78-year old bike rider killed in Moorpark hit-and-run

Once again, a cryptic CHP dispatch hinted at a horrible cycling collision long before anyone else.

A transmission early Thursday afternoon told of a damaged bicycle on the right shoulder of Tierra Rejada Road in Moorpark, with debris in the roadway — and a body in a tree.

And someone — maybe a passerby, maybe the driver involved — was waiting on the right shoulder to guide CHP officers to the collision site.

Now the Ventura County Star and Moorpark Patch confirm that 78-year old Simi Valley resident Bernard Cooper was killed in a rear-end collision while riding on the right shoulder of Tierra Rejada east of the Moorpark Freeway around 1:20 pm Thursday; the CHP puts the initial report at 1:28 pm.

After hitting Cooper with enough force to throw his body into a tree, 20-year old Nicolas Santiago of Ridgecrest drove for another mile-and-a-half before evidently having a change of heart and returning to the scene. The CHP dispatch identifies the vehicle waiting for them as a Nissan Xterra; unfortunately, there’s no word on what kind of car Santiago was driving or whether he returned after the collision had been reported.

Both Cooper and Santiago were headed east on Tierra Rejada; a satellite view of the roadway shows a wide shoulder where Cooper should have been safely out of the line of traffic, while a Google street view shows a 55 mph speed limit in the area.

Not surprisingly, he was pronounced dead at the scene.

The crash was still being investigated Thursday evening, however, the CHP reports that alcohol does not appear to have been a factor.

Santiago was arrested at the scene for hit-and-run. However, based on similar cases, the fact that he returned to the scene of the collision — apparently voluntarily — suggests that the charge is unlikely to result in significant penalties.

This is the fifth cycling fatality in Southern California this year, and the second in Ventura County; that compares to three bicycling deaths in Ventura County in all of 2012.

Update: A comment below says the driver of the Xterra was the one who called 911, and was not involved in the collision.

Guest post: No justice, no closure for family of a fallen Palm Spring cyclist

This story breaks my heart. And it scares the crap out of me.

Last spring, Donny McCluskey was waiting at a red light when he became collateral damage in a violent vehicular collision.

He did everything right. He was exactly where he was supposed to be, and obeying the law in every way.

And yet he still died when a speeding driver ran a red light, and was broadsided by a drunk driver who was crossing on the green, sending the van tumbling into him.

The pickup driver who was otherwise obeying the law was arrested on the spot for DUI. Yet the driver who caused the collision and took the life of an innocent cyclist got a relative slap on the wrist, charged with a single count of misdemeanor vehicular homicide.

The victim’s family thought they’d see justice and get closure at his hearing. They were mistaken.

No JUSTICE

Update on Donny McCluskey’s case with opening court date completed on February 13, 2013. It appeared to be held in Indio traffic court where most of the crimes were DUI, not showing up for DUI work (warrants) or driving without a license. After hearing these cases, there was Donny’s case: MISDEMEANOR vehicular manslaughter. No bail, no driving suspension, no reason to even show up in court for the driver (Armando Gomez of Cathedral City) who killed Donny-HE NEVER has to go to court because as the judge said several times: he was only charged with a misdemeanor (never mentioned manslaughter again) and he hired an attorney to represent him.

The judge explained the charges and the law as the DA had but the DA had no way of knowing he had hired a lawyer. As a family, we believed we would see the man and have some kind of closure. We agreed it was a terrible tragic accident caused by one man’s inattention and selfishness but not intentional. Yet, after court we realize the man who killed my brother, NEVER HAS TO GO TO COURT. Court was imagined as a form of cathartic movement for us to check off our grief list. We know there is no bringing Donny back, no matter what our actions are. We left the court in disbelief as to what kind of message are these charges delivering? Donny’s life was not worth more than paying a lawyer and going on with your life without much ado?

I could literally feel my 82 year old dad’s heart break as he sat next to me. I sensed him using sheer will to keep on breathing through the impersonalization and lack of importance attached to the death of his son. He also had to go home to tell Donny’s wife and mom what occurred. My heart breaks for everyone. My sister, my dad and I came to INDIO as we felt it was Donny’s day in court and since he was dead, his family would represent him.

Seems there are no laws protecting cyclists who die from gross vehicular operation unless the driver was texting, drunk or leaves the scene. Mr. Armando Gomez ran a light and accelerated an additional 30 mph when he realized it. Unfortunately, Mr. Gomez and his van were hit by a truck traveling through a green light resulting in his van flipping and skidding into my brother causing massive life ending injuries (Donny was following ALL the laws).

Mr. Gomez’s lawyer actually stated it was possibly the OTHER man’s fault. Now that is taking responsibility for your actions. I don’t know what the green light man did, but he was arrested at the scene for being under the influence. Maybe he could have stopped, if he was not under the influence but he was not the root cause of the accident. I am sure this driver will have more profound consequences.

Meanwhile, we grieve and acknowledge every month that goes by without our amazing husband, brother, son and uncle. Today is the 10 month anniversary. February 28th would have been his 50th birthday.

We need to change CA law. A car is a weapon and when not following laws that govern their use, even if you did not intend to kill someone and you do, then there needs to be consequences. It could be you or someone you love next time!

We need guidance on how to change these laws!

The scary thing is this could happen to any of us. The actions of a careless driver can cause a chain reaction that can put us at risk; I’ve jumped the curb myself to avoid a car careening from a collision.

And if it does, the driver will probably get off. Or face the most meagre of charges, despite the damage he or she may cause.

The law has to change to ensure lawbreaking drivers who kill or maim innocent people face consequences equal to their actions.

Because their victims do.

Piru cyclist killed in Sunday rear-end collision

The Ventura County Star reports that a 41-year old bike rider was killed in a rear-end collision on Sunday.

According to the report, the rider, who has not been publicly identified, was headed east on East Telegraph Road near Howe Road around 6:35 pm when he was struck from behind by a pickup. A photo view of the area shows a wide shoulder, suggesting that the driver either drifted off the roadway or hit the rider while making a right onto Howe; it’s also possible that the rider may have left the shoulder for some reason, such as to avoid broken glass or a pothole.

A cryptic CHP dispatch report shows a fatal vehicle versus pedestrian collision at that time and location; for reasons that will forever escape me, the CHP often refers to cyclists as pedestrians in their reports.

The paper cites the CHP as saying the victim was not using all or some of the lights required by law after dark, nor was he wearing a helmet. However, whether a helmet would have offered any benefit at what was undoubtedly highway speeds is a matter of conjecture.

This is just the fourth cyclist killed in Southern California this year, excluding shooting victims, and the first in Ventura County. That compares to nine SoCal cyclists killed this time last year, and three victims in Ventura County in all of 2012.

Bike rider killed in Blue Line collision; Metro once again fails to inform the public

According to the L.A. Times Sunday edition, a bike rider was killed in a collision with the Blue Line Metro Train yesterday.

According to the paper, the collision occurred about 12:50 pm at the intersection of Grandee Avenue and Century Blvd, apparently in an unincorporated area of South L.A.

The identity of the male rider was unknown at the time of printing; the photo shows a mountain bike with a tacoed and twisted front wheel.

Unfortunately, no other information is available at this time.

The photo is not available on the Times’ website, and no information is available online from the Times, L.A. Metro, the L.A. County Sheriff’s Department — which evidently investigated the death — or any other news source. If I hadn’t happened to read the California section of the Times’ print edition just now, I wouldn’t have known about it.

Maybe it’s just me, but I consider it shameful that Metro doesn’t post information about fatal collisions involving their buses or trains as soon as possible after they happen. Or at all, in too many cases.

They have an obligation to keep the public informed about the safety of their operations, and far to often, fail to fulfill it. Which isn’t to say the Sheriff’s Department couldn’t do a much better job, as well.

This is just the third bicycling fatality in Southern California so far this year, and the second in the County of Los Angeles.

Bike rider killed in Long Beach last night; victim may have run a red light

Maybe it was the cold that kept less committed cyclists of the streets.

Whatever the reason, Southern California had suffered just one cycling fatality since the first of the year, compared to four this time last year.

Unfortunately, that unusual combination of good luck and — hopefully — safer streets came to an end last night, as a 50-year old bicyclist was killed while riding in Long Beach.

According to the Press-Telegram, the Long Beach resident, who has not been publicly identified, was riding west on Atherton Street at 7:17 pm when she allegedly ran the red light and was struck by a green 2002 Honda Odyssey headed south on Bellflower Blvd. The 19-year old driver stopped at the scene and attempted to render aid; unfortunately, the victim died of her injuries at a local hospital four hours after she was struck.

The Long Beach Post reports the driver was released at the scene, and no charges are pending.

What none of the stories answer is whether anyone other than the driver witnessed the collision. Reports that the rider ran a red light should be taken with a grain of salt unless it can be confirmed by independent witnesses. It’s a common problem in investigating bicycle collisions that police often only get one side of the story when the victim is unable to speak for him or herself.

A satellite view reveals a wide, complicated intersection that required the rider to cross 10 lanes of traffic get to the other side. It’s entirely possible that she started out with a green light, which may have turned red before she could get all the way across.

It seems unlikely that anyone would try to blow through the light at such a wide intersection, especially at such a relatively early hour when traffic could have been expected. But it’s always possible that she may have thought she could make it and didn’t see the car that killed her until it was too late.

This is the second cycling fatality in Southern California this year, and the first in L.A. County; there were 24 bike-related fatalities in the county last year, and 74 in the SoCal region. There were no bicycling deaths in Long Beach last year, following five in the bike-friendly city in 2011.

Update: The Press-Telegram has identified the victim as 50-year old Susan E. Curtis of Long Beach. 

According to the paper, Curtis’ bike was her primary form of transportation, which she used to get to her two part-time jobs, as well as working as a pet sitter and dog walker. She leaves behind a dog and six cats, along with an assortment of other pets, which are now in need of a new home.

Belmont Shore – Naples Patch reports that her friends don’t consider her someone who would run a red light under any circumstances. 

Meanwhile, Opus the Poet, who writes the Witch on a Bicycle blog, crunches the numbers to suggest that Curtis if entered the entered the intersection near the end of the green light, she could have easily failed to make it across the wide 10-lane intersection before the light turned green on Bellflower Blvd. And leaving her stranded and vulnerable in the path of oncoming traffic.

I’m not say that’s what happened, but it’s possible.

And it makes more sense than the idea that a 50-year old safety-conscious woman would intentionally run a red light on such a wide, busy intersection. 

Update: Cyclist killed in San Diego collision; first SoCal cycling fatality of 2013

That didn’t take long.

Just three days into the new year, the first Southern California bicycling fatality rears its tragically ugly head.

Several San Diego sources are reporting that a cyclist was killed while riding on eastbound Clairemont Mesa Blvd near the onramp to southbound I-805 around 5:50 pm Thursday.

No details are currently available on the identity of the victim or how the collision occurred; the bike rider was dead by the time paramedics arrived. The woman driving the Pathfinder remained at the scene; there was no immediate indication that alcohol or other intoxicants played a role in the collision.

However, a satellite view of Clairemont Mesa Blvd suggests the sort of virtual freeway all too typical in San Diego, designed for high speeds and traffic volume at the expense of safety. A bike rider approaching the 805 onramp near the curb would be forced to cross in front of exiting traffic in order to continue on Clairemont Mesa.

That doesn’t mean that’s how the collision occurred, though. We’ll have to wait for more information to tell us what really happened.

This is the first fatal bicycling collision in Southern California this year, and the first in San Diego; that compares with 12 cycling fatalities in San Diego County in each of the last two years.

Update: BikeSD reports that the victim, who still has not been publicly identified, was a 53-year old married man of Chinese descent. He was reportedly using lights and wearing a reflective vest, yet a story from San Diego’s CW station suggests that no one is assigning blame to the driver — even though the rider should have been clearly visible to anyone who was paying attention.

In fact, police appear to blame the victim for veering in front of the driver, despite the fact that the design of the roadway forced him to do exactly that.

Yet a city official rejects any suggestion that bad roadway design could have played a role in the collision — even though a cyclist wanting to ride straight on Clairemont Mesa has to cross directly in front of high speed traffic exiting onto the on ramp, as I surmised above.

In the CW link above, San Diego 6 quotes key figures disputing the city’s head-in-the-sand comments:

“The design of the roadway is at fault,” said Kevin Wood of the San Diego County Bicycle Coalition. “This interchange was never built with my needs as a cyclist in mind. It wasn’t built with the needs of pedestrians in mind. This interchange was built using 1960s design standards that only considered automobile traffic.”

According to an attorney handling a similar case in San Diego, 

“This case [on Clairemont Mesa] is about as good as they get when it comes to lawsuits against cities for dangerous conditions,” he said.

It’s long past time for Southern California officials to stop denying the obvious, and accept that bad roadway design is just as much a problem as bad drivers or careless cyclists.

And people will continue to die until they finally accept that cars — and bad roads — can kill, and changes must be made.

Owner of PV Bicycle Center died while riding in Malibu Hills last weekend

Just getting word this morning that Steve Bowen, owner of the PV Bicycle Center, died of an apparent hear attack while riding above Malibu on Sunday.

Bowen was reportedly climbing up a hill with a friend when he collapsed, and a passing motorist flagged his companion down to tell her he’d fallen. A physician stopped and attempted to revive him, without success.

I won’t waste your time trying to tell you more about Bowen or what happened to him. To the best of my knowledge, I never had the privilege of meeting the man; Seth Davidson of Cycling in the South Bay did, and writes far more beautifully than I ever could about the loss of his friend.

Read it, and you’ll understand why I regret not knowing him. And why the local cycling community will be poorer for his loss.

Bowen was the 74th cyclist to die in Southern California this year, excluding gunshot victims, and the 24th in Los Angeles County, matching the total for last year as well as the average for the past six years. And he is at least the third rider to die of natural causes in SoCal this year; it’s likely that others have, as well, but have not been publicly reported.

I include deaths from natural causes in the fatality totals since in many, if not most, cases, it’s impossible to determine if riding or a fall from the bike contributed to the physical events leading up to the death, or if they were what cause could have triggered a heart attack or stroke; however, that does not appear to have happened in this case.

But to avoid splitting hairs to a near-infinite degree, I now include all deaths from any cause other than gunshots in these totals, which is why they are unlikely to match the figures from law enforcement or highway safety agencies.

Bad news on Christmas Eve — Hero Newport Beach lifeguard dies in apparent solo fall

This is not the news any of us want on Christmas Eve.

According to Corona del Mar Today, a hero lifeguard has died after an apparent solo fall.

Thirty-eight-year old Brian Gray was found laying face down near his bike at 2:02 am Friday at the intersection of 26th Street and Newport Blvd in Newport Beach. A police spokesman says he was simply fell while riding his bike; he died the following day in a local hospital.

The news site reports that Gray, a lifelong resident of Newport Beach, was one of the rescuers who saved the life of 13-year old Dylan Scott of Riverside when he was buried in the sand in 2006; he received the Bravo Award from the American Red Cross, along with other lifeguards involved in the rescue.

In addition to his work as a lifeguard for the past 21 years, Gray worked as a courier for the Newport Beach Fire Department; paramedics reportedly recognized him at the scene.

Of course, as in any solo fall, the question is why.

Given the hour, it’s possible that Gray may have been drinking and simply fell off his bike.

However, it’s also entirely possible that he fell as a result of being brushed or buzzed by a passing car, leaving little or no evidence behind to point to a dangerous pass that may have resulted in the rider’s death — which I suspect happens far more often than any of us realize.

Or he could have simply lost control of his bike for any number of reasons, something that happens to even the best riders, myself included.

This is the 73rd cycling fatality in Southern California this year, three above the total for last year, and the 14th bicycling death in Orange County this year. Remarkably, it’s the third bicycling fatality in tiny Newport Beach, with a population of just 86,000 — though it should be noted that the area is a popular biking destination, drawing in far more riders than its small size would suggest.

Gray is also the 14th SoCal rider to die in a solo fall in 2012, and third in Orange County.

So please, let’s be careful out there.

Jurupa Valley rider killed in rear-end collision

It’s been a bad several days for Inland bike riders.

According to the Press-Enterprise, 47-year old Riverside resident Aristeo Vallardares was hit from behind while riding on the 5900 block of Limonite Avenue in Jurupa Valley at 7:31 pm. Witnesses performed CPR until paramedics arrived and transported Vallardares to Riverside Community Hospital, where he was pronounced dead shortly after 8 pm.

The satellite view shows a wide, divided roadway with little or no shoulder — exactly the sort of road that forces riders to compete for space with high-speed traffic.

Yet once again, there’s no word on how the collision occurred, other than it was a rear-end collision — a pattern that seems to be common in Riverside and San Bernardino County bicycling deaths.

There’s no mention on whether he was using lights, or why the driver failed to see a bike rider who was apparently on the road directly in front of him.

And as usual, no mention of who the victim was beyond the most meagre description. No word on what he did for a living, whether he had a family or if there is anyone besides his fellow bicyclists to morn his death.

This is the 71st bicycling fatality in Southern California this year, one more than last year’s already too high total. It’s the 13th cycling death in Riverside County, two above the total for last year.

And Vallarades is the third rider to die in Riverside and San Bernardino Counties in just the last five days, and the 4th killed in Southern California in the past 10 days.

21-year old Ontario cyclist killed Sunday night

The Inland Valley Daily Bulletin reports that 21-year old Ontario resident Pascual Antonio Garcia was killed last night while riding in Ontario.

According to the paper, Garcia was riding on Mountain Avenue south of Flora Street when he was struck by a southbound car at 8:38 pm. He was taken to Arrowhead Regional Medical Center, where he was pronounced dead about an hour later.

The driver reportedly stopped and called for help.

Once again, there is no information on how the collision occurred, whether the victim was using lights or riding in an unsafe manner, or whether the driver was intoxicated, distracted or otherwise careless.

You’d think the life of a human being would be worth more than three paragraphs and four short sentences.

This is the 70th bicycling fatality in Southern California this year, which equals the total for last year. It’s also the ninth in San Bernardino County, a 50% increase over the six cycling deaths in the county in 2011.
