Update: Bike rider fatally shot in South L.A.; 15-year Santa Clarita rider critically injured in Wednesday collision

LAist is reporting that a bike rider was shot and killed in South L.A. yesterday.

Thirty-year old Darnell Charles was riding near the intersection of Menlo Avenue and Imperial Highway around 3:20 pm Wednesday when a car pulled up next to him. After exchanging words, the driver pulled out a gun and fired before speeding off.

No word on exactly what street Charles was on, or what was said. It’s possible it was a road rage case; however, it’s more likely that the shooting was gang related or that the driver and victim knew one another.

The fact that police know words were exchanged suggests that there may have been at least one witness to the shooting.

He was the first bike rider to be fatally shot in Southern California this year; it’s highly unlikely that he’ll be the last.

Update: The Daily Breeze adds more details to the story, identifying Charles as a former star football player for Leuzinger High School. 

According to the paper, the gunman got out of his vehicle and walked up to Charles before shooting him multiple times in the upper body, then fleeing in his car. Charles was transported to a hospital where he died at 4:50 pm.

The victim, who worked as a security guard, leaves behind a son. Police confirm that they suspect the attack was gang related. 

That does not necessarily mean Charles was a gang member, however; it suggests that the shooter is suspected of having gang affiliations, whether or not his victim did.

As I note in the comments below, the overwhelming majority of fatal shootings involving cyclists are gang related. Of the 17 SoCal shooting deaths since the beginning of 2011, gang involvement was confirmed or suspected in all but two.

Until we as a society decide it’s time to put a stop gun and gang violence, people will continue to fall victim to bullets on our streets. 

Some of them will be on bikes.

In other news, a 15-year bike rider suffered life-threatening injuries in a collision with an SUV in Santa Clarita yesterday.

The rider, who has not been publicly identified, was struck by a vehicle driven by a 17-year old motorist around 5:30 pm Wednesday at the intersection of Fairview and Waterford Drives. Again, no information on how the collision may have occurred.

News stories note that the victim was not wearing a helmet; however, they don’t say whether he suffered head injuries, or if a helmet might have made any difference.

Two years for a fatal SD hit-and-run, and kneejerk NIMBYism rises in opposition to Westwood bike lanes

Two years in prison for Jin Hyuk Byun for the fatal hit-and-run collision that took the life of 18-year Angel Bojorquez in Rancho Santa Fe last year.

Police say Bojorquez was wearing reflective clothing and should have been highly visible as he rode his bike home from work for the first time, while Byun initially claimed his badly damaged truck hadn’t been driven recently, then claimed he thought he’d hit a mailbox, a deer or a dog.

Yeah, no point in stopping to find out, right?

Kneejerk NIMBYism strikes again, as anti-bike forces are urged to attend tonight’s Westwood Neighborhood Council meeting to fight proposed bike lanes on Westwood.

We love cycling and want to create a bike network on the Westside, but anyone who walks or drives down Westwood between Pico and Santa Monica knows that taking out lanes, or parking, or creating a bus/bike transit lane (that was vigorously opposed on Wilshire) will necessarily reduce lanes, and motorists will “peel off” onto the residential streets to find the path of least resistance.  This will not work for the community, for the businesses, or for the safety of cyclists.

In short, Westwood Blvd. simply can’t handle this proposal, and even the local cyclists find the proposal unworkable.

Actually, this local cyclist — and virtually every other rider I’ve discussed it with — finds the project not only workable, but necessary in anticipation of the coming Westwood Blvd Expo Line station.

Much of Westwood is already unworkable — and pretty much unrideable — in its current configuration, with a high level of congestion through most of the day. The only real solution is to provide a safe, workable alternative to encourage drivers to leave their leave their cars behind for short trips, as well as offering a much needed connection between the Expo Line and UCLA.

If you don’t have other obligations — and frankly, I don’t understand the logic of anyone hosting an important meeting on Valentines Day, forcing them to choose between their relationship and their safety on the streets — maybe you can stop by and argue against the insanity of maintaining the status quo.

Especially if you were one of the 150+ riders who took part in last weekend’s Ride Westwood.

Update: Flying Pigeon‘s Josef Bray-Ali makes the point that no traffic or parking lanes are actually being removed; they’re being repurposed from automotive to bicycle use, since bikes are still a form of transportation. 

The key is that streets serve to move people, not motor vehicles.

I’ve heard from people accusing current State Senator and CD 1 council candidate Gil Cedillo of lying at Sunday’s candidate forum co-sponsored by the LACBC.

Cedillo is accused of misrepresenting his ties to Chevron, as well as why he failed to vote for landmark legislation regulating pollution that causes global warming.

Streetsblog’s Damien Newton has done his typically great job of looking at all sides of the issue, including talking to the candidate himself. If you live in CD 1, you owe it to yourself to read the story, and decide for yourself if Cedillo whether being honest with you.

I don’t know where the truth lies in this case.

But the last thing L.A. needs is another truth-challenged city leader.

Just Another Cyclist lists the cast of characters who inevitably show up in threads for such stories. Meanwhile, others reverse the dynamic by converting cars to bikes.

Big surprise — ex-LAPD cop killer doesn’t like bikes, either; big silence from Santa Monica’s Big Blue Bus

You knew there had to be a bicycling connection in there somewhere.

Here in L.A., local news reports have been commandeered by the manhunt for Chris Dorner, the former LAPD officer who allegedly murdered three people in a bizarre attempt at getting justice for his firing.

Note to anyone considering a similarly unhinged rampage in an attempt to set the record straight: It won’t work. All it will do is convince the world that you’re crazy, and that they were right all along.

In an attempt to justify his actions, Dorner posted a rambling online manifesto (trust me, you’re better off with the Cliff Notes version) in which he professes his support for Tim Tebow, Charlie Sheen, Dave Brubeck’s Take Five and Michelle Obama’s bangs. Not to mention his love and admiration for a long list of female performers, and his thanks to unnamed individuals for some great and not-so-great sex over the years.

Oh, and a list of those deserving of death at his hands.

But surely, anything that long and convoluted has to mention bikes somewhere, right?

Dorner does not disappoint.

Near the end of his meandering philippic, he vents his spleen on those of us who take to two wheels.

Cyclist, I have no problem sharing the road with you. But, at least go the fucking speed limit posted or get off the road!!! That is a feasible request. Livestrong you fraudulent assholes.

How surprising that a former cop wouldn’t understand our right to the road. Then again, he was fired before the LAPD released its groundbreaking bike training video for its officers.

I guess we should just be glad that we didn’t make it onto his high-value target list.

But he’s not completely irrational. He does call for a ban on assault weapons and high-capacity ammo clips.

You know, to keep them out of the hands of people like him.

And Streetsblog notes that coverage of the story shows the need for a separated bike lane in front of LAPD headquarters.

Still no follow-up from Santa Monica’s Big Blue Bus about the complaint I filed this week, following Monday’s close call in which I found myself sharing a bike lane with a speeding bus.

Despite leaving my phone number when I filed the complaint, as well as leaving it on the voice mail of their head of security, I’ve heard absolutely nothing from them. Which is even more disturbing since the woman I spoke with refused to view my video of the incident or take down a link to the video, saying they have their own cameras on every bus.

Maybe so.

But they don’t have anything that shows it from the perspective of a bike rider who came less than two feet from getting run down by a driver who should never have come close to the bike lane. Let alone passed me with two wheels inside it.

Kind of makes me wonder if they just don’t give a damn.

But we’ll see.

The 15th annual Tour de Palm Springs rolls this Saturday. A cyclist is injured in a collision on the Coast Highway in Corona del Mar, but apparently not badly. San Diego commits to making the city safer for cyclists; considering the high speed virtual highways that pass for surface streets, they have a long way to go. San Luis Obispo students conduct a mock trial in a fake hit-and-run case that left an imaginary cyclist injured. Yes, it’s illegal to run over a cyclist, no matter how much he or she may annoy you; you’d probably get away with it, though. San Francisco cab drivers are learning to make room for bikes. Forget road diets, the goal is now right-sizing streets to create great public spaces. Oh how the mighty have fallen, as Lance is now the most hated athlete in America. Can Seattle have a successful bike share program with a mandatory helmet law? Denver offers cyclists a separated bike lane complete with bike boxes, green mixing zones and a special signal giving riders a head start on vehicular traffic at a dangerous intersection, yet local bike advocates say it’s not good enough; someone should tell them not to let the perfect be the enemy of the pretty damn effing fantastic. Even tiny Hays Kansas — population 21,000 — is getting a bike-friendly makeover. Des Moines plans to make the bikeable city even better. Bikes may use full lane, except in New York. A Louisiana driver kills a 14-year old cyclist while drunk, and a grand jury concludes it’s no big deal. Maryland cyclists oppose a proposed mandatory helmet law.

Uruguay tries to cut violence by trading bikes for guns. Evidently, life is cheap in London, as a driver gets a six month suspended sentence for carelessly killing a cyclist, but at least he won’t be able to legally drive for the next three years; on the other hand, his victim won’t ever drive again. A rising young British cyclist was killed after losing control and crashing into a stone pillar at 40 mph at a dangerous corner, which should have been fixed long before someone got killed. A UK truck driver attempted to delete the texts he was sending when he killed a 13-year old bike rider. Cycling deaths and serious injuries are headed the wrong way in the UK. A lawyer says a new bike superhighway could make things more dangerous for British riders. Current Tour de France champ Bradley Wiggins is voted Britain’s funniest celebrity. It’s hard to obey the cycling restrictions if you can figure out what the hell they are. Can Scotland copy the Netherlands success in cycling; then again, can anyone? Speaking of the Netherlands, the risk of death for Dutch riders over 80 is 80 times higher than for younger riders. A Kenyan pick-up driver disappears after a bike is crashed beyond repair in a collision; unfortunately, so was the person riding it. Whole lot of linking going on — a hit-and-run presser, charges in SD, a bike celebration in Santa Monica

L.A. authorities plan a press conference this Thursday to announce a person of interest in the hit-and-run death of bike rider Sergio Rodriguez last December.

Meanwhile, news finally comes out that San Diego is pursuing a vehicular manslaughter charge against Francis Henry Zegler, the driver who killed cyclist Chuck Gilbreth last April. The question is why it took a Freedom of Information request to learn that charges were filed last August.

Doesn’t the public have a right to know — especially in cases like this where there’s a genuine demand for justice within the cycling community?

So much for open government in our neighbor to the south.

Friends remember former surfer Jonathan Koontz, the homeless man killed in collision with another rider while riding or walking his bike on the Santa Ana River Trail last December.

The fact that he was homeless does not make this case any less tragic; that such a well-loved and promising person ended up on the streets just adds to the pathos.

Los Angeles approves the planned expansion of Universal Studios, which now includes a commitment to build a park and bike/pedestrian path, presumably an extension of the L.A. River bike path. Santa Monica plans to cut traffic by reducing parking. Will Campbell says Pasadena and Glendale have left Los Angeles in the bicycling dust. CLR Effect has a frightening story of a rider ignoring the warning signs of a heart attack until it was too late — and struck in the middle of a crit.

Cycling Unbound says better enforcement of traffic laws is a myth; sort of like the NRA’s argument that better enforcement of current laws is the sole solution to gun violence. Despite a highly concerned cycling community following the deaths of two bicyclists last year, the Newport Beach Bicycle Safety Committee is on hold while the city works to get its shit together renew its charter. People take precedence over cars in new plans for Solano Beach. Being blind doesn’t mean giving up bike racing — evidently, neither does heart surgery, kidney and pancreas transplants, broken bones or an amputated toe. Bay Area cyclists are looking forward to riding just halfway across the new Bay Bridge.

Bicycling says Cannondales’ Peter Sagan could be the new Eddy Merckx; how about just letting him be the first Peter Sagan? Under the heading of who really gives a rat’s ass, banned ex-Tour de France champion Lance Armstrong is told he can keep using Strava; no, seriously, I don’t give a whit. MSNBC host Chris Hayes joins the not-so-exclusive club of bike theft victims. A whopping 182 days in jail for a New Mexico man who killed a cross-country cyclist in 2010 while most likely drunk; he seems a little confused about which one was the victim but didn’t break the law by posting a hate-filled tantrum on his Facebook page. Denver man charged in the hit-and-run death of a cyclist walking his bike in the crosswalk tries to hang his own brother out to dry. Those Mormon missionaries aren’t any safer on their bikes than anyone else. Despite weather problems, last weekend’s world cyclocross championships were a success. As the world of Greg LeMond turns, he suffered a serious back injury after losing consciousness and crashing his car, he’s starting a new company focused on his indoor trainer, and still wants to run the International Cycling Union; not like it’s starting to seem like a soap opera or anything. Some people just don’t get it, as a DC area driver complains about law breaking cyclists — and the ticket he got for going nearly 50% over the speed limit. Shocking news, as a North Carolina cyclist rides a whole six miles — each way! — to school every day; yes, the boy should be applauded, but if our society had its priorities right, it wouldn’t be that big a deal. Yes, people like this really do drive among us. New Orleans bike lane more than triples the number of cyclists using the street. A Florida man is ticketed for riding he wrong way on a one-way street and failure to come to a complete stop, as an over-zealous deputy cracks down on the first-time rider in front of his own house. On the other hand, no hint of favoritism here, as Florida troopers fail to cite a truck driver they know for the death of a cyclist last September. A Myrtle Beach cyclist is punched with brass knuckles as he’s riding for no apparent reason.

An international adventurer concludes it’s better to bike 35,000 miles than walk 3,500. New cars could soon feature airbags to protect cyclists and pedestrians, or drivers could just, you know, stop running into us; thanks to Patrick Pascal for the heads-up. Buenos Aires builds new bike lanes in a bid for the 2018 Youth Olympic Games. An Ottawa driver pleads guilty to running down a cyclist while probably very intoxicated, in front of police officers, moments after hitting several cars in a parking lot, with coke and oxycodone in the car. Make it safer for Brits to bike, and they will, but if ideas for better cycling infrastructure are ignored, nothing will change. Truckers consider changing delivery times in London to cut back on killing cyclists. A UK man loses his memory of his entire life and family following a cycling collision. Pro cyclist Johnny Hoogerland — the rider who won a worldwide following for continuing to ride after crashing through barbed wire — is seriously injured when he’s hit by a car while training in Spain. Drivers turn a new Dubai bikeway into a high speed raceway for overpowered cars. An angry Aussie driver hits a cyclist with a wooden pole, then goes back to his car and tries to run the rider over. A bizarre Australian study concludes that cyclists without helmets are more likely to ride drunk; a more reasonable interpretation of the data might lead to the conclusion that people who take risks are more likely to take risks. An Aussie father dealt drugs to fund his late cyclist son’s riding career; now the son’s home may be seized because it was purchased with drug money. Tokyo police plan to crack down on cyclists rather than the drivers who hit them. An artistic attempt to discourage Japanese cyclists from parking on the sidewalk. Shockingly, some cyclists break the rules, even in Singapore.

Finally, no, just no. And it’s technically illegal for women to wear pants in France unless holding handlebars or horse’s reins.

Two sides to every anti-bike story — maybe we’re not two-wheeled pack-riding psychopaths after all

If it seems like there must be more to the story, there usually is.

Take this one from Woodside, near Palo Alto, in which a motorist reported to the police that a group of about 50 cyclists surrounded his vehicle after he had passed them, punching and kicking his window and mirror. And evidently, for no apparent reason.

Those crazy cyclists.

Fortunately, Richard Masoner of Cyclelicious was as curious about the cryptic story as I was, and dug a little deeper to get the answers.

And found them on the discussion list of the Bay Area’s Alto Velo cycling group, where witnesses reported that the driver of a full-size Dodge Ram diesel pickup truck had deliberately brake-checked riders and run them off the road, blown diesel soot into their faces, and run stop signs to get away from them.

After passing one large group of cyclists, he got out of his truck to start something — then quickly got back in when he realized he was outnumbered by something like 50 to one.

Then called the police to report the altercation he started.

Which is kind of like a bank robber calling police to say the security guard was rude to him while he was making of with the contents of the vault.

Unfortunately, unless someone managed to capture his actions on video, it’s likely to end up as just another case of he said, she said, as police are usually reluctant to dig any further to get to the truth in a situation like this.

Which means a dangerous, aggressive and violent driver is likely to remain on the roads to threaten someone else’s life another day.

That’s not to say the riders are automatically blameless. Maybe one or more of the cyclists said or did something to provoke his wrath.

Like occupy space on his planet, for instance.

But nothing short of brandishing an automatic weapon — or maybe a small rocket launcher — would be equivalent to attacking a group of riders with a multi-ton truck.

California bike advocates are asking our governor to step up his support for biking and walking, which has been somewhat lacking up to this point. Calbike sets a bold agenda for 2013. The 2nd Orange County Bicycle Film Festival screens at the end of February. Bike lanes and sharrows should be coming soon to the Coast Highway following a unanimous vote by the Encinitas City Council. Cyclists give Caltrans a June 1 deadline to fix a botched repaving job on PCH above Cambria. Santa Cruz police bust five bike thieves in a single week — one of whom stole a bike as he was leaving jail on another charge. UCSF offers a mini-course on the Medicine of Cycling. The owner of women’s pro Team TIBCO was seriously injured in a left cross collision last weekend.

Not surprisingly, people who bike or walk to work enjoy their commute more. Sometimes your legs come around, sometimes they don’t; either way, you usually get where you’re going. A New Mexico truck driver loses control, hears a thump and drives off, leaving an injured cyclist in his wake; no point in stopping to see what he hit, right? Aspen considers a 14 mph speed limit. Somehow, a Topeka driver manages to hit a salmon cyclist traveling in the same direction on the opposite side of the road. When you’re riding around the world, take a pass on El Paso. What good are bike lanes if Dallas motorists drive all over them? LSU police are ticketing cyclists in response to a whopping 27 bike and/or pedestrian collisions last year — and evidently, ignoring the other 587 collisions that didn’t involve either. A passing hero on a bike saves a Boston-area girl from drowning. Over 15,000 cyclists and pedestrians were injured in New York traffic last year, with 155 killed. Brooklyn businesses are up in arms over the loss of a single — yes, one — parking space to make room for a bike corral; if the success of your business depends on a single parking space, your problems go way beyond parking. Before you try to steal a bike, make sure you know how to ride it. A ban on U-turns across DC’s Pennsylvania Ave bike lanes suggests authorities are taking bike safety seriously. The DMV gets it right, a killer hit-and-run driver may get what’s coming, and your Monday morning links

Over the years, I’ve seen a lot of publications from the DMV about bicycling and sharing the road with cyclists.

But this is the first one I’ve seen that really gets it right — even if it is a tad light on instructions for motorists.

It even answers the question the LAPD has struggled with for the past year, explaining that bike riders can, in fact, ride in the crosswalk. Although it doesn’t say anything about whether riders have to cross with traffic, or if crosswalks are bi-directional for cyclists just as they are for pedestrians.

A preliminary hearing is scheduled Monday for Jason Cox, charged with gross vehicular manslaughter while intoxicated and hit-and-run resulting in death or injury for the death of cyclist Michael Vega in Rancho Cucamonga last August.

Unfortunately, this case will be held in Bernardino County, where the lives of cyclists seem to have little value.

Bike harassment caught on video, a small step to fight hit-and-run and a long list of links and events

The state legislature is about to consider its first, small step to halt the epidemic of hit-and-runs.

Burbank state Assembly Member Mike Gatto has introduced a bill to increase the statute of limitations for drivers who flee the scene of a collision.

Currently, the limit expires three years from the date of the collision, after which the driver is free to publicly confess his or her crime without fear of prosecution. Gatto’s bill would allow prosecution within three years of the collision, or one year after the suspect is identified by law enforcement, whichever is later.

It’s a step in the right direction, if only a small one.

It won’t do anything to encourage police to pursue more hit-and-runs where the victim isn’t killed or seriously injured, or for prosecutors to file charges in such cases. And it won’t do much to encourage drivers to resist the impulse to run like cowards to avoid responsibility for their actions.

But it’s a start.

Just like the city council’s fledging attempts to look into the epidemic.

If this had happened in Los Angeles, it would have been the perfect test case for the city’s bicyclist anti-harassment ordinance. Instead, it will be up to Santa Monica authorities to determine if a chargeable crime took place.

Flying Pigeon isn’t the only group hosting brewery rides these days, as Brewcyclers provides a beer doubleheader with a ride to Brew-Ligion Brewhouse and Aftershock Brewing Co on Sunday, February 17th. The 30 mile loop kicks off at Brew-Ligion, 39809 Avenida Acacias in Murrieta at 8:30 am, rolling at 9 am.

If you’re as tired of cyclists and pedestrians being left to bleed in the streets as I am, mark your calendar for Tuesday, February 19th when the LAPD reports back to the Police Commission on hit-and-run stats requested by the city council; the meetings usually take place at 9:30 am at the new, officially unnamed police headquarters across from City Hall at 1st and Main.

Stand up for bike lanes on the Westside as L.A. Planning and LADOT host the West Area Bike Lanes Public Hearing on Tuesday, February 19th from 6 pm to 8:30 pm at the Medina Parking Enforcement Office, 11214 W. Exposition Blvd at Sepulveda Blvd.

LACBC will host the city’s first Bike Prom from 8 pm to midnight on Saturday, February 23rd, at the American Legion Hall Post 206, 227 N. Ave 55 in Los Angeles. Similar events have been very popular in other cities, so this could be the bike social event of the year — get your tickets early.

Also on Saturday the 23rd, the annual L.A. Chinatown Firecracker Bike Ride will offer a 20-mile route along the LA River for families and casual riders, and a more challenging 30-mile on city streets for more advanced riders. The LACBC will provide a free bike valet.

Registration is open for the 2013 UCLA Complete Streets Conference on Thursday, February 28th at the DoubleTree by Hilton, 120 South Los Angeles Street Downtown.

This should be a major party, as the infamous semi-official Wolfpack Hustle Marathon Crash Race takes place on St. Paddy’s Day, Sunday, March 17th, starting at 3:30 am at Tang’s Donuts, 4341 West Sunset Boulevard. Be sure to wear green — or better yet, ride a kelly green bike festooned with shamrocks and leprechauns.

Make your plans for the Malibu 7-Canyon Ride on Saturday, March 23rd with rides of 100 miles, 100 kilometers and 50 miles. The fully supported ride will begin at Zuma Beach, and pass through Latigo, Encinal, Decker, Mulholland, Little Sycamore, Yerba Buena and Deer Creek Canyons, with over 9,000 feet of climbing on the century ride.

The next CicLAvia rolls out on Sunday, April 21st from 10 am to 3 pm, following a new route from Downtown to Venice Beach — or as Yo! Venice! puts it, from Dogtown to Downtown — along Venice Blvd. Future events will follow Wilshire Blvd from Downtown to Fairfax on Sunday, June 23rd, before returning to an extended Downtown route on Sunday, October 6th.

Registration has opened for this year’s LA River Ride, to be held Sunday, June 9th, starting and ending in Griffith Park. If you haven’t done the River Ride, I highly recommend it; if you have, then what are you waiting for?

In light of l’affaire Lance, the Times dug up this story from 1989 reporting that America’s only remaining Tour de France winner was pressured to dope by his former Dutch team. And speaking of Lance, it looks like no one really buys it; although he may — or may not — have kept one local promise.

After a colleague is arrested for protesting the removal of a bike lane, Toronto physicians call for more bike lanes, more quickly. One writer says cyclists present the wrong image when they show up for mass protests in cycling attire, while another says if we focus on making the roads safe it won’t matter what we wear. The UK Parliament debates the future of bicycling, but questions remain whether the country’s leaders have the will to get it done; I can’t imagine Congress caring enough to even discuss the subject. As long as bike theft is ignored, Great Britain will never be a cycling nation; the same could be said on this side of the pond. How to rebuild your bike after someone backs into it. Chinese artist Ai WeiWei creates a tower of bicycles in Italy. Beijing pledges to get tough on blocked bike lanes; something every city should do — including this one.

Update: Bike rider illegally ticketed by pissed-off cop for non-infractions on Venice bike path

Give Yo! Venice! credit for reporting this one.

The popular website broke the news yesterday that a bike rider on the beachfront Marvin Braude bike path was ticketed by a cop for a made-up violation — simply because he pointed out the LAPD officer’s motorcycle was blocking the pathway last Thanksgiving weekend.

According to the site — and backed up by a helmet cam video of the interaction — Venice resident Chris J. was slowly riding north on the pathway when he encountered the officer blocking the entire southbound section of the bikeway, at the same time a girl on a tricycle was blocking the north side of the path.

So after going around, he — politely, evidently — informed the officer his motorcycle was blocking the path, to which the officer responded “I can give you a ticket for that.”

Next thing he knew, the cop was following behind his slow moving beach cruiser with lights flashing.

And that’s when it gets interesting.

The cyclist turned on his helmet cam and recorded the officer fumbling for something, anything, he could ticket him for. And admitting on camera that the only reason he was writing up the rider was because he had argued with him.

Politely asking a cop not to block the bikeway may not be smart, but it sure as hell isn’t arguing.

Kind of violates the meaning of “To Protect and Serve,” doesn’t it?

First the officer threatens to write up the cyclist for riding on the wrong side of the bike path. Which, to the best of my knowledge, isn’t illegal; if the same traffic laws that apply to motor vehicles also apply to an off-road, Class I bikeway — a multi-use pathway in places — this is the first I’ve heard of it.

If so, the department could make up the state’s entire budget deficit just by writing tickets on the bike path. Starting with pedestrians walking on the bike-only sections, since people generally aren’t allowed to walk in the street, either.

Of course, it would also require cyclists to signal their lane change every time they pass someone. Along with a host of equally absurd requirements never before enforced on this bike path, or any other that I’m aware of.

So Chris argues that there’s a dotted yellow line dividing the two sides of the path in that section, rather than a solid yellow line, legally allowing him to cross over it in order to pass someone.

When the officer can’t argue that point, the cop switches gears. And instead, writes a ticket for violating the state’s Basic Speed Law, for — wait for it — riding 5 mph in a 10 mph zone.

Never mind the fact that the officer appears to have made up the 10 mph speed limit, which is not posted anywhere along the bikeway. Or anywhere else that I can find, for that matter.

Instead, let’s consider that the Basic Speed Law, CVC 22350, refers only to a speed greater than is reasonable under the circumstances. It says absolutely nothing about going too slowly.

Basic Speed Law

22350.  No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.

And to the best of my knowledge, a bike path is not a highway.

But I could be wrong about that; I’ll let you know if I see a semi-truck and a few speeding SUVs rolling down it when I’m out that way this afternoon.

Maybe the officer meant to write a ticket for CVC 22400, the Minimum Speed Law. Except that pertains only to highways, as well.

Not bike paths.

And part of which only applies to vehicles subject to registration.

In other words, not bikes.

Of course, had the officer written a ticket for that, he likely would have been laughed out of court when the case comes up before a judge on Friday. As he should be for attempting to make up traffic laws on the spot in order to cite a bike rider simply because the rider pissed him off.

Which is not exactly what we should expect from a trained officer sworn to uphold the law, who should have known better.

Or at least, known enough not to admit it on camera.

And I should also point out that it’s not against the law to argue with a cop. Although it’s seldom a good idea.

If you find yourself in a similar situation, take the ticket. Then take it up with the officer’s superiors, or fight it in court.

I’ve reached out to the LAPD’s bike liaisons for the West Traffic Division to see what they have to say on the subject. So far, I haven’t gotten a response; I’ll let you know if I do.

Update: According to KNBC-4, Detective Gus Villanueva of the LAPD’s Media Relations Section says the ticket was canceled “in the interest of justice,” and that the department was conducting an investigation into the officer involved.

Yo! Venice!, which has done a great job keeping on top of this story, reports that the officer involved works out of the West Traffic Division; still no response from the bike liaison from that Division. 

Reading between the lines — did California Governor Jerry Brown kill a bike rider with his pen?

Sometimes the irony is as tragic as it is overwhelming.

It was just a few years ago that the New Jersey Star-Ledger published an editorial ridiculing efforts to pass a three-foot passing law in the state — one day after printing a story proving the need for it.

The paper said that while they supported “protecting bicycle enthusiasts,” they feared a society in which drivers could get a ticket for passing a cyclist at just 2’11”, and called the proposed law unenforceable.

Pity they don’t read their own newspaper.

Just 24 hours earlier, they’d run a story about a 78-year old man who died after being passed so closely by a school bus that witnesses thought the driver had hit him. Police initially investigated the death as a hit-and-run before concluding that the bus never came in contact with the rider.

It just passed so closely that the rider, an experienced cyclist who averaged 5,000 miles a year on his bike, lost control and fell, fatally, off his bike.

Something a three-foot law might have prevented. Or at the very least, could have provided a basis to charge the bus driver for his death.

Now we have a very similar situation right here in California.

Except instead of an editorial providing an ironic context, we have the veto pen of a misguided governor to blame.

And instead of a 78-year old victim, it was a visiting professor at UC Berkeley who died when he was passed by a dump truck last July.

Israeli professor Shlomo Bentin, a renowned expert in cognitive neuropsychology, was riding his bike next to a line of cars when he was buzzed by the dump truck — once again, so close that witnesses at the scene believed the truck had hit him.

Yet investigators, relying on video, interviews and forensic analysis, concluded that the truck never made contact with the rider.

And even though state law requires drivers to pass at a safe distance without interfering with the safe operation of the bicycle, authorities felt they didn’t have enough evidence to make their case.

Something that probably wouldn’t have been a problem if we had a three-foot passing law in place.

Anyone who has ever been in Bentin’s position knows the sheer terror that comes with having a massive, multi-ton vehicle mere inches from your elbow.

It takes near-superhuman self control not to overreact in that situation, where the slightest mistake could result in a serious, if not fatal, collision with the passing vehicle – or a crash into the parked cars on the right that could throw you under the truck’s wheels or into the path of following cars.*

Or cause you to simply fall on your own, as Bentin and the rider in the New Jersey case appear to have done with tragic results.

And make no mistake. While most falls from a bike are harmless, any fall can be dangerous.

Yet thanks to the veto pen of our misguided governor, California drivers still have no standard in place to tell them what is and isn’t a safe passing distance.

And as this case clearly shows, any pass that doesn’t actually come in contact with the rider is effectively legal under current law.

Even if the rider dies as a result.

Had the governor not vetoed two straight safe passing laws — including one he indicated he would sign after vetoing the first — Shlomo Bentin might be alive today, training the next generation of neuropsychologists.

Or at the very least, the driver could have been held accountable for fatally violating the three-foot rule, rather than walking thanks to the current nebulous and virtually unenforceable standard.

Instead, the governor traded our lives, not for the implausible reasons he gave for his vetoes, but as a political favor to groups he evidently felt were more important than mere bike riders. Or so I’m told by people in a position to know.

Bentin’s body should be laid at Governor Brown’s feet — figuratively, if not literally. Because he’s traded the safety of every bike rider on California streets for political expediency.

And he should be held accountable, morally and politically, for Bentin’s death, and any other cyclists who have been Jerry Browned following his vetoes, or will be.

Our governor has blood on his hands.

And nothing he can do will wash it away.

*If you find yourself in a similar situation, the best course of action is to bail to your right if there’s room — even if that means going over a curb or off the roadway; road rash or a broken arm is a lot better than getting run over. If there’s no room to your right, hold steady and try not to react in any way; it’s not easy, but this is one situation where doing absolutely nothing could save your life.

A Canyon Country bicycle advocate was seriously injured in a collision on Saturday.

Kevin Korenthal was riding south on Little Tujunga Road when a 16-year old driver lost control rounding a curve, crossed the center line and hit him head-on. He was airlifted to the hospital, where he underwent 7 hours of surgery for injuries including three broken vertebrae in his neck and back, as well as a broken wrist, tibia, fibula, scapula and femur.

The founder of the Santa Clarita Valley Trail Users, Korenthal lost his lower left leg as a result of another cycling collision 21 years ago; the latest crash left a steel rod in the amputated leg bent at a 45-degree angle.

Finally, the Times offers a great look at L.A.’s jet-beating Wolfpack Hustle.

Surprisingly — or maybe not so much, given the number of cyclists who work for the Times — it offers a fair, balanced and objective look at a leading segment of the city’s formerly underground bike culture.

Although as usual, some of the comments leave something to be desired.
