Update: Bike rider dies Monday after apparent solo Fathers Day fall; Temecula rider dies of natural causes

These are the emails I hate to receive, when someone contacts me asking if I’ve heard about a bike rider who was killed.

Because too often, it’s something that hasn’t crossed my radar yet. And too often, it turns out to be true.

That’s what happened last night when I got a message asking about reports that a rider was killed on Avenue 64 in Los Angeles, near the Pasadena city limits.

A little research turned up a story on the Highland Park–Mount Washington Patch site, describing an apparent solo fall in which a rider suffered sever head trauma; comments to the story reported the victim had died, and gave a name.

According to the site, Jose Cuellar was riding south on Avenue 64 at Burleigh whn he lost control of his bike and fell, suffering severe head trauma. He was reportedly unconscious for 15 minutes before paramedics arrived and took him to a nearby hospital.

Reports of how the incident occurred are a little confusing. The site says the first indication of a problem was the sound of screeching tires; witnesses then report seeing the rider struggling to control a speed wobble before falling.

However, bike tires don’t normally screech, no matter how fast the rider is going or how much strain they’re under, suggesting that there may have been a motor vehicle involved which could have caused Cuellar to lose control of his bicycle.

The site notes he wasn’t wearing a helmet, which is relevant for a change, as this is exactly the sort of fall bike helmets are designed to protect against.

A call to the L.A. County Coroner’s office confirmed that 43-year old Jose Cuellar died at Huntington Memorial Hospital on Monday, June 24th.

According to the person I spoke with, the investigation into his death was just beginning, so no other information was available.

Update: Just received word from Sgt. Lazlo Sander, the LAPD’s bike liaison for the Central Traffic Division, that following further investigation, Cuellar’s death has been reclassified as a single vehicle traffic collision rather than a solo fall; however, there is still no suspicion that any other person or vehicle may have been involved.

In more bad news, a popular Temecula high school teacher died of natural causes while riding Sunday.

According to the Press-Enterprise, 52-year old Darren Thomas, a history and social sciences teacher at Chaparral High School, collapsed while riding in the 40000 block of Calle Medusa, and was pronounced dead at a local hospital at 9:49 am.

There will be vigil in his honor at 7 pm this Thursday at Puma Stadium, and a memorial service is tentatively scheduled for 1 pm on Saturday, July 6th in the school gym.

My deepest sympathy and prayers for Jose Cuellar and Darren Thomas, and all their loved ones.

These are the 39th and 40th bicycling fatalities in Southern California this year, compared to just 28 this time last year.

It’s also the 19th bike-related death in Los Angeles County this year, compared with 24 bicycling fatalities countywide for each of the last two years. And the third in Riverside County, compared to 11 and 13 in 2011 and 2012, respectively.

It’s also the sixth bicycling death in the City of L.A. this year, compared to five in all of 2011 and four in 2012.

In other words, we’re already 50% above last year in the City of L.A.

And this year isn’t even half over yet.

Just a few quick thoughts on Sunday’s CicLAvia.

After all, there’s been more than enough written on the subject to make a review by yours truly truly irrelevant.

But let me offer my congratulations to the folks at CicLAvia for pulling off the most successful event yet.

Maybe it was the extended 9 am to 4 pm hours, allowing people to travel the route more leisurely.

It could have been using both sides of a wide boulevard, unlike the recent CicLAvia to the Sea, allowing more space to move. And the limited traffic crossings certainly didn’t hurt, making it possible for even the slowest riders to cover the entire route in an hour or so of actual pedaling.

Meanwhile, the shorter distance encouraged more walking, making this the first one where I’ve seen a significant amount of pedestrians along the entire route.

It might have been the iconic theme for an iconic boulevard. Along with the many entertainment and educational options along the route; the woman singing traditional Korean songs in not so traditional Koreatown was a highlight for me.

Call it Gangnam-style from a handful of centuries back.

Then there was the food of every possible description, dispensed from everything from trucks and restaurants to church groups and kids hawking cookies and lemonade.

It could have been the abundance of portapotties, reducing bladder pressure and putting everyone in better mood.

Or maybe it was all of the above, in what felt like the best planned and organized CicLAvia yet. Clearly, organizers have looked at what didn’t work in previous events and made some changes for the better.

One minor criticism is that participants universally ignored signs suggesting slower people should keep to the right, resulting in conflict zones throughout the full length of Wilshire. Which may have been why I saw three riders fall, resulting, thankfully, in relatively minor injuries.

The worst was a woman who lay in the street grabbing her collarbone, causing me to ride a few blocks back to an aid station get medical help.

The others suffered scrapes and road rash, and declined medical help.

Note to everyone: If you have the option for free medical help in an event like this, take advantage of it. Prompt first aid can prevent worse problems later, and the need for avoid more expensive medical attention if further injuries become apparent the next day, as often happens.

A friend writes that she witnessed a bike-bourn hit-and-run, in which a couple on a tandem rode off after knocking down another rider. Witnesses were unable to stop the bike before it disappeared into the crowd, leaving the victim sprawled bloody on the street.

Then there’s the schmuck — and I use the term advisedly — who apparently was unwilling to make his way to one of the four crossing points, and gunned his late model Toyota through the barricades at Windsor Ave and across the CicLAvia route, where he hit a cyclist before fleeing the scene.

Fortunately, the rider wasn’t seriously hurt, though badly shaken. (Update: The rider has three fracture vertebrae as well as a mangled bike; having suffered the same injury a few decades back, he likely faces a long road to recovery and a lifetime of back pain.)

Unfortunately, the limited description means the driver will probably get away with it.

But on the off chance they find him, I hope they take away his license. And shove it so far up his ass he’ll need to see a proctologist to buy his next six pack of beer.

California’s latest attempt at passing a three-foot passing law is now before the Senate Standing Committee on Transportation and Housing after overwhelmingly passing the state Assembly, just shy of a veto-proof two-thirds majority.

The bill’s sponsor, Inglewood Assemblymember Steven Bradford, has been very smart in answering the unreasonable objections Governor Jerry Brown gave in vetoing the last two attempts to pass a three-foot law.

There should be no rational reason for Brown to veto the law this time around. Although as we’ve seen, rationality isn’t exactly his strong point when it comes to bikes.

There are some strong supporters of bicycling on this committee, including West Valley Sen. Fran Pavley. But it couldn’t hurt to contact committee members to voice your support.

As we’ve seen with the previous attempts to pass this law, nothing is guaranteed in California politics.

After learning that the rate of cellphone violations are down in California, a writer from the Press-Enterprise conducts his own survey and finds 7.7% of drivers he observed at a Temecula intersection were texting or using handheld phones — slightly higher than state stats.

More interesting, however, was his secondary observation that two-thirds of the drivers failed to stop for the stop signs.

Based accusations from motorists, I would have sworn only bike riders do that.

Pot, meet kettle.

Speaking of anti-bike bias, so much for the L.A. Newspaper Group’s self-proclaimed Summer of Cycling being a good thing, as the owners of the Daily News, Daily Breeze, Press Telegram, et al, once again trot out the tired cliché of licensing cyclists and requiring insurance for bike riders.

As usually happens when the press chums for angry drivers, the results will inevitably skew towards requiring licensing for bike riders, if only because there are far more motorists than there are bicyclists. Never mind that this question reads like a classic push poll designed to draw a negative response.

So once again, for their benefit and that of anyone else unclear on the concept, like most bicyclists, I have a drivers license, which means we’ve already passed the same test as anyone else on the road — and probably have a better knowledge of traffic law than most, since we too frequently have to defend our right just to be on the road.

And despite what the papers suggest, my automotive insurance covers me for liability when I ride, as well as covering medical expenses resulting from a collision with an uninsured motorist or a solo fall.

Just like pretty much every American bike rider over the age of 16.

So get over it, already.

And before they claim to cover the subject, they need to reach out to the people and groups who are fighting for the rights of cyclists every day.

Not the angry drivers who don’t have a clue about the rights of cyclists, or how to ride a bike safely on the streets of Southern California.

A memorial ride will be held at 8 am Saturday in Coronado for San Diego bike racer Jackie Dunn, and a second ride will be held in Rancho Cucamonga. Now if someone will just organize rides for the other six riders who’ve lost their lives in Southern California in the past week or so.

Meanwhile, Michael Wagner of CLR Effect writes movingly about the effect Dunn’s death, and that of Chris Cono, have had on the local bike racing family.

KNBC-4 looks forward to Sunday’s Wilshire Blvd CicLAvia. LAist offers a guide to CicLAvia, which it calls the longest — in terms of hours, not distance — most walkable and event-filled; I prefer the jelly filled, myself. The Militant Angeleno offers his own great tour of CicLAvia sites, but  you can always settle for the official guide and/or podcast initiated by the Getty, whatever that means. One of those Wilshire Blvd sites is the famed Gaylord apartments, built by the boulevard’s socialist capitalist namesake. Take a bike train from the Tar Pits to the Wolfpack Crit. The Bikerowave will be closed for CicLAvia on Sunday.

And Forbes says CicLAvia is turning L.A. into a city of pedestrians.

A Virginia letter writer says I’m okay but you suck, as he draws an artificial distinction between bike riders like him and those damned cyclists. And if this reminder to get on your bike doesn’t make you smile, you may be beyond hope.

Bike lawyer Bob Mionske weighs in on Santa Monica cyclist convicted of assault with a deadly weapon

Sometimes I’m surprised by just who reads this blog.

Let alone their willingness to weigh in on the issues we discuss.

Case in point: The other night, I mentioned I’d be writing a piece for LA Streetsblog about the cyclist who pleaded guilty to assault with a deadly weapon after blowing through a red light, and seriously injuring a pedestrian on the Third Street Promenade in Santa Monica.

And while I was reaching out to a handful of the area’s leading bike lawyers for comments, I invited any other lawyers who wanted to weigh in on the case to send me their thoughts.

Still, I was surprised to receive an email yesterday from bike lawyer Bob Mionske, Bicycling Magazine’s Road Rights columnist, and author of Bicycling and the Law.

I used some of what he had to say in my piece, which is now online at Streetsblog.

But his entire response is well worth reading, as it shines a light both on issues in the Santa Monica case, and the mentality facing cyclists on the road everywhere.

With regard to the “assault with a deadly weapon” charge against the cyclist in Santa Monica, it seems to me that this is overreach, and is due to a frustration with cycling in general, and scofflaw riding specifically. But as we have witnessed in the aftermath of many a cyclist death under the wheels of a culpable motorist, comments about the scofflaw straw man always emerge. This may be a version of the same mentality. When people are frustrated by some group—in yesterday’s culture, young “hotrodders,” in today’s culture, “scofflaw cyclists”—finding a member of that group who has actually broken the law and been caught may lead to a sort of collective punishment for the entire group, in which the culprit is made an example of.

Looking beyond the particulars of this case, there are two larger issues here.

First, there is the issue of disparate treatment of cyclists who break the law, and drivers who break the law. We can see this in the “Scofflaw Cyclist” meme that cyclists are tarred with. In fact, drivers break the law at least as often as cyclists do, and perhaps more often. And when drivers break the law, they are more likely to be a danger to others than when cyclists break the law. And yet, cyclists are the ones who are tarred with the “Scofflaw” meme, even when they are the law-abiding victims of negligent drivers.

When drivers are negligent and injure or kill a cyclist, are they charged with “assault with a deadly weapon”? Not that I’ve ever heard of. Often, they are coddled with “it was just an accident.” And often, law enforcement bends over backwards to shift the blame to the cyclist, when it is crystal clear that the driver was breaking the law. I have seen this happen many, many times.

Part of the problem we are facing is that we live in a culture where most people, including law enforcement, prosecutors, judges, and jury members are drivers. Prosecutors have a high bar of proof when pressing criminal charges, and if the accused was a driver who did something that every driver does, it may be difficult for the prosecutor to convince a jury made up of drivers to find the accused driver guilty of a serious charge. But when the accused is a cyclist, and the general opinion of cyclists is that they are scofflaws, it will be easier for the prosecutor to convince a jury made up of drivers to find the accused cyclist guilty.

There is nothing inherently wrong with pressing charges against cyclists who negligently injure pedestrians. But there is something wrong when we treat cyclists more harshly than we treat drivers who negligently injure cyclists and pedestrians. If as a society we want to start charging cyclists with serious violations when they negligently injure pedestrians, then we’d better get serious about charging motorists with equally serious violations when they negligently injure cyclists and pedestrians.

Second, when charges are filed, they should reflect what actually happened. This means that the incident should not be undercharged (for example, “unsafe passing” when in fact somebody was killed as a result of an unsafe pass), and the incident should not be overcharged. The question raised by the charge in this incident is whether the charge reflects what actually happened, or whether the cyclist was overcharged. From my own experience, I have never seen a motorist charged with “assault with a deadly weapon” after running a stop (yes, motorists run stops) and hitting a cyclist or pedestrian.

One other quick note.

Many of the attorneys I spoke with described the charge against the cyclist as an overreach. Meaning, yes, the cyclist could be charged with assault with a deadly weapon, but it probably wasn’t the appropriate charge in this case.

And while they didn’t say it, one that a good lawyer might have been able to get dismissed.

Which brings up one last point I’m surprised none of the lawyers mentioned.

If you get a ticket while riding, whether in Santa Monica or anywhere else, you may want to fight it — especially if there’s a question of selective enforcement, which may be the case as the SMPD plans to target violations by bike riders over the next few months.

Mionske offers a good guide to determine whether to fight or pay.

You may or may not be able to fight it on your own. But it’s always a good idea to talk with a lawyer first.

But if you’re facing criminal charges, for whatever reason, you need a good lawyer. It’s not a question of whether you can afford one, but that you simply can’t afford not to have one.

I don’t know if Rocky Martin had one.

But I suspect if he had, his case might have turned out differently.

An open letter to the Los Angeles City Council — Don’t let LA down on Wednesday

You’re scaring us.

After putting off the motion from Councilmembers Huizar and Reyes to repaint the Spring Street Bike Lanes from last Friday, to Tuesday, to today, we have to wonder what’s going on.

Like whether negotiations have been going on behind the scenes that we haven’t been privy to. Or if the vote has been repeatedly postponed to reduce the number of bicyclists who can attend to argue for the motion; after all, it’s one thing to clear your schedule for a single day, quite another to clear it over and over again.

Paranoid, I know.

But that’s what happens when the lies — yes, lies — of the film industry seem to take precedence over the safety and preferences of the city’s citizens.

Starting with the absurd claim that a little bit of green paint is chasing thousands of film industry jobs out of the city, when in fact, filming in Los Angeles is up over the last year.

Then there’s the lie that no other city in country has green bike lanes, or at least this particular shade of green. When in fact they’ve been in use in cities across the country, from Portland to Chicago and New York, with more coming every day. And the new bike lanes on San Francisco’s Market Street seem to be a very familiar hue.

And don’t get me started on the ridiculous claim that the lanes are impossible to remove in post production. Or that the real problem is the reflected glow from the lanes; I can color correct video to remove unwanted tints in just a few minutes on my laptop, with a lot less computer power — and skill — than even the lowliest production house employs.

Then again, a little paint — or any of the attributes of a modern city, for that matter — never stopped the Hollywood of old, which knew how to hide problematic things before filming ever began.

John Ford, Frank Capra or Stanley Kubrick would have just covered the street with hay or a black mat to hide the offending paint. FilmLA could easily invest in a mat that could be rented to production crews on a daily basis for minimal cost.

Or just give me a couple of hours and a box of gaffers tape, and I guarantee there won’t be a hint of green in the dailies.

Then there’s the claim — okay, lie — that supporters of the bike lanes have repeatedly backed out of compromise solutions that would work for everyone, from changing the paint to a less reflective hue to dramatically reducing the surface area to be painted.

I’ve talked to people directly involved in the discussion. And each one has made it clear that it was the representatives of the film industry that backed out after everyone thought they had an agreement.

Which raises the question of what, exactly, they want.

The only answer that makes sense is they want the bike lanes to go away. Not because they actually cause a problem, but because the film industry wants to stop any future changes to what they consider their street.

But it’s not.

It’s not a Hollywood back lot. It’s our home.

We live and work here. We ride our bikes for transportation and recreation, to work and shopping, nights out and meetings — sometimes with you. And sometimes, just because it’s fun.

Those green lanes, as battered and faded as they may be, have been a huge success.

And even motorists support bike lanes, including, yes, green ones.

According to a letter you’ve already received from the Downtown Los Angeles Neighborhood Council, the number of people bicycling on Spring Street increased 52% in the first year after the lanes were installed, with another 40% increase this year.

More impressive, the number of women bike riders on Spring increased 100% on weekdays, and 650% on weekends. Women tend to be more risk averse when it comes to bicycling; the fact that they are responding to this street to such a degree suggests just how safe they feel in the green lanes.

In other words, the green lanes are doing exactly what they were designed to do.

If you vote to let them die, as the film industry is selfishly demanding — and as we fear you will in the face of your continued silence —  you will send a clear message that the convenience of wealthy special interests outweighs the safety and desires of the general public.

It will also tell the bicycling community that the hard-won bike plan you approved a few years ago isn’t worth the ink on the pages. Let alone the paint on the street.

Because we’ll know that any bikeway, anywhere, can be removed on the whim of a few well-connected opponents. And that your support for our lives and safety, let alone the livability of our city, runs neither deep nor wide.

Please, I beg you, prove us wrong and dispel our fears.

Send a clear signal that you are sincere in your desire to end car culture and reshape L.A. into the livable, walkable, bikable world-class city it should be.

And that this is our city, not a Hollywood back lot.

Because Hollywood will survive, and thrive, with or without these bike lanes.

We, and the city we love, may not.

I have to beg your forgiveness.

Trying to follow up on the recent rash of bicycling fatalities ate up the time I would have used to write today’s post, which was intended to be a rant over the City Council’s repeated rescheduling of the vote to repaint the Spring Street green bike lanes.

Because it’s looking more and more like this issue is being hammered out behind closed doors. And while the council may or may not be talking with representatives of the film industry, they sure as hell aren’t talking to us.

And that scares me.

Meanwhile, if you haven’t seen them, I’ve updated the stories on the death of the 25-year old Los Angeles resident killed while riding near Caltech, and the 12-year old killed in Camarillo on Sunday.

Just a couple other quick notes.

Damien Newton offers a great recap of the issues involved in the debate over repainting the Spring Street green bike lanes, pointing out the fallacies offered by the other side — which is the nicest way I can put it.

A new study shows California drivers want bike lanes just like we do. I’ve long argued that bike lanes provide as much benefit to drivers as they do for cyclists; thanks to Monet Diamonte for the link.

Yes, the Bible teaches us to share with the less fortunate. But if you encounter a bear while riding your bike, it’s probably best not to offer it any barbecue from your church picnic.

And if you’re too drunk to stay on your bike, you might not want to ride away from the police while making siren noises with your mouth.

Just a suggestion.

Flying Pigeon Bike Shop and the Los Angeles County Bicycle Coalition team up for a Raspados Ride on North Figueroa on Saturday the 15th to promote bicycling in the local area, and support proposed bike lanes on North Figueroa. Riders meet at 3 pm at Flying Pigeon, 3404 N. Figueroa.

Sunday the 16th, Flying Pigeon rides to Downtown’s Good Girl Dinette for their monthly Get Sum Dim Sum Ride. Meet at Flying Pigeon, 3404 N. Figueroa at 10 am, rolling at 10:30.

Tuesday the 18th, the City Council is scheduled to vote on restoring the successful Spring Street green bike lanes in the face of intense opposition from the film industry. This vote has been delayed twice already, which suggests behind the scenes machinations that may not bode well for L.A. cyclists. The Council session begins at 10 am at 200 North Spring Street in Downtown L.A.

CD4 Council Member Tom LaBonge hosts his annual Tour LaBonge each Wednesday through August 17th. The next ride meets at 6 pm at Fire Station 88 at 5101 Sepulveda Boulevard in Sherman Oaks. If you go, ask him why he opposes the proposed bike lanes on Lankershim Blvd and the green bike lanes on Spring Street, and has been a major impediment to the long-delayed Bike Friendly Street on 4th Street. If he’s our friend, we don’t need any enemies.

Metro is co-sponsoring a series of bike traffic skills classes throughout the summer, with the first one taking place on Saturday, June 22nd in Claremont, followed by Los Angeles on Friday and Saturday, the 28th and 29th.

It’s time to retake our streets once again as the next edition when CicLAvia rolls down L.A.’s iconic Wilshire Blvd on Sunday, June 23rd, with a focus on exploring the city’s art and architecture. The ride rolls, walks, scoots and skates from Downtown to Fairfax — on both sides this time —  with extended hours from 9 am to 4 pm, and pedestrian-only zones on both ends. CicLAvia returns to an expanded Downtown route on Sunday, October 6th.

Once you’ve taken in CicLAvia, head over to City Hall for the first ever Wolfpack Hustle Civic Center Criterium, qualifying starts at noon, with races rolling at 4 pm. Note: Prize money is being split evenly between the four races; more racers are needed for the women’s category.

The Los Angeles County Bicycle Coalition’s Civic Engagement Committee meets at 6:45 pm on the last Tuesday of each month. This month’s meeting will take place at the Pitfire Pizza at 2nd and Main in Downtown L.A. Now that the election cycle is over, the meeting will focus on where the committee will go from here. The meeting is open to everyone, and you don’t have to be an LACBC member to participate; email bikinginla at hotmail dot com to be added to the discussion list.

On Saturday the 29th, Metro, C.I.C.L.E. and Walk ‘n’ Rollers combine to kick off the summer with a 14-mile trek along the Ballona Creek Bike Path from Culver City to the Sea. Meet at the La Cienega / Jefferson Expo Line Station at 10:30 am, rolling at 11. Alternative start points meet on the bike path at 11:20 am at Overland Ave, and 11:45 am at Centinela.

On Saturday, July 6th, the Red5 Yellow7 Gallery hosts the closing of Passable Atlas, an exhibit by artists Sean Deyoe and Nathan Snider recreating four years of The Passage of a Few People Through a Rather Brief Moment in Time, a weekly Wednesday night bike ride exploring far-flung areas of the city. The exhibit will be followed by a Special Passage ride beginning at 8:30 pm at 4357 Melrose Ave in the HelMel Bicycle District.

Anyone willing to make the trip to the Bay Area may want to head to Oakland’s Jack London Square on Saturday, July 20th for the third annual Pedalfest, a free celebration of bikes, cycling, food family and fun; the event takes place from 11 am to 7 pm. Thanks to prinzrob for the heads-up.

Here’s your chance to bike the famed Las Vegas strip and the surrounding Las Vegas Valley, with the 6th Annual RTC Viva Bike Vegas Gran Fondo Pinarello on Saturday, September 21st. The event will offer routes for riders of all levels, from a 17-mile ride to 60-mile Metric Century and a 103-mile Gran Fondo; the longer rides will visit the Red Rock Canyon National Conservation Area and Lake Mead.

Santa Monica police have identified a suspect in the shooting of a bicyclist last Sunday. Oddly, they say it doesn’t appear to be related to the shooting of two men, one fatally, in the same area Tuesday morning — let alone the nearby shooting rampage on Friday.

You might want to avoid the area south of Pico Blvd in Santa Monica for awhile until things settle down.

Save the endangered San Pedro and Spring Street bike lanes; hit-and-runs involving bicyclists up in L.A.

I’m a little battered and bruised tonight.

Riding home from another wildly successful River Ride, I hit an open 8-inch mini-manhole cover somewhere along the transition from Silver Lake to Beverly Blvd. I somehow managed to stay upright, although how I have no idea, finding myself momentarily riding a wobbling and fully ballistic bike veering dangerously towards both the curb and the asphalt.

Falling down there would have meant going down hard and in front of traffic. It would have also meant my second fall of the day, as I misjudged a steep hill on my way there in the morning, and couldn’t clip out from pedals in time after a bad shift.

Which would have made it just my second fall in the past several years, as well.

Even so, I ended up with cuts and bruises where my legs smacked the frame. And everything from butt up feels like I was hit by a Mack truck.

Yes, everything.

Enough said.

Just a reminder that something most drivers wouldn’t even notice can be dangerous if you’re on a bike.

Even if you don’t hit the street.

So with that, let’s catch up on the news we missed as I tried to sleep off my bumps and bruises yesterday.

Bad news from Redondo Beach, as a 48-year old triathlete Michael Giardano collapsed and died after the swimming leg of the Redondo Beach Triathlon. My condolences to all his loved ones.

Buscaino FlyerIf you’re anywhere near San Pedro tonight, try to make it to the 6 pm meeting with Councilmember Joe Buscaino to defend the recent road diets and bike lanes in the area.

As we’ve discussed before, the primary complaints center on the road diet installed on Westmont Drive, which reportedly results in traffic congestion just 20 minutes each morning and afternoon as parents pick their children up at the local school.

Yet the bike lanes those parents complain about exist primarily to tame traffic and improve safety around that very school. Which means that instead of demanding that they be removed, parents should be thanking city officials for taking tangible steps to protect their children.

The mantra for this meeting should be it’s not about bicyclists, it’s about the safety of your children. And if local residents somehow think the convenience of a few drivers is more important that, something is seriously wrong in San Pedro.

With school ending for the year, they’ve got all summer to find a solution that works for everyone. And returning to the previous status quo ain’t it.

Remember that vivid green paint that lasted about a week on Spring Street, which Hollywood location scouts claimed was impossible to avoid filming or remove in post-production and was used nowhere else in the known universe?

Yeah, right.

Mark your calendar for a Battle Royale this Friday when the issue comes before the full City Council. Every bike rider who can make it should be at City Hall at 10 am Friday to refute the lies and demand that the safety of our citizens should take precedence over the convenience of filmmakers — as if there’s not enough money in their bloated budgets to cover-up a little green paint on the street.

Tell you what.

Just give me a couple of hours and a box of gaffers tape, and I guarantee they won’t see an glimpse of green in the dailies.

Fortunately, not all Hollywood types are bike-unfriendly. Or have such small hearts.

I haven’t had a chance to dive into it yet, but the long-awaited LAPD report on hit-and-runs has finally been released, and will be presented to the Police Commission at today’s meeting.

At first glance, it suggests that the city’s rate of hit-and-run, while not acceptable, is not out of line for comparable major cities, and hit-and-runs resulting in death or serious injuries to pedestrians is on the decline.

But if you think more drivers fleeing after killing or injuring bicyclists, you’re right.

The “new” LADOT issues their annual report, and takes credit for more than doubling the number of bike lanes in the last eight years compared to the previous 32, with 150 miles installed during the eight-year Villaraigosa administration.

A bike rider is shot in Santa Monica in an apparent gang driveby, which had absolutely nothing to do with last week’s shooting rampage, despite the Times unfortunate spin on the story. L.A. mayor-elect Eric Garcetti promises bike lanes and walkable communities. The Source names the bikiest guy in L.A. The upcoming Wilshire Blvd CicLAvia should be better for pedestrians; CicLAvia means open streets for everyone, not just bike riders. Another neighborhood council wants your take on bike lanes on North Figueroa; take a few minutes to respond, because the bike haters certainly will. Turns out handlebars aren’t the safest place to ride, but you knew that, right?

Laguna Beach sees an increase in bicycle collisions. If you hit another cyclist or a pedestrian, stick around until you know they’re okay, hit-and-run laws — and common human decency — apply to us, too; thanks to Allan for the heads-up. A Sacramento man faces a murder charge after deliberately running down a bike rider he’d argued with, then getting out and kicking him repeatedly. An 18-year old Pleasanton driver kills a woman cyclist and injures her husband; since she rear-ended both of them, it doesn’t really matter if one might have been outside the bike lane, does it? In what was clearly a horrible weekend for NorCal cyclists, a 25-year old bike rider is killed in Elk Grove, a San Jose cyclist is killed in a collision with a train and a Modesto man is killed in a hit-and-run. Once again, a San Francisco pedestrian is injured by a cyclist.

Your next bike could be a lot smarter than your last one; on the other hand, I’m not looking forward to a bike that can say “I’m sorry Dave, I’m afraid I can’t do that.” Especially since my name’s not Dave. IsolateCyclist looks at the people who self-identify as cyclists in order to criticize other cyclists. Bicycling is catching on with the NBA. Members of my college fraternity will be riding cross-country to raise half a million dollars for people with disabilities. Lessons learned by a first-time bike commuter from my hometown. London’s bike czar says the city needs fewer testosterone-fueled cyclists and more careful female ones; nope, not a hint of reverse sexism there. A UK cyclist suffers a broken arm in a road rage assault. As usual, the Cycling Embassy of Great Britain offers a blog roundup that puts this one to shame. Bike safety devices designed to prevent collisions with trucks could make things worse. Guess which country has gone pazzo for bicycling? A South African driver flees the scene after plowing into three cyclists. An Australian woman is killed while riding with her husband the day before an appointment to find out if she was pregnant. Proof that bike riders aren’t always the good guys, as an Aussie cyclist shoots a sleeping transient with an arrow. A special New Zealand inquest rules mandatory hi-viz clothing won’t cut bicycling deaths. Chinese authorities apologize for beating a bike salesman. Well said: “If we meet out on the road or trail, let that be the start, not the totality, of a friendship.”

Finally, it’s seldom a good idea to celebrate your birthday by riding drunk and trying to strangle the cop who stops you. This is why it’s not a good idea to use people instead of traffic cones at bike races, with entirely predictable results. And someone should tell this 10-time loser that just because the sign says Highway 101, that’s not actually the speed limit; seriously, if you lose your license 10 times in four years, you shouldn’t even be on the damn highway. Or any other street, for that matter.

Too easy to get, too hard to lose, indeed.

Actually, the Newport Beach Police Department gets it after all; Gardena may be another matter

No one gets it right all the time.

Myself included

But I have to respect anyone who can accept criticism. Especially when they actually do something about it. And particularly when the problem involves the often troublesome intersection of police and bikes.

That’s exactly what happened recently when I criticized the bicycling webpage of the Newport Beach Police Department.

As you may recall, I took them to task for offering bike safety advice that suggested cyclists should always ride to the right, while ignoring the many exceptions to CVC21202 that allow bike riders to take the lane for their own safety.

As well as disputing their recommendation to ride single file, a requirement which is contained nowhere in the California Vehicle Code.

My reasoning wasn’t just that they were wrong. It was that both bike riders and motorists might get the wrong idea from reading it, needlessly contributing to the conflicts on our streets.

The surprising part came a few days later when I received an email from bike riding NBPD Deputy Chief David McGill.

Needless to say, he wasn’t thrilled my criticisms. But instead of arguing with me, he wanted to reach out to me to work together in addressing the problems facing bicyclists in Newport Beach.

As he put it,

When Jay Johnson was sworn in as our Chief of Police in 2010, he made bicycle safety an important part of the Department’s mission.  As a result, in the past several months the NBPD has increased their efforts to work together with the community and the City’s Citizen’s Bicycle Safety Committee (recently reformed as the Bicycle Master Plan Oversight Committee) to do what we can to help improve bicycle safety for all people who visit, live and work in Newport Beach.  Together with our partners, we have accomplished much in the past few years, but there is always more work to do.

When I took a second look at what I’d written, I realized that I’d come off a little harsher than I had intended for what was, in balance, good advice for bike riders. So I toned down my criticism of their website, while responding to his email to explain my objections.

Then, to be honest, I forgot all about it, as a continuing parade of various issues and crises, both personal and bike-related, took precedence.

But they didn’t.

This week I got another email from McGill saying the department had considered my suggestions. And actually acted upon them.

But more importantly, they got it right this time.

My only suggestion was to add the phrase “when traveling below the speed of traffic” to their advice about “riding furthest to the right.” And when I checked back before writing this, I saw that change had already been made.

Of course, we didn’t win on every count.

While they continue to interpret the vehicle code as not allowing side-by-side riding in most situations, it also seems to be a lower priority for the department. And they’ve removed the instruction to ride single file from their website.

I can live with that.

And you can’t ask for much more than a police department that is willing to listen to — and better yet, act on — criticism from the bike riding public.

NBPD Chief Johnson, and those who work for him, have won my respect.

And my gratitude.

Gardena might be another story.

According to the official version, police responding to a report of a robbery and/or stolen bicycle attempted to stop two men they spotted riding bikes. That’s when a third man ran up to them, and — allegedly — reached into his waist band.

Thinking he was reaching for a gun, the officers shot multiple times, killing him and wounding one of the other men.

But if he really was armed, no one has bothered to mention it yet.

Now witness reports are coming out that the victim, Ricardo Diaz-Zeferino, was actually running with his hands in the air, rather than near his waistband. And he was trying to tell the officers that the two men were his friends, and weren’t involved in the theft.

In other words, he died because it was his bike that was stolen. And he was trying to help two friends who had nothing to do with the crime.

Now, don’t get me wrong.

I understand that cops have their lives on the line, and things can go horribly wrong in any contact with the public. And that they have to make split-second decisions to protect both their own safety and those they are sworn to protect.

It’s easy for us to sit back and judge their actions after the fact. A lot harder to make those split-second decisions in real time, in real world situations.

But it looks like an innocent man — one of the L.A.’s area’s many bike riding Los Invisibles — became all too visible at exactly the wrong time, in front of cops who apparently reacted to what they thought was happening, rather than was actually was.

And now a man is dead because of it.

All because he was the victim of a bike theft, and some cops in an area with a large Latino population who apparently didn’t understand Spanish.

On a related note, KPFK’s Michael Slate Show will interview Sandra Cotton, sister of Terry Laffitte, who was fatally shot by police who initially attempted to pull him over for riding without lights last month.

Finally, just a few more quick notes.

Nearly forgotten in the dust-up over New York’s bike share program is the fact that L.A.’s Bike Nation bike share program was supposed to be up and running by now. Streetsblog’s Damien Newton explains why it isn’t and maybe never will be.

The new mayor of Compton is young, female and an actual urban planner.

John Grotz forwards a link to a video currently making the rounds showing a New York bike rider repeatedly cut off, then threatened in a Hassidic neighborhood before another man comes to his rescue. He notes this is the same neighborhood that successfully lobbied to have new bike lanes removed a few years back.

A Victoria BC mountain biker is nearly decapitated when a wire is strung across a bike trail in an apparent sabotage attack.

And a Brazilian billionaire’s son gets community service, loss of his license for two years and a nearly half million dollar fine — chump change for his family — for running down a bike rider in his $1.3 million Mercedes SLR McLaren.

And yes, he’s planning to appeal his very generous slap on the wrist.
