58-year old bike rider killed in Camarillo hit-and-run during police chase Saturday; medical examiner says it’s an “oopsie”

You’ve got to be kidding.

A man riding a bicycle was killed by an armed robber fleeing from police in Camarillo on Saturday — something which could reasonably be expected to result in a murder charge.

Except the Ventura County medical examiner said it was just an “oopsie.”

You know, big harm, no foul.

While this site was down for the last few days, news broke that the victim was killed, and several other people injured in a separate collision, when they were struck by the robber as he tried to escape the cops in an SUV shortly after 4 pm.

Ventura County Sheriff’s deputies began chasing the alleged robber, identified as 21-year-old Makare Toliver of Lancaster, and his partner after they reportedly stole a gun from a man at the Good Nite Inn on Ventura Boulevard.

Toliver initially yielded to the cops after pausing at a gas station, before taking off again and running down the victim as he rode on Central Ave between Beardsley Road and Santa Clara Ave.

The victim, later identified as 58-year old Ventura resident Robert Pierret, died after being taken to a local hospital.

There’s no word at this time on just how the crash occurred.

Toliver continued without stopping until he crashed into another car, injuring a number of people in that car, and was arrested at gunpoint along with another man.

Fortunately, none of those victims were seriously injured.

Toliver was booked on suspicion of armed robbery, as well as evasion of law enforcement and second-degree murder.

However, the murder charge was dropped after the medical examiner inexplicably ruled Pierret’s death an accident, explaining that traffic deaths are usually considered accidents “unless there is some unusual circumstance.”

Apparently, killing someone while evading police after robbing someone is perfectly normal in Ventura County.

Instead, Toliver was charged with two counts of second degree robbery, evading an officer causing death, fleeing the scene of an accident aausing death, grand theft of a firearm, and assault with a semi-automatic firearm, along with a whopping 21 special allegations.

He pled not guilty Tuesday to all charges.

The other man, also from Lancaster, was released on bail without formal charges.

This is at least the 31st bicycling fatality in Southern California this year, and the fourth that I’m aware this year in Ventura County.

Eleven of those deaths have been hit-and-runs.

My deepest sympathy and prayers for Robert Pierret and his loved ones.

I’m still battling the same health issues I’ve been dealing with since before Halloween. Most nights I battle through it; last week I couldn’t. 

But after seeing four different doctors since this all began, we’ve reached a clear consensus is that it’s definitely a) an inner ear problem, or b) not an inner ear problem. 

Maybe the next four specialists I’m supposed to see can figure it out. 

Meanwhile, have happy Presidents Day! Go out and buy a mattress or something.

Good news and bad from the former Biking Black Hole.

The good news is Beverly Hills, which has made a major turnaround in recent years, will be implementing a “minimum grid bikeway network.”

The bad news is, it’s just going to be signs and sharrows. In other words, it’s the least they can do.

Literally.

Hopefully, this is just the first step as the city implements its Complete Streets plan, with its promises of pursuing “parallel, longer-range efforts to expand and upgrade cycling infrastructure.”

Let’s hope so.

On the other hand, until the paint is on the ground, we’re always just one election — or uprising by angry drivers and/or overly privileged home or business owners — from a change of heart.

Maybe she’s starting to get it.

It was only a week ago that we criticized the Los Angeles Times’ Robin Abcarian for concluding that Vision Zero was a worthy, but impossible goal, so “why go out on a limb with a big, bold promise that is so obviously doomed to fail?”

But yesterday found her reconsidering use of the word “accident,” after reading author Jessie Singer’s new book There Are No Accidents: The Deadly Rise of Injury and Disaster — Who Profits and Who Pays the Price.

Although the AP’s change of heart on the word should have tipped her off long before now.

She quotes Singer saying that in virtually every case, there is a cause — often more than one — leading up to the cause of any unfortunate event.

“Never focus on the last causal factor,” Singer told me. “The thing we screw up about ‘accidents’ is looking at the last person who made a mistake. Accidents have layered causality. When you look toward the question of preventing harm, there are just so many answers, so many ways we can throw a pillow between us and our mistakes.”

Abcarian seems to take that message to heart, concluding,

Almost every day, I drive past the intersection on Venice Boulevard and Shell Avenue close to where the actor Orson Bean was struck and killed by two cars as he crossed the four-lane street one dark evening two years ago. There’s a new bright crosswalk, warning lights and signs now where before there were none.

I used to think his death was an unfortunate accident. I’m starting to think of it as inevitable.

Meanwhile, Singer, author of There Are No Accidents, says it’s time to stop yelling at drivers, and start expecting the government to demand safer cars.

After the founding of the National Highway Traffic Safety Administration in the 1960s, the organization began requiring safety improvements to protect the occupants of cars, from seat belts and collapsable steering wheels to air bags.

The result was a steady decline in traffic deaths, resulting in as many as 600,000 lives saved, Singer says.

Until now.

But progress began to reverse even before the coronavirus pandemic. Speeding on pandemic-empty streets only exacerbated the threats posed by heavier, more powerful SUVs. The crisis of traffic safety has been particularly acute for people on foot. While traffic fatalities rose 5 percent in the past decade, pedestrian deaths rose by nearly half. For people living in povertyBlack people, and Indigenous people, the likelihood of traffic death, inside and outside a car, is even more acute.

The European Union and Japan have not seen a concurrent crisis. In those jurisdictions, regulators protect people both inside and outside of a vehicle; vehicle-safety ratings take pedestrian risk into account. More than a decade ago, EU and Japanese regulators required that automakers redesign bumpers, hoods, and detection systems to reduce the likelihood of death on impact. Putting the onus of survivability on the automaker spurred the development of new technology, such as airbags that inflate outside the vehicle. Pedestrian fatalities fell by more than a third in a decade in Europe and have fallen by more than half since 2000 in Japan.

Meanwhile, The Nation makes that case that cars kill twice as many people as guns, and disproportionately affect people of color.

And why.

We also need to change our roads, which often plow through Black and low-income communities with the goal of making it easier to drive farther and faster. Replacing intersections with roundabouts could reduce crashes by more than 50 percent. We can hem in streets with curbs. Removing lanes, adding shoulders, bike paths, and speed bumps, and creating turn lanes would all decrease speeding and crashes.

On the other hand, Fox News’ Laura Ingraham seems to come out in favor of traffic deaths in the name of freedom.

A writer complains that a 17-year old boy riding an ebike “could have been traveling upward of 20 mph” when he was critically injured in a collision with a truck driver, using that to justify a call to put the brakes on ebikes. Then again, the teen could have been doing just 12 mph. Or 17. Or any other number he wants to pull out of his ass.

Boston bike riders support a pilot program for widening a bike lane over a key bridge, even as video shows vandals tossing the orange cones off it.

Life and lies are cheap in the UK, where a woman walked without a single day behind bars for fleeing the scene after running down a nine-year old boy on a bicycle, then lying to police investigators, claiming she hadn’t been in a wreck.

Life is cheap in the UK, part II. A 76-year old British man will spend two years behind bars for the impatient pass and head-on crash that killed a man riding a bike, who was reportedly doing everything right. But at least he’s been banned from driving for seven years, even though it should have been life.

Life is cheap in Ireland, too, where a drunk, hit-and-run driver got a lousy two and a half years for killing a man on a bicycle, after leaving him lying in a field to die alone.

Candidate list for June primary, Times’ Abcarian says Vision Zero “impossible,” and PCH claims another victim

Pick your ponies and place your bets.

The Los Angeles City Clerk has posted the latest list of candidates filing for the city’s June primary election.

Like most California elections, not everyone is a serious candidate. But there are some genuine choices hidden among the clowns and wannabes.

No, Vision Zero is not “impossible.”

LA Times columnist Robin Abcarian writes that eliminating traffic deaths is a worthy, but impossible, goal.

The goal is worthy, but why go out on a limb with a big, bold promise that is so obviously doomed to fail?

In Australia, at least, they call the effort “Toward Zero,” which seems more realistic…

As long as there is traffic, there will be traffic tragedy, especially in a car-centric city like ours, where you cannot drive an inch without seeing distracted drivers holding phones. How many times have you been stuck behind a car at a red light that doesn’t move when the light turns green because the driver in front is poking at a screen? At least while they aren’t moving, they aren’t killing anyone.

The obvious problem with that attitude is the question of just how many deaths are acceptable as the cost of just getting from here to there.

And if that number is anything other than zero, which of your loved ones are you willing to sacrifice to the motor vehicle gods?

Which makes it clear that one is the only acceptable answer.

Abcarian’s right that we may not get there today. But it’s up to all of us to do everything we can to make sure we get there tomorrow.

To her credit, she does identify one of the biggest problems with Vision Zero, with each of the city’s 15 councilmembers free to implement their own vision of how to end traffic deaths, or the lack thereof.

As well as the lack of alignment between the city and county, with Los Angeles aiming for 2025 — just three years from now — while the county aims to end traffic deaths a decade later.

Never mind the other 87 cities that call LA County home.

But the solution to that is to coordinate, not forget it. Then give the city and county transportation agencies the power to override individual councilmembers and supervisors to do what needs to be done to save lives.

Which also serves to shield our elected officials from blame by angry drivers, which is what some of them really care about, anyway.

And while we’re at it, someone please tell Ms. Abcarian the difference between a crash and an accident.

Someone in newly bike friendly San Diego clearly doesn’t get it, ruling that no action is necessary for a traffic signal clearly designed to thin the herd by encouraging drivers to turn left through a bike lane while bike riders still have the green. Thanks to Victor Bale for the heads-up.

There’s a special place in hell for the couple who flipped off a bike-riding Florida boy as they passed him in their car, then whipped a U-turn and threatened him with a gun when he responded in kind, before proceeding to pistol whip and slap him repeatedly; they were arrested after the boy managed to record video of the couple, along with their car and license plate.

A 67-year old Scottish man was left shaken after a construction worker pelted him with cement when he stopped his bike to ask if they had a permit to block an Edinburgh bike lane with a cement mixer.

But sometimes, it’s the people on two wheels behaving badly.

A thirsty armed robber helped himself to cash and a canned drink from a Houston convenience store before making his getaway on a baby blue bike.

No bias here. And no surprise, either, as a new study from the UK shows that drivers and bike riders are treated differently by the press following a crash.

British bicyclists rode to protest a “discriminatory” daytime ban from the Bedford town center, which resulted in 3,200 fines for the equivalent of $107 — including one issued to a man on the second week of his around-the-world bike tour.

New book says accidents aren’t accidents, WeHo considers protected bike lanes, and keeping deadly drivers on the road

She gets it.

The New York Times’ Peter Coy talks with journalist Jessie Singer about her new book, which concludes that there are no accidents, just events that could have been prevented.

And that too often, it’s the marginalized members of society who pay the price.

On the other hand, Coy clearly doesn’t get it.

Coy: …Anyway, is it possible to go too far in preventing accidents? It wouldn’t make sense to limit cars to going 30 miles per hour.

Singer: It is our moral and ethical imperative to do everything in our power to protect human life. When people talk about the nanny state, what they’re doing is making excuses for deeply preventable, deeply racialized and class-divided causes of death.

If we look at places that do everything in their power to protect human life, from Sweden’s Vision Zero traffic safety policies to Portugal’s harm-reduction overdose prevention policies, we see that countless lives could be saved just by putting people first.

Never mind that cities across the world have successfully reduced the frequency and severity of collisions by cutting speed limits below 30 mph.

Let alone the worldwide 20 Is Plenty movement to reduce the risk of collisions as well as the risk of death or serious injury by slowing drivers to 20 mph in populated areas.

So yeah, it does make sense to lower speed limits to 30 mph, or less. Because the convenience of drivers should never outweigh the lives and safety of those around them.

Either one would be a game changer.

Today’s common theme is the lenient courts and government officials who inexplicably keep dangerous drivers on the road until they kill someone.

Like the heartbreaking news from New York, where a 99-year old Holocaust survivor was killed by a reckless driver with a long record of speeding and red light violations.

Or the Florida hit-and-run driver who killed a 70-year old man riding a bicycle, and was somehow still on the road despite five previous DUIs; he was caught after two days, which presumably gave him plenty of time to sober up before he was busted.

A Florida city puts the entire obligation for safety on bike riders by requiring lights and bells on their bikes. But there’s not a bike bell made that will do a damn thing to stop aggressive, speeding and/or distracted drivers.

A new bill from bike-riding La Cañada Flintridge State Senator Anthony Portantino would require cities and counties to identify a High Injury Network of their most dangerous roads and intersections, and create a plan to correct them within 15 years. But do we really want to let them keep killing people for another 15 years? Cut the timeline to five years, and I’m all in.

Streetsblog offers more details on SB 922, which would permanently exempt bike lanes and other environmentally friendly transportation projects from lengthy environmental reviews. Which are too often abused to halt or delay bike, pedestrian and transit projects that would benefit the environment.

San Diego belatedly begins work on building a separated bikeway along Pershing Drive through Balboa Park, after a bike commuter and a scooter rider were killed on the existing bike lanes last year. Meanwhile, the family of noted architect Laura Shinn, who was killed by an allegedly stoned driver while riding her bike to work, have filed suit against the city. Considering the years-long delay in improving the bike lane, they might as well just back up the Brinks truck. Thanks to Phillip Young for the heads-up.

Bad news from Livermore, where a woman was killed when her bike was hit head-on by a driver after they both crossed the yellow line while rounding a curve from opposite directions.

Hahn moves to study safety after Woods crash, sheriff calls it oopsie, and parking matters more than bike rider’s death

It only took the near death of a celebrity.

LA County Supervisor Janice Hahn is finally pushing for much needed safety improvements on Hawthorne Blvd, where golf legend Tiger Woods was seriously injured in a high speed end-over-end collision.

Hahn directed the county Department of Public Works to review safety on the stretch of roadway where the crash occurred, which residents described as a scene of frequent crashes.

However, no one ordered a similar review when a 32-year old homeless man, identified as Jonathan Valbuena, was killed in a hit-and-run a few miles north on the same deadly corridor.

And no one ordered immediate action despite the corridor’s inclusion on the equivalent of the High Injury Network under the county’s Vision Zero plan, which doesn’t seem to have made any more progress than LA City’s seemingly forgotten plan.

Then again, none of the six people who were killed or seriously injured over a five-year period in that deadly section of the street were famous.

Which, sadly, seems to make all the difference.

That’s not to say the dangerous downhill street where Woods crashed doesn’t need to be fixed.

But maybe we could do something where the rich and famous don’t live and drive, too.

On a related note, LA County Sheriff Alex Villanueva has given Tiger Woods a pass on the crash, saying his wreck was just an oopsie.

Apparently, Woods was traveling without a driver to film a low-budget documentary show for Discovery when he crashed.

San Diego business owners complain about the loss of 22 parking spaces to create a temporary separated bike lane where a bike rider was killed last year.

Even though they’ll get them back when it’s converted to a protected bike lane later this year.

Yet there’s not a single mention of 65-year-old Dan Sweeney, who died nearly two months after a hit-and-run directly in front of their restaurants. Or that the driver left him in the street to die after getting out of his van and moving Sweeney’s bike out of the way.

Almost as if they don’t even care.

Nor, apparently, did anyone seem to care that the driver, 29-year old Mauricio Armando Flores, now faces up to four years behind bars after pleading guilty to leaving Sweeney bleeding in the street after running him down from behind.

He’ll face sentencing next month.

Driver identified in Portland rampage that left 1 dead and 10 injured, and AAA says it’s crash not accident

We finally know who was — allegedly — responsible for the murderous vehicular rampage that left a 77-year old Portland woman dead, and as many as ten others injured.

And why, sort of.

Sixty-four-year old Paul Rivas pled not guilty to 14 felony counts in the 15-block rampage, including second degree murder and multiple assault and hit-and-run charges.

Unbelievably — literally — he had shifting explanations for why he intentionally ran down so many people, most of whom were walking or riding bicycles.

Rivas initially claimed his Honda Element was having brake problems and that he was searching for an auto repair shop.

Other times, he suggested the injuries could have been inflicted by “another, similar looking” Honda car, not his; and he admitted at one point to striking a bicyclist but characterized the collision as an “emergency maneuver” he made to avoid a more serious crash with oncoming traffic, Multnomah County prosecutor Sean P. Hughey wrote in a probable cause affidavit.

This despite running down the elderly woman as she was crossing the street, then making a U-turn and slamming into her again, dragging her to her death under his SUV.

Yeah, sounds like bad brakes, all right.

The descriptions of his attacks are simply horrific.

Donald Hinson was riding his bicycle on Southeast 18th Avenue when the Honda “drove straight at him without slowing,” sending him and his bicycle onto the hood of the Honda. He fell onto the street and suffered injuries to his leg and a cut to his nose, the affidavit said…

Raymond Chihak said he was on the sidewalk near Southeast 19th Avenue and Stark when he heard screaming. That’s when he noticed the Honda speeding directly toward him. It struck him as he stood on the sidewalk, he said, then sped off, according to the affidavit. Chihak also was treated for his injuries at a hospital.

Bicyclist Juan Caicedo-Gomez was riding in the bike lane on Southeast Belmont Street when the Honda swerved into the lane and hit him from behind, throwing him off his bicycle, according to police.

Pedestrian Faviola Palomera said she was walking in Laurelhurst Park and saw the Honda doing U-turns nearby. “The next thing she knew she woke up in the hospital,” with a head injury after she had been knocked unconscious when the Honda was seen driving out of the park and struck her while walking, according to her statement to police and a witness’ account, the affidavit said.

Yet those are just a few of the victims who were lucky enough to survive.

And yes, those were real people.

That crowdfunding campaign to replace their bikes and help with medical expenses has raised nearly $1,000 of the modest $4,000 goal.

After repeated denials, Rivas finally admitted to detectives that he was the one behind the wheel of the killer SUV.

According to police, he denied drug or alcohol use and did not appear to be under the influence, leading them to suspect he suffered from some sort of mental illness or physical ailment.

Let’s hope it’s enough to keep him off the road for the rest of his life.

Speaking of Calbike, the statewide bike advocacy organization sings the praises of Quick-Build Projects, saying it’s more equitable to vet a project on the ground than on paper. Morning Links: AP gives a little on crash not accident, and headphones don’t cause distracted riding

The AP finally gives a little on calling crashes accidents.

The latest edition of the press network’s new stylebook will advise reporters not to use the term when “negligence is claimed or proven,” since it could be interpreted as exonerating the person responsible.

Now we just have get them to flip that, and tell reporters and editors to never call a crash an accident unless it’s proven that no one’s at fault.

But it’s a start.

Britain’s equivalent of AAA is the latest to blame distracted walkers and cyclists for collisions, calling them smombies, or smartphone zombies.

Yet like so many others, they also throw headphone-wearing bike riders into the distracted riding mix. Even though headphones only affect hearing, rather than focus.

Here in California, it’s legal to wear headphones or earpieces in one ear, illegal to use them in both.

But blaming them for distracting riders is like saying drivers are distracted when they have their windows rolled up and the radio on. It may keep them from hearing the fire truck blaring its siren next to them, but it doesn’t significantly distract their focus from the road.

Just as riders don’t suddenly lose their ability to concentrate on the road ahead of them when they plug the second earpiece in.

It may not be legal. And it may not always be smart.

But it’s time to stop the ridiculous narrative that equates it to distracted driving.

It’s been a rough few days for dogs in the UK, as one pup barely survives a collision with a bike rider, while another was repeatedly kicked following an argument between its owner and a man on a bike. Seriously, no matter how pissed off you are at the owner, don’t take it out on the dog. Or anyone else, for that matter.

A business in the UK warns that cyclists who ride under the influence are ten times more likely to be injured than sober riders — then makes a blatant pitch for their roadside breathalyzer.

A South African man goes from stealing bikes to running his own bikeshare company. Let’s just hope he bought the bikes he’s using now.
