Morning Links: Notes from Neil Storm Stephany sentencing, and update on new Camp Pendleton bike policy

Our anonymous Orange County correspondent offers some belated, and very hard-hitting, notes from the recent Neil Storm Stephany case.

As you may recall, Stephany was sentenced to 15 years to life for the heroin-fueled 2014 hit-and-run death of cyclist Shaun Eagleson on PCH in Newport Beach.

The impact statements presented at Stephany’s sentencing were brutal. The Register didn’t (and couldn’t) print half the poignancy. At one point, Eagleson’s mom yelled “I hate you! I fucking hate you!” at the back of Stephany’s head, which he kept bowed for most of the proceedings. She told the judge that no matter how long the murderer’s sentence is, it will never be enough, and she will be at every parole hearing he ever has. She ended her statement with, “I am Shaun’s voice.” No mama should ever have to say that.

Sandra, Shaun’s widow, presented two statements. One detailed the inescapable darkness left by the absence of her husband, who was “my past, my present, my future, my forever.” Although she didn’t quite offer Stephany forgiveness, she wasn’t going to hold onto her hatred, because she recognized it eclipsed everything her husband loved about her. As she was writing her statement, “each word was killing the woman Shaun loved so much. With every ugly word I wrote, I was killing Shaun’s best friend.”

Her second statement was a letter to her unborn child, begging forgiveness: “Once again, I have failed you. Please forgive me. I have cried for you since the first time I lost you. Please find your father wherever he is and tell him I love him.” She described the rush to the hospital, and the denial that flooded her as she clung to her husband’s lifeless body: “Wake up. This isn’t real. We still have adventures to go on.”

Stephany wrote a letter of apology to the family, but it didn’t get him any reduction in sentence, although the judge did grant 450 days of credit for time served. When the defense argued that “some degree of mercy is a appropriate here,” tsk’s of incredulity arose from one side of the courtroom.

Judge Paer used the word “mind-boggling” several times while pronouncing sentence. He pointed out that Eagleson, like many others who use that stretch of PCH, was a vulnerable road user. The judge was mindful of the irony that such “an ugly event could occurring one of the most beautiful places in the county.” “Hopefully,” the judge said, “this case will send a message.” That message is: If you’re gonna engage any homicidal activity, make sure you use a motor vehicle, ’cause otherwise you’re goin’ away for a long time.

My jaw dropped when the judge said, “Believe it or not, I have to give Mr. Stephany a Watson advisement again.” He then recited the advisement, even though it didn’t do Mr. Stephany any good the first time. He also revoked Stephany’s current probation, since it’d expire long before Stephany could even start hoping for release.

(As a side note, one probation was for assault; the victim died of a heroin overdose a month after the assault, with his broken jaw still not fully healed.)

Stephany’s sister is an LA County Sheriff’s Deputy; their uncle is a homicide investigator for the OC Sheriff’s Department. Young Neil was a Boy Scout, First Class. He played team sports in high school, while also taking ROP classes in fire science & first aid. He earned his Professional Mariner’s certificate. Unfortunately, he fell in love with a girl whose family had moved from up north to get her away from unsavory characters who influenced her opiate addiction. It didn’t help; the contagion spread to Neil.

On the day Shaun was murdered, Neil had left his apartment knowing he was going into rehab. When his parents went to his apartment to retrieve his belongings, they found his bags already packed, with his Bible and a rosary his mom had given him for strength.

In December, a juror recognized Neil’s mom and approached her. They spoke; the juror said they think of the family a lot, and hoped that Neil would get help. How kind to get a hug from someone who had to convict your son of murder.

The Stephany case is going to stick with me. Such a small percentage of people, especially in Orange County, commute by bike. Of that tiny percentage, even fewer do so because they like to, rather than out of economic necessity. And out of that number, how many commute fixed? I might be the only one left.

Camp Pendleton riders, don’t panic. Not yet, anyway.

There’s still a lot of confusion over upcoming changes in the access policy for bicyclists at the Marine base.

So Mike Wilkinson reached out to Joe A. Grabman, Assistant Services Officer with the base’s Provost Marshal’s Office, and got this response.

A final decision on the procedure for recreational bicyclists after 01 Feb 2016 has not been made.

Which is about as clear as the mud the base’s Marines have to crawl through after an El Niño rain storm.

I was confused by Officer Grabman’s response, so I called and left a voicemail asking for clarification. He called back just a few minutes ago and told me this:

  • There will be a process or an accommodation that will allow recreational bicyclists who comply with certain requirements to ride through Camp Pendleton.
  • The exact form and requirements of that process or accommodation have not been determined yet. However, they are scheduled to be in place by March 1.
  • Until March 1, bicyclists will be able to ride through Camp Pendleton the same as they have been able to do recently. They will need to present a U.S. or state government issued identification card.

I wish that I had some exact quotes for you, but Officer Grabman talks very quickly. He told me he has been contacted by hundreds of people about this issue, so I guess he’s a busy guy.

Based what I have learned on my own, those who want to ride through the base should remember the usual advice: Your ID must be the original – no copies; comply with the traffic rules of the base, because as you wrote a couple of days ago, “…don’t mess with the Marines!;” the base closes from time-to-time, some times on short notice.

For once, the punishment fits the crime.

And not surprisingly, it comes from Orange County, where the DA and courts take traffic crime seriously, especially when it involves the loss of an innocent life.

Neil Storm Stephany, who killed 30-year old Fountain Valley cyclist Shaun Eagleson in a heroin-fueled 2014 Newport Beach hit-and-run, was sentenced Friday to 15-years to life behind bars.

Yes, life.

Despite signing a statement following a 2011 DUI conviction that he could face a murder charge if he killed someone while driving under the influence, Eagleson shot up with heroin before getting behind the wheel with two additional drugs in his system that may have amplified the effects of the illegal narcotic.

Witnesses reported seeing him weaving dangerously along PCH. But before police could respond, he plowed into Eagleson’s bike, leaving him to die in the street as he drove on; Stephany’s lawyer claimed he was too high to comprehend what had happened.

He also says the self-described substance abuse counselor had planned to enter rehab the next day, too late for everyone concerned.

Stephany’s actions, piled atop a long string of priors, left Eagleson’s wife without a husband, and dashed their plans to have a child together after she had long been told she would never be able to. And left his mother grieving a son taken away too soon, and hoping his killer never again sees the light of day.

As the judge put it in handing out his sentence,

Shooting heroin and getting into a car after being through several rehabs and after being warned of the consequences is mind blowing,” the judge said.

“Yes, Mr. Stephany (you) did not set out to kill again that day, but when you act with such disregard for the safety of others, this can happen.

The sad fact is that two lives were ended that day, and two families shattered. One life lost on the side of the road, through no fault of his own, and the other lost behind bars through his own actions, his parents left to grieve a son lost to drugs.

Despite the possible life term, it’s likely that Stephany will get out of prison one day. Whether he will come out a better man is highly debatable.

Streetsblog’s Joe Linton provides a full report on Wednesday’s meeting on closing the Northvale Gap in the new Expo Line bike path.

In a case of major irony, two of the proposals would run on Northvale Road, directly in front of the homeowners who fought to keep the bike path from running behind their homes. Although the street has a steep hill that could cause many riders to seek an alternate route.

It’s also ironic that the price tag to complete the .7 mile gap runs between $13 million and $52 million.

It was only six years ago that some cyclists rose up to oppose a $30 million plan to extend the beachfront bike path two miles from Will Rogers State Beach nearly to Malibu, bypassing the narrow section of PCH where riders are currently forced to take the lane in front of often speeding traffic.

At $15 million per mile, it would actually have been cheaper than the least expensive option for closing the Northvale Gap.

The obvious choice, given the hill on Northvale, is to place the bike path next to the train line, precisely where the small group of homeowners fought to prevent it.

But where the $52 million to pay for it will come from is a very good question.

As is whether building the most expensive sub-one-mile of bikeway in the city is the best use for funds that could build many more miles somewhere else.

Former San Francisco Bicycle Coalition staffer and current Bike the Vote LA volunteer Marc Caswell is conducting a study of the many Peak Hour Lanes throughout the City of Los Angeles to determine if they affect safety.

For my Masters in Urban Planning, I’m trying to determine if LA’s Peak Hour Tow Away Zones (PHTAZ) have an impact on street safety.

We know that the city has implemented these policies with no attention to safety — but simply to move cars. And they automatically preclude a street from the ability to have a bike lane (since the curb lane becomes traffic) — or from having pedestrian bulb-outs.  So, they are inherently prohibiting safety improvements.

But — I want to know if these unexpected, temporary, and erratic parking restrictions are creating driver confusion and/or increasing the rates of crashes — for all modes.

When I chose this project, I planned to map the crashes to the streets and assumed that the LADOT would have a map of all these zones — but they don’t.  They don’t even have a list.  I’ve had to use Google Street View and my own knowledge to find the 211 miles I’ve found so far…

But, now I need to open it up to the rest of the region and crowdsource the information.  So, I’ve published the map — and am calling on the public to help me identify the blocks I may have missed.

Take a look. And if you see one missing, add it to the map.

The results could make a real difference in how our streets look in the future.

Morning Links: Stephany convicted of 2nd degree murder, KCRW can’t find bike riders to discuss Mobility Plan

No surprise here.

An Orange County jury has found Neil Storm Stephany guilty of second degree murder in the heroin and Ativan-fueled hit-and-run death of cyclist Shaun Eagleson as he rode on the East Coast Highway just over a year ago.

And despite his attorney’s bizarre argument that Stephany can’t be held responsible because he was so high he had no idea what he was doing behind the wheel.

Stephany had been warned following a previous DUI conviction that he could face a murder charge if he killed someone while driving under the influence. Instead he shot up, got behind wheel and did exactly that; he was reportedly found incoherent with fresh needle marks at the time of his arrest.

He faces 15 years to life in prison when he’s sentenced on January 15th.

Despite one juror’s hope that this is a wake-up call for Stephany, it’s a little too late for that.

And for the man he killed.

If you’re carrying 64 tabs of Lorazepam, aka Ativan, on your bike, put a damn light on it and stay off the sidewalk. Talk about casting a big shadow; a little ingenuity and elbow grease, and you, too can frighten the neighbors into thinking a rogue elephant is on the loose.

And this is what happens when you don’t have any women — or men capable of thinking with the larger head — in your marketing department.

Morning Links: Amgen ToC route announced, Stephany trial goes to jury, and the state of cycling in Santa Ana

Looks like they’re going backwards.

Reversing their usual north to south route, next year’s Amgen Tour of California will start in San Diego and end in Sacramento; the race will also include four women’s stages as part of the UCI WorldTour this year. Other SoCal legs include South Pasadena to Santa Clarita, and Thousand Oaks to Santa Barbara.

Word has it bike riding former UCLA and NBA star Bill Walton is particularly stoked about the San Diego start.

Our anonymous Orange County correspondent reports the Stephany DUI murder trial went to the jury today, but no word on whether they reached a verdict; if not, deliberations will resume next week.

She adds,

In closing, Stephany’s lawyer was adamant and clearly believed his own words, but his argument just wasn’t very compelling. Plus I think Juror #11 wanted to smack him.

She also offers a few uncensored thought on the state of bicycling in Santa Ana.

Civic Center Drive has fresh new stripes for, I suppose, a buffered bike lane. The “buffer” is skinny and there are no bike graphics yet, and the placement of the dashed lines is so random I don’t even know if it can possibly conform to the MUTCD.

Also, a fucktard swooping into the semicircular driveway in front of the courthouse and CUT ME OFF and when I yelped, he was all, “What? I didn’t hit you!” Well, true, and the ONLY reason he didn’t hit me while he was failing to yield, failing to signal, and failing to make a proper right turn from the correct lane position is because I have three separate braking mechanisms, all of which I immediately engaged so that his criminal maneuver wouldn’t put me on a goddamn gurney. Maybe all the new visual clutter induced vertigo in his head?

During the 2-hour lunch recess, I rode around and despaired at the wobbly sharrowed path on 3rd Street. And the complete absence of sharrows on, say, narrow-laned Broadway, or anyplace they’d actually be useful on. And the insufficient bike racks. (Ya wanna rack in front of, or at least anywhere near, City Hall? Well, TOO BAD FOR YOU, PAL).

It’s like Santa Ana is just slapping bike & ped infrastructure down wherever it happens to fit, whether it will be functional or not. Kinda like the way God slapped together the platypus from leftover spare parts He had lying around, except that critter works just fine, whereas the hodgepodge of bike stuff in Santa Ana is nothing but frustration.

Downtown Santa Ana makes downtown LA look like a dream world.

Just a day after lamenting that Timbuk2’s new MuttMover messenger bag was too small for the Corgi, the company tweeted back that they have a bag large enough to carry a 40 pound dog.

Or more precisely, had one, since it’s no longer listed on their website.

Looks like the Corgi will have to keep waiting for her first bike ride, dammit. Then again, I’m not sure how well I could ride with 30 pounds of doggie ADD on my back, anyway.

I’ve never been a fan of the LA Daily News editorial department.

Remember the laughable Summer of Cycling?

But a new editorial about the dangers of walking in the City of Angels shows they finally get it, at least when it comes to travel on two feet.

Virtually everything they write also applies to riding a bike, so let’s hope this marks a permanent change in attitude towards everyone not encased in tons of metal, as they put it.

Our anonymous Orange County correspondent offers what promises to be the penultimate report on the murder case of self-described drug counselor Neil Storm Stephany in the heroin-fueled DUI death of cyclist Shaun Eagleson.

Courtroom C37 (Stephany case) was jurorless today as the attorneys wrangled over striking some testimony from the record. Whatever the outcome, both sides expect to present closing arguments tomorrow morning. Stephany waived his right to be present. I think he’s bored with the whole thing.

Yesterday, the People played a video of Stephany’s interrogation in which he admitted he’d gone to the court-ordered First Offender Program after his first DUI. When asked what he’d learned, he replied, “Nothin’, they really don’t teach you anything.” He also opined that the classes were just a “racket” for the government to make money. A few minutes later, when asked directly, “Did they say it’s dangerous?” Stephany answered, “Yeah.” Subsequent similar yes or no questions were all answered in the affirmative.

The video began with the phlebotomist’s difficulty in finding a usable vein to draw blood for a tox exam; she eventually has to return with a smaller needle. An officer then brings in paperwork for Stephany’s 30 day temporary license for the DMV! (Which, of course, the suspect ended up not needing.)

Several tests were off camera, in the hallway. The DRE (Drug Recognition Expert) administering the tests can be heard issuing the typical instructions and telling Stephany to stay upright. During the Romberg test, he fell asleep standing up, and failed to find his nose in ten attempts. The DRE terminated testing for Stephany’s own safety; he’d nearly fallen through an open doorway into the police supervisor’s office.

Stephany clearly remembers a collision, but repeatedly stated that he didn’t know what he had hit. When prodded, he said he thought he’d hit a car. He had stopped his pick-up very briefly, but then punched the gas when he saw people running toward him. (This corresponds to the descriptions provided by the horrified witnesses.) When asked why he hadn’t stayed at the scene, he admitted that he knew it was a probation violation and he would be in trouble.

When asked “What does it feel like when you do heroin?” Stephany began crying, and answered honestly through the sobs. In the courtroom, Eagleson’s family appeared unmoved.

After the officer left the tiny room at the conclusion of the interview, Stephany rustled through his empty pockets, perhaps trying to find his confiscated Suboxone.

A Fullerton cyclist suffered head trauma when he was hit by a car Wednesday morning; fortunately, he’s expected to survive. Note to Fullerton police: Why the hell would it matter if the victim was in the crosswalk? Bike riders are allowed to cross the street, crosswalk or not. Also in Fullerton, a former gang member was shot with a pellet gun while riding his bike in a park; he continued riding to a hospital to get help.

The California Bike Summit starts in three days in sunny San Diego. Having attended the first one in LA, I strongly recommend going if you can make it.

A man was shot by a U.S. Customs and Border Protection officer after he allegedly got off his bicycle and approached the officer with a knife. For some reason, the LA Times — which usually knows better — identifies the victim only as a bicyclist in the headline, rather than, say, a man, as every other source seems to do. Universal Sports, the channel that broadcasts the Tour de France, Amgen Tour of California and the USA Pro Challenge, will cease to exist next month. No word on what NBC, which owns Universal, will do with the rights to those races.

Despite panicking press reports, construction of a new protected bike lane in Denver has not snarled traffic.

No matter how much a student driver angers you, don’t bust out a window with your U-lock and shower a three-month old baby with glass. The Internet is lighting up in response to video of a boy knocking a girl off her bike with a basketball after she tells him to fuck off. Remarkably — or maybe not, given the nature of online comments — some actually say she deserved it.

And yes, blame those damned green-loving, environmentally friendly, non-driving Millennials for the sad state of our roads.

Not the people in massive, multi-ton trucks and SUVs.

Or even the bee-killing Volkswagen drivers.

We’ve had a few updates recently from danger d regarding the unannounced closure of the Orange Line bike path in the San Fernando Valley. Yesterday he went straight to the source to find out what’s going on.

At least it’s good news from the Orange Line bike path construction. Workers on site say they expect the fenced off section to be closed for 6 weeks, so they can build a new path on the other side of the trees in order to build the new flyaway bus stop and comply with ADA standards. The detour is set up but there is room to walk around the fencing on Victory and get back to the path. Workers say this is the only section that will be fenced off.

Our anonymous Orange County correspondent offers a brief update from the murder trial of Neal Storm Stephany, who was allegedly high on heroin and anti-addiction meds when he ran cyclist Shaun Eagleson down from behind on the coast highway in Newport Beach last year.

Today, Eagleson’s widow held it together as long as she could, but when the prosecution brought out photos from the crime scene again after lunch recess, she whimpered at the images of the gouges left in the asphalt by her husband’s bike, and then broke down so completely at the photo of Shaun’s shredded clothing that her family (& the extraordinary victim services specialist) escorted her out of the courtroom.

She didn’t return.

Court recessed early, and will continue next Tuesday.

Despite the heat, I wanted to go down to PCH. The gouges are still there. And despite the repeated use of the term “bike lane” by NBPD Sgt. Little on the stand and the prosecution, no designated bike lane exists at that location.

No word on whether the jury has gotten a glimpse of Stephany’s reputed “fuck the police” and swastika tatts under his new haircut.

She also adds a few thoughts about the Santa Ana courthouse, where the trial is being held.

I think Civic Center Drive (on the north side of the Santa Ana courthouse there) has preliminary markings for a buffered bike lane. (Or maybe upcoming sewer work, dunno.) New sensors were installed very recently, including a bike sensor, but it’s not marked yet.

Bike racks at the courthouse would be f’ing nice.

As we mentioned on Monday, trial began on Tuesday in the murder case against Neil Storm Stephany for the DUI hit-and-run death of cyclist Shaun Eagleson in Newport Beach last year.

Stephany’s defense attorney actually claimed his client was so high on a combination of heroin and two anti-addiction drugs than he had no idea he’d hit a human being.

Evidently, being so stoned that he didn’t have a clue what the hell he was doing behind the wheel is supposed to absolve him of any responsibility.

The seemingly endless helmet debate rages on, as the Wall Street Journal asks if helmet laws do more harm than good, while the Guardian compares lessons on the subject from Seattle and Amsterdam.

Meanwhile, a Seattle writer says scrapping the city’s helmet law could improve bike safety.

But at least police in this country don’t usually assault cyclists for not wearing a helmet, then falsely accuse them of assaulting an officer.

Two hundred injured vets will set off from Palo Alto this Saturday on their way to the Los Angeles VA Medical Center in Westwood on the UnitedHealthcare Ride 2 Recovery California Challenge.

Westwood officials propose turning the northern end of Broxton Ave into a pedestrian plaza. It’s a small step in the right direction; what’s really needed to revive the dying district is to do the same with Westwood Blvd through the Village. That’s not likely while Paul Koretz is the area’s councilmember, though, since he’s promised local businesses that he won’t even allow bike lanes on the street that could bring them more customers.

CiclaValley reports Mulholland Drive will be closed west of Beverly Glen for construction of a water project this weekend from 8 am to 5 pm, Friday through Sunday.

And it’s not his fault if your bike-riding nephew jumps off his new bike to give you a hug, and breaks your wrist in the process. But it is your fault if you’re jerk enough to sue him for it.

Frequent contributor danger d sends word that the Orange Line bike path has been closed with no advance warning. And at one of the most inconvenient, if not dangerous, points.

Here’s the complaint he filed with the county, which seems to be responsible for the unannounced closure, since Metro denied having anything to do with it.

The bike path on Victory Blvd. From Woodley Ave to the 405 is fenced off. There was no notice of closure and traffic is rerouted to the street. Very Unsafe. NOT VISION ZERO. THIS IS THE ONLY WAY UNDER THE 405 FREEWAY THAT IS OFF STREET.

When will this reopen? Why is this path closed?

He hasn’t gotten a response yet; we’ll let you know if he does. And there’s no mention of it on the county map of bike path closures as of Sunday night.

Then again, there’s no mention of any of the other closures shown on their map, either.

Seems like we just can’t get away from court cases.

Twenty-four-year old Neil Storm Stephany will go on trial for murder Tuesday in the hit-and-run death of Shaun Eagleson last October.

According to the Orange County Register, the self-described drug counselor was high on heroin when he plowed his truck into Eagleson as he rode in a Newport Beach bike lane. Stephany hit a guard rail as attempted to flee the scene, before being arrested later that day.

Following a previous DUI in 2011, Stephany had signed a legal advisement stating that he understood he could face a murder charge if he killed someone while driving under the influence any time in the future.

Which, sadly, is exactly what happened just three years later.

He also amassed an extensive criminal record in his 24 years, including convictions for felony assault with force likely to produce great bodily injury, unlawful possession of a controlled substance, and possession with intent to sell. In addition, he is also facing a separate domestic violence charge.

Stephany faces 15 years to life if he’s convicted.

A source in Orange County tells me he has grown his hair just long enough to cover the “fuck the police” tattoo on his forehead and the swastika tattooed on the back of his head, most likely on the advice of his lawyer.

I’m also told Eagleson was a regular reader of this site.

Let’s hope his family gets the justice they deserve. And that we can get a dangerous driver off the road for a very long time.

In an exceptionally generous offer, the judge in the case of fallen OC cyclist John Colvin offered hit-and-run driver Dylan Thomas Randluby a reduced one-year sentence in county jail; remarkably, his attorney wants to think it over.

If the case goes to trial, he faces four years in state prison.

Evidently, life is cheap in the Bay Area.

Even though he had already been convicted and sentenced for felony hit-and-run, an Alameda County judge retroactively reduced all the charges against the driver who killed a bike-riding Chinese tourist to misdemeanors, and sentenced him to just 30 days in jail, calling it an unfortunate accident.

Since when is driving drunk and fleeing the scene of a fatal collision an accident? Judges who refuse to take traffic crimes seriously are why people continue to die on our streets. Let’s hope voters remember this case when he’s up for re-election.

Two-time Olympic gold medalist Craig Buck is fighting for his life at Ronald Reagan UCLA Medical Center after suffering severe head trauma in a Santa Barbara bicycling collision.

CHP investigators blame him for riding on the wrong side of the road, even though the truck that hit him has allegedly been used in a prior road rage incident involving cyclists.

The TurnCycle gesture-controlled wireless bike light promises to follow your hand gestures, and convert them to LED signals to indicate turns or stops; MSN picked it as one of the best Kickstarter inventions of the month.

Update: Bike rider killed in Newport Beach; DUI driver faces murder charge

For once, the charges fit the crime.

Last night, we linked to news that an Orange County bike rider had been hit by a vehicle Sunday evening. Sadly, the Newport Beach police announced this morning that the victim died later that night.

According to the police report, 30-year old Fountain Valley resident Shaun Eagleson was riding west on East Coast Highway just east of the Los Trancos entrance to Crystal Cove State Park when he was rear-ended by a pickup truck around 5:03 pm.

He was taken to a local trauma center for treatment, where he succumbed to his injuries at around 9:45 Sunday night.

The driver, identified as 23-year old Neil Storm Stephany of Huntington Beach, fled the scene, but was arrested shortly afterwards near the intersection of Newport Center Drive and East Coast Highway. He was taken into custody on charges of including Felony DUI (causing Great Bodily Injury), Hit and Run, Narcotics Possession and Possession of Drug Paraphernalia; bail was initially set at $100,000.

The charges were later amended to include one count of murder, based on Stephany’s previous DUI conviction. According to the press release,

Further investigation revealed that Mr. Stephany has a prior conviction for Driving Under the Influence.  In California, a previous DUI conviction, and the subsequent required alcohol education, is considered an adequate indicator to suggest “implied malice” in subsequent DUI arrests involving the death of another party.  That fact, combined with Mr. Eagelson’s passing, lead Newport Beach Police to change Mr. Stephany’s booking charges to include 187 PC – Murder.  Mr. Stephany is currently being held without bail.

 

Yes, they even revoked his bail.

And they added one more thought that can’t be repeated enough.

Driving Under the Influence is a serious crime, with the potential for tragic and fatal consequences.  It is also completely preventable. The Newport Beach Police Department urges all members of the Community to make responsible decisions and to avoid getting behind the wheel of a vehicle while under the influence of alcohol, narcotics, or prescription medications.

Nice to find a police department and prosecutors that take traffic crimes seriously for a change. Let’s hope they don’t plead this one away.

This is the 73rd bicycling fatality in Southern California this year, and the 15th in Orange County; that compares to 12 in the county for all of last year. And it’s at least the eighth fatal bike collision in Newport Beach in just the last five years.

Update: The Orange County Register reports Stephany has an extensive criminal record, with prior convictions for felony assault, possession of a controlled substance and possession with intent to sell, in addition to the prior DUI.

He is also currently facing a charge for domestic violence.

With a background like that, it’s possible that a murder conviction in this case could be his third strike, resulting in life in prison.

Update 2: A fund has been established to help pay funeral costs; in just one day, it’s already raised over half of the $15,000; thanks to Olivia Eagleson and Chris Nguyen for the link. 

Meanwhile, Corona del Mar Today reports that Neil Stephany was formally charged with murder, as well as felony counts of hit and run causing permanent injury or death, and possession of a controlled substance, identified as SUBOXONE sublingual films.

Chris Nguyen also says in his comment that Shaun Eagleson was an avid reader of this site, which makes this one even more personal and heartbreaking for me.

Update 3: The following comment appeared on the original story about the collision on the Corona del Mar website; if true, it raises a lot of very uncomfortable questions. Thanks to Jeffrey Fylling for the tip. 

I think this accident could be prevented and this was the fault of Laguna Beach Police and paramedic. I was following the driver who hit the bicyclist and killed him, from Laguna Canyon in Laguna Beach and I noticed that he drives out of control. Immediately I contacted 911 and gave his license plate number, but 911 kept me waiting for 6 minutes and asking not important questions and finally they told me since you reached the Newport Beach we have to transfer to Newport Beach department. Instead of wasting time they could send immediately someone to catch this guy before he kills someone. But they didn’t and I saw that the driver hit the poor bicyclist. I pull over and contacted for paramedic it took for them about 10 to 15 minutes to show up and they were not at rush at all. I told them to hurry up the bicyclist is bleeding from head. And I don’t know with having so many closer trauma center why they took him to Mission Viejo Hospital which end up that young man dye at age of 30? big question for me….. who is really responsible for his death Laguna Beach Police, Paramedic or both?

Update 4: Sandra Eagleson, the wife of the victim, describes just how much she has lost as she becomes a widow at just 31 years old. Meanwhile, the OC Weekly details Stephany’s priors; I’m told by someone with knowledge of the case that he has “fuck the police” tattooed on his forehead, along with a swastika on the back of his head.
