Ill-advised bike ban on Palos Verdes Drive South as ground shifts, and more on drunken Texas hit-and-run mayhem

Just 195 days left until Los Angeles fails to meet its Vision Zero pledge to eliminate traffic deaths by 2025.

No one ever accused Rancho Palos Verdes of displaying common sense.

As we mentioned last month, the wealthy enclave felt a need to address dangerous road conditions on Palos Verdes Drive South, caused by shifting of the bluff underlying it.

So naturally, they responded to the slick, cracking and crumbling roadway by banning all two-wheeled vehicles, primarily bicycles and motorcycles.

Never mind that it’s the people in the bigass cars, pickups and SUVs who cause the most damage. Or that’s it’s in direct violation with state law, which allows bicycles and motorcycles on any public roadway where motor vehicles are allowed, with the single exception of banning bicycles from some limited access highways that have alternate routes.

Oops.

While a bicycle can get its tires caught in cracks in the roadway, bike riders also have a greater ability to avoid obstacles than people in motor vehicles, which are much harder to stop or turn.

And it’s not the people on bicycles who risk causing further damage through their sheer weight.

Unfortunately, however, the only way to beat the new rule is to break it, get a ticket and fight it in court, which is a long, complicated and expensive process. And would probably require a good lawyer to make your case for you.

Let’s just hope the sheriff’s department, which is charged with policing the Palos Verdes Peninsula, has enough sense not to enforce it.

But based on previous experience with the LA County Sheriff’s limited grounding in bike law, I wouldn’t count on it.

The seemingly road-raging Texas driver who was caught on video plowing into two bicyclists from behind on Monday, apparently on purpose, was captured when he was chased down by witnesses.

Thirty-one-year old Benjamin Hylander taken into custody on multiple charges including driving while intoxicated and aggravated assault with a deadly weapon.

He had a roadside BAC, or blood alcohol content, of .25 — over three times the legal limit.

Hylander reportedly insisted he had to talk to the victims to apologize after he was stopped. But he can be clearly seen driving over one of the victims to get away, as the man lay face down in the roadway following the initial impact.

Which doesn’t exactly bespeak regret for his actions.

Remarkably, neither victim was seriously injured.

This is great news for anyone who doesn’t drive, for whatever reason, in a state where driving is considered the default mode.

No bias here. A Thai website relates how a 71-year old amputee fatally stabbed a drunken 45-year old man who had repeatedly harassed him while the older man played chess with friends — yet they described the murder as a case of “cycling rage” just because of how the killer got back home afterwards.

But sometimes, it’s the people on two wheels behaving badly.

A bike-riding vandal is accused of deliberately smashing the driver’s side mirrors on a dozen cars in Torrance as he rode by Monday night, for no apparent reason.

Fox News offers video of a crazed, road-raging New York man who threw his bikeshare bike in front of an SUV after arguing with the driver, before the other person drove over the bike’s front wheel and apparently went on with his day; the bicyclist calmly rode off after giving the SUV driver and other honking motorists the bird. Although there’s no mention of what the poor, tormented driver may have done to induce such anger — or that merely driving over the bicycle is a crime. 

A British bike rider has been fined the equivalent of $280 for blowing through a red light while a mother was pushing her child in a stroller, forcing them them to stop mid-step to avoid a crash — rising to a well-deserved $500 including court costs and fees. Seriously, it’s one thing to go through a light when there’s no one around. But don’t be an ass when others have the right-of-way.

Santa Monic bike riders rode throughout the beachfront town to celebrate the Juneteenth holiday on Wednesday, in a ride sponsored by the Santa Monica Black Empowerment Association.

Add e-scooters to the list of things you’ll have to dodge on the beachfront bike path in Long Beach.

 

State

Add Costa Mesa to the ever-growing list of Orange County communities trying to crack down on ebikes.

No surprise here. After Palm Springs bicyclist Bond Shields penned a “Bicycling Manifesto” for the city — composed of common sense safety reforms — he passed it on to the city manager and a councilmember; only the latter promised to do anything, passing it on to the city’s Sustainability Commission, where it apparently died a quick, quiet death.

San Francisco’s transportation authority has voted to remove the contentious Valencia Street centerline bike lane, although work won’t begin on a curbside replacement until next year; some of the newly empowered local merchants don’t like the new bike lane plan, either.

A British man has completed his third bike ride around the world — or his 11th if you count motorcycles. Which makes you wonder how he’s had time for anything else. 

The nonprofit European Cyclists’ Federation honored the European Union; Ghent, Belgium; Bologna, Italy; Lyon, France; and Quelimane, Mozambique; for their efforts to support and encourage bicycling at their annual Velo-City conference.

More than 1,800 bicycles have been delivered to war-torn Ukrainian communities through the #BikesForUkraine initiative.

No bias here. A Toronto bike lawyer suddenly had his mic cut after asking a city counselor to denounce anti-bicyclist comments made at a recent public forum that had devolved into a war of words, with one commenter threatening to run over any bike riders that get in his way.

No bias here, either. A UK petition calling for bicyclists to “display registration, pay road tax and have insurance” has closed after drawing just 353 signatures in six months.

Investing in Place considers the implications of LA’s newly approved Measure HLA, and what needs to be done to prevent implantation from devolving into a chaotic mess, and leaving already underserved communities behind.

Streets Are For Everyone, aka SAFE, is looking for volunteers to help with next month’s Finish the Ride and Finish the Run in Griffith Park.

Metro is offering a new and improved on-demand process to rent their new and improved electronic bike lockers.

West Hollywood approved a Complete Streets makeover for Willoughby Ave, as well as parts of Gardner Street, Vista Street and Kings Road, replacing the existing sharrows with curb extensions, scaled traffic circles, protected bike lanes, wayfinding signs, a mini-park, and enhanced crosswalks near schools.

Pasadena wants your input on a proposal for quick-build Complete Streets improvements along Allen Ave to improve access to the Metro A Line Station, and connect to existing bike lanes on the city’s north side.

Santa Monica cops will conduct yet another Bike & Pedestrian Safety Enforcement Operation on Saturday, ticketing any driver, bicyclist or pedestrian who commits a traffic violation that could endanger anyone on two wheels or two feet. As usual, ride to the letter of the law until you cross the city limits so you’re not the one who gets written up.

More on the Encinitas bicyclists calling for removal of a curb-protected bike lane on the coast highway, after a 48-year old man was found dead next to his cruiser bike early Sunday morning, even though there is no indication yet that the barriers played any role in his solo crash; Oceanside bike lawyer and BikinginLA sponsor Richard Duquette says the rash of bike crashes since the lanes were installed may be an argument to remove those barriers, but not all protected bike lanes.

A Palo Alto website says a proposal by Caltrans to install green bike lanes on busy El Camino Real is the wrong way to go, because it would encourage bicyclists to ride on a busy street interrupted with frequent entrances and exits, and other “ingress and egress interruptions.” Or is it just that only drivers deserve safe, direct routes to wherever they happen to be going?

Cycling Weekly says forget Amazon’s Big Spring Sale if you’re looking for good deals on quality bikewear, although you can find some deals on bike tech.

Bike Portland says a whopping 94.5% of women and non-binary bicyclists responding to a recent survey reported some form of traumatic harassment while riding on the streets. Which should be astonishing, but sadly isn’t. 

A Montana man says he hated ebikes, but using one to go elk hunting changed his mind. Although I suspect the elk might have a different opinion.

With a timeline only Los Angeles could envy, Edinburgh, Scotland officially opened the city’s longest bike lane after a ten-year process, with a local councilor complaining that contractors had made a “pigs ear” of the installation work.

Manchester, England bike advocates are calling for the removal of new barriers recently installed to keep “antisocial motorcyclists” off a bridge forming part of the UK’s National Cycle Network, warning that the “unlawful, discriminatory” barriers would block access to anyone with a disability.

An “incredulous” federal judge questioned a proposed plea deal in the death of US Masters Champ Ethan Boyes.

Prosecutors said they were nearing a deal on a one-year misdemeanor sentence for the drunken crash that killed Boyes in San Francisco’s Presidio Park, reducing the charges to one count of unlawfully killing a human being without malice and without gross negligence.

According to the San Francisco Chronicle,

“Isn’t being intoxicated gross negligence in itself?” the judge said, incredulous.

That question, (Assistant U.S. Attorney George) Hageman said, was “up for interpretation.”

The judge replied that interpreting the severity of the alleged crime was Hageman’s job as federal prosecutor…

Eighty-one-year old Arnold Kinman Low is currently facing one count of vehicular manslaughter and one count of driving under the influence of alcohol in the fatal crash.

Felony vehicular manslaughter and felony DUI causing death could result in a maximum sentence of 16 years behind bars, while dropping the DUI count could reduce it to just 12 months.

For killing someone while too drunk to drive in a straight line.

Allegedly.

Los Angeles officials approved a five-year, $10 million contract with transit firm Tranzito to provide a series of integrated mobility hubs,

The firm will establish 13 of the centers throughout DTLA, Hollywood and Long Beach to provide “bike sharing, car sharing, secure bike parking and on-demand microtransit services” for first mile/last mile transportation from Metro  stations.

But sometimes, it’s the people on two wheels behaving badly.

When you’re riding your bike in Capitola, California with an outstanding warrant while carrying meth and fentanyl, put some damn lights on it — and don’t try to pass yourself off as your sister.

A Madison, Wisconsin man was arrested for riding a stolen bicycle while on his way to the courthouse to be sentenced for a series of other burglaries — after he had already been banned from riding a bike.

When you’re carrying coke and a crack pipe on your bike in Kentucky, put some damn lights on it, already — and don’t jump off a roof to escape the cops.

An English town dealt with “anti-social cyclists,” as police responded to complaints from the public for such horrendous activities as riding without lights. Which isn’t exactly what I would describe as antisocial, but still. 

A clinically blind bicyclist in the UK was fined the equivalent of $253 for riding on a highway while “extremely” drunk, less than a year after he crashed into a passing car while riding under the influence. And giving a whole new meaning to being blind drunk.

Caltrans is teaming with the California State Transportation Agency (CalSTA) to offer a new tool to address the inequitable distribution of transportation benefits and burdens, including mapping out crash rates.

Calbike promotes their upcoming Bicycle Summit Plenary in San Diego next month, saying it will promote the city’s bike cultures.

A California man rode 625 miles around Taiwan in twelve days, despite never riding for more than half an hour before his trip.

London’s Evening Standard rates the best road bikes below £2,000 — the equivalent of $2,500.

Over 800 bicyclists took to the streets of London to call for safer infrastructure and streets for women bike riders.

Completing our London trifecta, a London business site questions whether the UK’s bike riders are really any safer after bike-friendly changes to the country’s Highway Code.

A campaign by disabled bicyclists in the UK tackles Shedgate, arguing that disabled riders should be allowed to build a bike shed in their front garden if they don’t have a back one, after several people were fined or ordered to remove them.

Over 35 percent the residents of Dutch cities Groningen and Amsterdam, and Copenhagen, Denmark ride a bicycle on a daily basis, compared to just 5% of Rome residents. Yet most American cities would be overjoyed by even the latter rate. 

Mumbai bicyclists plan a mid-March silent protest to demand safer streets for bicyclists, runners and pedestrians, in response to the bicycling death of former Intel India chief Avtar Saini, who is credited with the development of the Pentium processor; meanwhile, an Indian columnist calls for making the bicycling safe, for everyone’s sake.

Competitive Cycling

Paris-Nice is already upon us, with American Matteo Jorgenson in 4th place, behind Laurence Pithie, Mads Petersen and Olav Kooij after three stages; Dutch cyclist Arvid de Kleijn got his first WorldTour win Monday, as his Tudor Pro Cycling team “broke their duck for 2024.” Which has to be one of the strangest terms I’ve heard in pro cycling, or anywhere else.

Evidently, the cycling world forgot the 2022 Strade Bianche, because history repeated itself with winners Lotte Kopecky and Tadej Pogačar once again winning the event two years later.

Giro and Dutch Team Visma/Lease a Bike have teamed for what has to be the weirdest looking, bizarrely futuristic aero bike helmet, which looks more like an AI rendering error.

NBA legend Reggie Miller may, in fact, be better on a mountain bike than you are, winning his first two races of the year this past weekend.

 

Finally…

Just because you’re legally required to wear a bike helmet doesn’t mean it can’t look like a dorky hat. That feeling when your bicycle looks like a bigass custom motorcycle.

And that feeling when it’s just a tad windy out there.

Man killed riding bike in Hemet collision Saturday; driver arrested for DUI

That didn’t take long.

Just days after the year’s first fatal bicycling hit-and-run, we’ve now seen the first fatal DUI involving someone on a bicycle in Southern California.

According to the Hemet Police Department, the victim was struck by a driver traveling north on San Jacinto Street near El Nita Lane in Hemet around 6:30 pm Saturday.

The victim, described only as an adult man, was trapped under the vehicle when paramedics arrived; he died after being taken to a local hospital.

The driver was arrested for driving under the influence. There’s no word on their identity, or whether they are suspected of being drunk or on some other intoxicant.

This is at least the second bicycling fatality in Southern California this year, and the first that I’m aware of in Riverside County.

You’ve got to be kidding.

Life is cheap in Arizona, where a Phoenix DA has declined to file felony charges against the driver who slammed into an entire group of bicyclists, killing two people and injuring 19 others.

Maricopa County Attorney Rachel Mitchell refused to file charges against 26-year old Pedro Quintana-Lujan, saying there was no evidence he was speeding, distracted or under the influence of alcohol, though he did still have cannabis in his system from the night before.

Because evidently, that’s the only way someone can be responsible for killing two innocent people, and mowing down a group of people on bicycles like an overgrown lawn.

Quintana-Lujan told investigators his steering locked up and he was unable to control his pickup, which was pulling a trailer at the time of the crash. Although you’d think a forensic examination of the truck would be able to determine whether that was true.

Mitchell tried to position her lack of action as a refusal to let the case go by referring it to the city prosecutor in Goodyear AZ, where the crash occurred.

However, that means Quintana-Lujan could be charged with just a misdemeanor, at best, making the whole damn thing just another fatal “oopsie.”

More on the 81-year old driver charged with DUI and involuntary manslaughter for killing US Masters track champ and national record holder Ethan Boyes earlier this year.

San Francisco resident Arnold Kinman Low faces federal charges because Boyes was riding on Arguello Blvd in Presidio National Park when Low lost control of his car, and hit Boyes head-on as he rode in an unprotected bike lane.

In addition to the recently installed guard rails separating the bike lane from traffic lanes in the park where Boyes was killed, San Francisco has secured $1.2 million in funding to install protected bike lanes connecting Golden Gate Park and The Presidio.

Normally I say that once again raises the question of how old is too old to drive safely, but the allegation that Low was under the influence probably had more to do with his deadly driving skills than his advanced age, although there’s no word yet on just how drunk he was.

A 47-year old Solano County driver faces a murder charge for the alleged drunken hit-and-run that killed a bike rider in Fairfield last year.

Witnesses testified at a preliminary hearing this week that Sean Richard Miron crashed into another vehicle as he fled the scene of the original crash, leaving Suisun City resident Christopher Blake Sudat lying in the roadway next to his shattered bicycle.

Miron was detained, along with his passenger, at the second crash, where officers said he appeared to be under the influence. Police also recovered a semi-automatic pistol with an illegal threaded barrel from Miron’s pickup, even though he was barred from having a weapon as a convicted felon.

He faces the murder count due to three prior DUI convictions, suggesting he likely signed a Watson advisement indicating he could be charged with murder if he killed someone while driving under the influence.

However, even without that, his prior convictions indicate he was well aware of the dangers of driving while intoxicated before he sat down behind the wheel that night.

Miron faces charges of murder, hit-and-run causing death, hit-and-run driving resulting in property damage, being a felon in possession of a firearm, and possession of an assault weapon.

Then again, if Miron had been charged in Southern California, he could probably plead out on a misdemeanor and walk with time served.

A “mean spirited” saboteur continues to put bike riders outside a London subway station at deliberate risk by tossing thumb tacks in a protected bike lane — and has somehow managed to go uncaught for the past two years. Although we can probably surmise that police indifference could be the likely cause for why they’ve gotten away with it so long.  

But sometimes, it’s the people on two wheels behaving badly.

A Florida city manager is asking for the public’s understanding after he wrecked his bike following a night of drinking. Although I’d much rather see a drunk on a bicycle than behind the wheel of a multi-ton vehicle.

Scofflaw bike riders in Salisbury, England are accused of “endangering the public and traffic” by riding salmon on a one-way street, which local police called “incredibly dangerous.” Although how traffic can be endangered is beyond me.

Um, okay. The Journal of the Congress for the New Urbanism examines the successful Move Culver City project, calling the 1.3-mile bus lane and bike lane installation the first quick build Tactical Urbanism project in the Los Angeles area — without mentioning that the newly conservative city council voted to rip it out, or that the city is being sued to keep that from happening.

The San Gabriel Valley Tribune says freeway cams counted 45,000 people taking part in the all-too-brief Arroyo Fest that shut the Pasadena Freeway down to cars, and opened it up to people on foot, skates and bikes.

Pasadena police will mark today’s first day of December with a bicycle and pedestrian safety operation, ticketing anyone who commits a traffic violation that could endanger either group — even if it’s the bike rider or pedestrian who commits it. So as usual, ride to the letter of the law until you leave the city, or you could be the one who gets a ticket.

The California Coastal Commission is standing in the way of traffic safety in San Diego, stalling the installation of bike lanes on a deadly Point Loma roadway.

An emergency inter-agency operation was mounted to save the life of a mountain biker who suffered life-threatening injuries in the remote mountains of Boulevard, California last Friday, requiring the services of the San Diego County Sheriff’s Office, US Border Patrol, a San Diego Air and Marine Operations helicopter, and CalFire to bring the victim out to safety. So remote, in fact, that I’ve never hear of Boulevard before. 

A San Francisco bar owner blames the installation of the centerline Valencia Street protected bike lane for the demise of his 150-year old subterranean establishment, suggesting the loss of parking and reduced foot traffic resulted in an 80% drop in revenue. And not, a business model resulting in a bar that no one wants to go to if it means being slightly inconvenienced.

 

National

Bicycling reports that Portland’s MADE Bike Show will be back next year, promising to be even larger than this year’s 200 exhibitors and 5,000 attendees. As usual, read it on Yahoo if the magazine blocks you. 

An Arizona man reminisces about his life on two wheels, and dreams of coming back in the next life to live and ride in Amsterdam. But it’s the archival photo of young boys riding for Western Union that’s worth the click.

In a big win for injured bike riders, the Illinois Supreme Court ruled that pedestrians and bicyclists must be covered by the uninsured motorist provision in their auto insurance if they’re stuck by an uninsured driver while walking or biking.

A 23-year old Florida woman thanked first responders in the Bahamas for saving her life after she rode her bike off an embankment in Walker’s Cay earlier this year, saying the moon and the stars aligned to enable her to survive.

A pair of London teenagers have been convicted of murdering an 18-year old man as he rode his bike to see his girlfriend; a then 14-year old boy, who can’t be named because of his age under British law, killed the victim with a machete in an apparent attempt to steal his bicycle.

While US traffic deaths continue to climb, Great Britain saw a significant decline in bicycling fatalities, with deaths dropping nearly 25% over the past year. Which is more evidence that the dangers on American roads are due to official indifference, as other nations show that reducing deaths is possible when they’re willing to make the necessary changes.

The alleged drunk driver who killed San Francisco cycling champ Ethan Boyes has finally been charged by federal officials.

The 44-year old national masters cycling champ was riding in the Presidio National Park when he was run down by 81-year old Arnold Kinman Low this past April.

Low is set to be arraigned Wednesday on charges of involuntary manslaughter and driving under the influence.

In addition to being an age-group national champ, Boyes held the national record for the “flying start” 500-meter time trial.

His death led to demands for protected bike lanes on Arguello Blvd in the park, where officials have recently narrowed traffic lanes and installed guard rails protecting bike lanes in response.

Once again, someone riding a bicycle has been intentionally injured by a driver in a stolen car, as security cam video showed a driver in Upper Darby, Pennsylvania deliberately ram a 72-year old man riding a bicycle, who escaped without serious injuries; the driver has been identified, but no word on whether charges have been filed. This appears to be part of a troubling nationwide trend, possibly inspired by a TikTok stolen car challenge.

But sometimes, it’s the people on two wheels behaving badly.

A former British news producer and regular anti-bike crank has turned the tables on BBC host Jeremy Vine, who frequently posts bike cam video of scofflaw drivers, by recording video of lawbreaking bicyclists while out walking.

Although that stat could just reflect the popularity of ebikes with kids under 18, and says nothing about whether the kids were on ped-assist or throttle-controlled bikes.

Juneteenth celebration at CicLAvia, settlement reached in Kizzee shooting, and 16-to-life for killer DUI bike path driver

Let’s start with a reminder about Sunday’s South LA CicLAvia.

The upcoming CicLAvia, arguably the nation’s largest and most popular open streets event, will run directly down Vermont Ave from Exposition to Century Blvd, before taking a three-block dogleg to the left along Century.

The Father’s Day event will undoubtedly see multiple celebrations of dads along the route, officially or otherwise.

It will also celebrate Monday’s Juneteenth legal holiday, which marks the day enslaved Americans in south Texas finally heard the long-delayed news of their freedom — marking the last of the southern slaves to be freed following the Civil War.

The father and aunt of Dijon Kizzee, who was fatally shot by a pair of sheriff’s deputies while riding a bike in South LA three years ago, have reached a conditional settlement in their lawsuit against Los Angeles County.

Settlement terms for the $35 million lawsuit were not announced.

Kizzee was shot 15 times as he tried to flee from the deputies over what began as a traffic stop for riding on the wrong side of the street.

Kizzee allegedly struggled with one of the deputies, striking him in the face and dropping a gun he was carrying; he was shot after he picked it up, even though he was running away from the deputies and didn’t point the gun in their direction.

His shooting came amid the protests over the murder of George Floyd in Minneapolis, leading many to argue he was killed for biking while Black.

No one was ever charged in the case.

The Sacramento driver who killed a 76-year old man while driving drunk on a riverfront bike path has been sentenced to a minimum of 16 years behind bars, with the possibility of life imprisonment.

Michael Dodson was riding his bike on the American River bike path when he was run down by 27-year old Armando Moreno-Rodriguez, who had somehow driven onto the ostensibly carfree pathway.

After crashing into Dodson, Moreno-Rodriguez drove another four miles on the path at speeds up to 35 mph before his car shut down, officials said.

Moreno-Rodriguez was convicted on charges of second-degree murder, gross vehicular manslaughter while intoxicated, hit-and-run involving death, and driving with a suspended license.

He had signed a Watson advisement after three previous due convictions, which states that he could be charged with murder if he killed someone while driving under the influence anytime in the future.

Which he did.

Moreno-Rodriguez had blood alcohol level of .27, over three times the legal limit.

Santa Monica Families for Safe Streets sent out a notice that the city’s new 17th Street protected bike lanes could be at risk.

Councilmember Phil Brock is has placed an item on the agenda for this Tuesday’s city council meeting tasking staff with looking into significantly undermining the new 17th St protected bike lane.

Apparently failing to notice the people in the big, dangerous machines speeding, failing to signal lane changes and turns, and watching their phones instead of the street in front of them.

Horrible news from the Baltimore area, where a man is accused of intentionally running down a bike rider with his pickup, then getting out and physically attacking the victim until police arrived to halt the assault; the victim was lucky to escape without life-threatening injuries.

A Vancouver driver apparently tried to drive over a metal bollard thinking it was a plastic car-tickler bendie-post, while driving on what should have been a carfree bikeway.

But sometimes, it’s the people on two wheels behaving badly. 

A letter writer complains that while older bike riders stopped to help as she walked back to her car after suffering a flat while riding with her toddler, bike riders in their 20s just seemed annoyed that they existed.

A road raging bike rider and van driver engaged in a tug-of-war over the rider’s bicycle, after he had reached into the van and grabbed the driver’s keys before throwing them down the roadway.

Huerta guilty of murder in Tour de Palm Springs crash, more Bike Week news, and annual Ride of Silence rolls tomorrow

Guilty.

To the surprise of no one, Ronnie Ramon Huerta Jr. was convicted Monday of killing Washington resident Mark Kristofferson in the 2018 Tour de Palm Springs.

A Riverside jury deliberated three days before convicting Huerta of 2nd degree murder, as well as driving under the influence of drugs resulting in great bodily injury, reckless driving and driving on a suspended license.

Although, for some reason, Huerta was not charged with severely injuring Huntington Beach resident Alyson Lee Akers in the same crash.

Huerta was high on weed and driving without a license when he ran down Kristofferson while driving at speeds up to 100 mph; he was arrested after being detained by witnesses in a nearby field as he attempted to run away on foot to high the cannabis he’d been smoking.

Huerta was remanded into custody after the verdict was announce, after being free on a quarter million dollar bond while awaiting trial. He now faces a minimum of 15 years behind bars.

On the other hand, Kristofferson received the death penalty at Huerta’s hands, while his loved ones were sentenced to life without him.

Huerta on trial for Tour de Palm Springs death, examining the racial gap in traffic deaths, and too little too late for LA mom

Jury selection has begun in the trial of Ronnie Ramon Huerta for the death of 56-year old bicyclist Mark Kristofferson during the 2018 Tour de Palm Springs.

Huerta was allegedly stoned and driving at up to 100 mph when he lost control of his car and plowed into the Lake Stevens, Washington man and 48-year-old Huntington Beach resident Alyson Lee Akers as they were riding their bikes.

Kristofferson died at the scene, while Akers miraculously survived the impact despite suffering significant head trauma, resulting in lasting injuries.

Huerta was arrested after he was detained by witnesses as he tried to escape into the desert.

He faces charges of second-degree murder, driving under the influence of drugs resulting in great bodily injury, reckless driving and driving on a suspended license.

NBC Palm Springs had this to say about Huerta’s driving history prior to the crash.

According to a trial brief filed by the District Attorney’s Office, Huerta was a repeat traffic offender, racking up seven citations over a two- year span for speeding, failing to obey traffic signals and signs, making unsafe lane changes and driving while distracted due to use of a cellular telephone.

The California Department of Motor Vehicles suspended his driving privileges in 2017 because he had accumulated so many points on his record that he was deemed a “negligent operator” of a vehicle and unsafe to be on the road, the brief said.

Huerta had been suspected of driving under the influence of marijuana during a Desert Hot Springs police investigation in January 2017 stemming from his plowing through a stop sign on Palm Drive. However, no charges were filed due to a lack of conclusive results in blood screenings that were done after his arrest, according to court papers.

Despite that, he still retained possession of his car, so he able to get behind the wheel despite his horrendous driving record and lack of a valid license.

And Kristofferson and Akers paid the price.

Allegedly.

In an op-ed in the New York Times, Adam Paul Susaneck, founder of Segregation by Design, examines the alarming racial gap in American traffic deaths.

Across the US — and right here in Los Angeles — your risk of dying in a traffic collision increases exponentially if you live in a community populated primarily by people of color, as well as lower income neighborhoods.

Which are too often the same thing.

The design of our cities is partly to blame for these troubling disparities. Pedestrian and cyclist injuries tend to be concentratedin poorer neighborhoods that have a larger share of Black and Hispanic residents. These neighborhoods share a history of under-investment in basic traffic safety measures such as streetlights, crosswalks and sidewalks, and an over-investment in automobile infrastructure meant to speed through people who do not live there. Recent research from the University of North Carolina, Chapel Hill, found that formerly redlined neighborhoods — often the targets of mid-century “slum clearance” projects that destroyed residences and businesses to allow for new arterial roads and highways — had a strong statistical association with increased pedestrian deaths. The neighborhoods graded D for lending risk by the federal Home Owners’ Loan Corporation had more than double the pedestrian fatality rate than neighborhoods graded A.

He writes that on a per mile basis, Black people are more than twice as likely to be struck and killed by a vehicle as white pedestrians, while fatality rates for Black bicyclists are a whopping 4.5 times higher than white cyclists.

For Hispanic walkers and bikers, the death rates were 1.5 and 1.7 times higher, respectively, than they are for white Americans using the same modes of transportation.

Then he brings it home for those of us living here in LA.

In Los Angeles, for instance, a 2020 analysis by U.C.L.A. researchers found that although Black residents made up 8.6 percent of the city’s population, they represented more than 18 percent of all pedestrians killed and around 15 percent of all cyclists. From 2016 to 2020, the Los Angeles metropolitan area had more pedestrian deaths than any other metro area in the United States and a pedestrian death rate higher than the metropolitan areas around New York, Philadelphia or Washington…

Last year, 312 people died in traffic accidents in Los Angeles, the majority of them pedestrians and cyclists. “If 300 people died of something in the city, whether it was something violent or whether it was something else like Covid, the resources were put behind it to try to prevent those things, to respond to those things,” said Eunisses Hernandez, a member of the Los Angeles City Council. “We have not seen that same urgency with people dying in traffic accidents as pedestrians and as cyclists.”

Shameful doesn’t begin to describe it.

The solution, he says, is investing in safer road design with proven interventions like “narrowing streets, reducing the amount of space devoted to cars, enforcing speed limits and adding trees to provide visual cues for drivers to slow down.”

And he adds,

City planners must recognize that we all should be able to walk or ride a bicycle through our own neighborhood without fearing for our life.

Call it yet another example to too little, too late.

A mom walking her 6-year old daughter in a crosswalk was fatally run down by a driver, and her daughter critically injured, as they crossed the street in front of the girl’s school Tuesday morning.

The driver may or may not have been intoxicated, or could have been suffering a medical emergency.

So the LA city council has responded with a plan to install speed bumps near every elementary school in the city.

Which raises the obvious question of what the hell took them so long — particularly since the city has ostensibly had a Safe Routes to Schools program for the past several years?

And why the hell do we always have to wait until someone is needlessly killed before making even the smallest safety improvements?

At least they’re doing something now. Too late for an innocent mother and her equally innocent child.

But still.

Americans are in a toxic relationship with their automobiles. They’re bad for us—polluting, noisy, and increasingly dangerous to pedestrians—yet we remain fully committed to them. They’re also bad at their primary function: transport.

But this week’s fiasco with the gutting of the MOVE Culver City project to add a traffic lane certainly makes their case for them.

Spectrum News 1 reports California’s long-delayed $7.5 million ebike rebate program will finally launch sometime in the second quarter of this year.

Which is, like, now.

The program will be limited to California residents 18 or older, with a gross annual household income less than 300% of the federal poverty level.

The station reports that the standard tax credit will be $1,000, with an additional $750 for cargo or adaptive ebikes.

You can also receive another $250 if you live in a a disadvantaged or low-income community, or have a gross income 225% of the federal poverty level, or less.

Meanwhile, Tuesday’s meeting of the Pasadena Municipal Committee was cancelled, delaying approval of a proposed ebike rebate program for residents of that city.

An Orange County man could spend the rest of his life behind bars for the drunken hit-and-run death of a man on a bicycle.

Twenty-nine-year old Garden Grove resident Victor Manuel Romero was sentenced to 15 years to life following his conviction for second-degree murder and hit-and-run causing permanent and serious injury in the death of 33-year old Raymond MacDonald in Huntington Beach four years ago this month.

The wreck that killed MacDonald, a homeless resident of Huntington Beach, was just the second of three crashes in an alcohol-soaked crime spree that night.

Romero started off with a bar fight outside a local nightclub, following by crashing into the bar owner’s Caddy on his way out of the parking lot. He then slammed into MacDonald, before crashing into a tree, all without stopping until the tree stopped him.

He still had a blood alcohol content of .18 — over two times the legal limit — when he was tested hours after the crash.

Romero was subject to the murder charge after signing a Watson advisement following a 2012 DUI conviction, and admitted to police that he remembered signing it when he was arrested after running off from the last crash — after trying to claim that he’d been carjacked.

Three Michigan state troopers are facing criminal charges for beating the crap out of a bike-riding man last August.

All three have been charged with misdemeanor assault and battery, while one of the officers also faces a felony count of misconduct in office for the incident that began with a simple traffic stop, for not having lights on the victim’s bike.

The victim, who hasn’t been publicly identified, attempted to flee by riding off on his bike on the sidewalk after officers approached him, likely because he allegedly had a small amount of suspected fentanyl and/or heroin on him.

According to UpNorthLive,

A traffic stop was then conducted and the bicyclist was placed in to custody after “several physical strikes, taser deployment and OC spray deployment,” according to the report…

As the head of the state police said, excessive force against anyone by a police officer is “unacceptable and inexcusable.”

Especially for not having lights on a damn bicycle.

After years of talk and wishes, extending the Ballona Creek bike path eastward from the current terminus at Syd Kronenthal Park could be on verge of becoming a reality.

Or at least, a study to determine the feasibility of extending it could be.

Trying to extend it westward from its current terminus near the Pacific would just mean a lot of soggy bike riders.

Because drivers entering from side streets and driveways tend to look towards oncoming traffic, and may not see someone coming from their right.

A Menlo Park columnist says bike-riding councilmembers display their own bias through an unwillingness to preserve parking in a bike lane project intended to improve safety for school kids, arguing that there’s very little risk of a kid getting doored or hit by a driver backing out of a parking space.

Police in Denver are looking for the road-raging occupants of a stolen car who shot and wounded a man riding a bicycle, after a confrontation that began when they nearly crashed into him.

No bias here, either. A Florida columnist and retired paramedic says no kid needs a $2,000 ebike, because he once saw a kid riding one roll through a stop sign while looking at his cellphone. And somehow uses the tragic 40-year old case of boy who wasn’t wearing a seatbelt to illustrate the dangers of ebikes.

A bike rider on the Isle of Man was stopped by police three times and ordered to put his bike in their van after drivers complained about being unable to see him in foggy conditions. Which means they should slow down and drive more carefully due to the conditions — not have someone on a bike kicked off the road.

A suspect could face charges for shooting a man who was riding his bicycle on the Expo Line bike path near the Sepulveda E Line Metro station, nee Expo Line. Police detained the bike-riding suspect after he was spotted by fire fighters responding to the scene; no word on what may have led up to the incident.

Calbike calls for passing AB 825 in the state legislature, which would legalize sidewalk riding anywhere in the state on streets and highways that don’t include a Class I, Class II, or Class IV bikeway.
