Bike rider killed in Hollywood collision

This is not the news anyone wants for Bike Week.

Or any other time for that matter.

Reports started coming in yesterday evening that a bike rider had been killed at the intersection of Hollywood Blvd and Hobart Blvd in Los Angeles.

Unfortunately, it took until this afternoon to get official confirmation.

According to the police report, the victim, who has not been publicly identified, was riding north in the west crosswalk on Hobart at approximately 3:07 pm Wednesday when he was struck by a car headed west on Hollywood.

The impact apparently knocked him into a parked car on the north curb, before falling back into the street. He died at the scene.

LAist reports that the crosswalk has a blinking yellow light to warn drivers that someone is crossing. However, it’s unclear if it was working at the time, or if the rider had activated it.

They also quote a comment from a Reddit thread indicating that the driver was taking an 84-year old grandmother to the hospital; however, while there are several hospitals nearby, they are all in the opposite direction from which the car was headed.

It’s unclear from the description who might have been at fault.

It’s legal to ride on the sidewalk in Los Angeles, which means it is also legal to ride in the crosswalk.

However, the LAPD interprets the law as requiring cyclists to ride in the direction of traffic when they enter a crosswalk. In this case, that would have required the victim to cross on the east side of Hobart, but the only crosswalk is on the west side.

On the other hand, unless the victim was traveling at a high rate of speed, the driver should have had time to see him and react before he reached the opposite side of the road.

If there’s a lesson to learn from this, it’s that you should never count on drivers seeing you and stopping in time, in a crosswalk or anywhere else; always wait until they actually stop before trying to cross in front of them.

This is the 19th bicycling fatality in Southern California this year, and the ninth in Los Angeles County; it’s also the fifth in the City of Los Angeles.

That compares with 41 in the seven county SoCal region this time last year, and 17 in the county. However, it’s one more than in the City of LA on this date in 2014.

Update: The victim’s granddaughter has identified him as Thomas Galvan Munoz, a resident of the area for 30 years who rode his bike through the streets of LA every day.

Just gotten word that the sentencing of Hasti Fakhrai-Bayrooti in the drugged driving death of cyclist Eric Billings has been delayed due to a technicality.

Fakhrai-Bayrooti unexpectedly pled guilty to a single felony count of vehicular manslaughter while intoxicated last March, and was scheduled to be sentenced to up to four years in prison today. The judge delayed sentencing until June 10th to allow the defense time to review the probation report.

However, he revoked bail and remanded her into custody to be evaluated prior to sentencing.

According to the OC DA’s office, Fakhrai-Bayrooti had Xanax and Suboxone in her system when she ran down Billings’ bike from behind on March 15, 2013, as he rode in a marked bike lane on Santa Margarita Parkway in Mission Viejo.

According to My News LA, Billing’s daughter, who was six month’s pregnant when he was killed, gave birth to a son who will never know his grandfather. And one her brothers is getting married Saturday without a father to stand by his side.

Mark Billings said he too had struggled with addiction, but it was his brother’s unconditional love that helped him overcome his own drug problems.

Eric Billings “was the kind of guy who carried extra shirts and sweaters in his car to give to someone out in the cold,” Mark Billings said.

I’m told the judge wept openly in the courtroom listening to the impact statements from family members. And the court reporter recorded it all with mascara running down her face.

Once again, there’s bad news from Ballona Creek.

A rider writing on Reddit reports that he saw another cyclist being robbed by four men on the bike path near the National/Jefferson exit Tuesday evening.

This has been an ongoing, if infrequent, problem over the years; in fact, crime alerts on the pathway date back to at least 1990.

It’s not that the bike path is particularly dangerous. However, just like any other place in the city where you’re out of public view, you have to be alert to the circumstances around you.

If you don’t feel comfortable, wait for other riders to catch up, or go back to the previous exit and ride around the problem area.

Just don’t hold your breath for the police to respond. There’s been an ongoing debate over which police agencies have jurisdiction where on the path.

And riders have complained that 911 operators can’t seem to find it on a map to send anyone, anyway.

Meanwhile, the women in these photos finally get four days in the AToC, which started Friday. Second-year UnitedHealthcare pro Katy Hall dreams of charging up Mt. Baldy just like the men, while Alison Tetrick looks forward to joining a deep field charging through the snow.

While this year’s women’s tour is a big step forward, it’s long past time to let women racers compete on equal terms. And put them on TV, for chrissake.

I’m told the LAPD has gotten several complaints about people blocking bike lanes with their garbage cans. And yes, that is illegal.

Great idea for a bike ride, as the San Jose Public Library host the Gira de Libro, visiting five of the city’s 23 libraries. Rumor has it that LA has public libraries, as well, though few residents have actually been inside one.

After the local Marin paper refused to even consider the possibility a bike rider might not have been at fault in a collision with an 80-year old woman, it turns out the rider did what he could to avoid hitting her. An estimated 15 to 17 mph sounds way too fast for a narrow bridge shared with pedestrians, though; we need to slow down when passing people on foot, just like drivers should slow down when passing bikes.

A Sacramento bike rider was killed in a collision with a train. By far the easiest type of wreck to avoid, since trains have to travel on tracks and have warning lights, bells and/or crossing gates to tell you they’re coming.

A Mariposa cyclist suffered major injuries when he was left crossed by a motorist; according to the comments, the victim is the principle double bass player for the local orchestra. Let’s hope makes a fast and full recovery.

Performance Bicycle is named a Gold Level Bicycle Friendly Business. Then again, if a bike shop isn’t bike friendly, something is seriously wrong.

America’s biggest bike share operator has now gone into the manufacturing business.

As we’ve said before, people don’t ride on the sidewalk if they feel safe on the streets, as shown by a new protected bike lane in Honolulu that’s cut sidewalk riding by 65%.

Salt Lake will build the nation’s first protected intersection, designed to keep bike riders and pedestrians safe.

A texting teenage Chicago driver could get off the hook for hitting a cyclist because the police never read the driver her rights.

And Bremerton WA police have apparently developed a new technique to stop fleeing drivers by throwing out a bike strip; no word on whether they use roadies, fixies or mountain bikes.

 

62-year old crosswalk rider killed in Santa Ana left cross collision

Bad news from Santa Ana.

I learned late last night from a source in Orange County that a bike rider was killed in a left cross while riding in a crosswalk Monday evening.

The victim, identified by the Orange County Coroner as 62-year old Robert Horton, was riding in a crosswalk along 17th Street when he hit by a car turning left onto the northbound I-5 Freeway onramp around 5:20 pm.

He was taken to UCI Medical Center in Orange, where he was pronounced dead at 6:06 pm.

Presumably, Horton was riding on the sidewalk when he rode into the crosswalk; no word on which side of the street he was on or which direction he was riding.

Riding on the sidewalk is banned in the downtown area in Santa Ana; whether that would apply along the freeway is unclear. Depending on how the local police apply the confusing laws on riding in a crosswalk, he could be blamed for the collision if he was riding against traffic.

However, looking at Google Earth, it’s unclear how the driver could have made a legal left turn onto either onramp, since they appear to be designed for right turns only, with left turns blocked by the median.

And while the Orange County Register identifies the make and model of the car, there’s no word on the driver. Or even if the car had one.

This is the 17th bicycling fatality in Southern California this year, and the second in Orange County. That compares with 38 and eight, respectively, this time last year.

Okay, so this one made me cry.

You see, one reason I write about fallen cyclists is the hope that somehow, some good will come out of such senseless loss. Whether in the form of improved safety measures at the site of the collision, or in some other way.

Patti McCluskey Andre made sure that happened.

It was just over three years ago that her brother, Donny McCluskey, stood waiting with his bike, for a Palm Springs red light to change. He was in the right place, exactly where he was supposed to be, obeying the law so many motorists seem to think we break with abandon.

Yet in the intersection in front of him, a drunk driver was hit by a motorist running that same red light. One of the vehicles went ballistic, spinning out of control and crashing into him; with his feet planted on the ground, there was nothing he could do to avoid the impact.

In seconds, he became collateral damage to the dangers on our streets, a victim of actions beyond his control.

The remorseful driver who ran the red light was ultimately convicted and placed on three years probation and community service. This at the request of the victim’s family, who saw no benefit in putting him behind bars.

In most cases, that would have been the end of it.

They would have walked away, mourning the loss of someone so dear to them, and trying to find some way to put it all behind them.

But Patti wanted Donny’s life to mean something.

So she started a fund in his name, which this month awarded its first two scholarships.

Here’s what she had to say:

Yesterday I had the honor of awarding the first 2 in memory of Donny McCluskey scholarships. Both recipients, Lisa Ponsford and Wendi Swanson are family nurse practitioners graduating in May with their DNPs. As FNPS working in our communities — they have the power to promote change at every level. Lisa works in the ER and Wendi in college health plus both are educators at WesternU. Both recipients are physically active and dedicated to changing population health with lifestyle interventions.

Both recipients were honored and touched to be chosen for this scholarship. All I can say is that I am honored to know them and wish they had known Donny, he would have been honored to have his name associated with these two!

Just how big a heart does it take to turn your own private tragedy into something so positive? Let alone something that will not only benefit those who receive them, but everyone whose lives they touch?

Patti has thanked me more than once for the work I do here. But I am in awe of her, and what she’s done to not only channel her own grief, but make our world a better place.

She’s currently raising funds for an additional scholarship for a graduate or doctoral student of Health Science at the same university. And promises to match every donation dollar for dollar.

I can’t think of a better cause.

In light of yesterday’s guest post about riding on crosswalks, I was forwarded this 1993 opinion from then California Attorney General Dan Lundgren, concluding that the rules of the road do indeed apply to bicyclists on the sidewalk, and that sidewalk cyclists can be required to ride with traffic.

We note that certain rules of the road concern the use of the roadway in particular rather than the highway in general (e.g., § 2165 [except in specified circumstances, a vehicle upon the highway is to be driven upon the right half of the roadway]). Although a sidewalk is a separate part of the highway from the roadway, we believe that, given the factors discussed above, the intent of the Legislature was for the operation of a bicycle on a sidewalk to be similar to vehicular travel wherever practicable. Therefore, to the extent that a vehicle must be driven on the right half of the roadway, a bicyclist riding on an adjacent sidewalk must travel in the same direction as the vehicular traffic. This interpretation of section 21200 provides pedestrians with some assurance as to the direction of bicycle riders on sidewalks at all times. Such statutory construction is consistent with the well-established principle that “[t]he courts must give statutes a reasonable construction which conforms to the apparent purpose and intention of the lawmakers.” (Clean Air Constituency v. California Air Resources Bd. (1974) 11 Cal.3d 801, 813.)

Of course, an opinion of the AG does not have the force law.

It’s up to the courts to interpret and rule on the meaning of laws guiding the use of bicycles on the sidewalk, as well as the crosswalks. And laws can be amended, and interpretations change, over three decades.

I don’t know of any California city where sidewalk riders are routinely expected to ride in the direction of traffic. However, many police departments — including the LAPD — believe bikes become vehicles once they enter the street, and so must travel in the direction of traffic when they enter a crosswalk, yesterday’s post not withstanding.

But it’s interesting to see such a different interpretation of the law from thirty years ago.

Somehow I missed this column from an auto-centric writer in my otherwise bike friendly home state, insisting that bike riders are law breaking junior partners who deserve only a small share of the road. And of course, the usual complaints about a “subset” of arrogant, self-righteous, self-centered and condescending riders.

A cyclist responds by shouting tongue-in-cheek taunts at other riders when he’s behind the wheel.

An article in a Boston College environmental law review makes the case for how strict liability could even the scales on our roads, improve safety and encourage more environmentally friendly forms of commuting.

Like bicycling, for instance.

Strict liability is based on the assumption that motorists, as the operators of the more dangerous vehicles, have a greater responsibility for avoiding collisions, and so are presumed to be at fault in a collision unless it can be shown otherwise.

Adopting it here is probably the biggest step we could take to reduce reckless behavior behind the wheel and stop the carnage on our streets.

No bias here, as the Press-Enterprise says a bike rider was badly hurt when he ran into a car; never mind that he was actually right-hooked. Note to the P-E: The victim was cut off, not passing on the right; thanks to sponsor Michael Rubinstein for the link.

No bias here, either. A Hollister newspaper reports a bike-riding child hit a car and fell over, but fails to mention if the car was even moving at the time. And in more Hollister news, if you’re a known gang member carrying a concealed weapon, ride to the right, damn it.

San Francisco police arrest the unlicensed hit-and-run driver who plowed into three bicyclists earlier this month; she’s scheduled to appear in court today.

In an exercise in sheer stupidity, a San Francisco man is arrested for stabbing another man to death in a dispute over a bicycle.

Police in Menlo Park are looking for a bike rider who whacked a driver in the head with his bike lock after throwing something at his car. Seriously, no matter how much you think someone might deserve it, don’t resort to violence. Ever. Period.

(Late) Morning Links: Griffith Park road under attack, more on Sunday’s CicLAvia, and stupid Scot cop tricks

LA doesn’t have many carfree places where people can walk and ride carefree.

And right now, one of the most popular ones is under attack.

I’m not going to mix words. Griffith Park is the greatest urban open space in the country.

Bar none.

While the park is filled with many attractions that would take days to frequent, the star is its natural beauty.

Many homes are blanketed across the Santa Monica Mountains, but Angelenos have been eternally blessed to be gifted this land that largely preserves its original character.

In what seems to be a move to placate those living below the Hollywood Sign, the Griffith Park Advisory Board is considering opening up Mount Hollywood Drive to vehicular traffic. I don’t have specifics, but cars would be allowed to travel and park close to the peak of the road.

While we already have examples of these traffic problems across the park, this move would pave the way for trams taking tourists up to the Hollywood sign, impacting yet another prized local resource.

Speaking as a cyclist, Griffith Park has the only paved accessway that climbs the hills of Los Angeles without the threat of vehicular traffic. The road is used by cyclists of every age, skill level and bike style.

To the many hikers and horse riders that also utilize the same paths, we share the same plight.

Not only does the addition of cars ruin this stretch for those that frequent it, but it would also add congestion to both stretches of Vermont and Western Canyon.

Please come to the Griffith Park Advisory Board Meeting this Thursday at 6:30pm at the Ranger Station on Crystal Springs & Fire Rd to show your support to preserve the nature of the park.

Griffith Park is our park. It should never be anything other than that.

There are very few places in this city that have been given over to people, rather than cars. Griffith Park needs to remain one of them.

Writing for HuffPo, Joel Epstein makes the point I’ve been trying to drive home — CicLAvia is good for business.

I was particularly impressed by the car dealer who handed out lip balm to passing riders, as well as the pet store employees who called out to ask people going by if they owned a dog or cat, then gave out pet-specific shopping bags to anyone who said yes.

Just two examples of smart marketing that will undoubtedly result in more sales later. Which beats the hell out of complaining about any possible negative impact on sales for a single day.

I was also impressed by an 80-something grandfather I met who rode to Studio City from Sylmar to meet his grandson to bike the full CicLAvia route, and planned to ride back home afterwards. Then again, he said he barely drives anymore, preferring to take his bike everywhere — despite, or perhaps because of, a hip and knee replacement.

I want to be like him when I grow up.

Note to press: ‪CicLAvia is not a bike festival, it is a human festival, open to all regardless of travel mode, as long as they leave their motors behind.

Somehow, Scotland cops manage to get it unbelievably wrong, as cyclist picks up a cup a littering driver had tossed out, and tosses it back into the man’s car.

The driver responded by getting out of his car and demanding to know if the rider wanted to fight.

So instead of citing the driver for littering or threatening the bicyclist, police naturally threaten to file assault charges against the cyclist for instigating the incident.

I’ve often wanted to do the same thing to jerks besmirching our planet.

Then again, I may, in my younger days, have politely attempted returned a lit cigarette or two to those who tossed one out of an open car window, inquiring if the driver had lost it.

The response was usually an embarrassed apology. Though on occasion, the reaction may have been an offer to break my face, which I invariably declined.

These days, it’s just not worth the aggravation.

But I’m glad someone, somewhere, picked where I may have left off.

Let’s just hope the local Scottish authorities manage to get their heads out of their collective posteriors and do the right thing.

Allow me a brief personal note.

When I returned home from Sunday’s CicLAvia, I received word that a woman I knew had died after a long and devastating battle with dementia.

The first time I met her, long before her disease took its toll, I observed a small, frail woman with a heavy accent and a number tattooed on her arm.

In an attempt to make casual conversation, I asked how she came to this country.

Instead of the brief answer I expected, I got a fascinating, hours-long recitation of a journey that began as a child in Hitler’s death camps, followed by a voyage to what was then British Palestine as part of the flotilla that included the Exodus. As a young woman, she carried — and used — a rifle in the fight for Israeli independence, knew the legendary Gold Meir on a first name basis, and founded a successful kibbutz before migrating to the US to raise a family.

The world is a poorer place today.

As this older generation slips away, we lose a measure of greatness our world may never see again. Or at least, let’s hope we never again see a time that demands such greatness.

My heart and prayers go out to her husband, children, grandchildren and great grandchildren, and all those who loved her.

Although I’d take the stats showing bike riders are at fault in most collisions with a big grain of salt, since determination of fault depends on the training and, too often, windshield biases of the investigators.

Few, if any, California police officers receive adequate training in investigating the unique properties of bicycle collisions, which differ greatly from motor vehicles. And not nearly enough officers have a working understanding of the actual rights and responsibilities of bike riders.

Today is election day in LA, as well as several surrounding communities.

I’d planned to write about the candidates running for the seat Tom LaBonge is vacating in Monday’s post, until the untimely death of Alex Baum — and yes, even at 92, he left us far too soon — took precedence.

So let me just offer an endorsement of sorts for the two candidates I’d most like to see make it into a runoff.

But let’s be clear on one thing first. I’m basing my choice strictly on those who bothered to respond to the LACBC’s candidate survey and participate in the recent Liveable Streets candidate forum.

Simply put, if a candidate doesn’t care enough to ask for our support, he or she doesn’t deserve it.

Of the 14 candidates in the race, only six meet both criteria. And of those, I prefer Tomas O’Grady and Carolyn Ramsay, with Sheila Irani coming in a not-so-distant third.

Either of those two would make a great choice; ideally, both will survive to compete against one another for the seat in the June general election, ensuring bicyclists will have a strong voice to replace a very weak one from the district in City Hall.

Meanwhile, the Times endorses Irani, while the Daily News picks O’Grady and Teddy Davis. And the LA Weekly calls the race total toss-up; with 14 candidates, the top two may only need a few thousand votes each to advance to the runoff.

As for the races in other districts, I’ve previously announced my unqualified endorsement of incumbent Jose Huizar in CD14.

A columnist for the San Francisco Chronicle says bike advocates are splitting hairs in opposition to SB 192, the bill that would mandate helmet use for all riders. Although someone should tell him that the law requiring helmets for minors, which he calls a success, is often blamed for why so few California children ride bikes, which is a major contributor to the obesity crisis in our youth.

The Daily News prints letters on both sides of the issue; once again, licensing people on bikes rears its ugly head even though it has nothing to do with the question at hand.

San Diego’s KPBS public radio station discusses both sides of the question, as well, while Santa Monica Spoke comes out in opposition to the bill. Digital Slurry echoes Copehangenize with a tongue-in-cheek call for walking helmets.

And if you still have any doubt whether the proposed helmet law is a bad idea, Streetsblog’s Melanie Curry nails it.

And if you’re drunk off your ass and get caught trying to take a shortcut through a fenced-off business lot, don’t ride salmon and crash into the police car trying to stop you from getting killed by riding into the path of a truck.

Morning Links: Gloria Molina wonders where all the poor cars will park, and KFI’s John and Ken go on the attack

It’s going to be a very interesting election year.

While my attention has been focused on the race to replace outgoing councilmember Tom LaBonge in CD4, bike-friendly councilmember Jose Huizar has been fighting for his political future in the face of a challenge from termed-out county commissioner Gloria “Where are we all going to park?” Molina.

That was her response to a recent debate question over development replacing parking lots in Downtown LA — even though DTLA already has more parking spaces per hectare than the downtown of any other major city on earth, according to UCLA parking meister Donald Shoup.

Oh, the poor cars.

While Huizar stood on his record as a champion of complete streets, Molina criticized his support of bike lanes, saying the community hadn’t been adequately consulted. That despite the extensive public meetings held in the multi-year process that lead to the adoption of the city’s 2010 bike plan.

Simply put, if anyone feels they weren’t adequately consulted, it’s because they didn’t care enough to get involved.

Evidently going after the afraid of change demographic, Molina complained about the increased density that has finally brought DTLA back to life after decades of decline. And has previously called for completion of the unneeded and largely unwanted 710 Freeway — which she later recanted after the forum, apparently after realizing most of the voters in the district oppose the project.

In effect, it was a debate over Huizar’s efforts to move forward to a more livable city based on complete streets, and Molina’s desire to turn back the clock to LA’s auto-centric past.

You can probably guess where I stand on the matter.

And yet the Times has inexplicably endorsed Molina; DTLA Rising’s Brigham Yen endorses Huizar.

Molina has also been endorsed by CD1 Council Member Gil Cedillo, singlehandedly responsible for killing the long planned, full funded and much needed road diet on North Figueroa.

Which should be the final nail in Molina’s coffin.

At least it is for me.

So if there’s any doubt, let me make it perfectly clear. Huizar has been one of the most effective members of the city council in recent years. And with the possible exception of Joe Buscaino, has done more to improve the quality of life in his district than any other councilmember.

Which is exactly what his constituents elected him for. And why he has my unqualified support in next month’s election.

Meanwhile, Bike the Vote LA has released a complete slate of endorsements for multiple candidates in races throughout the county.

And yes, Huizar is on the list, along with Nadine Diaz, who is also running in the district.

Streetsblog’s Damien Newton somehow managed to keep his cool when KFI shock jerks — excuse me, jocks — John and Ken repeatedly misrepresented the facts on bicycling and bike advocacy in LA. Then kept interrupting Newton to insist he was lying when he tried in vain to correct them.

You can listen to it here if you have the stomach for it.

Personally, I couldn’t take more than a few minutes; frankly, I have better things to do than listen to that kind of crap.

The problem is too many people don’t. Presumably, they believe the kind of kneejerk anti-bike, auto-centric misinformation — to put it kindly — John and Ken were trying to shove down Newton’s throat.

Joe Linton politely took them to task afterwards for incorrectly insisting that half of the roadway on some unnamed streets in Downtown LA had been given over to bicycles.

Of course, the thing to remember is that John and Ken, and other blowhard TV and radio hosts like them, are entertainers, not journalists.

Their job is to draw listeners and increase ratings for the station. And any controversy, real or imaged, helps do exactly that.

The truth has nothing to do with it.

More reaction to SB 192, the proposed legislation from Glendale State Senator Carol Liu that would make California the first state to require helmets for all bike riders, as well as requiring reflective high visibility clothing after dark.

CiclaValley says the law would place a financial burden onto bikes but only have a trace impact on safety, while Boyonabike says it’s not the bikes, the helmets or the hi-viz, it’s the cars, stupid.

San Francisco’s SFGate says a mandatory helmet law would deflect attention from more pressing road dangers, like all those dangerous streets and drivers.

And the Fresno Bee tries to have it both ways, saying Liu should look at incentives to encourage, rather than requiring, helmet use. But that cyclists need to clean up their act or a helmet law may be necessary, as if being forced to wear a helmet is somehow punishment for bad behavior.

If you’re not familiar with them, the Tuskegee Airmen were not only among the greatest heroes of World War II, but paved the way for the Civil Rights Era by proving they were as good, if not better, than anyone else in the air. On either side.

My dad, who fought in both Europe and the Pacific, always wanted to meet one of them so he could thank him for the job they did in the face of incredible racial injustice.

If I get the chance on May 15th, I’m going to do it for him.
