Open letter to SaMo City Council — Ensure fairness before approving Selective Traffic Enforcement funds today

Just 48 days until LA fails to meet its Vision Zero pledge to eliminate traffic deaths by 2025.

We have a time-sensitive matter to discuss.

The Santa Monica City Council is going to address a motion to accept a $300,000 grant from the Office of Traffic Safety as part of their pro forma consent calendar at today’s meeting.

The purpose of the grant is to fund more Bicycle and Pedestrian Safety Enforcement Operations by the Santa Monica Police Department, in which officers ticket anyone who commits a violation on the road that could endanger vulnerable road users.

But as you’ll see below, that isn’t always enforced equally, fairly or equitably.

Longtime Santa Monica bike advocate and former LACBC Board Member Dr. Michael Cahn wrote the following open letter to the council, calling attention to the windshield bias and other problems inherent in these operations.

So I’m going to step aside, and let Dr. Cahn do the talking today.

You can do some talking of your own by contacting the Santa Monica City Councilmembers prior to today’s 5:30 pm meeting, to call for fairer police enforcement in bike/ped safety operations before approving Item 5D — particularly if you live, work or ride in Santa Monica.

And if you’re one of those unfortunate bike riders who was ticketed in one of the previous operations, they especially need to hear from you.

Dear Council Members,

Before you give a green light to the OTS Grant for 300.000 $ for Selective Traffic Enforcement, let me give you some feedback, from the handlebars and from the sidewalk, looking back at how these grants have worked in the past.

They used to be awarded for Pedestrian and Bicycle Safety, and they were always conducted “through the windshield”. The motto was: Drivers are driving, now let’s keep the pedestrians and cyclists out of harm’s way. To do that we must ticket them when they ride their bikes on the sidewalk, we must educate them to cross at the intersection.

There is a big monster in town, it is called vehicle traffic, and it will snap a pedestrian, a cyclist here and there. The main job of SMPD Traffic Division is to keep the monster rolling through town, and keep those who use the streets without a license plate out of the path of this dangerous beast. Not exactly the best way to address the source of the danger, methinks.

It does not look good when an SMPD Sergeant is parked at the intersection and ignores how this Prius endangers the pedestrian in the crosswalk (Montana):

But the cyclist on the sidewalk is quickly found and stopped and “enforced”:

Sometimes crossing the intersection without a green light is safer for the cyclist, but the officer only cares about the rules:

SMPD knows that riding bicycles on Lincoln Blvd is hairy, so they do it on the sidewalk:

We all sometimes think cars can not be avoided. Our police force, too, is fully subscribed to this attitude. We once had a transportation management division in this city, but how do you manage the king of the American road? The car is in charge, but CicLAvias and other open streets events come and go.

And yet, we must manage and challenge all this driving. We must do less of it, and we must do it less often. And the SMPD, too, must project this goal of less driving. One way to do this is to contradict the idea that driving is always necessary (it is not), that we all drive (we do not). Imagine the citywide moment of education and insight that would happen if our own police department challenged the poison of motonormativity. Encourage the SMPD to challenge the notion that driving is the default. Let’s see these officers on their bicycles enforcing the law on Wilshire, for a change.

Yes, they do ride their bicycles on the beach path, but are they big and strong enough to do it in town? In town the bicycles are transported on the back of a car.

Every time the SMPD is not riding a bicycle in traffic, it gives us cyclists the sense that we are just a crazy suicidal minority. And it gives all the drivers out there the same message: Crazy cyclists. What we need from them is to share the road with us on a bicycle, and to bring their authority and their uniforms and their tickets to the bike lane, and to deal with the drivers parking on the bike lane, turning without indicating, overtaking dangerously, ignoring crosswalks, opening doors without looking.  This should be part of the 300K grant from OTS!

You want safer streets in Santa Monica? Put your officers on bicycles and let them ride up and down Wilshire, up and down Lincoln. That is where the education and the enforcement needs to happen. Enforcement of our drivers, the single most dangerous road participants

You know you want to do it, just see how you imagined the SMPD as an all terrain mountain cyclists force. No road chickens here.

Please make approval of item 5D contingent on consideration of the following items

  1. Highly visible bicycle patrols on heavily trafficked streets: Film it, Share it: Show us and show the community that cars are not always necessary.
  2. Conduct Crosswalk Sting Operations on Montana, Wilshire and Santa Monica Blvd etc. Film it, Share it.
  3. Enforcement of drivers who stop or park on bike lanes.
  4. Enforcement of illegal parking and waiting around schools: Lincoln Middle School has crossing guards. Their good work is made impossible by parents defiantly waiting in their cars on bike lanes and in alleys in the vicinity. Saint Monica School proudly displays long lines of illegal parking and waiting on California Ave over multiple blocks.
  5. Revisit the sidewalk riding ordinance.

It’s now 328 days since the California ebike incentive program’s latest failure to launch, which was promised no later than fall 2023. And a full 41 months since it was approved by the legislature and signed into law — and counting.

Morning Links: LAPD recovers possibly stolen bikes, Los Feliz NC gets real with Ryu, and ticketing trucks in SaMo

If you had a bike stolen recently in Santa Monica or Venice, you might want to check with the LAPD’s Pacific Division.

According to the LA Times, the driver of a pickup crashed into two other vehicles as he was fleeing the police. The chase began when officers discovered the truck had been stolen a few days earlier in Bakersfield.

Three people were hospitalized, including a passenger in the truck.

After police arrested the driver, they discovered a number of bicycles in the back of the truck, and were checking to see if they had been stolen.

However, given that most bike thefts are never reported to the police, if the bikes weren’t registered, there’s a good chance they won’t show up in a police database.

Which means the thief will get away with it — assuming they are stolen.

And the owners may never see them again.

I can’t say I’m familiar with the members of the Los Feliz Neighborhood Council. But after reading this letter, I could kiss every one of them.

This especially matters as Ryu contemplates ripping out the highly successful road diet on Rowena — after he already cancelled the desperately-needed road diet planned for 6th Street behind LACMA in the Miracle Mile neighborhood.

LA’s Vision Zero program is already at risk of dying before it has even been implemented, thanks to the auto-centric reactions of city councilmembers who, like Ryu, seem to fear angry drivers more than they fear blood on their hands.

And to answer the question posed in the letter, there is no acceptable number of traffic deaths.

None.

I’d love to see a version of this letter forwarded to every member of the city council. Especially CD1’s “Roadkill” Gil Cedillo and CD5’s Paul “Killer” Koretz.

File this one under things that never happen in real life.

Yes, that’s a Santa Monica police officer ticketing a delivery driver double-parked in the San Vicente bike lane.

I complained about delivery drivers blocking the bike lanes for years when I regularly rode that route, and never got any results. From the police or the delivery companies.

And was harassed so much that I had to block the comments on my videos of bike lane-blocking trucks on my YouTube channel, and finally had to delete the videos entirely.

Which seems to be what’s happening in Reddit, as redditors argue that police are overreacting to what they consider a minor inconvenience for people on bikes.

Even though blocking those bike lanes forces riders out into the general traffic lanes on a section of roadway where few drivers seem to pay attention to much of anything, including the speed limit.

Still, it’s good to see SaMo police taking this seriously.

Let’s hope they keep it up. And maybe delivery drivers will finally find somewhere else to park.

The war on cars is a myth, but the war on bikes goes on.

A Toronto bike rider shook his head as he passed a driver blocking an off-road cycle track. So the motorist drove down the road to the next crossing point, waited for other riders to pass, then intentionally plowed into him.

And denied afterwards that he hit anyone.

Fortunately, the whole thing was caught on video.

He now faces charges for hit-and-run and failing to report a collision, as well as failure to yield. Even though he should have been charged with assault with a deadly weapon.

And then a local website has the audacity to say “Both drivers and cyclists are responsible when it comes to road safety.”

Which is like telling shooting victims they have a responsibility to stay out of the way of bullets.

Then there’s this one, where an impatient and indignorant driver can’t even manage to wait a few seconds for a bike rider to have room to pull over and let her pass.

And evidently concludes that the woman on the bike doesn’t belong there, because there’s no bike lane on a street that’s too narrow for one.

In a study that runs counter to what we’re usually told, Boston researchers conclude that lowering speed limits actually does result in lower speeds. Which we should remember the next time we’re told that raising speeds under the deadly 85 percentile law really doesn’t matter.

The Vuelta saw a long breakaway in Wednesday’s stage, and a change in the leader’s jersey.

Britain’s Mark Cavendish is shutting down his cycling season after being diagnosed with the Epstein-Barr virus; he ranks second on the all-time Tour de France list with 30 stage victories.

Italy’s Vincenzo Nibali continues to have pain in his back after suffering a vertebra fracture in a crash during the Tour de France, and questions whether he will ever be the same again.

 

Finally…

No, it’s not okay to right hook someone in a bike lane. Pedestrians say people on bikes should wear license plates.

I was hoping to attend today’s official opening of the MyFigueroa Complete Streets project, but it looks like a busy day with too many obligations will keep me away. 

If you go, try to corner LA Mayor Eric Garcetti — assuming he’s not too busy running for president to show up — and ask how Vision Zero can work if councilmembers have the power to block projects like MyFig in their own districts. 

And how it can possibly succeed if his own office isn’t willing to go out and fight for it.

I think we’d all like to hear the answers to that.

 

Morning Links: Creed calls for a safer Westwood, SaMo PD gets Share the Road wrong, and bike rap & Corgi bikes

Maybe there’s still hope.

Yesterday morning, Jesse Creed, who’s running against incumbent Paul Kortetz in LA’s 5th Council District, announced that his one of his first actions as a councilmember will be to call for a safety study of Westwood Blvd, saying “a safer, better Westwood will the bedrock of a more vibrant Westwood Village.”

While it’s not an outright endorsement of the shovel-ready bike lanes Koretz singlehandedly killed at the behest of wealthy homeowners, it’s a huge step towards improving the dangerous street following its shameful removal from the city’s Mobility Plan.

It should be noted that a study of the proposed bike lanes was already underway when Koretz halted it, insisting that they would not be built no matter what the study showed. And even though I’ve been told by multiple sources that it would have shown the bike lanes would improve safety, with no significant impact on travel times or parking.

While Westwood is part of LA’s Great Streets program, it’s also part of the Vision Zero High Injury Network, indicating that it’s one of the city’s most dangerous streets — especially for pedestrians and the many bike riders who have no other viable route to get to Westwood Village from the Expo Line or other areas further south.

As Creed notes, despite the Great Streets designation, nothing has changed on the street under Koretz’ watch, unlike some of the others which have made great strides since receiving the designation. And despite the councilmember’s apparent belief that the best solution to a dangerous street is to keep it that way.

Creed seems to get that Westwood — or any other street, for that matter — can’t be a Great Street if it’s not safe and inviting for everyone who uses it, and that it needs to serve more than just a handful of local residents who claim it as their own.

Evidently, LA had an ulterior motive in agreeing to host the world para-cycling championships at the last minute, hoping it would boost the city’s chances of winning the 2024 Olympics.

After experiencing the walkable streets and pedestrian plazas of New York, DTLA Rising’s Brigham Yen calls on LA to cut the backward bullshit and focus on road diets to create a more walkable — and by extension, bikeable — city.

Despite projections of a budget shortfall, Governor Jerry Brown proposes increasing funding for active transportation by $1 billion over the next ten years; Calbike notes that the funds are prioritized for disadvantaged communities.

A New Jersey website recommends Orange County as a cyclist’s mecca for riders trying to escape the state’s cold winter.

The San Diego Union-Tribune wants your bike commuting stories. Actually, they want everyone’s commuting stories, which means they’ll need bicyclists and pedestrians to balance out all those people in cars.

Santa Monica police are asking for the public’s help in finding the cowardly jerk who ran down a woman as she walked Tuesday evening and left her lying in the street with serious head injuries.

Be on the lookout for a possible 2000-2006 silver, four-door Nissan Sentra, which could have damage to the bumper, hood and windshield on the right front.

Anyone with information is urged to call investigator Jason Olson at 310/458-8954 or the SMPD at 310/458-8491.

The LACBC, in conjunction with AARP, released the findings of last year’s annual Los Angeles Bicycle and Pedestrian Count, which for the first time show a decrease in bike ridership as the city largely stopped building new bike lanes.

The report includes a number of key findings, including:

  • The most popular streets for walking and biking are also the most unsafe: All of the top 30 count locations for people walking are located on the High Injury Network, along with 24 of the top 30 locations for people biking. These top 30 locations accounted for 65% of all people walking who were counted and 55% of all people biking who were counted. All of these locations are located in high-density neighborhoods, near major destinations, or in low-income communities of color. Almost all of the top 30 locations were in neighborhoods with median household incomes below the rest of the city.
  • As bike lane installation has slowed, new ridership has decreased: In 2015, riders continued to gravitate towards bike lanes; however the count shows an overall 9% year-by-year decline in same location ridership from 2013 to 2015. In the last two years, bike lane installation has decreased significantly from a high of 101 miles in fiscal year 2013 to only 11 miles in fiscal year 2015. Many of these new lanes have been installations where bike lanes could be included in other road resurfacing or safety projects, rather than installations along high priority corridors identified in the Bicycle Plan. Of the initial 183 miles of bike lanes prioritized in the 5-year Bicycle Plan Implementation Strategy, only 45 miles (25%) have been installed. As a result, the bike network in Los Angeles remains fragmented with large gaps in bike lanes along most riders’ trips. This lack of connectivity continues to be the greatest barrier reported by many people who bike or would like to.
  • Women want safer biking options: In Los Angeles, women make up just 16% of cyclists overall, but the gender disparity is lowest on streets with quality bikeways (bike paths at 22% and bike lanes at 17%) and highest on streets with no bicycling infrastructure. Cities with safer streets for bicycling in general tend to have smaller gender disparities in bicycling, such as Portland, Oregon (35%), and Copenhagen, Denmark (50%).
  • Bike lanes have made streets safer, but more work needs to be done: On the new bike lanes studied, bike ridership increased by 62% after installation. After accounting for increases in bike ridership, new bike lanes reduced bicycle crash risk by an average of 42%.

Steve Herbert forwards news that the Marvin Braude bike path will soon be rerouted and improved where it currently twists awkwardly, and dangerously, through a parking lot around Pier 44 in Marina del Rey.

But riders will have to detour along Admiralty Way in the meantime.

Here’s what he had to say.

The Marvin Braude bike path snakes through Marina Del Rey connecting Ballona Creek & parts south to Washington Blvd. where cyclists can ride to Venice boardwalk or other parts of the region. Pier 44 is about to undergo renovation with the existing tenants, boats and trailers all cleared out. Pier 44 is at the end of Basin G of the marina which is bound by Bali Way on the north, Admiralty Way on the east and Mindanao Way on the south.

The bike path winds through this facility which is about to be closed and I asked Anthea Raymond, a Beaches and Harbors Department Commissioner I know, what plans there are to accommodate cyclists and the path while it’s under construction. Below are the answers and diagrams I got.

She didn’t provide any specific dates, but the pier is now a ghost town and I expect to see fencing and demolition equipment any day now just based on what I observe riding through the site as one of my commute routes.

Here’s what I learned about the Marina bike path, both during renovations on Pier 44 and going forward:

The Pier 44 project includes significant improvements to the bike path. Whereas the current bike bath snakes across the parcel, forcing riders to navigate around buildings and boat storage, the new bike path will have a straight alignment along the waterfront, next to the new 20’-wide pedestrian promenade.  Additionally, the project includes two public restrooms along the bike path, and bicycle racks that can accommodate 68 bikes.  This project also includes a WaterBus stop, because early on we wanted it to be a destination that people could visit by foot, by boat, by car, or by bike.  While the parcel is under construction, the bike path will temporarily be routed along the eastern portion of the parcel, adjacent to Admiralty Way.

It looks to be a significant improvement to one of the worst sections of the popular beachfront bike path.

Let’s just hope the construction doesn’t take too long, and they provide an adequate alternative in the meantime.

It’s time to catch up with upcoming bike events.

BikeSGV is hosting a pet and family-friendly Pet-acular Bike Train tomorrow. But neither you or your pet are allowed to use training wheels.

Sunday marks the World Day of Remembrance to honor victims of traffic fatalities; 40 artists will participate in the event with LA Road Concerts in Downtown LA.

Malibu is hosting a community outreach meeting on November 29th to discuss the problems with parking along PCH; anyone who’s ridden the coast highway through the city knows the dangers poorly parked cars can pose.

Metro’s El Monte Bike Hub will host a Commute 101 Clinic on November 30th to help you get more comfortable riding your bike to work or school.

San Bernardino will hold 14-mile Inland Regional Center Memorial Ride on December 2nd, riding one kilometer for each of the 22 people injured in last December’s terrorist attack, which is equal to 14 miles for each person killed. A similar ride will start out from Redlands, with 22 turns to honor the wounded and 14 miles to remember those killed.

A British town gets it, saying if close passes make people too afraid to ride a bike, it’s a police matter.

Now that’s more like it. Drivers in a North London borough could have their cars crushed if they’re caught passing bike riders too closely twice in a single year. And yes, bike cam video counts. Now if we could only get California to do that for hit-and-runs.

Like LA, advocates blame stalled bike path plans, as well as draconian fines, for a drop in the number of bicyclists in Sydney, Australia; last year the state government gave up on plans to double the rate of cycling.

It’s great to talk with fellow advocates who don’t let differences in approaches to bicycle safety get in the way of finding common ground in their efforts to make bicycling safer and more enjoyable for everyone who rides.

Santa Monica police blame the victim in a new bike safety video, two better videos and your Morning Links

Santa Monica police are offering up a new PSA suggesting that stopping for stop signs while riding a bike is child’s play. And the best way to ensure you’ll get home to yours.

Children, that is.

It’s not like their message isn’t reasonable — both the law and common sense dictate that we should observe traffic signals just like anyone else. But while they’ve undoubtedly scored points with bike-hating residents, they could have done a lot more good by focusing on the need for motorists to pay attention and drive safely around bike riders.

Which is what share the road really means, despite the way some drivers — and police departments, apparently — try to twist it these days.

After all, even the most dangerous cyclists pose a risk primarily to themselves, while dangerous drivers pose a risk to everyone around them.

I don’t have any records on what may have caused bike injury collisions in Santa Monica. But neither of the two bicyclists killed in Santa Monica in recent years ran a red light or stop sign. Antonio Cortez died after riding into an open car door while allegedly riding drunk, while Erin Galligan was run down from behind by while riding home from work on PCH.

Even if he was as stumbling drunk as SMPD officials implied, Cortez would probably still be alive today if a driver hadn’t left his car door open in violation of California law.

And to the best of my knowledge, no one has ever suggested that Galligan did anything wrong, other than occupy the same road space as the speeding hit-and-run driver who killed her.

Maybe the SMPD’s next bike safety videos should focus on closing your damn car door and not running away like a coward after you kill someone.

Then again, this is the same department that has promised to crackdown on scofflaw cyclists more than once. Even though they can’t legally focus enforcement on specific violators as opposed to violations.

That is, they can legally ticket everyone who rolls stop signs, for instance. But they can’t direct their enforcement towards cyclists as opposed to everyone else on the road.

And they should know that.
