Blaming the victims in OC — bad behavior isn’t behind the high rate of bike deaths

You might recall that earlier this week, I linked to a column in the Orange County Register.

A writer for the Orange County Register joins with the OC Wheelmen to challenge other bike clubs to enforce safety rules for their members.

I have to admit, the story bothered me.

In it David Whiting joined with a couple of local OC cycling organizations to call for strict observance of all traffic laws, with riders who don’t risking banishment from the club. And suggested a prohibition against riding side-by-side, even though that’s legal in California — and explicitly allowed under chapter 11-1206 of the Universal Vehicle Code.

Obeying red lights is probably not the deal breaker. But stop signs? As a cyclist, I know many of us figure they don’t apply to us. Wrong.

And single-file pelotons? You might be muttering, “Not going to happen.”

As one man said Wednesday night, cyclists are more visible and safer when riding in a pack. And I might agree.

But I’m also looking at it from a driver’s perspective. Not only do packs block streets, they scare the bejeebers out of drivers.

Simply put, cyclists need to extend courtesy to drivers whenever possible. Swarming a road is not the way.

The reason for that club-level crackdown is to keep cyclists alive, noting that 80 cyclists have died in Orange County over the last 5 years — seven this year alone.

It’s an admirable goal.

Personally, I support anything that will make our chosen form of transportation/recreation safer while supporting our right to the road. And I have no problem with enforcing traffic laws, as long as authorities target dangerous behavior regardless of who commits the violation, and don’t single out cyclists for selective enforcement.

I also recognize that this could go a long way towards improving the image problem cyclists have with the driving public, many of whom see us as reckless scofflaws who needlessly flaunt traffic regulations.

Unlike all those drivers who never speed, text while driving or fail to come to a full stop at red lights and stop signs, of course. And each of whom are no doubt fully versed on the rights of cyclists, and gladly give us the road space to which we’re legally entitled.

I had other things to deal with, though — not the least of which is a bad back that’s kept me off my bike and wacked out on muscle relaxants most of the week.

Not to worry, though. It only hurts when I move.

Or breathe.

But the story continued to lurk in the back of my drug addled mind, until Richard Masoner, author of the excellent Cyclelicious, emailed me yesterday to ask the same question that had been eating at me.

Just how many of those recent deaths resulted from club rides or cyclists blowing through stop signals or riding two abreast?

So I stopped what I was doing, cleared my head, and dug through my files for every OC bike death I could find dating back to December of last year. The results didn’t surprise me, though they might surprise Mr. Whiting.

  • Dan Crain died in August, hit by a car merging at high speed at what appears to be a poorly designed intersection.
  • Michael William Nine died in July while on a club ride; but rather than “swarming the road,” he was leading the group downhill when a gardener’s truck pulled out in front of him on the wrong side of the street.
  • Alan Earl Miller died in May when a driver drifted off the road and struck him while he was riding on the shoulder of the roadway.
  • Annette Ferrin-Rodgers died in April when she was hit by a bus while riding in a crosswalk with no lights on her bike.
  • Jeffery Blum died in March after lingering in a coma since 2007, following a collision in which the driver who hit him — the only witness — blamed Blum for swerving in front of him.
  • Donald Murphy was killed in December when a woman high on prescription meds ran him down as he was riding single file with other riders on the shoulder of the road.
  • Nine-year old Nicolas Vela was killed in December when he was crossing in the crosswalk in front of a monster truck whose driver was too high up to see the kid on a bike directly in front of him.

That’s seven deaths in nine months — none of which involved cyclists running red lights or stop signs, or riding two or more abreast. And only two involving multiple riders or club rides.

I also found three other bike collisions I’d mentioned since last December.

  • An unnamed 16-year old rider was critically injured in March while riding across a Santa Ana street.
  • Patrick Shannon was killed in April, 2009 when he was struck from behind by a hit-and-run driver while riding home from work.
  • Fourteen-year old Danny Oates was killed in August, 2007 by a driver high on drugs who was also texting at the time of the crash.

If you see any collision on that list that could have been prevented by observing stop signals or riding single file, you’re doing better than me. And only three — Blum, Ferrin-Rodgers and the unnamed 16-year old — could arguably be blamed on the cyclist.

And that my problem with Whiting’s plan.

While I have no doubt his heart is in the right place, it sounds like another case of saying we have to clean up our act so drivers won’t kill us, rather than placing the blame squarely where it belongs — on dangerous drivers, bad infrastructure and lax enforcement.

And dangerously customized trucks that prevent drivers from seeing bike riding kids right in front of their bumpers.

As Masoner wrote,

I’m sure the monster truck driver was terrified of the little nine year old he crushed on the road.

I’m a big believer in being responsible for my own safety. There are certainly actions we can take to reduce the risk of crashing and dying. We as cyclists should be courteous, and we should share the road by riding legally, but pelotons of cyclists hogging the road and blowing stop signs is not a bike safety issue in Orange County or anywhere else. Will single file riding do anything to prevent cyclist fatalities in Orange County? Should a bike club really suspend membership for rolling a stop sign, which is something that 97% of motorists are also guilty of? Can we also call on the AAA to suspend benefits for their members who are observed violating the rules of the road and not exercising common courtesy on the road?

Whiting promises a Phase II that will focus on driver safety. I’ll look forward to seeing it.

In the meantime, though, let’s agree that cyclists should ride safely and observe the law.

But stop blaming the victims.

And stop pretending that it’s the behavior of bicyclists that puts us at risk.

Cop tells seniors not to ride in the street — then tickets them for riding on the sidewalk

Sometimes, it seems like you can’t ride anywhere.

According to the Orange County Register, four OC senior citizens were stopped by a police officer for riding on the sidewalk — just moments after the same officer warned them not to ride in the street.

As they rode along a restaurant-filled section of PCH, the four riders passed a motorcycle cop as he finished writing a ticket, and made a comment about the busy street. The officer responded by saying he wouldn’t ride there, so they took to the sidewalk — legally, as shown by a sign indicating that the sidewalk was a designated bike route.

So imagine their surprise when the same officer roared up a few blocks later, lights and siren blaring, and — incorrectly — told them that riding on the sidewalk is against the law in California. He specifically pointed to CA Code 12.56.30 (A) NBMC, which doesn’t seem to exist in the Vehicle Code.

In fact, the only California Code I could find by that number is one that assigns responsibility for the unauthorized release of hazardous materials.

Maybe he just scared the crap out of them.

Oddly, only two of the cyclists were cited by the officer, while the other two — who apparently committed the same infraction — were let go.

As it turns out, the cyclists were technically in violation of the law because riding on the sidewalk is allowed next to PCH before Riverside Ave, but banned immediately after crossing the street — even though there’s no sign indicating that the bike route ends or that riders must leave the sidewalk.

Amazingly, Lt. Bill Harford of the Newport Beach Police Department defends the officer.

“The officer did cite them appropriately, and they need to go through the process,” Hartford said. “They’ll have their day in court — that’s the purpose of it. It’s up to the judge to look at the circumstances and make a decision.”

It seems far more likely that the department owes them an apology, and should do everything in their power to get the tickets dismissed. They should also work with the city to get proper signage installed instructing riders to leave the sidewalk once the bike route ends.

And a little common sense wouldn’t hurt. Because the police can observe the letter of the law.

And still be very, very wrong.

Update: I may have been overly harsh in my criticism of the officer who wrote the ticket. TC points out in the comments below that the code he cited is part of the Newport Beach municipal code, rather than state law. We don’t have the actual ticket for reference, so there’s no way to know if the officer actually said it was a violation of state law, or if the riders misunderstood him or inferred he was referring to state law.

As a result, I’ve toned down some of my comments, and apologize for my earlier criticism that the officer involved was ignorant of the law.

However, I still believe that a warning would have been appropriate under the circumstances. Most cyclists aren’t familiar enough with local ordinances to know where they can and can’t ride on the sidewalk, and it’s virtually impossible for cyclists to know when they’ve moved from one area where it’s allowed to another where it’s banned without adequate signage, particularly after having just passed a sign saying it was legal.

Meanwhile, LADOT Bike Blog continues its excellent examination of local sidewalk riding ordinances; maybe they’ll go south of the Orange Curtain and take a look at those wacky folks in Newport Beach.

And Gary points out that if Santa Monica wants to ban bikes from the sidewalk, they should defend cyclists who ride in the street.

A British law firm wants to increase the understanding between cyclists and truck drivers; how’s this for an understanding — just don’t kill us, okay?

Another OC cyclist killed, another giant yawn from the local press

One hundred words.

That all the life of an Orange County cyclist was worth today.

Allen Earl Miller, a 55-year old cyclist from Costa Mesa, was riding north on Temescal Canyon Road south of Indian Truck Trail between Corona and Lake Elsinore around 2:40 yesterday afternoon when a Ford SUV driven by Scott Reis drifted off the road for unknown reasons and struck him from behind; Miller died at the scene.

According to the Orange County Register, which offered the best coverage, no one has been arrested; the CHP is still investigating. Neither of the people in the truck were injured.

It took the Register exactly 100 words to tell the story, not counting the headline. The sum total of a life, nothing more than name, age and cause of death.

A story so insignificant, it didn’t make the first 10 pages of news stories in a Google search last night or again this morning. And didn’t even make the news at all just a few miles north in L.A. — then again, neither did the tragic death of Jorge Alvarado.

It’s only another death on the roads.

Only another cyclist killed.

Chances are, I still wouldn’t have know about Miller’s death if the Claremont Cyclist hadn’t picked up the story.

I cringed when I saw the image of the Ghost Bike on his site, because it meant another cyclist had died. And I hope Michael will forgive me for quoting liberally from his post. But he has something important to say.

Explain to me again how someone just drifts “off the road for an unknown reason”….  I do not think I will ever understand why there is not more widespread outrage over these incidents. Just because a cyclist has lost his life, does not mean this is solely a cycling concern – it is a societal concern. This driver could just as easily have drifted the other direction for an unknown reason, hitting a car head on instead. Indeed most crashes involving cars are with other cars, not bikes, not pedestrians. Getting and keeping people who cannot, or will not, take driving seriously off the roads benefits everyone, not just cyclists.

Finally, the Mounties always get their man — even if it’s just for riding without a helmet.

16-year old Orange County cyclist critically injured

This hasn’t been a good weekend for teenage cyclists in Southern California.

Just two days after a Pacoima rider was shot in an apparent gang-related attack, a 16-year old Orange County cyclist was critically injured after a collision with a car in Santa Ana Sunday afternoon. According to the Orange County Register, the cyclist was riding across Lacy Street between Fifth Street and Santa Ana Blvd when he collided with a vehicle traveling north on Lacy — the story subtly assigns blame to the cyclist while noting the accident is still under investigation.

Meanwhile, Gustavo Arellano of the Orange County Weekly, author of the popular Ask A Mexican column, was on the scene to witness the aftermath of the collision.

Arelleno said that the car hit the rider — rather than the other way around — with enough force to shatter the windshield, leaving a massive dent in the vehicle and breaking the bicycle in two. While no blood was visible, Arelleno did not see the rider move his hands or legs, and says “the teen’s tortured gasps for air were a sound I hope to never hear again.”

He credits police and fire personnel for arriving on the scene within minutes of the 1pm collision, and places blame on the conflict between the city’s “ambitious plans to remake its downtown core and the head-in-the-sand approach to the area’s actual needs.”

“This is already a neighborhood that’s way overcrowded,” said a lady who identified herself only as Yuri. She had no idea of the city’s plans for her neighborhood, which include squeezing in high-rise apartments. “We need parks, not more buildings–there’s already too many apartments! With more people and more cars on these small streets, there’s going to be more accidents!”

A Georgia insurance executive says bike riders face risks on the road, and there’s not much consolation in saying “it wasn’t my fault.” A 60-something cyclist in my home town is critically injured in a collision; no information on his name, direction or travel, whether the driver was distracted, wearing a seatbelt or whether charges might be filed. An 11-year old Iowa cyclist is critically injured in a hit-and-run; police say the driver may not even know she hit anything. Cell phone use while driving is even more dangerous than previously thought. Over 2300 riders roll the roads of New Zealand, despite warnings from police. Brisbane’s shared bike/pedestrian paths turn into danger zones as both users compete for space. Will a better water bottle holder revolutionize cycling? A 19-year old Brit cyclist hopes to raise £1 million to thank a hospital for saving his life. Instead of charging cyclists to use the roads, we should get tax cuts and the thanks of motorists.

Finally, a writer claims that most cars carrying two or more passengers have a smaller carbon footprint than the average man on a bike.

Bike counts, toy rides, another near-fatal OC hit-and-run

Let’s get the bad news out of the way first.

Donald Murphy of Irvine was critically injured in yet another hit-and-run around 6 am Wednesday while riding in the northbound bike lane on Jamboree Road near the intersection with Ford Road in Irvine. According to police, a driver indentified as Patricia Ann Izquieta entered the bike lane he was riding in while making an “unsafe turning maneuver,” striking him and leaving a 300-yard pattern of debris.

That’s three football fields of bike parts strewn along the roadway from the bicycle trapped under her car as she fled the scene.

Izquieta was stopped by police a few blocks later with damage to the windshield and front undercarriage of her car, and is being held in Orange County Jail on $50,000 bond. Police reports indicate that she was not on a cell phone and alcohol does not appear to be a factor.

Witnesses said Murphy was wearing a helmet and riding in a safe and legal manner when struck. A passing driver stopped to give CPR along with one of his riding partners

Murphy was transported to Western Medical Center ­– Santa Ana. The Orange County Register quotes Lt. Rob Morton of the Newport Beach Police as saying “He’s in pretty bad shape.”

Update: Today’s OC Register reports that Murphy died at Western Medical Center on Thursday; there was no comment from the family. My deepest condolences to his family and loved ones.

The LACBC finally has preliminary results from the city’s first bike count.

What I find interesting is that only 12% of the riders were female — less than the number of children counted — while 54% of riders weren’t wearing a helmet, 38% were on the sidewalk, and 6% were riding the wrong way.

They also offer an LACBC-centric report on Wednesday’s semi-bike-only Transportation Committee meeting.

There’s no shortage of big hearts in biking community.

But I never fail to be impressed by gull rescuer and stray dog wrangler Will Campbell — although his odd attachment to ‘Bama football does make me wonder sometimes. So I wasn’t surprised to learn that the Midnight Ridazz All-City Toy Ride was his idea, though he gives much of the credit for organizing the first ride to Ridazz co-founder Roadblock.

The ride kicks off tonight — appropriately enough on the first night of Channukah — from various points throughout the city, converging on the Plaza Gazebo on Olvera Street around 10 pm. Riders are asked to bring an unwrapped toy valued at $5 to $25 dollars for free admission to the after party; toys will be donated to the East L.A. Women’s Center.

Recently I included a link to the excellent Bike San Diego website, for a story about a cyclist who was ticketed for passing a short row of stopped vehicles on the left, even though that is not prohibited under California law.

The judge upheld the ticket, convicting Andrew Woolley for violating CVC 21202, despite the fact that his actions were explicitly allowed under the statute. According to the judge, the exceptions allowed under 21202 did not apply, since the speed limit on the road is 35 mph, which he determined was the normal speed of traffic — even though 21202 specifically refers to the speed of traffic “moving in the same direction at that time.”

Writing on Bob Mioske’s website, Rick Bernardi offers a great examination of exactly why the judge was in error, while noting that it sometimes doesn’t make any difference if the law is on your side. And contrasts it with a Utah case, in which a cyclist was cited for doing exactly what the judge in the Woolley case said he should have done.

So let me see if I’ve got this right. You can’t pass on the right, and you can’t pass on the left. Or maybe you’re required to break the law one way in Utah, and another in California. Or the judge is allowed to misapply the law one way in one state, and another in the other.

Damned if you do, damned if you don’t.
