$24 million settlement in 2014 Fiesta Island crash, LA County tackles racial bias in bike stops, and Culver City gets mobile

Evidently, justice delayed isn’t always justice denied.

It was seven long years ago when a wrong-way driver slammed into a group of 30 bicyclists on San Diego’s Fiesta Island, injuring ten people.

Theresa Owens was high on meth when she got behind the wheel, looking for a boyfriend she thought was cheating on her.

She was speeding on the 25 mph roadway, after turning the wrong way on the narrow, one-lane road, when she rounded a blind corner and smashed into the group of riders.

Six of the victims were seriously injured, with Juan Carlos Vinolo ending up paralyzed from the chest down, as well as suffering a long list of other injuries.

A jury divided the liability between Owens and the city in 2019, ruling San Diego was responsible for failing to maintain visibility on the roadway, despite knowing of the dangers.

They held the city responsible for 27% of the damages, while state law required the city to pay 100% of Vinolo’s past and future medical bills and lost earnings.

Yesterday that bill came due, when the San Diego city council agreed to a whopping $23.75 million settlement for Vinolo and his wife for the meth-fueled Fiesta Island crash.

Although something tells me they’d gladly give back every penny in exchange for the use of his legs again.

Meanwhile, the city could have saved a fortune just by trimming some bushes and reducing berms, instead of waiting until it was too late.

And maybe reworking the intersections to channel drivers so they can only turn in the right direction.

Los Angeles County responded to a recent LA Times investigative report that found biased policing of bike riders by LA County sheriff’s deputies.

The Times found that the overwhelming majority of bicycle traffic stops conducted by deputies were in areas where people of color make up the majority of the population, and with limited bike infrastructure.

Seven out of ten of those stops involved Latino riders, and 85 percent of the riders stopped were searched by deputies — even though those searches only turned up illegal items eight percent of the time.

Just imagine the outcry if drivers were routinely placed in the back of a squad car while police searched their belongings following a simple traffic stop.

Let alone white drivers.

The LA County Board of Supervisors responded on Tuesday by unanimously approving proposals to decriminalize bicycling violations, including

  • Developing a diversion program allowing bike traffic school in lieu of fines for traffic tickets, which was approved by the state a few years ago, and
  • Drafting a change to county code to legalize riding a bicycle on the sidewalk in unincorporated areas, although only on non-residential streets without bike lanes.

In addition, the supervisors ordered a review of biased policing of bike riders by the sheriff’s department.

Not surprisingly, though, the sheriff’s department, which has attempted to stonewall virtually every other effort at oversight, had no response.

Granted, these are just proposal to develop new rules, so far. But it’s a big step in the right direction.

Newly bike-friendly Culver City officially kicks off Move Culver City this Saturday, featuring three new quick-build bus-bike lanes in the downtown area.

Quite a change from the not-too-distant past when Culver City cops would meet group rides at the city limits, and ticket riders for every real and imagined violation they could find, while they escorted them out of town.

Last month’s Vision Zero Cities conference considered how the language used in ads and newspaper reports can hurt crash victims, who are inevitably blamed for their injuries.

An Arizona man is 6,700 miles into a planned 18,000-mile journey by bicycle to visit each of the more than 400 national parks in the US, although he may need to pick up the pace a little after hitting just 14 parks, leaving another 386+ to go. He’s attempting to raise $50,000 for conservation projects in the National Parks.

Speaking of national parks, Utah’s Zion National Park now has a new ten-mile bike trail on the east side of the park.

A Streetsblog op-ed says New York’s bike lanes need more protection than the usual plastic car-tickler bendy posts, which don’t keep anyone out.

A Washington Post op-ed says American bicycling has a racism problem, tracing the roots to discrimination against Southern Black bike riders around the turn of the last century.

Tragic news from Florida, where a 14-year old boy was found dead after he went missing while riding his bike on Monday; no word on the cause of death, though his school described it as an “accident.”

Montreal’s Bixi bikeshare had a record-setting year, with ridership up 74% as they packed the bikes up for the winter.

This is who we share the road with. A London woman mistakenly stepped on the gas instead of the brakes, jumped the curb and killed a man walking on the sidewalk, then lied to investigators by saying the man stepped out into the street in front of her. So naturally, the court let her walk without a day behind bars, and took her license away for a whole year.

Burglars broke into a British bike park and stole literally everything there was to take, from generators and Park Tools, to cash raised for a local air ambulance service.

He gets it. A writer for Britain’s Independent says we’ll never get to zero emissions until we admit we’re all climate hypocrites who want to stick to our comfortable, fossil-fueled lifestyles.

A member of the UK Parliament says the country’s lax hit-and-run laws give drivers an incentive to flee the scene rather than stick around and get tested for DUI. We have exactly the same problem in California, where lax penalties and minimal enforcement encourage drivers to flee, knowing they’re unlikely to ever get caught, or seriously punished if they are.

Nineteen years.

That’s the sentence given to Teresa Owens in San Diego on Thursday, for the meth-fueled wrong way collision that injured a dozen cyclists on Fiesta Island last year, leaving one paralyzed from the chest down.

According to the Union-Tribune,

Owens, 50, was at Fiesta Island to try to catch her boyfriend cheating on her. She admitted doing “a small line of methamphetamine” 12 hours beforehand. She was also driving on a suspended license, and she was fresh off a previous DUI arrest.

She drove the wrong way on the one-way road around the island and slammed into a group of cyclists on a training ride coming around a corner. Several flew onto her car or smashed into her windshield.

After her arrest, she was also found with a bag of meth hidden in her snatch.

While making a legal left turn on the yellow, bike rider Wes High was nearly hit by a Santa Monica driver who swerved into the bike lane to get around a stopped car and blow through the light long after it had turned red.

A new study is quick to blame the victims after 40% of teenagers report being hit or nearly hit by cars while walking. Never mind that careless or distracted drivers may have had something to do with it. And no, walking after dark is not an unsafe habit; that’s what human beings have done since we first stood upright.

Some of the biggest names in international, national, and local cyclocross racing are coming to Long Beach’s El Dorado Park on November 21st and 22nd. As part of this weekend of racing, SoCalCross is offering a Palms to Pines community ride (Ride with GPS route is can be found here.) The ride, along the San Gabriel River Trail, will take riders from the palm trees and sand in Seal Beach all the way north to the pine trees at Azusa River Wilderness Park at the start of the San Gabriel Mountains, before returning to El Dorado Park in plenty of time to watch an afternoon of exciting racing action, enjoy food and beverages at the races, and visit the event’s sponsor Expo. The ride is 77 miles long, but you can ride as much or as little as you like. A shorter Ocean Breeze ride goes to the beach and back. Both are 100 percent on protected bike paths with no car traffic (only 3 street crossings). Registration is $45 ($55 day-of), less for the short ride, and includes an event t-shirt, lunch, pit stops, and a donation to LACBC and other local bicycle advocacy groups.

Santa Monica gets a $300,000 grant to improve traffic safety and help make “streets a more pleasant experience for everyone.” Meanwhile, Seal Beach gets a $140,000 traffic safety grant of their own.

A memorial will be held today for John Pavlisin, Sr., the 89-year old owner of the Orange Cycle bike shops in Orange and Santa Ana.

A Saratoga driver is being sought by police for intentionally swerving into a bike lane in an attempt to hit a bicyclist. Somehow, that doesn’t merit more than a couple lines in the police blotter, though.

Menlo Park plans to add buffers to an existing bike lane, along with pedestrian-activated crossing lights, to improve safety along a preferred school route.

Palo Alto plans to extend the nation’s first bike boulevard three decades after it was first installed.

Napa police arrest a man claiming to be a wolf who speaks 13 languages for stealing a bike at knifepoint. No word on whether one of the languages is Lupine.

It’s been a busy few weeks for courtroom drama.

In the latest case, 21-year old Alexis Virto has pled guilty in the horrifying hit-and-run death of bike rider Jose Luna.

Luna was crossing North Figueroa in a marked crosswalk with another rider last June when Virto’s car smashed into him at an estimated 60 to 80 mph, then sped away with his victim still on the hood of his car, carrying Luna’s body 200 yards from the crash site.

Police found his abandoned car, which led them to arrest Virto as he slept with his girlfriend just six blocks from where the collision occurred; still drunk, with windshield glass glittering in his hair.

EGP News reports he plead guilty to gross vehicular manslaughter while intoxicated as part of a plea deal; prosecutors are expected to drop additional counts of driving under the influence of an alcoholic beverage causing injury, driving with a 0.08 percent blood-alcohol content causing injury, and hit-and-run resulting in death or serious injury to another person.

He’s due for sentencing on November 5th; the story does not say what sentence he faces as a result of the plea.

North Figueroa had been scheduled for a road diet intended to improve safety and slow speeding drivers. Had it not been summarily cancelled by Councilmember Gil Cedillo, it would have been completed long before this collision, though there’s no way to know if it would have made a difference in this case.

Not surprisingly, the meth-infused wrong way driver who plowed into a group of cyclists on San Diego’s Fiesta Island has been found guilty.

Despite her lawyer’s bizarre claim that she wasn’t impaired by the meth in her system. Or the meth hidden in her privates.

According to the San Diego Union-Tribune, Theresa Owens was found guilty of felony DUI causing injury, as well as causing permanent paralysis to one victim and great bodily injury to three others.

She was also convicted on a misdemeanor possession count for the .15 grams of methamphetamine stashed in her vagina.

She now faces up to 18 years in prison.

Let’s hope wherever she ends up, it has a good rehab program.

A new study from the University of Arizona shows that wearing a bike helmet reduced the risk of severe traumatic brain injury in a collision by 58%, and the risk of death by 59%. The authors also note helmet use reduced the risk of facial fractures by 29%.

The LA County sheriff’s deputy who killed former Napster exec Milt Olin has been officially disciplined by the department. But since it’s considered a personnel matter, we’ll most likely never know what that discipline is.

And there will be no discipline for the department, which reportedly encouraged its officers to use their onboard computers while driving, despite an official policy against it.

A psychiatrist says the alleged meth-using wrong way driver who plowed into 10 cyclists on San Diego’s Fiesta Island, leaving one paralyzed, “has bipolar disorder with chronic or long-standing mania and psychotic features, but also depressive features.”

Oh. Well, okay then.

She reportedly blames the crash on an invisible boyfriend who somehow popped up, apparently inside her car, before disappearing.

And she had a bag of meth in her vagina when she was arrested.

Allegedly.

Update: Despite the testimony of the psychiatrist, Theresa Owens was found competent to stand trial on Friday.

The Uber driver who allegedly ran down a San Francisco bike rider in a road rage dispute has surrendered his drivers license.

San Francisco’s director of transportation and public health director team up to explain the city’s Vision Zero policy. It would be nice if we could see something like that here; most Angelenos have no idea what Vision Zero is, let alone that the city has adopted it.

Unbelievable. The 2013 police shooting of a Florida bike rider was caught on dash cam video; he was left paralyzed from the waist down — even though his only weapon was a cell phone.

The Justice Department will review the Tampa Bay police department’s ticketing of African American bike riders, who received 79% of the city’s tickets for bicycle violations even though they make up just 26% of city residents. They never learn. A young British driver becomes the latest to lose her job after tweeting about hitting a bicyclist without stopping.

A Brit woman may have suffered permanent scars resulting from a collision with a grinning hit-and-run cyclist.

A formerly morbidly obese man from the UK loses 210 pounds in a single year after taking up bicycling; he’s now planning to run a half-marathon — and have 14 pounds of excess skin removed.

Now that’s what I call fleeing the scene. An Irish driver gets six-and-a-half years for causing the death of a cyclist. He first fled to the UK, then Australia; he was arrested after being recognized in an ill-advised return to the UK.

Join the Army, and you too can experience the German equivalent of a ciclovía.

Kazakhstan-based pro cycling team Astana somehow manages to keep its top-tier racing status, despite a number of team members busted for doping.

Unbelievable. An Aussie man jailed for killing a cyclist in a 2011 hit-and-run killed another man in a second hit-and-run the same month, and hid his body under some bark and leaves.

 

Finally…

Caught on video: A llama joins the peloton. In Canada, no less, where the animals aren’t exactly native.

If you’re going to climb into a driver’s vehicle and drive off after coming to blows in a road rage dispute — with the owner still clinging to the outside of his car — try to make a clean getaway without crashing into a parked car. But if you want to experience just one angry, honking driver on your ride to work, make sure you have a police escort.

Bad news from San Diego. The wife of the cyclist critically injured by an allegedly drunk and/or high wrong way driver on Fiesta Island says he’s on a breathing machine and fighting for his life; if he survives, he’ll be paralyzed from the waist down.

Sounds like prayers or good wishes are in order, whichever you’re comfortable with.

The family of fallen randonneur Matthew O’Neill encourages drivers to observe the new three-foot passing law and change lanes to pass a cyclist.

Meanwhile, a website uses video from the Rock Store climb, aka The Snake, to suggest the three-foot law will make driving impossible, even though passing at an unsafe distance has always been illegal; the only thing this law changes is specifying just what a minimum safe distance is. And the rider in question is legally taking the lane on what is clearly a substandard lane.

Bottom line, as a side-by-side comparison of these two stories make clear, observing the three-foot law is a question of safety — that is, someone’s life — versus a minor inconvenience to impatient motorists.

I know which side I fall on.

This could be a big step forward in bike safety, as a new reflector tricks the Crash Avoidance System found in many new cars into seeing a cyclist or pedestrian as being closer or larger than they really are. The makers are looking for a strategic partner to help bring it to the right markets; this could be a great investment for someone with the right knowledge.

And yes, I want one. Now.

Evidently, the nut doesn’t fall far from the tree, either. The father of the teenage driver who got off using the affluenza defense was arrested last month for impersonating a police officer.

If you’ll recall, his 16-year old spawn got away with killing four people in an under-aged drunken crash when the judge agreed his parents were too rich for him to be expected to take responsibility for his own actions.

*My apologies for missing yesterday’s post, as well as a few others in recent weeks. I try to post every weekday; however, while my diabetes is officially under control, I’m still having major health problems that may or may not be related, and which leave me largely incapacitated for much of the day — and have kept me off my bike for the better part of two months. Most days, I’m able to rally long enough to get a new post online, but others — like yesterday — find me down for the count.

Hopefully, my doctors will finally figure out what’s going on, and this too shall pass.

If you’ve been following this site for awhile, you’ll know that we link to pieces written by my friend Richard Risemberg of Bicycle Fixation on almost a daily basis, whether on his own site, or as a guest writer for Flying Pigeon and Orange 20 Bikes.

Now he’s collected some of his best essays for the new volume, Our Own Day Here.

While many of the chapters focus on bicycling, the tome goes beyond bikes to examine “how the way we travel, live, and shop shape our lives and our souls, and reveals the richness of experience he finds in city living.”

Among the subjects covered in these sometimes poetic, sometime humorous essays are cars, transit and bicycling, economics and politics, development, as well as the sense of place and the places that make it happen.

As he notes, some of the pieces have appeared on various websites, as well as in the pages of local and national publications, while others have never seen print or pixels before.

I haven’t had a chance to read it myself yet, though I hope to offer at least a partial review soon.

The driver charged with killing popular Beaumont cyclist Phillip Richards has been found guilty on charges stemming from the fatal hit-and-run.

Jurors convicted William Donald Johnson of both gross vehicular manslaughter while under the influence and hit-and-run causing injury, with enhancements for leaving the scene of a collision and causing great bodily injury.

However, the jurors split on an additional murder charge; the Riverside County DA is unsure if he will be retried on that charge. He will be sentenced October 3rd; no word yet on how much time he faces.

Johnson’s wife Kari had previously pled guilty to aiding in Johnson’s escape in the hit-and-run, and was sentenced to 90 days in jail and three years probation.

Tragically, the bike rider most seriously injured in that wrong-way collision on San Diego’s Fiesta Island that sent eight cyclists to the hospital is paralyzed from the chest down as a result.

Meanwhile, the driver responsible pled not guilty to felony DUI with injury and possession of a controlled substance after meth was found hidden in a very private place.

That other notable cyclist from my hometown sets out today to win his second USA Pro Challenge, while Jens Voigt says this will be his last pro tour after 33 years.

The New York Post applauds the NYPD’s crackdown on cyclists who “terrorize pedestrians and endanger life and limb,” and calls on the city to make it permanent. On the other hand, they seem to be fine with the lawbreaking drivers who kill a hell of a lot more people than cyclists ever could.

Caught on video: Continuing today’s New York theme, an NYPD officer is caught leaning in to deliberately block a bike lane, evidently just for the hell of it.

Finally leaving Gotham, a Maryland cyclist pens a powerful open letter to the hit-and-run driver who cracked his ribs and ran his bike over.
