Morning Links: 77-year old victim of bike hit-and-run dies, arrest made in Expo Park road rage murder case

Sadly, the 77-year old Echo Park man injured in a collision with a bicyclist has died.

The Eastsider reports Levon Avetisyan was crossing Glendale Blvd on his way to Echo Park Lake on October 15th, when he was hit by a rider described only as a white man in his 40s. He was hospitalized in grave condition with severe head trauma, and passed away on Sunday.

While police have described this case as a hit-and-run, the rider initially did the right thing by remaining at the scene until paramedics arrived. However, he left before police arrived, without leaving his name or contact information.

It’s possible the rider may not have realized he needed to stay, just like he would in any other injury collision.

If you know this person, tell him to contact a lawyer, then come forward by calling LAPD Central Traffic Division detectives at 213-833-3713.

In case you missed it earlier, an arrest has finally been made in the alleged road rage death of a bike rider next to Expo Park last month.

Or more precisely, the arrest of the suspect has finally been announced.

Thirty-five year old Ruben Wharton Vanegas was killed after he reportedly got into an argument with the driver of an SUV on October 15th. A witness reported that the driver pushed him off his bike, then threatened to run over him, before doing exactly that.

Word broke today that police had actually arrested 32-year old Andrew Williams just four days after the fatal argument; he was held in lieu of $1 million bail.

Williams was scheduled to be arraigned on charges of murder and felony hit-and-run yesterday, but the hearing was put off until November 20th. He faces 25 years to life if convicted on all charges.

Why there was no public announcement of the arrest until now is unclear.

The College of Environmental Design at Cal Poly Pomona is hosting a reception to honor famed alternative transportation advocate Gil Penalosa in DTLA on Tuesday the 17th.

This free after-hours reception/mixer is a great opportunity to meet Guillermo “Gil” Penalosa, the founder and chairman of 8-80 Cities, previously served as the commissioner of parks, sport and recreation in Bogotá, Colombia, leading a team that designed and built more than 200 parks and opened 50-plus miles of car-free city roads for biking, walking, running and skating. His team is responsible for initiating the “new Ciclovia” — a program internationally recognized and emulated — which sees 1 million people walk, run, skate and bicycle along 121 kilometers of Bogotá’s city roads every Sunday.

Update: Arrest made in Expo Park road rage attack; driver charged with murder, hit-and-run

Evidently, it was a secret.

In a surprise announcement, My News LA reports a suspect in last month’s fatal road rage assault near Exposition Park is under arrest — and has been since four days after the October 15th incident.

Thirty-two-year old Andrew Williams was scheduled to be arraigned today on felony counts of murder and hit-and-run in the death of 35-year old Ruben Wharton Vanegas, who had not been previously identified.

That confirms an earlier witness report that Williams had been arguing with Vanegas, and had threatened to run him over before doing exactly that.

Williams has apparently been in jail the past 16 days in lieu of $1 million bond. He faces 25 to life upon conviction, according to the site.

Update: Williams arraignment has been delayed until November 20th.

The LAPD reports that they’re on the lookout for a bike rider who rode away after hitting a 77-year old pedestrian on Glendale Blvd in Echo Park.

The victim was left in the street suffering from a severe head wound; he’s still hospitalized in grave condition two weeks after the collision.

Anyone with information is urged to call LAPD Central Traffic Division detectives at 213/833-3713.

Seriously, bike riders have the same obligation to stick around following a wreck as drivers, both legally and morally.

So do it, already.

The LA City Council is planning to unadopt the Mobility Plan, less than three months after they passed it.

And supposedly, that’s a good thing.

Confused? You should be.

Apparently the problem stems from three minor changes the council made before adopting the plan, which only served to give greater attention to things that were already in it, according to Steetsblog’s Joe Linton.

However, because they didn’t follow the correct process in amending the plan, they may have given Fix the City, the self-appointed guardians of LA’s auto-centric past, grounds to sue and possibly get the entire plan thrown out in court. Or at least tie it up for years while lawyers fight over every comma and period.

So to head them off, a group of LA’s more progressive councilmembers have put forth a motion to rescind the plan, then re-adopt it sans amendments. Which should remove the basis for the lawsuit suit.

We’ll see.

Meanwhile, you never know what roadblocks anti-bike Councilmember Gil Cedillo and pseudo-environmentalist Paul Koretz will attempt to throw out in order to derail what should be easy passage.

And new Councilmember David Ryu remains a cypher after promising to re-evaluate everything predecessor Tom LaBonge had done, then following in his footsteps by attempting to have certain streets, including the long-promised 4th Street bikeway, removed from the plan.

A group of Veterans Administration employees pitched in to buy a homeless Kansas vet a new bike, after he returned a lost wallet with $400 inside that had been dropped from a female vet’s wheelchair.

And nice move from Specialized, as they replace the bike Dallas a woman was riding when a driver went through a red light and hit her; however, she’s still not able to ride nearly two months later.

The LACBC’s monthly Sunday Funday Ride celebrates Fall-Sedena with a 22-mile guided ride through tree-lined Pasadena.

Planning ahead, there’s a family-friendly group ride with the Biking Bunch scheduled for Culver City on November 15th.

And Finish the Ride makes it’s first appearance in the Valley on December 27th to help you burn off those sugar plums and figgy pudding.

It looks like that rails-to-trails bikeway that would link the coming Crenshaw Line with the LA River in South LA may actually become a reality, as Metro gets a $15 million grant to begin work on the first phase.

Morning Links: LA asks drivers to stay after they hit someone; suspect identified in North Fig hit-and-run

Sometimes I don’t even know what to say.

I mean, their hearts are in the right place. And it’s nice to see an outdoor advertising company give back to the city, after decades of ignoring every law on the books regarding their business.

Although the largesse of Clear Channel Outdoor in donating billboard space to the city couldn’t possibly have anything to do with the new billboard regulations currently under consideration.

Regardless of their motivation, the city teamed with CCO on Wednesday to unveil a new outdoor ad campaign designed to tackle the epidemic of hit-and-run in the LA area, apparently developed without the input of the many people who have been working to solve this problem.

Or anyone with any experience in advertising, for that matter.

The billboards, which will be posted in English, Spanish and Korean, politely ask drivers to obey the rules of the road and stick around after a collision because it might save a life.

Sure, that’s really going to motivate someone who just ran down a pedestrian after downing a few too many.

No moral authority. No threat of consequences. And not a hint at LA’s hit-and-run reward system, which pays up to $50,000 for information leading to the conviction of runaway drivers.

Let alone the state’s new Yellow Alert system, which could mean countless more eyes on the street looking for suspect vehicles.

No offense, but I’ve seen harder-hitting ads asking toddlers to switch diaper brands. And don’t get me started on the art direction, which looks like it was done on a PC in someone’s basement.

Hit-and-run is a serious problem, with serious consequences for the victims.

And we seriously deserve something better than this.

AR-151029487Police have finally identified a suspect (scroll down) in the hit-and-run death of Irma “Yolanda” Espinoza-Lugo as she crossed North Figueroa on September 18th.

They’ve asked the public to be on the lookout for William Armando Portales, described as a 49-year old Hispanic male, 5’ 6” tall and weighing 165 pounds.

And yes, there’s a $50,000 reward for anyone who helps bring him to justice.

I haven’t gotten involved in the My LA 2050 Challenge Grant Challenge on here, simply because there are so many projects that deserve your support.

It seems like a waste to make them battle it out for public votes, when the goal should be to find funding for as many as possible.

However, one of the more interesting proposals is one to build a bike and pedestrian bridge over Ballona Creek at McConnell Ave, which would help make the bike path a more viable commuter link connecting Culver City with Playa Vista.

Not many artists get a chance to work in asphalt. LADOT is looking for an artist to provide creative thinking to help reduce traffic deaths; the position will pay $20,000 over two years. Which is about $20,000 more than most LA artists make.

The LA City Council approved a pilot program allowing people to lock their bikes to parking meters in Westwood Village and on some major streets. Assuming the world doesn’t end, it will hopefully spread throughout the city.

There’s only one thing worse than being stopped by the CHP for riding your bike on the 101 Freeway — having them call your mom to pick you up.

Caltrans will be teaming with SCAG and UCLA to host the 2015 California Transportation Planning Conference at the Millennium Biltmore Hotel in DTLA this December; advance registration is a mere $400 unless you can manage to form a non-profit or get adopted by a tribal government before then.

British Columbia’s state insurance agency insists on blaming the victim in a bicycling fatality, even though the driver has been charged with driving under the influence, negligence and hit-and-run. The company first claimed the cyclist was drunk or high, then settled on claims that his brakes were bad, that he failed to ride far enough right, and didn’t warn the driver before the driver hit him.

A British bike safety group calls for allowing bike riders to make the equivalent of a right turn on a red light.

Update: West Covina bicyclist killed in (alleged) drunken late-night hit-and-run

For once, there was a cop around when he was needed.

Unfortunately, it came too late for a bike rider in West Covina last night.

Multiple sources are reporting that a bicyclist was killed in a high-speed hit-and-run just before midnight, and the allegedly drunken driver arrested moments later just a few blocks away.

Forty-four-year old La Puente resident Jose De Jesus Ruiz-Villanueva was riding his bike north on the 1100 block of South Valinda Avenue, just above Merced Avenue, at 11:49 pm when he was hit from behind by a car traveling at a high rate of speed.

A police officer who was writing a report at nearby Melinda Elementary School heard the collision, and gave chase as the driver sped away, he stopped the car on Cameron Ave, where he noticed substantial damage to the vehicle.

According to the San Gabriel Valley Tribune, a second officer went back to the scene, and found Ruiz-Villanueva dead at the scene.

The paper reports he had been on his way to work when he was killed.

Police arrested 25-year old Presley Danielle Rodriguez of Glendora on suspicion of felony driving under the influence causing great bodily injury or death and felony hit-and-run. She was booked on $100,000 bail.

Unfortunately, this occurred in Los Angeles County, where cases like this are usually plea bargained away, leaving the drivers to face little or no jail time.

This is the 64th bicycling fatality in Southern California this year, and the 25th in Los Angeles County.

Eight of those 25 deaths have been hit-and-runs.

Update: The driver, Presley Danielle Rodriguez, faces up to 15 years in prison on charges of hit-and-run and gross vehicular manslaughter while intoxicated. And for a change, the court appears to be taking this case seriously, increasing her bond to $150,000, $50,000 more than prosecutors requested.

The SGV Tribune reports Ruiz-Villanueva was on his way to work at A-1 Power Sweeping Co in Baldwin Park; his bicycle was his only form of transportation.

Morning Links: Guilty in North Fig hit-and-run and meth-fueled Fiesta Island crash, & still more Coronado madness

It’s been a busy few weeks for courtroom drama.

In the latest case, 21-year old Alexis Virto has pled guilty in the horrifying hit-and-run death of bike rider Jose Luna.

Luna was crossing North Figueroa in a marked crosswalk with another rider last June when Virto’s car smashed into him at an estimated 60 to 80 mph, then sped away with his victim still on the hood of his car, carrying Luna’s body 200 yards from the crash site.

Police found his abandoned car, which led them to arrest Virto as he slept with his girlfriend just six blocks from where the collision occurred; still drunk, with windshield glass glittering in his hair.

EGP News reports he plead guilty to gross vehicular manslaughter while intoxicated as part of a plea deal; prosecutors are expected to drop additional counts of driving under the influence of an alcoholic beverage causing injury, driving with a 0.08 percent blood-alcohol content causing injury, and hit-and-run resulting in death or serious injury to another person.

He’s due for sentencing on November 5th; the story does not say what sentence he faces as a result of the plea.

North Figueroa had been scheduled for a road diet intended to improve safety and slow speeding drivers. Had it not been summarily cancelled by Councilmember Gil Cedillo, it would have been completed long before this collision, though there’s no way to know if it would have made a difference in this case.

Not surprisingly, the meth-infused wrong way driver who plowed into a group of cyclists on San Diego’s Fiesta Island has been found guilty.

Despite her lawyer’s bizarre claim that she wasn’t impaired by the meth in her system. Or the meth hidden in her privates.

According to the San Diego Union-Tribune, Theresa Owens was found guilty of felony DUI causing injury, as well as causing permanent paralysis to one victim and great bodily injury to three others.

She was also convicted on a misdemeanor possession count for the .15 grams of methamphetamine stashed in her vagina.

She now faces up to 18 years in prison.

Let’s hope wherever she ends up, it has a good rehab program.

A new study from the University of Arizona shows that wearing a bike helmet reduced the risk of severe traumatic brain injury in a collision by 58%, and the risk of death by 59%. The authors also note helmet use reduced the risk of facial fractures by 29%.

Over the weekend, I received this email from a source in Orange County.

At 9:30am on Saturday, December 27th, 2014, William Joseph Klein was driving under the influence of prescription drugs when he killed Vinh Tran.

Friday morning, he pleaded guilty to one count of gross vehicular manslaughter while intoxicated. He was sentenced to a year in jail and 3 years of formal probation. His driver’s license was suspended for three years. He must pay a whopping $390.00 in fines, plus unspecified restitution. Despite long-term abuse of drugs, he is required to attend a First Offender Alcohol Program. He is also required to “donate” an amount to the county’s Victim Witness Emergency Fund.

His victim remains dead.

Incidentally, Klein also pleaded guilty to a second set of charges against him, resulting from a drunken bar fight last summer. For disturbing the peace and resisting arrest, he was sentenced to 72 days in jail.

He is currently in custody.

Talk about late breaking — and inaccurate — news.

Sheriff’s investigators just now got around to releasing news that a Huntington Park cyclist was injured in a hit-and-run in Cudahy on September 20th. However, the report on KTLA-5 says the 20th was a Wednesday, even though it was Sunday.

So that date may or may not be accurate.

It also gives the time of the collision as about 9:02, but fails to indicate if it was AM or PM.

The victim was riding east on Ardine Street when he was struck by an SUV traveling north on Salt Lake Avenue. The driver reportedly stopped after traveling a half block north of the impact site, then drove away without calling 911 or attempting to help the victim.

He remained hospitalized as of this past Thursday, though his condition was unknown.

Deputies are looking for middle-aged Asian woman with wavy black hair, average height and weight. The vehicle was described as a newer white or light-colored SUV with a tinted rear window and possible damage to the front grille and right quarter-panel.

Anyone with information is urged to call the East L.A. Traffic Investigation Unit at 323/981-5020.

A UK paper bizarrely says a man attacked two boys who laughed at him when he fell off his bike — but then describes him getting off his bike to attack the kids after accusing them of lying, instead. It looks like pedestrians are starting to fight back, as a New York man shoots a driver who came too close while making a U-turn.

And apparently, if you ride with your dog on your bike, you’re a bad, bad person.

 

Update: Bicyclist found dead in Cathedral City hit-and-run Saturday night

The local TV station calls it an accident.

A better description would be the actions of a heartless coward with a callous indifference to human life.

Or maybe just murder.

According to the Desert Sun, the body of an unidentified bicyclist was found lying in the roadway on Dinah Shore Drive in Cathedral City around 9 pm Saturday. It was clear he had been hit by a car.

KESQ-TV reports that the victim, identified only as a man in his late 30s or early 40s, was found on the westbound side of Dinah Shore just west of Whispering Palms on the Dinah Shore Bridge. His bike was found 50 feet away in the median on the eastbound side of the road.

There were no apparent witnesses, and no description of the car or driver at this time.

A satellite view shows a four lane roadway with a center divider west of Whispering Palms. Based on the limited description, there’s no way to tell which direction the victim was riding, whether he was on Dinah Shore or attempting to cross it.

There’s no speed limit sign visible in the street view; however, the distance his body was apparently thrown would suggest he was hit at a high rate of speed.

There’s also no way of knowing whether he might have survived if the driver had stopped and called for help as the law, and basic human decency, requires.

This is the 55th bicycling fatality in Southern California this year, and the sixth in Riverside County. That compares with 69 in Southern California this time last year, and six in the county.

Update: The victim has been identified as 37-year old Sergio Reynoso; a gofundme account has been established to help pay funeral expenses. The driver reportedly turned himself in on Tuesday, which would have given him or her plenty of time to sober up.

My deepest sympathy and prayers for Sergio Reynoso and his loved ones.

Maybe this will tame our streets a little more.

Governor Brown surprised nearly everyone by signing AB 8 Monday afternoon. The new law creates a Yellow Alert system to place notices of serious hit-and-runs on digital freeway and street signs in the area surrounding a collision.

The bill, sponsored by Glendale Assembly Member Mike Gatto, is patterned after a successful Colorado hit-and-run alert system. Brown signed it just hours after a press conference urging him to approve it, despite his veto of a similar bill just last year.

Maybe it’s no coincidence that the signing came the same day an Orange County driver was convicted of second degree murder in the drunken hit-and-run death of a grandmother as she walked in a San Clemente bike lane with her grandson.

The driver, Kelly Michele Wolfe, had a BAC over three times the legal limit when police arrested her at her home, shards of windshield glass still twinkling in her hair. Prosecutors estimate that she had downed as many as 15 drinks at a local bar before getting behind the wheel.

Wolfe had been warned when she got her California license that a second DUI could result in a murder charge, following her previous conviction for drunk driving in Nevada in 1994.

She now faces a well-deserved 18 years in state prison.

Sad news from Yolo County, as an amateur cyclist competing in a time trial was killed when a driver crossed the center line to avoid one rider, and didn’t see the victim riding in the opposite direction.

Police inexplicably said the driver was obeying the law, even though drivers aren’t legally allowed pass if they can’t do so safely.

They wouldn’t have said she was obeying the law if it had been a semi coming the other way.

New world champ Peter Sagan finally gets the support of his volatile team owner after months of criticism. Sagan used his podium finish as a chance to call for changing the world, after getting there by timing his final sprint perfectly. It wasn’t his first podium finish in a world championship; he finished second in the junior cyclocross worlds in 2008.

The perfectly named Joan of Arc becomes the first Rwandan woman to compete in the worlds, winning by her mere presence despite a last place finish. The championships gave other riders a chance to fly their flag, as well.

Attendance for the worlds topped expectations, with over 645,000 spectators over the ten days of racing. Evidently, support for bike racing is alive and well in the USA.

Speaking of alive and well, Lance Armstrong is still with us, but his specter haunts the worlds. Maybe there’s a female Lance Armstrong waiting to be discovered; while women’s racing expands, it doesn’t face the same anti-doping scrutiny the men do.

And speaking of Lance, he’s not out of the woods yet, despite settling with the insurance company suing him for $10 million for bonuses it paid out for all those Tour de France wins that aren’t any more.

London won’t be hosting the start of the 2017 Tour de France after all, as the city pulls the plug a day before final contracts were set to be signed.

That’s one way to ruin a good ride. Bicyclists and pedestrians were herded off the Ballona Creek bike path after a body was found resting along the jetty Sunday evening.

The Times talks with Matty Grossman, the 11-year old voice of reason in the debate over the Rowena road diet and the needless and never-ending battle betwixt people on bikes and those in cars. And he’s not the only kid to face aggression from angry motorists. If someone yells at you to be careful after a near collision as he exits a bus, don’t respond by chasing him down and trying to steal his watch. If you’re carrying burglary tools and a ski mask at 1:40 am on a hot high desert night, put some damn lights on your bikes.

And at seven years old, most kids are happy to bike around the block; this Chula Vista kid is already a professional BMX champ.

No bias here.

Not from the press. And certainly not from the San Diego Police Department.

According to San Diego’s ABC 10 News, a female driver called 911 to report a “mob” of nine or ten bicyclists had chased her down and smashed her car window.

It must have seemed frightening to the people huddled at home watching the broadcast.

But the real story is hidden in the details.

The bike riders were using the sharrows in the city’s Normal Heights neighborhood when the driver came up behind them and began harassing them by honking nonstop, which is a violation of California law. Even though they were exactly where they were supposed to be.

She then broke the law again by passing too close, striking one of the bikes; fortunately, the rider was able to jump off just in time to avoid serious injury.

The riders then chased down the hit-and-run driver as she dragged the bike for several blocks, banging on her window in an attempt to get her attention and keep her from fleeing the scene.

Pedestrians and other motorists are often called heroes when they stop a fleeing driver under similar circumstances.

Instead, these riders were portrayed as a crazed mob, and threatened with prosecution on vandalism charges for punching and kicking the car.

So it’s okay for the driver to mangle a bike after running down the rider. But not for riders to break a window, apparently inadvertently, in an effort to make her stop.

Got it.

Police refused to even ticket, let alone arrest, the woman, despite obvious violations for

  1. harassing the cyclists
  2. breaking state law governing the use of a horn
  3. violating the three-foot passing law
  4. destruction of property
  5. failing to stop and exchange information following a collision

And yet somehow, she’s portrayed as the victim, with the people on bikes her attackers.

It’s sadly reminiscent of a case that marked the first stirrings of the bicycle rights movement here in Los Angeles.

Andres Tena was riding with a group of friends in the spring of 2009 when they were confronted by an impatient Hummer driver, who attempted to flee the scene after striking Tena’s bike and injuring him enough to require hospitalization. The other riders chased the driver down and blocked his way; in response, they were threatened with an unseen gun before the driver ran over their bikes in an effort to escape.

When police arrived, they somehow concluded that Tena had crashed into the side of the Hummer — which would have required backing into it at a high rate of speed, since he was thrown forward by the impact and suffered significant damage to the rear of his bike.

And that the driver was justified in attempting to flee, because he was frightened by all those scary bike riders, despite being safely ensconced within his multi-ton urban assault vehicle.

The cop on the scene took it a step further, saying if the cyclists had surrounded him like that, he would have done the same thing the Hummer driver did.

In fact, the only criminal prosecution that was even contemplated was a misdemeanor charge against a cyclist for “throwing his bike at the Hummer.”

Funny how some things never change.

It took years of sometimes difficult negotiations, but now LA’s bicycling community has a much better relationship with the LAPD than we did back in the dark days of just six short years ago.

But clearly, San Diego police haven’t gotten the memo.

And as this case clearly shows, they have a long way to go before cyclists can feel like they have the same support from law enforcement that drivers have come to expect, and are considered equal road users rather than two-wheeled pirates.

None of us are safe on the streets if we can’t count on the police to be there when we need them. And to do it fairly, without an obvious — and repugnant — windshield bias.

According to a tweet from BikeSD, they’re working with the San Diego Bicycle Coalition to arrange legal representation for the bike riders.

They may need it.

And sadly, the angry hit-and-run driver who started it all won’t.

The publisher of the Malibu Times mentioned Tuesday that a bike rider had been killed on PCH near Busch Drive, but didn’t have any details.

However, the report cannot be confirmed at this time.

There have been no other reports in the press, and repeated web searches have turned up empty. And there has been no response yet to a request for information from the CHP.

Meanwhile, he goes on to criticize cyclists for riding with inadequate lighting on their bikes. While he has a point, it is irresponsible to bring it up in response to the unconfirmed report of the bicycling fatality without knowing if a lack of lights had anything to do with it.

Or if it even happened.
