just one of those potential riders, and ask you to help him get from the California Wine Country to Sacramento next month.

Alex Amerri, President of the LACBC Board of Directors, has done an incredible job of guiding the organization through some turbulent times — often at the expense of his own career and personal life.

I’ve watched as he’s often put in more than full-time work in an unpaid, volunteer position. When he leaves the board — which hopefully won’t be anytime soon — he’ll leave the LACBC a far stronger, more stable and successful organization than he found it, positioned for even greater growth and influence in the years to come.

And you can’t ask any more than that of anyone.

However, the time he’s put in solving problems and creating opportunities for the coalition lately has meant he hasn’t had time to raise the funds he needs to participate in the Climate Ride. In fact, he’s less than a third of the way to his $3,500 goal.

So let’s send a boy to camp.

Or rather, a man to ride.

If you’ve got a little extra money laying around, make a donation to a good cause to support sustainability and improve our environment. And do it in the name of someone who truly deserves a few uninterrupted days on his bike.

And if not Alex, then help one of the other team members who do so much to help you.

Note: Alex has no idea I’m writing this. So let’s not tell him. Just let him be surprised when the donations start coming in, with no idea where they’re coming from or why.

Prepare to be outraged.

It’s not unusual to find a story or two that makes a mockery of justice, and reminds us all that cyclists are still second-class citizens on our streets.

But today’s news carried three examples of just how far we have to go. And how self-centered, heartless and cruel some people can be.

First up, a Massachusetts woman is convicted of a reduced charge in a fatal hit-and-run when the judge rules that a second vehicle that hit the victim afterwards could have caused the fatal injuries. Never mind that the trailing vehicle would never have hit the rider in the first place if the hit-and-run driver hadn’t plowed into her and left her lying in the street.

Or there’s this, as Pennsylvania authorities refuse to file charges against a driver who killed a teenage cyclist — even though she was under the influence of cocaine and prescription drugs at the time. Nice to see them taking DUI so seriously.

And in a truly disgusting demonstration of genuine overly entitled, self-absorbed heartlessness, an Ontario — Canada, not California — driver sues the family of the teenage cyclist she killed for the emotional turmoil that taking his life has caused her. Evidently, she’s the real victim here, not the kid who lost his life, the parents who lost a child or the brother who OD’d because he couldn’t deal with the loss.

I never to wish ill on anyone. But I’m sorely tempted to make an exception in her case.

A severely auto-focused Texas jerk letter writer says “You ‘need’ a car for business, shopping and taking your kids to Burger King. You only ‘want’ to ride your bike…” which places “an unreasonable safety burden on drivers of other vehicles.” Right. And maybe if those kids walked or rode to Burger King they might be healthier now, and as adults.

After a Brit thief steals a $4,200 e-bike, he calls the local dealer for advice on how to charge it. Which turns out to be the same guy he stole it from.

Lance says he’s still the winner of all those Tours de France, regardless of what anyone else says, while former Armstrong lieutenant George Hincapie promises an unvarnished look at pro cycling’s doping era in a new book.

Osaka police crack down on reckless cyclists — or any, for that matter — at the urging of local merchants.

 

Finally…

Morning Links: Wrist slap for drunken hit-and-run killer; Breaking Away’s Dave Stoller was sort-of real

As expected, Wendy Villegas was sentenced to three years and eight months in an overly generous plea deal for the drunken hit-and-run death of Andy Garcia that left two other riders seriously injured, and robbed his fiancé of both her heart and future.

Yes, justice may have been served. But the time does not begin to suit the crime.

Especially for a driver who left Garcia laying in the road to be run over by a second vehicle, and was reportedly still drunk when she was arrested the next morning.

Had she stopped after the collision, it’s likely that the van that followed might have seen her and her victims, and managed to stop in time to avoid them. And Andy Garcia might — might — still be alive today.

We’ll never know.

Meanwhile, the judge made it clear that if Villegas did it again after she’s released, she’d face a minimum 15-years for murder.

So let’s get this clear.

You have to get drunk and kill a second person before the legal system takes it seriously. But you get a virtual pass on the first one.

Even if you don’t show any sign of giving a rat’s ass that you took the life of another human being, and shattered countless others.

Good to know.

A preliminary hearing reveals 18-year old Sommer Gonzales had failed two drug tests while on probation for undisclosed crimes. And yet somehow, she was still allowed on the road to kill 21-year old cyclist Joe Robinson while driving under the influence.

Nice.

Gonzales has additional court hearings scheduled for May 19th and June 6th.

Turns out there was a real Italian-obsessed, bike prodigy, Little 500-winning inspiration for the Dave Stoller character in Breaking Away, the movie that inspired my own lifelong obsession with bicycling. And Steve Tesich, who won an Academy Award for the screenplay, was his teammate in the winning race.

On the other hand, it looks like the hometown Cutters team was fictional, dammit. Although in a case of life imitating art, one was formed in response to the movie.

A Torrance father is going the extra mile for his daughter.

Or rather, 300 miles.

On May 3rd, Joel Elliot will ride his bike 24-hours straight, with a goal of riding 300 miles in that time, to call attention to the rare disease that renders his daughter unable to speak.

The purpose of my ride is to bring attention to Hannah, to Selective Mutism, and to the failure of Torrance Unified to properly address Hannah’s needs.

My ride will take place on the 1-mile industrial loop just outside of the Strand Brewing Co tap room. I invite you all to come do the first few laps with me to kick off my 24 hours. After a few laps, I will continue solo and the group will move into the tap room to celebrate and prepare to help support my long ride. We will do something similar on Sunday when I finish. I would love to have a large group of riders as there is a good chance local news will be there.

A couple of important court hearings today.

First up, cyclists will ride to attend the sentencing of Wendy Villegas for the drunken hit-and-run death of Andy Garcia.

And riders are encouraged to attend the pre-trial hearing for Jose Gonzales, charged with vehicular manslaughter in the death of Pasadena cyclist Phillip O’Neill.

Sometimes it seems like justice moves slowly. And it doesn’t often seem sufficient in cases involving bike riders.

But at least prosecutors seem to be paying attention these days, in part because cyclists are turning out for cases like this.

I plan to spend a lot of time checking out this website about Vintage Trek bikes.

My 33-year old steel-frame Trek is still parked in my office, waiting for the funds to fix it up and get it back out on the streets where it belongs. It may not be as fast as my LeMond, but it hugs the road like it’s on rails, and you won’t find a smoother ride anywhere.

My wife has suggested selling it more than once. But after roughly 130,000 miles stretching from LA to LA — Louisiana to Los Angeles — I’d no more get rid of it than I would her.

Mad props to the 75 fifth graders — yes, I said 5th graders — who rode their bikes 267 miles from Yuma AZ to Carlsbad CA over spring break, riding up to 53 miles a day and up a five-mile climb. At that age, I was happy to ride to the other side of my own neighborhood without falling over much.

The national traffic fatality toll is bad enough; now it turns out it doesn’t include motor vehicle deaths that don’t occur in traffic situations. So add another 6,483 deaths and 91,000 injuries from 2008 to 2011, 39% of whom weren’t in cars.

The publishers of Momentum Magazine says it’s time to move the conversation beyond helmets. I couldn’t agree more; there are lots of good reasons to wear one, but no adult should ever be compelled to.

Bicycling’s Heidi Swift says riding through a cemetery isn’t disrespectful, it’s showing respect for life. Someone should explain that to the director of the Los Angeles National Cemetery, which continues to ban bikes for reasons I will never understand.

Morning Links: Eleven years in drunken Victorville hit-and-run, great Arizona three-foot law video

Now that’s more like it.

According to the Victorville Daily Press, 28-year old Jason Thomas Scott of Victorville was sentenced to 11 years for the — allegedly — drunken hit-and-run that took the life of a cyclist two years ago.

Apple Valley resident David Epperson was walking his bike along Ridgecrest Road just east of Victorville when he was plowed down from behind by Scott’s vehicle, which dragged him over 60 feet before leaving Epperson to die on the side of the road.

Scott was reportedly driving with a suspended license due to a previous DUI conviction at the time of the collision. He’s been behind bars since his arrest in June, 2012; the paper reports he could be out in another three-and-a-half years with good behavior following his plea deal.

Five-and-a-half years behind bars barely seems sufficient. But it’s far more than many other drivers have served under similar circumstances.

And it’s nice to see the life of a bike rider taken seriously for a change.
