Update: Cyclist gets double smackdown crossing PCH — seriously injured by car, then blamed by police

First he gets run down by a car on PCH.

Then he gets smacked down once more by the LAPD.

According to Pacific Palisades Patch, a bicyclist was riding his bike in the crosswalk across Pacific Coast Highway at Temescal Canyon Road at 7:51 am on Tuesday, October 30th when he was hit by a car heading north on PCH.

The rider, identified only a 30-year old white male, suffered severe injuries, including broken legs and lacerations to his arms and chest.

Then, Patch reports, police blamed him for the collision simply because he was riding in the crosswalk.

(Officer) Johnson said the accident report has the bicyclist listed as the cause of the accident.

“Bicyclists can’t ride in the crosswalk,” he said. “You have to walk it. As soon as you start pedeling (sic) you’re basically considered a vehicle and have to consider the rules of the road.”

Never mind that in order for the collision to occur the way it’s described, someone had to run the red light. Either the cyclist was crossing against the light — which would seem unlikely, given the heavy traffic on PCH at that hour — or the car that hit him ran it.

Either way, that would seem to be a more immediate — and important — cause of the collision than the simple presence of the rider in the crosswalk.

And never mind that the explanation given by Officer Johnson would appear to be in direct contradiction to state law.

According to California law, bikes are allowed to use crosswalks, which are legally considered an extension of the sidewalk. So if it’s legal to ride on the sidewalk — which the City of Los Angeles allows — it’s also legal to ride your bike in the crosswalk.

Sort of.

In a failed attempt to clarify the law, the state legislature recently amended the law to say that cyclists can ride along a crosswalk. Yet failed to clarify what exactly that means.

After all, you can ride along a pathway or along a river, with very different meanings. One puts you on it, the other next to it.

So depending on who is interpreting the law, and how, you can either ride on the crosswalk or alongside it.

Thanks for the clarification, guys.

Then there’s the question of which way you can ride on the crosswalk. And that’s where it really gets complicated.

According to the LAPD, after consulting with the City Attorney, they’ve come to the following, extremely convoluted, interpretation of the law.

As we discussed, cyclists are allowed to ride on the sidewalk in Los Angeles. And since sidewalks don’t have any direction, bike riders can legally ride either way — as long as they remain on the sidewalk.

But in what appears to be a gross misinterpretation of the law, the LAPD says as soon as a bike enters the street, it becomes a vehicle. Even if it’s just crossing the street. And regardless of whether it’s in — or next to — the crosswalk.

And since it’s a vehicle, it then has to be ridden in the direction of traffic.

Even though pedestrians are allowed to use the crosswalk going in either direction. And even though state law says absolutely nothing about direction in allowing bikes to ride along the crosswalk.

That would appear to be the actual violation the police were referring to in this case, rather than riding in the crosswalk.

And there is nothing — absolutely nothing — that I am aware of in state law that says riders must dismount and walk their bikes across the street.

In fact, that would appear to be another violation of state law, which assigns bike riders all the rights and responsibilities of other vehicle users. I am unaware of any requirement that drivers have to get out of their cars and push them across the street before being allowed to get back inside and drive off.

Which brings up the other problem with this collision.

This intersection is a popular route for riders leaving the beachfront bike path along Will Rogers State Beach, whether to ride up Temescal Canyon or cross to the other side of PCH to continue on towards Malibu.

But there is no way for cyclists to trigger the green light at this intersection. The signal detectors embedded in the pavement don’t recognize bikes, and there is no push button for bikes or pedestrians headed east across PCH.

During busy summer months, that’s usually not a problem. Cars leave the parking lot on a regular basis, triggering the light and allowing riders to cross with the light.

But this time of year, you can wait hours for a car to come by and trigger the signal.

So the workaround many riders use — myself included — is to ride over to the north side of the intersection, push the signal button at the crosswalk, then ride across the street on or next to the crosswalk.

Which is probably exactly what the victim was doing that morning when he was hit by a Subaru. And which is now illegal, according to the LAPD.

So first this cyclist was victimized by bad roadway design, which robbed him of his right to ride like any other vehicle, and forced him to use the crosswalk.

Yes, state law does require signal detectors that recognize the presence of bikes, but only when the intersection is repaved or rebuilt in some other way. And just like drivers, cyclists are legally allowed to cross against the red light if it fails to change for several cycles.

Although you might have a hard time explaining that to a cop. And it would be a foolish thing to attempt at rush hour on a busy, high-speed highway like PCH.

Then he was hit by car, which may or may not have run the red light.

And finally, if the article is correct, he appears to have been victimized a third time. This time by the LAPD, with what looks like a highly flawed interpretation of the law.

He may or may not have been at fault.

But he certainly wasn’t at fault for the reason given.

Update: Now it makes more sense. 

It turns out that the Patch story misplaced the location of the collision, according to the LAPD’s new bike liaison for the West Traffic Division, Sgt. Christopher Kunz, in response to an email from Colin Bogart, Education Director for the LACBC.

Rather than the intersection of PCH and Temescal Canyon, the collision actually occurred about 1700 feet north at the crosswalk leading from the parking lot to the trailer park

And rather than being cited for riding in the crosswalk, the primary factor leading to the collision was a violation of CVC 21804(a), entering a highway without yielding to oncoming traffic. Sgt. Kunz says independent witnesses reported the victim rode across PCH at a high rate of speed, in an apparent attempt to beat oncoming traffic.

And failed. 

So while the intersection of PCH and Temescal remains a difficult and dangerous place for cyclists to cross, and the department’s current interpretation of crosswalk law would seem to leave a lot to be desired, neither one had anything to do with this collision. 

Instead it appears to be a case of bad judgement. A rider taking a chance he shouldn’t have taken.

And a news report that only told part of the story.

Cyclist refuses to back Governor’s Prop 30 in response to Brown’s repeated 3-foot vetoes

I got an interesting email tonight from a regular reader and bicycling advocate who asked that his name be kept private.

He forwarded an email he sent to Governor Jerry Brown, connecting the dots between Brown’s ill-advised vetoes of two three-foot passing laws, and support for the tax increase Brown is currently pushing. As well as his own safety.

After much soul searching I have decided not to support Prop 30.

As someone who commutes over 5,000 miles per year by bicycle, the Governor’s callous unwillingness to protect my safety by twice vetoing the 3 ft passing law is so important to me, that I cannot bring myself to cooperate with him on an issue of far less importance to me.  Just today I was again struck by a motorist (thankfully uninjured) while riding home in Hollywood.  My life, my safety, is personally more important than the solvency of this state.

If he can’t be bothered to protect me, I can’t be bothered to help him.

Regretfully, 

First of all, let me say I’m glad he’s okay; collisions with cars don’t always turn out so well.

Second, I have to admit, the same thought has occurred to me.

I can’t say I’d recommend basing your vote on a funding measure on Brown’s lack of support for California cyclists. On the other hand, I couldn’t blame you if you did; the governor shouldn’t expect our support when he won’t give us his. Which is something he can ill afford right now.

Downtown L.A. cyclist encounters the worst of the LAPD — and the best — at the same time

Funny how things work sometimes.

Just hours before a group of bike advocates meet with the LAPD to discuss changes in the department’s bike liaison program — and just blocks away — we were reminded why the program is so important.

And, despite how far we’ve already come, just how far we still have to go.

A rider who goes by the nom de bike of Cyclepathic — which beats the hell out of bikinginla, if you ask me — saw the worst and best of the LAPD in a single Downtown L.A. interaction.

And posted her story on Facebook just three hours before we met at police headquarters.

LAPD cop almost ran me over after failing to knock me down with his car. Does another illegal lane change just to roll down his window & tell me that I cannot take the whole lane!

The story- I’m going down Broadway from Temple, & a car behind me passes me on the left within inches of my rear tire, it then cuts me off at such a short distance to get in front of me that he almost ran me over.

…but wait! Wait… that’s not it, he then cuts off a Channel 5 news van to get to the middle lane, rolls down his passenger’s window & says, “You can’t be riding in the middle of the road!”

-Before I knew he was a cop-

Me: “Wtf? You have to pass me at a 3-foot distance & you cut me off almost running me over!”

Cop, is now flashing his badge & in an even deeper demanding voice says: “YOU CAN’T RIDE IN THE MIDDLE OF THE LANE!!” …now trying to make me aware of his badge and over assuming his position as an officer.

-After I knew he was a cop-

Me: -looking at his badge- “So, you’re still wrong! You have to give me a 3-foot distance and I have the right to take the lane if the lane isn’t wide enough to share.”

He looked behind me checking if there was a chance to pull over but before he could react, we were interrupted by the chirping sirens of an undercover squad (that was a few cars behind me) announcing from the PA:

“The person on the bike has the right of way! You almost hit her and you have to drive safer!”

Me:-looking at the cop through his rolled window- “See!”

Without a word, he rolls up his window and turns left at the next light. I had to pull over to avoid further endangering myself by cycling angry.

Before I could pull over, the undercover who put the cop in his place drove by me, tipped his head & told me to ride safe.

As Cyclepathic’s experience shows, you may get a well-informed officer who understand the rights and responsibilities of bicyclists. Or you could get an officer who ignored the department’s bike training video, or forgot everything he learned the minute he turned it off.

Or both.

Suspect arrested in hit-and-run death of Michael Vega; bike-jacking bank robber and Sat’s Tour de Fat

Let’s start with good news from the Inland Empire.

The Press Enterprise reports an arrest has been made in the late August hit-and-run death of Michael Vega in Rancho Cucamonga.

According to the paper, published news reports and a phone tip led police to a truck driven by construction worker Jason Cox; after inspecting the vehicle, they arrested Cox on suspicion of gross vehicular manslaughter while intoxicated and hit-and-run resulting in death or injury.

It will be interesting to see how they can make the intoxication charge hold up, since Cox had over two weeks to sober up.

The paper says he’s being held in the West Valley Detention Center in Rancho Cucamonga on $250,000 bond.

But before you get too excited, remember this is the same DA and court system that let the street racing killer of Jorge Alvarado off with just three lousy months in jail.

Update: The Inland Valley Daily Enterprise reports that the tip that led to Cox’s arrest came as a result of a video plea for information from the Sheriff’s Department that was posted on their website Tuesday.

Deputies received a tip Wednesday evening pointing them towards Cox, who drove a work truck for a construction company in Chino. When Police inspected the truck, they found heavy front-end damage, as well as paint the matched the truck and the bike.

Cox will appear in court on Monday.

A Santa Ana cyclist chases down a bike-jacking bank robber with the help of a stranger, recovering his bike and leading to the arrest of the thief, who had previously failed to carjack three separate vehicles.

The thief may want to consider a new career once he gets out. Which isn’t likely to be anytime soon.

This weekend’s big bike news is the return of Tour de Fat at L.A. State Historic Park — a full day of bikes and beer, starting with a can’t miss bike parade through Downtown from 11 to noon, with registration for the parade starting at 10 am.

Entertainment runs from noon to 5 pm. I’ll be there volunteering at the LACBC booth until at least 1 pm, so stop by and say hi; anyone who signs up for LACBC membership gets a token for a free beer.

And if you hurry, there’s still time to sign up to trade your car for a bike worth up to $2,250.

Admission is free. Costumes are encouraged, but remember the forecast is for temperatures in the mid to upper 90s on Saturday. So you might want to dress for the weather and wear as little as possible.

And no, you don’t need arrive by bike; there’s plenty of parking in the area, and it’s walking distance from the Chinatown Metro station.

Edmonton cyclists get their first bike box, which is one more than L.A. cyclists have. Better UK bike commutes through technology. As usual, British courts give a slap on the wrist to a killer driver who failed to see a cyclist before running him over; they’re almost as bad as New York. The World Anti-Doping Agency considers amnesty for riders who confess to drug use, but too late to help Lance, who rudely insists on riding anyway. You won’t want to miss the tongue-in minutes of an appeasing — not appealing — Aussie bike club.

Finally, after a driver attempts to run a cyclist off the road, they talk it out like British gentlemen. And it turns out giving birds the bird won’t stop Aussie avian attacks.

Stupid Driver Tricks — bizarrely impatient Brentwood driver; and knee-jerk Hollywood anti-bike hatred

Maybe it was something in the water.

Or maybe it was a little lunar lunacy in anticipation of tomorrow’s Blue Moon.

But Thursday’s ride to Manhattan Beach and back was marked with more Stupid Driver Tricks — and not just drivers, as a few cyclists and pedestrians insisted on getting into the act — than I usually see in a month.

But this one takes the cake.

All this woman had to do was wait a few seconds until the light changed, and she could have easily gotten out of that parking lot with her dry cleaning.

Instead, she pulled out directly towards the car in front of her. When that didn’t work, as he failed to magically disappear from her way, she backed up, pausing as I pulled up next to her. Then looked directly at me, and cut me off anyway — as the driver next to me and I both shook our heads, arms extended in the universal WTF gesture.

And yes, I may have made another gesture that didn’t show up on camera as I pulled up next to her.

No, not that one.

Streetsblog offers a good look at what you should do if you encounter my pet peeve — bike lanes needlessly blocked by Hollywood production crews.

Even though experience has taught me that Corgis make much better pets than peeves.

As they note, film crews are required to have a permit before they’re allowed to block a bike lane, or any other traffic lane, for that matter.

And yes, a bike lane is a legal traffic lane, albeit one reserved for bikes, just as HOV lanes are reserved for vehicles with more than one occupant. Or people willing to pay for the privilege of driving alone.

Which means that, without a permit from the city — which is remarkably easy to get — film crews have no more right to block a bike lane than they do the center lane on Wilshire Blvd. Though that never seems to stop them from doing it anyway.

The story also notes, correctly, that you have every right to demand to see that permit, whether they like it or not. And that if they don’t have one, you’re entitled to call the police — or Film LA — and demand that they move the offending cones to reopen the bike lane.

Although getting someone to actually care enough to do something about it can be another matter.

Then there are the seemingly inevitable comments from film crew workers unwilling to even attempt to obey the law.

Including this one from a self-described Assistant Location Manager who threatens to have anyone who asks to see the permit arrested on false charges.

As an Assistant Location Manager, the guy whom you will probably be approaching for a film permit, which will then be followed by your venting hippie diatribe about why my working trucks are blocking your bike lane here’s what I am going to do….Ask to see my permit, which I will produce for you. Then it will be I who will call the cops and claim that you threatened my production company with extortion, which I will be able to produce witnesses for. I will also suggest to the officer who responds that we spotted you taking illicit drugs not far away from my set, which I will also produce witnesses for. Being that most bikers I know engage in the occasional to regular use of drugs, I will most likely be right. When your being cuffed and taken to jail, I will then sell your bike on ebay….I may even use the funds to put gas in my Ford F-150 (not a Prius). You guys want a fight, your going to get one…

Point is, we are losing production jobs everyday to other states and cities because of BS like this. My methodology may seem machiavellian but I will do whatever it takes to keep filming in Los Angeles, keep food on my family’s table, and not be forced to move to keep working in film industry which provides a much needed paycheck and health benefits to family and I. Be warned, if the working trucks are parked in a bike lane, bike around us and go on your merry way…

Nice way to put a good face on Hollywood, dude.

And summing up exactly why many people in this town are fed up with self-entitled production crews, regardless of the jobs they create.

Yes, we all want to put an end to runaway productions, and keep those high-paying jobs right here at home.

But Hollywood needs to take a long, hard look at itself, and accept that other people in this city have rights, as well.

In a highly biased story, police won’t file charges against a group of cyclists who struck a driver’s car and shouted obscenities when she merely tapped her horn at them. However, the original story notes a broken mirror and dents on the passenger side, which might give an explanation for the riders reaction if they resulted from getting Jerry Browned by a sideswiping driver.

Then again, this sort of bizarre narrative in which a wholly innocent driver is assaulted by a group of crazed cyclists never ceases to astound me. You’d think someone — anyone — would question why the riders reacted that way, but too often, no one ever does.

A British cyclist clips a traffic cone, and falls beneath a tailgating 17-ton truck; in case anyone ever wondered why drivers need to give us some space, that’s why. UK cyclist fakes a fall to distract driver while partner steals from her car. A Glasgow cyclist is stabbed in the neck after stopping to speak with an apparent stranger.

Finally, a Denver hit-and-run driver claims he thought he hit a dog when he killed a cyclist — even though he dragged the victim’s bike under his car for several blocks.

Call me crazy, but I think all the sparks and grinding of the bike underneath his car should have tipped him off. And I don’t know many dogs who ride a bike.

A little this, a little that — Expo bikeway heads off the rails, Long Beach writer gets it mostly all wrong

I’ve been hearing a number of reports that the westward extension of the Expo Line bikeway is rapidly going off the rails.

Instead of prudently incorporating a safe, separated cycling facility along the full route, word is that Metro and LADOT are cutting corners and giving riders short shrift — including those recruited to serve on the line’s Bicycle Advisory Board, who complain that no one seems to be listening to them.

Which begs the question, why have an advisory board if you’re not going to listen to their advice?

This bikeway has long been a dream for riders who are desperate for a safe, efficient route between Downtown and the Westside.

But despite repeated promises in recent years, it sounds like we may have to keep dreaming.

Once upon a time, journalists had standards.

Or so I’m told.

Writers — even columnists — were expected to get the facts straight before they went to press. And editors were expected to hold their feet to the fire to ensure that every item in the paper was as accurate as possible.

Seems like a long time ago, in that golden age before the current revenue crunch caused most papers to lay off too many of their editors. And allowing the few remaining writers to slip their erroneous flights of fancy onto newsprint and online without being challenged.

Then again, some papers never did have standards.

I’m not sure which case applies here.

Tim Grobaty, a columnist with the Long Beach Press-Telegram — who surely should know better, given the city he works in — could have gotten it right with just a little research. But apparently didn’t bother.

All it would have taken is a simple trip to the DMV website, where he would have learned that cyclists are expected to use left turn lanes. And which took me roughly 10 seconds to find via Google.

Instead, he offers the following advice.

1. Bicycles aren’t cars. Don’t act like you’re driving one by tying up the left-turn lane. Conversely, bicycles are cars. Don’t pedal through stop signs.

At least he gets the last part right.

Somehow, though, I manage to get through left turn lanes on my bike just as fast as the drivers in front or behind me, if not faster. So how, exactly, am I tying up anything?

He also instructs cyclists not to employ the common courtesy of calling out “On the left” when passing pedestrians, because it confuses him.

Maybe he should carry a pebble in his left hand when he walks to avoid stepping in the wrong direction.

One of the biggest complaints from pedestrians is that they don’t get any warning when riders are about to pass. But evidently, Grobaty would rather see cyclists refrain from offering walkers a verbal warnings, and is willing to accept the inevitable increase in collisions between bikes and pedestrians that would result, as if there aren’t too many already.

And yes, bike bells are friendlier.

But they don’t give walkers or slower riders any idea whether they should move right, left, go straight or levitate the hell out of the way.

All they tell you is that a bike is nearby.

And that an angel just got its wings.

Of course, it’s not just Grobaty.

We live in a society where the voices of those with little knowledge of a given subject carry as much weight as those who actually know what they’re talking about. Especially if they have their own TV or radio show.

Or newspaper column.

And don’t even get me started on the royal we Grobaty uses. Unless he has multiple personalities, in which case I owe him an apology.

Of course, the main point in his column is that Long Beach has spent $20 million on making the city safer and more inviting for bicyclists, and that retailers are starting to see a return on that investment as sales from cyclists increase. But people who drive to stores continue to spend more.

He’s right, of course. The overwhelming amount of retail sales continue to result from driven trips, even though numerous studies are starting to show the economic benefit of encouraging bicycling.

But he fails to consider the hundreds of millions of dollars that have been invested in streets and other infrastructure that allow people like him to drive a few blocks to the corner store.

And which is paid for in large part by every pedestrian, bicyclist and transit user, as well as drivers, whether or not they ever get behind the wheel.

Wake me when, or if, that ever gets repaid.

In a horrifying report, a 13-year old Milwaukee girl is charged with the hit-and-run death of a cyclist while street racing friends in a stolen car. A passenger in the car suggests she may have intentionally steered towards the bike rider, later laughing about it and saying he shouldn’t have been on the street.

Looks like LADOT hasn’t forgotten the Westside after all. Niall Huffman notes preliminary bike lane markings have gone down on Ohio between Bundy and Centinela, where the street becomes Broadway as it crosses into Santa Monica. Personally, all this talk about a $600 single-use device brings out my inner cranky old man and makes me want to yell at them to get off my lawn. I’d rather see an actual helmet that can provide real protection beyond the current 12.5 mph standard — and one most cyclists can actually afford.

A road raging Monrovia driver, a bike riding RB police chief, and an anti-bike ordinance in Costa Mesa

Let’s catch up on recent news.

Starting with a traffic-crazed Dr. Thompson wannabe who tried to run over, then punch out, a group of cyclists last Friday.

Monrovia Patch forwards word of a roadway altercation in which a motorist apparently became enraged with a group of cyclists and swerved his car into them, forcing one rider to rear-end a parked car.

Then the candidate for anger management got out of his car and started hitting another rider before police arrived and took him into custody.

Patch reports that two cyclists were treated at the scene by paramedics.

Two big stories hit the news while I was tied up with family activities over the holiday period.

Even if that family consists of my wife and a six-year old Corgi.

First up is the news of the off-duty Redondo Beach police chief who commandeered a theft suspect’s bike to chase him down and help make the arrest.

Hats off to Chief Joe Leonardi for proving a police chief can still be a real cop; I’m not sure how many of his peers would have chased the suspect themselves, rather than just calling in their street level officers. And for remaining in riding shape — and recognizing that a bike is often the best way to get there, whether or not you’re chasing someone.

And whether or not it’s yours.

Chief, you can ride with me anytime.

Second is the news that Costa Mesa has banned bike parking on public property to — get this — battle the local homeless population.

Apparently, homeless people don’t like having their bikes stolen any more than people with residences to go home to at night.

Go figure.

So instead of dealing with the problem — like maybe providing a secure place to store their belongings, let alone a roof over their heads — city leaders respond in a regressive fashion by attacking everyone who rides a bike.

A member of the Homeless Task Force that came up with the recommendation promises police won’t be heavy-handed in enforcing the ban.

Neighborhood Improvement Manager Muriel Ullman, a member of the task force, said the ordinance would be enforced within reason. For example, if nearby bike racks are all full, then police would not enforce the ordinance.

“If the police see there is an open rack, and they sees (sic) some bikes lying on the grass…they’re not just going to go impound the bike, they’re going to work with the people,” Ullman said.

Right.

Never mind that the city currently has only 38 bike parking spaces in their 30 parks.

Something tells me they have a hell of a lot more than 38 parking spaces for cars. And not just at public parks, but anywhere in the city that cyclists — excuse me, human beings — would like to go.

The nearly forgotten Cyclists’ Bill of Rights, which clearly has not made it to Costa Mesa, includes the right to safe and secure bike parking at the end of a trip.

Personally, I think the law should be changed so that anytime secure bike racks are full or unavailable, cyclists have a legal right to lock their bikes anywhere they damn well please. Up to and including the legs of Costa Mesa council members.

That would only begin to put us on a par with motorists, who enjoy tens of thousands more parking spaces than are available for bicyclists in most areas. As well as forcing cities and building owners to invest the relative pennies needed to provide adequate bike facilities, as opposed to the $4000 to $40,000 it costs to provide space for a single car.

We can only hope that Costa Mesa somehow comes to its senses and repeals this discriminatory, wrong-headed anti-bike and anti-homeless ordinance.

If not, I hope everyone who rides a bike will remember this on election day.

Erik Griswold forwards a comment on a Danish website (scroll down) claiming to be from a San Francisco motorcycle dealer.

One of my business endeavors is a motorcycle dealership in San Francisco, California. Among other things my dealership services and repairs Police motorcycles for the City of San Francisco and for the California Highway Patrol in this area. I have talked to Police Officers about the “bicycle problem.” We have a serious problem in California with bicyclists thinking that traffic rules apply only to others and that “share the road” means “take the road and screw the cars.” I think some of these people purchased the wrong size spandex and the blood flow to the brain got cut off.

All of the Police Officers I have talked to will not ticket an automobile driver if a bicyclist ignores traffic rules and gets run over in the process. Several of the Officers smiled and quietly encouraged me to “just hit them.”

Everyone is tired of bicyclists inventing their own rules, not just in Copenhagen. Being sustainable, greeny and eco-friendly is not a blanket pass to misbehave.

I cannot wait to paint the first bicycle on the side of my company truck, fighter-pilot kill style. 😉

Aside from the obvious threat in the last line, if this is legitimate — which, given the nature of anonymous internet comments is always questionable — it goes a long towards illustrating the bias bike riders face from those charge with protecting us.

And yes, I’m looking at you, San Diego Police Department.

A judge orders the thrill killers who shot developmentally disabled cyclist Jordan Hickey as he rode his bike to stand trial on murder and special circumstances that could result in the death penalty. Testimony in the preliminary hearing indicated they were cruising for victims when they encountered Hickey, shooting him three times with a shotgun just for the hell of it.

Which, appropriately enough, is where they belong.

I’m not a supporter of the death penalty. But if anyone ever deserved it, these two would be at the top of my list.

Team Sky’s Bradley Wiggins dons the yellow jersey in the Tour de France, as teammate Chris Froome won stage seven and stage eight was taken by the youngest rider on the tour. It looks like a good tour for the British Commonwealth, as Wiggins takes yesterday’s time trial to keep his yellow jersey, while last year’s winner Cadel Evans holds second overall.

Wiggin’s Team Sky teammate Chris Froome finished second in the time trial. For awhile, it looked like young American rider Tejay van Garderen would win, instead settling for the white jersey as best young rider.

The new leader gets a little hot under the collar when asked about cynics who believe doping is required to win the tour. Cyclists are dropping like flies as countless collisions deplete the riding roster.

Meanwhile, New Zealand pro Michael Torckler is bouncing back after a near fatal hit-and-run in Sonoma county. A South African woman is the first to finish in the top ten in the women’s Giro d’Italia, as Marianne Vos, Emma Pooley and American Evelyn Stevens take the top three.

Lance files suit against the U.S. Anti-Doping Agency in an attempt to derail doping charges, and is quickly shown the door for now. Former TdF champ Jan Ullrich briefly almost comes clean. And Cofidis rider Remy Di Gregorio is the latest to be arrested for suspected doping in today’s “clean” riding world.

A Register writer points the finger, bike crime fighting councilmembers, and a trail full of bike links

The OC Register’s Dan Whiting calls for better etiquette from riders after a couple of roadies yell at a group of children scattered on the wrong side of the Santa Ana River trail.

While yelling at children who may not know any better is never the right thing to do, I question if the parents involved — and Whiting, for that matter — considered the danger uncontrolled children pose to themselves and those around them on shared trails.

Personally, I consider it child endangerment when parents allow their kids to run around on pathways oblivious to the presence of other path users. I’ve gone to the ER myself when I had to lay my bike down to avoid a small boy who darted out in front of my bike with no warning.

Whiting’s explanation is that the cyclists were simply unwilling to slow down. Having been there too many times, I’d suggest it’s far more likely they were worried about a collision that could have sent both them and the children to the hospital.

And responded in a predictable, if inappropriate, manner.

Yes, the situation he describes was a violation of trail etiquette, as well as safety. But he may be pointing the finger in the wrong direction.

While there are no shortage of rude riders — and walkers, drivers, skaters, equestrians and humans in general — as Rashomon makes clear, there are multiple perspectives to every story.

And please, enough with that bike bashing “Lance Armstrong wannabe” crap, already.

After dragging on… and on… and on… it looks like we may finally see white smoke on the new federal transportation bill.

Despite rumors that negotiators were going to cave in to the more radical anti-bike and pedestrian elements in Congress — even though 83% of Americans support continued funding, as do over 70 national organizations, the U.S. Conference of Mayors and 13 state governors — at least some protected funding for non-motorized traffic appear to have made it into the final bill.

A New York cyclist and bike researcher says it’s insane for the city to offer a bike share program without mandating helmet use, while the city’s CFO calls for mandatory helmet use, but gets the numbers, among other details, wrong.

So let me get this straight. Anyone wanting to rent a bike would have to bring their own helmet, or share one with the all the greasy haired, lice-ridden riders who used it before you?

Count me out.

Besides, there are other ways to keep cyclists safer.

Bicycling magazine names their top 50 American bike-friendly cities.

And in a very surprising development, L.A. makes the list at 32, just ahead of Thousand Oaks at 38, and behind Long Beach at 19. Not surprisingly, Portland leads the list at number one, followed by Minneapolis, Boulder and newly bike-friendly Washington DC; New York City comes in just before San Francisco at seven and eight, respectively, while my hometown just misses the top 10 at number 11.

Best wishes to Better Bike’s Mark Elliot, who was hit by an SUV in Beverly Hills on Saturday, just days after getting screwed by the city’s auto-centric Traffic and Parking Commission. Fortunately, Mark says he’s okay. But warns ominously that it might be you next time.

The Bike League is now tracking bicycling fatalities on a national level, just as I’ve been doing in SoCal; preliminary results show over a third of all bike-related collisions were hit-from behinds, followed by failure to yield (18% drivers, 10% cyclists). Riding a bike to work could cut your tax bill, as well. The bike writer for my hometown paper says education is more important than more bike lanes. A Lafayette LA cyclist disappears riding home from a night out. Bollards are almost always a failure of good bikeway design — especially when they go in for no apparent reason.
