Good news and bad news — Box finishes third in CD4, LACBC’s City of Lights honored

Newly re-elected CD4 Councilmember Tom LaBonge with LACBC board member Scott Moore.

Despite running what appeared to be a very smart campaign, bike activist Stephen Box lost overwhelmingly to Council District 4 incumbent Tom LaBonge yesterday.

While he appeared to have support from many in the cycling community — as well as backing from food truck operators — it wasn’t enough to keep him from finishing third in the three man race, with less than half the votes of second place Tomas O’Grady.

And far behind LaBonge, who sailed to victory with over 55% of the vote — echoing predictions from internal polling.

I won’t go into a lengthy post-mortem here. Bicycle Fixation offers a good look at what went wrong, while pointing out LaBonge’s re-election is far from a disaster.

However, it would be wrong to look at this as a failure of the cycling movement in Los Angeles. Prior to the election, a number of cyclists told me privately that they preferred the more moderate and usually bike-friendly LaBonge; so despite how it may have looked before the election, the bike vote may have actually been split between the two candidates. And it’s important to note that many of Box’s most ardent supporters live outside of his district.

In the end, he lost out to one of the city’s most likeable politicians. As well as the power of incumbency, which seems almost impossible to overcome in L.A.

It is worth noting that LaBonge will be termed out in four years, leaving an open seat; whether Box will try again is another question.

So let me congratulate Councilmember Tom LaBonge on winning another four years, and encourage him to continue to be a friend to the cycling community.

And hats off to Stephen Box for a very hard-fought, if ultimately unsuccessful, campaign. And for opening the door for cyclists to run for city office.

Whatever the reasons behind his loss, it wasn’t due to a lack of effort.

And he certainly won’t be the last to try.

Congratulations to the LACBC’s City of Lights program, which was honored last night with the Best Practices Award from the Alliance for Biking and Walking at this year’s National Bike Summit.

The Best Practices Award goes to an organization that serves as a model for other bicycle and pedestrian advocacy organizations. In 2010, countless individuals and a number of advocacy organizations drew information and inspiration from the Los Angeles County Bicycle Coalition. The LACBC’s City of Lights initiative elevated the conversation about “invisible cyclists” – men and women who ride bicycles but whose voices aren’t heard and needs aren’t acknowledged because of language or economic barriers. Through thoughtful outreach and, more importantly, true collaboration, the LACBC is changing the dialogue among city officials about urban planning, bringing new advocates into the movement and, expanding the scope of the bike-ped movement to address critical issues of social and economic justice.

Lately, it seems like half the links on here have to do with the state of cycling in New York City. For instance…

A writer for the New Yorker bizarrely says he supports programs that encourage cycling, as long as they don’t affect his ability to park his Jag, although he does seem to consider bipedalism a passing fad; Aaron Naparstek artfully deconstructs — or perhaps eviscerates — his arguments. The Observer says straw men on bikes represent the city’s last culture war. Turns out that NY pol was only joking about ripping out the bike lanes; it was a real knee-slapper alright. The suddenly embattled Janette Sadik-Khan reports that her controversial efforts to reshape Gotham’s streets have improved safety 40% for all road users; yeah, I can see why they want to get rid of her. Bob Mionske offers his typically insightful perspective on the city’s bike wars. And the Guardian says it could negatively affect the future of cycling worldwide.

If you find yourself in the Valley Thursday afternoon, stop by the groundbreaking for the West Valley L.A. River Greenway. Streetsblog reports $2.6 million in local Measure R funds will go to L.A. bikeways. LADOT Bike Blog looks at the role of mini-roundabouts in calming traffic on bike-friendly streets; considering the way drivers race around the one near me at Eastborne and Westholme, it doesn’t seem to be working. Looking at the politics of cycling from a female perspective. The National Bike Summit is now underway in Washington DC; one of these days, I’ll find a way to be there. UK cyclists fight back against Northern Ireland’s proposed mandatory helmet law. Evidently, becoming the UK’s leading bike city doesn’t happen overnight, or even in three years. A look atSouth African cyclists. And a brilliant post on IPayRoadTax.com looks at driver bias and says cyclists don’t own the road, we rent it; seriously, if you don’t read any other links today, read this one.

Finally, a new study shows that traffic fatalities increase after nail-biter finishes in sporting events, but only in the hometown of the winning team. So you might want to be careful riding after Lakers games, but feel free to ride after Clippers play.

It’s Election Day in L.A. And yes, your vote matters.

It’s high noon.

Otherwise known as Election Day in L.A. And just like in the movies, this town ain’t big enough for all the candidates — and the showdown is taking place at the polls across the city.

Most of the attention has been focused on the LaBonge/Box/O’Grady race in Council District 4. While history shows it’s virtually impossible to unseat an incumbent councilmember in Los Angeles, bike advocate Stephen Box has run a very smart race and stands a real chance of pulling off an upset, drawing support from throughout the biking community, as well as significant support from local food truck operators.

But make no mistake. Neither Box, nor anyone else in the CD4 race, is likely to reach the required 50% to avoid a runoff. Right now, my best guess is that we’ll see a runoff between Box and incumbent Tom LaBonge; however, this race looks close enough that any of the three could emerge on top. And any of the three — including the incumbent — could get left off.

So if you live in the district and care who wins — or who loses — get out and vote.

And yes, your vote matters — two years ago David Vahedi won the first round of the CD5 voting by just 60 votes before losing to Paul Koretz by a slim margin in the general election.

And this one could be just a close.

There are also vital elections in council districts 4, 6, 8, 10, 12 and 14. KPCC offers a great overview of each race, as well as candidates for the Board of Education, Board of Trustees and a raft of City Measures including pension reform, library funding and a proposed tax on medical marijuana.

You can find your polling place here. And if you can’t ride to the polls, you may be able to take a free taxi.

So you don’t have any excuse.

Now get out there and vote for someone who supports your right to ride.

This week marks two important meetings as the BAC Planning Subcommittee meets today at 1:30 pm; the City Council Transportation Committee meets Wednesday at 2 pm to consider the proposed anti-harassment ordinance and Safe Routes to Schools. L.A.’s newly adopted bike plan will be effective the day we convert street parking or travel lanes to protected bike lanes. Matt Ruscigno is looking forward to a RAD Bike Night at the Hammer. Not surprisingly, young drivers are more distracted than older ones. If you don’t notice a lot of cyclists on the streets, it’s because we often take the roads less traveled by. One more reason to move to the front of the intersection, as riders stopped in traffic often enjoy two types of second-hand smoke. If anyone is surprised a lawsuit has been filed to force the removal of New York’s Prospect Park West bike lanes, you haven’t been paying attention. Zeke says you can now get a degree in cycling; if real world experience counts, I should have a PhD in bikeology. After a teenage bicyclist is killed, South Carolina cycling advocates question how safe the roads really are.

British officials recommend retaining the Cycle to Work program despite anticipated budget cuts. A cyclist’s helmet cam captures an assault, as a driver jumps out to throttle him. Riverside cyclist killed by train; more on the new bike plan and press conference

Somehow I missed this one while I was tied up with the bike plan this week.

According to the Riverside Press-Enterprise, a 26-year old Riverside man was killed on Tuesday when he was hit by a train.

The cyclist, who has not been publicly identified pending notification of next of kin, was riding with his girlfriend on Adams Street east of Highway 91 while they waited for a train to pass. After the train had gone by, he rode around the crossing arm barriers and directly into the path of a second train coming in the opposite direction.

He died in a local hospital several hours later, after suffering head injuries and broken bones; according to the Press-Enterprise, it was the 3rd similar incident in the last two years.

Evidently, some people think that’s funny.

Update: The victim was identified as 26-year old Roberto Garcia.

A unanimous vote, a new bike plan for Los Angeles, and a reminder why it’s needed

Plus ca change, plus c’est la meme chose. Plus ca change, plus c’est la meme chose.

This afternoon, I sat in City Hall and watched as L.A.’s City Council unanimously passed a widely praised new bike plan. Tonight, I got a call from a friend who got clipped by a car on her way home.

The more things change, the more they stay the same, indeed.

I got up early to take the 1 to 1.5 hour bus ride downtown, arriving to find the council chambers filled to overflowing with Teamsters. They were there, I’m told, to support a proposal to disincorporate and annex so-called city of Vernon — the city where businesses outnumber residents and local government seems more akin to a fiefdom operating on a code of omertà.

The long, passionate discussion meant it was well after noon before the room emptied out enough to let us in. And because of the late hour, we were at risk of being pushed off to another day.

As a result, Councilmember Bill Rosendahl, who has championed the plan from the beginning, made a simple request. He could hold the quorum together long enough for a vote on the motion if we agreed to limit comments in favor of the plan to just 10 minutes.

I looked around the room, counted the cyclists — including several members of the city’s Bicycle Advisory Committee, as well as the LACBC and Bikeside — and decided that mine could wait for another day.

I’ll let others fill you in on the nuts and bolts of the hearing. But there were a few standout moments.

For instance, Bikeside’s Alex Thompson lead things off by knocking it out of the park, saying this plan makes L.A. competitive with any other city in the U.S. — better, even, than the widely praised plans of New York and Chicago.

Flying Pigeon LA owner Josef Bray-Ali said the plan includes propoals to document “the trail of blood on our streets.” And said that this information needs to be collected and made public.

The LACBC’s Alexis Lantz stated that our streets are currently biased against those too young or too old to drive, as well as those who choose not to. This plan, she said, will create complete, healthier streets, and she noted that the support of the council would be critical to its implementation.

The BAC’s Jeff Jacobberger pointed out that bikeways have already been placed where it’s easy, so now it’s time to put them where it’s hard, which may mean removing parking or a lane of traffic.

New Chair Jay Slater says the BAC stands ready to work with the city to implement the plan, insisting that it should not go the way of the failed 1996 bike plan. And outgoing Chair, and current Vice Chair, Glenn Bailey quoted William Mulholland, saying “There it is. Take it;” noting that we can’t turn back the clock, but we can educate drivers and cyclists to take back the streets.

Then there were the dueling comments from cyclists who support allowing mountain biking in city parks, and the equestrians dead set against any mode of parkland transportation with wheels instead of legs.

In the end, the plan was adopted, with a motion by Councilmember Tom LaBonge that the issue would be studied and that nothing in the plan would change existing policies in the meantime.

Although it should be noted that virtually every horseman and horsewoman, as well as a couple representatives from the Sierra Club, insisted that they support cyclists who ride for transportation; it’s just recreational riders in city parks that they oppose.

Which of course leads to the question of whether horses in the park are recreational, or if they’re used for transportation.

Then there was the comic relief provided by two commenters appearing on video from the Valley City Hall, who seemed to think that a three-foot passing law had miraculously been included as part of the plan. And insisted that no driver could possibly pass a cyclist at such a dangerously extravagant distance.

So if you get buzzed riding in the valley, you can start there in your hunt for suspects.

Meanwhile, Council President Eric Garcetti noted that he’s supported bikeways since he was seven years old, and takes pride in the design standards included in the plan that say Los Angeles embraces bicycling.

And Rosendahl said the plan isn’t the final word, and that if changes are necessary, “I’m not leaving; if the people re-elect me, I’ll be here for another five years.” He also suggested that once the plan is built out, “If you get me a safe place to ride, I’ll get on that bike.”

With that, LaBonge had BAC Chair Emeritus Alex Baum — the only remaining original member of the BAC, appointed by the late, great Mayor Tom Bradley — call for a vote on the motion. And it carried unanimously, with all 12 members voting in favor.

As for my remarks, I had intended to point out that the adoption of the bike plan wasn’t the end of a long and difficult process.

Rather, it’s the beginning of an even longer and more difficult one. Because now it’s up to all of us to ensure that the lines on that map turn into paint and signs on the street, and that it doesn’t end in failure like the last one.

I was also going to ask that we use this plan as a springboard to accomplish something that would have been unthinkable just a few years ago. Or last year, even.

That the city commit itself to zero bicyclists killed on our streets by 2020.

It wouldn’t be easy. It would take education, enforcement, and genuine commitment from the Mayor, City Council, LAPD, LADOT, Street Services and Planning, as well as the entire cycling community.

But it is achievable. And using this plan as a springboard, we could make the last bike death in this city the last bike death in this city.

As for my friend, she was shaken up, but it sounds like she’ll be okay.

And when she called the police, they took her seriously, and sent a patrol car to her home to investigate what they said was a clear case of a hit-and-run.

And that alone is a big change.

Two other brief notes:

Frank Peters of cdmCyclist reports that agreement has been reached to ensure that bike lanes will be included on the soon-to-be-rebuilt Gerald Desmond Bridge in Long Beach — and that they won’t be cut from the plans, even if it comes in over budget.

And Road.CC says that Brazilian banker Ricardo Neis, who was recorded plowing down dozens of cyclists participating in the Porto Alegre Critical Mass, will be charged with attempted murder.

Clearly, Brazil gets it.

And evidently, Caltrans — and L.A.’s leadership — is starting to.

Talking back to L.A. Weekly, Newport Beach decides it’s safe enough, a London look at U.S. car culture

A cyclist, bike activist and long-time volunteer responds to the recent L.A. Weekly article about Stephen Box and the rise of bike activism in the city, complaining that more than just straight, white males were instrumental in building the bike community, including himself.

He makes a very valid point.

It doesn’t detract in the slightest from the amazing efforts of CD4 candidate Stephen Box and the others mentioned in the story to note that the LACBC and other groups, such as C.I.C.L.E., Midnight Ridazz and Bikeside and other groups, have done a lot to make this city safer and more inviting for cyclists of all types. As well as the efforts of countless individuals of every possible description, working together and on their own, to advance the cause of cycling in Los Angeles.

Singling out any one person or group, however deserving, ignores the efforts of everyone else who has done what they can to make this a better place to ride.

And we wouldn’t be where we are today without all of them.

Newport Beach, home of yet another cycling fatality this week, plans to shut down the city’s Bike Safety Committee at the end of this year.

Evidently, the recent crackdown on dangerous riders and drivers has solved all their safety problems, and local cyclists can now ride the city’s streets without worry. Even though Amine Britel was the fourth cyclist killed in the city in just the last two years. And even though he was killed just days after the first weekend of the crackdown.

Or maybe they expect to solve any remaining problems during the second weekend this Saturday and Sunday — despite the fact that this seemingly wealthy seaside city can’t afford to buy a single Share the Road sign. Let alone one that says Bikes May Use Full Lane.

Because, you know, they still have to pay for that new $131 million City Hall.

Meanwhile, Danae Miller, the driver arrested for killing Britel, never had enough points charged against it to have her license suspended, despite receiving somewhere between 15 and 17 tickets in the last five years, depending on who’s doing the counting.

And a writer for the Examiner questions whether the law should be changed to keep people like her off the road.

If that’s what it takes, I’m all in favor.

London’s Guardian offers an overseas look at America’s car culture — and trust me, it’s not pretty. However, there may be hope:

Before Communist China became partner with Capitalist America in a new world order of union-free sweatshops, Americans used to laugh at all the bicycles on Chinese streets. Now, as the Chinese become more car-dependent, as their cities become more clogged and polluted, many Americans are rediscovering the pleasures, healthiness and sanity of bicycling or walking. Suddenly, a street full of bikes seems positively idyllic. In a country, and empire, in a downward spiral, this will be one of the few changes for the better.

Riding and walking through one’s community at a more human pace, one will also regain one’s sense of belonging. One will also discover that one has two legs, arms and a set of lungs. Sprung from the steel prison of the automobile, Americans will be glad to see other faces and limbs. They will realise that they actually have neighbours.

The long and difficult path to a new bike plan should come to a completion when the L.A. City Council takes it up for final consideration at 10 am on Tuesday, March 1st at Downtown City Hall, 200 North Spring Street.

The 2nd meeting of the Bike Plan Implementation Team (BPIT) takes place from 2 pm to 3:30 pm on Tuesday, March 1st following the council meeting in room 721 of the Downtown City Hall, 200 North Spring Street.

Make a full bike day of it by helping plan CicLAvia’s advance to the Eastside with a meeting at 5:30 pm on Tuesday, March 1st on extending the route into Boyle Heights, Roosevelt High School cafeteria, 456 South Mathews Street, Los Angeles.

The third LACBC Sunday Funday ride will roll 62 miles through the North San Gabriel Valley on Sunday, March 6th. Lead by board member Alex Amerri, the fast-paced ride for advanced cyclists will explore the area’s architectural and historical highlights; riders assemble at 8:30 am at Parking Lot K at the Rose Bowl, 1001 Rose Bowl Drive in Pasadena, with the ride starting at 9 am.

Flying Pigeon and the Bike Oven host the free Spoke(n) Art Ride on the 2nd Saturday of every month; the next ride will take place on March 12th, starting 6:30 pm at 3714 N. Figueroa St. in Highland Park.

Flying Pigeon’s Get Sum Dim Sum ride takes place on the third Sunday of each month; the next ride will be Sunday, March 20 from 10 am to 1 pm, starting at 3714 N. Figueroa St. in Highland Park.

The Santa Clarita Century is scheduled to roll on Saturday, April 2nd with rides ranging from a family ride to a full century.

The next three CicLAvias will take place on April 10th, July 10th and October 9th; if you missed the first one, don’t make the same mistake again.

L.A.’s 17th annual Bike Week takes place May 16th through the 20th, with an emphasis on bike safety education, and events throughout the city. This year’s Blessing of the Bicycles will take place as part of Bike Week on 8 to 9:30 am on May 17th at Downtown’s Good Samaritan Hospital, 616 S. Witmer Street. And Metro is looking for Bike Buddies to guide inexperienced cyclists on Bike to Work Day; heads-up courtesy of the marathon-training danceralamode.

The San Diego Century ride takes place on Saturday, May 21st with rides of 37, 66 or 103 miles, starting in Encinitas, along with free admission to an expo featuring sports, local cuisine and live music.

Groundbreaking L.A. cyclist anti-harassment law nears final approval

A first-of-its-kind new anti-harassment law could prove as inspiring as City Hall itself.

In the end it was a false alarm.

For a brief period Thursday afternoon, there was a flurry of online activity suggesting that the groundbreaking new Bicycle Anti-Harassment Ordinance had unexpectedly become law.

It hadn’t.

Instead, it was something almost as big, but not quite as final.

I first heard that this law was in the works when I appeared with LADOT Sr. Bike Coordinator Michelle Mowery on Larry Mantle’s AirTalk program on KPCC back in November ’09. She told me confidentially that she had been working quietly behind the scenes with members of 11th District Councilmember Bill Rosendahl’s staff to develop additional legal protection for the city’s cyclists, though in a far different form from what we see today.

So give credit where it’s due. Because this wouldn’t be happening at all if she hadn’t been pushing for it.

Yesterday was that the City Attorney’s office officially unveiled the final draft of the ordinance. The confusion came from the inclusion of Council Rule #38 in the City Attorney’s letter accompanying the draft, which said that because it didn’t require enforcement by an city officer, board or commission, it didn’t require review by “any such City officer or entity.”

To those of us who lack a legal background and aren’t grounded in the minutiae of city regulations, that sounded like it might not need further approval by the City Council to become law.

It does.

Fortunately, after a mad flurry of emails, texts and tweets Thursday afternoon, City Council President Eric Garcetti and his staff helped us unravel what had really happened, and what the next steps will be.

It turns out that Rule #38 simply means that the ordinance doesn’t need to be reviewed by any other city department, such as LADOT or the police department. Instead, it will go straight to the Transportation Committee for review, leading up to a hearing before the full Council; if they approve it, it goes to the Mayor for his signature.

And assuming Mayor Villaraigosa signs off, it will then become law, most likely 30 days after signing unless otherwise noted. L.A. cyclists will then be protected by this innovative ordinance — as near as I can find, it’s the first of its kind anywhere that makes the harassment of cyclists a civil, rather criminal, violation.

Which means that you’ll be able to take drivers — or anyone else — who threatens your safety or refuse to recognize your right to the road to court yourself, rather than relying on the police to determine if a crime has been committed, and the District Attorney or City Attorney to file charges.

And because your case will be heard in civil court, it requires a lower burden of proof; just a majority of jurors will have to agree instead of the unanimous verdict required in criminal cases.

It also doesn’t preclude criminal charges, so you can pursue your own case against someone who threatens you without jeopardizing any possible criminal case.

Of course, it won’t work miracles.

While it sets a new standard for other cities and states to follow in ensuring cyclists a safe place on the road, you’ll still need to prove your case. As all too many of us have learned the hard way, it’s not easy to get the license number of a driver who just ran you off the road. And you’ll still need to gather evidence and witnesses so it’s not just your word against theirs.

But with a potential judgment of triple your actual damages or $1,000, whichever is higher, plus any punitive damages the court may impose, it should act as a significant deterrent to hot headed motorists.

In addition, the provision for attorney’s fees should make it much easier to find a lawyer who’ll take your case despite the relatively small potential judgment. Which means that whatever money you receive as a result will go to you instead of your attorney — something I learned about the hard way when the small settlement I received in a road rage case was eaten up by attorney’s fees; in fact, I would have owed him if he hadn’t written off the excess.

So it should be an effective tool to fight back against things like this that occur countless times every day in every part of the city. And it should also serve as a model for other area cities, since harassment and threatening behavior is hardly confined within L.A.’s borders.

We still have some significant hurdles to jump before this becomes law, though. While the drafting of the ordinance enjoyed unanimous support from the council, we haven’t heard from the motoring public, who may not yet be aware this law is being considered.

But now we finally have an actual draft in our hands.

It was a just over a year ago that Council President Eric Garcetti offered me his personal assurance that he would stay on top of the proposed ordinance and keep it moving forward. Yesterday he reacted to the release of the draft by saying “This is a long-overdue recognition that our streets are shared and bicyclists deserve to be free from fear on our streets.”

It looks like he’s kept his word.

As has Rosendahl, who has been driving — or perhaps, pedaling — this ordinance since the very beginning, famously declaring that “The culture of the car is going to end now!”

There are other people to thank, of course — not in the least of whom is Deputy City Attorney Judith Reel, who had the brilliant idea of treating harassment as a civil violation.

But let’s save that until we’ve actually crossed the finish line.

Because we still have some work to do in the meantime.

ORDINANCE NO. _________

An ordinance adding Article 5.10 to Chapter IV of the Los Angeles Municipal Code to prohibit harassment of bicyclists because of their status as bicyclists.

THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS:

Section 1. Article 5.10 is added to Chapter IV of the Los Angeles Municipal Code to read as follows:

ARTICLE 5.10

PROHIBITION AGAINST HARASSMENT OF BICYCLISTS

SEC. 45.96.00. FINDINGS AND PURPOSE.

After public hearings and receipt of testimony, the City Council finds and declares:

That the City of Los Angeles wants to encourage people to ride bicycles rather than drive motor vehicles in order to lessen traffic congestion and improve air quality;

That harassment of bicyclists on the basis of their status as bicyclists exists in the City of Los Angeles;

That existing criminal and civil laws do not effectively prevent the unlawful harassment of bicyclists because of their status as bicyclists;

That riding a bicycle on City streets poses hazards to bicyclists, and that these hazards are amplified by the actions of persons who deliberately harass and endanger bicyclists because of their status as bicyclists; and

That because people have a right to ride a bicycle in the City of Los Angles and should be able to do so safely on City streets, it is against the public policy of the City of Los Angeles to harass a bicyclist upon the basis of the person’s status as a bicyclist.

SEC. 45.96.01. DEFINITIONS.

The following words and phrases, whenever used in this Article, shall be construed as defined in this Section. Words and phrases not defined herein shall be construed as defined in Section 12.03 of this Code, if defined therein.

A. Bicycle. A device upon which any person may ride, propelled exclusively by human power through a belt, chain or gears, and having one or more wheels.

B. Bicyclist. A person riding a bicycle.

SEC. 45.96.02. PROHIBITED ACTIVITIES.

A person shall not do or attempt to do any of the following:

A. Physically assault or attempt to physically assault a Bicyclist because, in whole or in part, of the Bicyclist’s status as a Bicyclist.

B. Threaten to physically injure a Bicyclist because, in whole or in part, of the Bicyclist’s status as a Bicyclist.

C. Intentionally injure, attempt to injure, or threaten to physically injure, either by words, vehicle, or other object, a Bicyclist because, in whole or in part, of the Bicyclist’s status as a Bicyclist.

D. Intentionally distract or attempt to distract a Bicyclist because, in whole or in part, of the Bicyclist’s status as a Bicyclist.

SEC. 45.96.03. REMEDIES.

A. Any aggrieved person may enforce the provisions of this Article by means of a civil lawsuit.

B. Any person who violates the provisions of this Article shall be liable for actual damages with regard to each and every such violation, and such additional amount as may be determined by a jury, or a court sitting without a jury, up to three times the amount of actual damages, or $1,000, whichever is greater, as well as reasonable attorneys’ fees and costs of litigation. In addition, a jury or a court may award punitive damages where warranted.

C. Notwithstanding Section 11.00(m) of this Code, violations of any of the provisions of this Article shall not constitute a misdemeanor or infraction, except where such actions, independently of this Article, constitute a misdemeanor or infraction.

D. The remedies provided by the provisions of this Article are in addition to all other remedies provided by law, and nothing in this Article shall preclude any aggrieved person from pursuing any other remedy provided by law.

Sec. 2. Severability. If any provision of this ordinance is found to be unconstitutional or othervvise invalid by any court of competent jurisdiction, that invalidity shall not affect the remaining provisions of this ordinance, which can be implemented without the invalid provisions, and to this end, the provisions of this ordinance are declared to be severable.

Sec. 3. The City Clerk shall certify to the passage of this ordinance and have it published in accordance with Council policy, either in a daily newspaper circulated in the City of Los Angeles or by posting for ten days in three public places in the City of Los Angeles: one copy on the bulletin board located at the Main Street entrance to the Los Angeles City Hall; one copy on the bulletin board located at the Main Street entrance to the Los Angeles City Hall East; and one copy on the bulletin board located at the Temple Street entrance to the Los Angeles County Hall of Records.

One quick breaking news note:

Tour de Fat has officially set a date for this year’s return engagement, coming back to Los Angeles on October 8th. Better yet, that’s one day before the city’s 4th scheduled CicLAvia, making for a full weekend celebration of cycling in L.A.

The bad news is, October 8th is also Yom Kippur.

You’d think someone would check the calendar before scheduling a date in a city with such a large Jewish community, many of whom are active cyclists. And might appreciate having a day full of beer and bikes to atone for.

File this one under the heading of They Just Don’t Get It.

Malibu City Council approved a three-hour Bicycle Safety public workshop, to be held on a Saturday morning at a date to be determined. Great news so far, as cyclists have been pushing for an open discussion of the problems we face riding in and through the ‘Bu, while city officials — particularly members of the city’s Public Safety Commission — have been surprisingly open to dialogue with the biking community.

And then there’s the Sheriff’s Department.

“It should be noted that the Sheriff’s department expressed concern about whether a workshop would be a benefit to the city’s goals of improved safety. During previous discussions with members of cycling organizations and bike clubs, the Sheriff’s liaison stated that the cyclists continued to disagree with the Sheriff’s interpretation of the law. There was additional concern expressed that the goal to open communication between motorists and cyclists would not likely be achieved through the workshop as it is doubtful that many non-cycling members of the public would consider attending,” the staff memo adds.

So, discussion is only worthwhile when we think they’re right?

Maybe we continue to disagree because the Sheriff’s Department in Malibu continues to interpret state law incorrectly. Despite the best efforts of cyclists to point out that we do in fact have a legal right to ride in the traffic lane, and that nothing in state law prohibits riding side-by-side in order to safely control the lane when necessary, even — or especially — on busy highways like PCH.

And somehow, given the passionate hatred expressed towards cyclists by some Malibu residents, I doubt getting the non-riding public to attend will be a problem.

Oh. My. God.

The driver who ran down cross-country cyclist and former USC Athletic Department employee Roger Grooters has had his license suspended for just six months and fined a paltry $1,160 by a Florida judge.

Six lousy months of being prohibited from driving — and no jail time — after carelessly killing another human being. Before being allowed back on the roads to do it again to someone else.

That isn’t even a slap on the wrist. They might as well have given him a cigar and a pat on the back for reducing the state’s surplus cyclist population.

Clearly, life is cheap in Florida.

There are no words. At least, none that I’d want to use here.

But I can tell you where I won’t be spending my next vacation.

In our continuing coverage of former Tour de France winners accused of doping, Lance officially retired once again on Wednesday. Contador’s decision to ride this year’s Giro may be a polite way to avoid being banned from Le Tour, while Spanish meat producers say he’s full of mierda. A physician says he was fired from a Spanish bike team when he refused to dope the riders. And UCI threatens to sue Floyd Landis over his allegations of a cover-up; Dave Moulton says Landis has a right to be ticked off.

Santa Monica’s Planning and Community Development Department invites you to participate in a special workshop to help transform the Bergamot area into an urban transit village, including pedestrian and bike linkages to the Expo Line, Bergamot Arts Center and other destinations. The meeting takes place from 6:30 – 9 pm tonight at Pier 59 Studios, 2415 Michigan Ave in Bergamot Station.

Glendale’s Safe and Healthy Streets Plan moves forward to make the city safer for cyclists and pedestrians; meanwhile, Glendale and Burbank cooperate to request Metro funds for transportation improvements, including a bike boulevard on Kenneth Road. In a typically illogical, knee-jerk motorhead response, a UK Member of Parliament suggests banning bikes from a highway to keep cyclists from getting killed, rather than doing something to keep drivers from killing them. A new car hood design promises to protect cyclists and pedestrians in collisions; instead of building safer cars, why not make safer drivers? Creative things to do with old bike parts. Finally, KCET’s Departures offers an exceptional in-depth look at the abused, and slowly recovering, L.A. River from the Headwaters to the Sepulveda Basin. Kudos to KCET; this one of the best examples I’ve seen of using online media to tell a story. Meanwhile, Flying Pigeon blogger Rick Risemberg looks at the graffiti and grace of the Downtown section of the river and its bike path.

Bike plan moves forward, police crackdown in OC, Box and bikes profiled in LA Weekly

First the big news, as the joint Transportation and Planning and Land Use Management votes to move forward with the draft bike plan, with a five year plan for implementation.

While that’s great news for city cyclists, it also means no for now to the proposed South Venice Beach bike path extension.

The debate was dominated by discussion over whether to allow bikes on city trails currently used by hikers and equestrians — something that safely occurs around the world, yet according to the local horse crowd, would lead to inevitable disaster here in L.A.

While there’s an obvious need for people to use trails safely and courteously, and observe the rights of other users, public parks and trails belong to everyone and shouldn’t be set aside for any single group. Or exclude any single group of users.

The committee voted to have the Planning Department negotiate language between both types of riders; however, anything that doesn’t find a way to accommodate all users would be a failure.

Meanwhile, the plan will now go to the full committee for final approval before going to the Mayor for his signature; all indications are Villaraigosa will sign off on the plan.

New York cyclists have been justifiably up in arms the last few weeks over the NYPD’s efforts to crack down on lawbreaking cyclists, while ignoring more dangerous violations by drivers.

Now a similar move is underway here as the Newport Beach, Huntington Beach, Laguna Beach and Costa Mesa police departments are banding together to conduct a “specialized Bicycle Safety Enforcement Operation” on the 19th and 24th of this month.

Despite the title, the press release promises officers will address traffic violations by cyclists and other vehicle operators that could “lead to bicycle vs. vehicle collisions, injuries and fatalities.”

The goal of the program is to educate the public about the safe and lawful use of bicycles, as well as the safe and lawful use of vehicles that share the roadway with bicycles. Prevention is a key component of the program, which centers on the traffic laws that can prevent bicycle riders from becoming injured to killed due to illegal use or reckless behavior by bicyclists and vehicles. In addition, the Police Departments involved may be required to enforce obvious violations to the City’s Municipal Code to maintain safe operations.

I don’t have any problem with enforcing traffic violations by cyclists; frankly, I’ve seen some cyclists who should be ticketed, if not thrown into leg irons. However, I would expect — and all cyclists have every right to expect — that unlike the situation in New York, the crackdown will address violations by drivers as well as cyclists.

And it should take into account which violators pose the greater risk to others.

Neon Tommy Editor-at-Large Hillel Aron offers an in-depth profile of CD4 City Council Candidate Stephen Box and the history of L.A. bike activism in this week’s L.A. Weekly.

As the article notes, it’s almost impossible to unseat a sitting council member in L.A.; even the most unpopular usually cruise to victory over seemingly more worthy opponents once special interest money starts pouring in. Despite that, there’s a growing sense that Box may have a real shot at forcing incumbent Tom LaBonge into a runoff next month.

LaBonge has long supported cycling, though not always in the way cyclists would prefer; if he were smart, he’d move to strengthen his support of bicycling to undercut Box’s strongest base of support. Instead, he seems to be focused on shoring up support from the anti-bike crowd, as many cyclists see him, rightly or wrongly, as an obstacle in the way of many bicycling issues.

And it’s hard to take the other candidate in the race, Tomas O’Grady, seriously when he ignores questions from the city’s leading newspaper.

You have your own chance to evaluate the candidates tonight when the Silver Lake Neighborhood Council hosts a candidate’s forum at Silver Lake Community Church, 2930 Hyperion Ave. Or you can meet Stephen Box at an open house from 2 to 4 pm this Sunday at 3311 Lowry Road in Los Angeles.

Box has also received an endorsement from MobileFoodNews; not to surprising since LaBonge has been seen as an opponent of L.A.’s popular food trucks.

One other note — the writer of the Weekly article gave me every opportunity to attack other bicycle advocates and advocacy groups; I chose not to do that. It’s my firm belief than anyone working to support cycling in Los Angles deserves my support and gratitude, whether or not I happen agree with them. I’m saddened that not everyone feels the same way.

A three-year old Visalia girl is killed when she’s backed over by a neighbor’s pickup while riding on the sidewalk. San Francisco police have refused to take reports or issue citations for collisions involving cyclists unless an ambulance is called; so not matter what a driver does, if they don’t seriously injure a rider, they walk. Shameful. Matt Ruscigno rides from San Louis Obispo to L.A. in a single day — while sick. This year’s Amgen Tour of California won’t tour California exclusively.

J. Edgar Hoover on a bike, sort of. It’s not the same as an Idaho Stop Law, but Oregon considers lowering the fines for cyclists who roll through stop signs. Somehow I missed this; Dr. Matthew Burke, the orthopedic surgeon, U.S. Army Major and Iraq war vet critically injured by aggressive driver while on a group ride last October, passed away over the weekend after 4 months in a coma; the driver is charged with reckless homicide.

Yet another London cyclist is killed by a large truck, this time a 28-year old art curator. More bikes than cars expected to cross London’s bridges during morning rush hour in 2011. Irish physicians urge the passage of a mandatory helmet law, even though you’re over six times more likely to die walking on the sidewalk. Europe already has the kind of airport bike lanes John McCain wants to kill. Looks like rising star Taylor Phinney will compete in the Tour of Oman after all. South African cyclist Michael Dean Pepper is banned for three years for a failed drug test; sometimes I think we should just ban everyone for two years and start over.

Well, that’s one more problem we don’t face in L.A. — a South African cyclist survives after using his bike to fight off a leopard attack; evidence suggests that the animal had just escaped from a snare and was fighting for its life, as well.

Okay, so it turned out to be a very long ride.

When I mapped out a route for the I ♥ the Westside ride, the second in the LACBC’s new series of Sunday Funday rides, I rode the 28 mile route in about two hours without breaking a sweat.

So I added another hour to my estimate to allow for a series of five minute stops to discuss different cities and issues along the way. And then added another half hour just to be safe, and assumed everyone would be on their way home to watch the Super Bowl commercials by 1:30.

Like the song says, it ain’t necessarily so.

What I hadn’t counted on was the need to stop — repeatedly — when riders were cut off by traffic or red lights. Not mention an unexpected encounter with the Sweet E’s Bakeshop truck in Culver City.

I learned a long time ago never to come between cyclists and their cupcakes.

In the end, we got back to our pier-side start point over an hour after what I thought was a very generous worst case scenario.

On the other hand, we made it without a single flat or mechanical problem. And everyone who started out either made it to the finish with the rest of the group, or left along the route to meet other obligations.

That alone made it a successful ride in my book.

I also learned that leading a ride is a lot like hosting a party — you spend so much time looking after everyone that you barely spend time with anyone.

There were a lot of great people that I didn’t get to spend as much time with as I wanted. And some I didn’t get to meet at all, much to my regret. In fact, 42 riders started out, including four new members of the LACBC who signed up that morning.

And everyone seemed to have a great time, myself included. Then again, any day on a bike is a good day, and the perfect Westside weather and great guest speakers just made it that much better.

We started off with a brief presentation from the LACBC affiliate Santa Monica Spoke’s Cynthia Rose, who offered a brief overview of the many projects the Spoke is working on to make L.A.’s city by the bay live up to it’s bike-friendly status.

After a brief jaunt down Main Street, I asked if anyone could tell me when we left Santa Monica and entered Los Angeles; not surprisingly, almost everyone was able to pinpoint the exact spot where the bike lanes ended, the road widened to two lanes and traffic sped up.

That lead to Paul Backstrom from Councilmember Bill Rosendahl’s office speaking for a few minutes about the proposed road diet that would tame the L.A. section of Main, by creating a mirror image of the Santa Monica stretch. He noted that the city is working on solutions to move the bike lanes that would result out of the door zone, which has been fairly criticized in the original plans.

As we rode up Ballona Creek, Rick Risemberg, aka Mr. Bicycle Fixation and one of the city’s leading bike advocates, volunteered to talk about the native plants and rest area that had recently been installed along the bikeway, as well as a water filtration system designed to keep pollutants out of the bay.

When we got to Culver City, Jim Shanman spoke briefly about the efforts of the newly formed Culver City Bicycle Coalition and their work on the new Culver City bike plan. And invited everyone to come back to participate in the LACBC-affiliate group’s next monthly Family Ride on the 27th.

One of my first thoughts in planning this ride had been that I wanted to see bikes rolling down Ferrari, Rolls Royce and Bentley-choked Rodeo drive. But I regretted that I hadn’t had time to reach out to Mark Elliot of the group Better Bike Beverly Hills — yes, yet another LACBC affiliate — to join us on the ride.

So while we were stopped in Culver City, I asked if any of the riders were from Beverly Hills. When one man raised his hand, I asked if he was involved with the BBBH.

He introduced himself as Mark, and said “I founded it.”

That was how I finally met Mark Elliot, one of my personal heroes among local bike advocates, if only because he’s taken on one of the hardest battles in the L.A. area.

So when we got to Beverly Hills — which currently lacks a single inch of bike lane — Mark spoke about the work his group has been doing to transform the Westside’s bicycling black hole into something more ridable. Including the group’s efforts to capitalize on a once-in-a-lifetime opportunity to restructure Santa Monica Blvd to make it, not just safe for cyclists, but actually inviting for the countless riders who now go out of their way to avoid it.

At our stop in Westwood Village, I spoke briefly about the decline of one of the city’s most beautiful neighborhoods, and my personal vision to turn Westwood Blvd into a pedestrian walkway from Wilshire to the UCLA campus. We also discussed the new Veterans Administration master plan and the importance of regaining bike access through the Los Angeles National Cemetery, which was closed to bikes after 9/11 — evidently because of the threat that bicycles would pose to all the people buried there.

Finally, Jen Klausner, Executive Director of the LACBC, spoke about the dangers that cyclists and pedestrians face in the Brentwood area, as well as the lack of adequate infrastructure to protect them from the dangerous behaviors and sense of entitlement displayed by many Westside drivers.

In the end, it was a great day, combining a fun, beautiful ride with an overview of local advocacy.

And it sets the stage for next month’s Sunday Funday #3, in which fellow board member Alex Amerri will lead a fast-paced 62-mile ride through the north San Gabriel Valley.

And riders on that one probably won’t have to worry about the group being broken up by red lights.

LAB calls on Colorado cyclists to support proposed legislation to fight the Black Hawk bike ban. I’d go a step further and encourage any cyclists to write in to support the legislation; Colorado’s economy depends on tourism, so your opinions on the misguided ban on bikes that could affect your decision to visit the state matters.

The LACBC notes that a second workshop will be held Thursday night on the proposed redesign of the South Figueroa Corridor that could result in the city’s first true Complete Street, incorporating real pedestrian and bike access.

And don’t forget Wednesday’s 2:30 pm joint meeting of the City Council Transportation and Planning and Land Use Committees at Downtown City Hall to consider the city’s draft bike plan; this is the last public hearing before it goes to the full Council for approval. At the moment, it looks like illness will keep me away, but I urge you to show your support if you can make it.

Help make bicycling a priority in Santa Monica’s next budget

Santa Monica Spoke sends out a reminder that tonight’s Santa Monica City Council meeting will address budget priorities for the next two years at tonight’s meeting. Cyclists are encouraged to attend to ensure that bike projects receive the attention they deserve — especially in a city that ranks highest in it’s category for bike and pedestrian collisions.
