Accused Dana Point killer mentally ill; LAPD’s version of Van Nuys bike rider shooting, and CicLAvia unveils April route

Now it makes a little more sense.

As if anything so random and violent could ever make sense.

The Daily Pilot is reporting that Vanroy Evan Smith was diagnosed with a mental disorder over two years before he allegedly murdered Dr. Michael Mammone — attacking first with his car, then finishing the job with a knife.

According to a child custody petition filed by Smith’s ex-wife, he was diagnosed with paranoid schizophrenia and bi-polar disorder following a meltdown in December, 2020.

Yet Smith was allowed to retain his driver’s license despite his illness.

Dr. Mammone apparently paid the price for that when Smith ran down his bike from behind, in what looks to be a deliberate, high-speed crash on PCH in Dana Point. He then got out of his car and repeatedly stabbed Mammone, who died hours later in the same emergency room where he sometimes worked.

Federal law would have prevented Smith from owning a gun with his illness. Yet he was somehow allowed to own and operate a motor vehicle, which became a deadly weapon in his hands.

Now the question is whether he will be found competent to stand trial, which will likely determine whether he gets treatment for his illness. Or spends the rest of his life in jail.

Or, hopefully, both.

Not surprisingly, the LAPD paints a different picture from what we got yesterday about the police shooting of a man riding a bicycle in LA’s Van Nuys neighborhood.

According to a press release from the department, the victim was wanted on an outstanding warrant for murder, and was also a suspect in an assault with a deadly weapon, when officers spotted him riding his bike Tuesday afternoon.

The officers drove alongside the victim, ordering him to stop, when he somehow “made contact with the patrol car’s passenger side mirror,” which caused him to get off his bicycle and flee on foot.

In other words, he fled after they hit him with the car’s mirror.

One of the officers pursued him on foot, at which point the man allegedly pulled a ghost gun out of his pants and pointed it at the officer, who fired, striking him.

He was treated at a hospital, and released into police custody, suggesting his wounds were not serious.

That’s the official version, anyway.

Whether we ever learn more depends on whether the patrol car and bodycam video is released.

Patch is reporting that a man in his 40s was shot by LAPD officers near Victory Blvd and Tyrone Ave in Van Nuys Tuesday afternoon, after they attempted to arrest him while he was riding his bike.

The victim, termed a “known suspect” by police, was shot after officers spotted a gun as he attempted to flee on foot. However, there’s no word on whether he fired or even brandished the weapon.

He’s reportedly hospitalized in stable condition. A gun was found at the scene after the shooting.

Only the release of bodycam video will tell us whether the shooting was justified.

This follows the highly questionable shooting of Dijon Kizzee by sheriff’s deputies, after Kizzee fled a traffic stop for riding salmon in 2020.

As usual, neither of the deputies who shot Kizzee 16 times ever faced charges.

Curbed’s Alissa Walker considers the danger America’s every-increasingly “macho” electric trucks and SUVs pose to everyone else around them.

Walker fittingly describes them as “dangerously powerful trucks driven by people who can’t see what’s in front of them, barreling through neighborhoods that were not designed for vehicles of this size.”

But the tame routes traveled by these vehicles don’t make them safe. Tracking of news reports and federal data by the advocacy group Kids and Car Safety shows that child “frontover” deaths — meaning cars driving forward over kids, not backing over them — have dramatically increased over the past decade, nearly doubling from 2009 to 2019 compared to the ten-year period before. During the same period, the average American pickup truck’s front hood grew 11 percent taller and vehicle weight increased by 24 percent, according to Consumer Reports. And in addition to their size, Macho EVs also have increased torque. In fact, only two trucks can go from 0 to 60 mph in 3 seconds, and they’re both electric: the Hummer EV and the Rivian R1T. But being able to accelerate so quickly in such a large vehicle creates an extremely dangerous combination. That extra power — the Hummer EV labels it, appropriately, “WTF” — has Hummer EV drivers posting videos where they’re struggling to control the vehicle. “I forgot how heavy this car is,” one driver says. “It did not want to slow down.”

Take a few minutes to read the whole thing.

Because this is definitely not the future we want.

A writer for The Malibu Times says a planned redesign of a 7.5 mile section of SoCal’s killer highway north of Malibu in Ventura County can’t happen soon enough.

The paper reports the section is currently the deadliest part of PCH, with 21% of the total crashes on the highway through Los Angeles and Ventura Counties occurring there.

After analyzing data, the engineer (Ashley Haire of Alta Planning and Design) stated, “There are a variety of different types of bicyclists. We have some long-haul tourists that are going through this area. We also have some folks who are good at riding in constrained spaces and are comfortable mixing somewhat with higher-speed vehicles. But overall this is a pretty scary section of road to ride a bike on. It’s not comfortable. Nobody’s out there taking their kids for rides.”

She goes on to explain that federal guidelines call for a separated bikeway when average speeds exceed 35 mph, which this section does.

“There’s really not a section of this project where people are only driving 35mph,” Haire stated. “We really think it would be important to have a separated facility out here, one that separates bicyclists and pedestrians from vehicular traffic, provides a safe barrier between those uses, and really gets folks out of harm’s way.”

Let’s hope they find the room for a fully protected bike lane. Or make it, if need be.

The Los Angeles Times says something has to be done to save the lives of California’s mountain lions, with over 500 killed by drivers in the last eight years; star Griffith Park puma P-22 was put down by animal control officers after he, too, was struck by a motorist.

Good idea. BikeLA, formerly the LACBC, is working with Wilmington business owners to clear the air in the largely Latino industrial community, one ebike at a time. Using a nearly half million dollar grant from the City of Los Angeles, the group is loaning 42 ebikes to local residents for six month, then giving them a chance to buy the bikes at a reduced rate.

Consumer Reports addresses the public panic over ebike batteries, with tips like sticking with OEM batteries, never charging your ebike overnight, and unplug your bike if the battery starts hissing. But check for snakes if it keeps hissing after your unplug it.

A Visalia bike shop is asking for the public’s help identifying a teenager who walked off with a bike while the shop’s workers were distracted.

A Berkeley op-ed says police enforcement should be a last resort in Vision Zero, used only after engineering and education efforts have failed.

Richmond has adopted a new Bicycle and Pedestrian Action Plan identifying 181 potential bicycle projects and 111 potential pedestrian projects. Of course, the key word there is “potential;” as we’ve learned the hard way in Los Angeles, even the most aggressive plan is meaningless without the political will to implement it. In what may be the most vital bike commuting article you’ll read this year, Momentum examines the best ways to carry coffee on a bicycle.

A new study published in Nature recommends a data-driven approach to Everesting, calling for elite cyclists to select a hill with gradient  over 12%, while amateur and recreational cyclists should choose a hill with gradient less than 10%.

Oregon’s proposed ebike rebate bill sailed through its first committee hearing in the state legislature; as the bill is currently written, it would offer up to $1,700 back on the purchase of an ebike. The LAPD is looking for a hit-and-run driver who seriously injured a bike rider in the Mid-Wilshire neighborhood earlier this month.

The victim was struck by the driver of a 2012 to 2017 Toyota Camry at the intersection of Venice and Hauser around 9 am December 7th.

No information has been given about the victim, who suffered serious, but thankfully, non-life threatening injuries.

As always, there is a standing $25,000 reward for any hit-and-run resulting in serious injuries in the City of Los Angeles. Anyone with information is urged to call LAPD detectives at 213/473-0234, or 877/527-3247 after hours.

A 91-year old Florida woman will spend what could be the last years of her life behind bars after running down a couple riding their bikes, then getting out to look at them, and just getting back in her car despite their serious injuries, and driving away to have it repaired at the local dealership; one of the victims called her “a heartless monster who only thinks of herself.”

$2 million for homeless man killed by police while holding bike part, and free Metro Bike ride through DTLA tomorrow

A federal jury awarded more than $2 million to the family of a homeless man who was fatally shot by an LAPD sergeant last year.

Thirty-one-year old Victor Valencia was erratically waving a bike part, which witnesses had mistaken for a gun. He was shot when he reportedly pointed the object at the officer.

However, a witness to the shooting claimed Valencia had his arms over his shoulders, and never pointed towards the cop.

Although I would have thought it was a gun, too, regardless of where it was pointed.

Then again, I’m not a cop. Or trained not to shoot unless a suspect is armed or someone’s life is actually in danger.

But we’ll all get to pay for it, anyway.

Unbelievable. A Memphis man riding a bike was run down by a driver leaving a parking lot, then intentionally run down again as he tried to ride away — after he swung his bike at the driver’s car, who repeatedly gunned the engine and lurched the car at him. All of it caught on camera, in front of witnesses, yet somehow, no arrest has been made.

A Georgia man faces felony charges for intentionally running down a man on a bicycle, after buzzing the bike rider just minutes earlier; he then tried to fight a witness trying to calm him down as the two men argued afterwards. Note to The Newnan Times-Herald — No, the truck didn’t ram someone on a bike, the driver did. And never mind that “Dodge Ram” is a brand name, while “Dodge rams” is an action.

Police in Santa Rosa are looking for a bank robber who made his getaway by bike after sticking up a Chase branch; they later found the bicycle, but the thief is in the wind.

A New Hampshire man faces multiple charges after fleeing from a police traffic stop on his bicycle while carrying a backpack packed with a loaded 9mm semi-automatic pistol, packages of suspected crack and heroin, and over $2200 in cash. His prize for his 21st arrest is getting charged as a career criminal.

The Aussie bicyclist caught on video screaming obscenities at a single mother who cut him off in traffic has been outed as a “high-flying executive” at some of Australia’s biggest financial institutions.

Maybe things have gotten safer.

Or maybe not.

A new study published in the Journal of Transport & Health found that collisions involving bicyclists decreased during the pandemic last year, as bike riders shifted from rush hour commutes to more midday rides, and from crowded roadways to offroad trails.

However, other reports suggest that bicycling collisions increased last year as the bike boom encouraged more riders to take to the roadways, with greater lethality as less crowded streets allowed motorists to drive more aggressively.

Unfortunately, we’ll have to wait until statistics for 2020 come out next year to know what really happened in the last one; right now, 2019 is the most recent year available.

And it remains to be seen whether things have reverted to previous levels as more traditional traffic patterns have resumed as businesses reopened this year.

But I’d put my money on things being worse, not better.

DTLA hit-and-run driver abandoned stolen car, US traffic deaths spike in 2021, and $1,500 federal ebike tax credit back in bill

More information on yesterday’s hit-and-run in Downtown Los Angeles.

The victim was riding an e-scooter against traffic when she was struck by the driver of a Chevy Spark; the impact threw her onto the sidewalk where she landed head-first.

She was hospitalized in the intensive care unit with severe head trauma, but is expected to survive.

And confirming yesterday’s speculation, the LAPD reports the car was stolen, which explains why the hit-and-run driver fled on foot while leaving the car behind.

An LAPD press release offered this description of the suspect.

The driver who fled was described as a 20- to 25-year-old man, 5 feet, 6 inches to 5 feet, 10 inches tall, weighing between 150 and 175 pounds with a tattoo of unknown writing on the right side of his chest. He was last seen wearing gray pants with a possible camouflage pattern.

Is anyone really surprised that US traffic deaths are up nearly 20% in the first six months of this year?

According to the press release below, that’s the largest six-month increase ever recorded, and the most deaths in the first six months of any year since 2006.

Meanwhile, a new AAA study shows fewer American drivers are running red lights or driving under the influence of alcohol or drugs, contradicting fears that stoned driving would spike as more states legalize cannabis.

At last, there’s a little good news out of Washington, as the latest version of the federal infrastructure bill restores the original $1,500 ebike tax credit, which had been cut to just $750 in a House committee.

The credit would cover 30% of the purchase price of ebikes costing up to $5,000, with a declining percentage above that for bikes up to eight grand.

LA’s hit-and-run plague just keeps on going.

The LAPD is looking for a shirtless driver who ran off on foot after crashing into a woman riding an e-scooter in DTLA.

The victim was riding against traffic when she was struck, which means the driver probably wouldn’t have faced any consequences if he’d just stuck around.

Instead, he abandoned his car and fled on the sidewalk, for reasons known only to him at this point. It could be that he was drunk or stoned, the car was stolen, or possibly he was in the country illegally and feared deportation.

Or any one of a number of other possible explanations.

Meanwhile, the victim was hospitalized with a head wound, which means there is an automatic $25,000 reward for the arrest and conviction of the suspect.

Police ordered a group of 200 to 300 mostly teenage bike riders to disperse Sunday afternoon after they were accused of stealing $300 to $400 worth of alcohol and other items from a Signal Hill Food 4 Less.

The teens were taking part in an organized rideout captured in a pair of videos.

Just one more example of keeping a dangerous driver on the roads until it’s too late. He should have been jailed and his car confiscated after the second offense. 

More proof that bike lanes work, as the latest round of data from New York’s Department of Transportation shows painted bike lanes reduce the risk of injury to bike riders by nearly a third, while increasing ridership an average of 50%; protected bike lanes reduced injuries as much as 60%.

Talk about a rough year. A celebrity chef has filed suit against the NYPD alleging he was brutally beaten for violating a curfew when he attempted to deliver a pizza for a bicycle delivery service, after losing his restaurant when he caught Covid-19.

A suspect has been taken into custody after a body was discovered in the New Jersey headquarters of Jamis Bikes; no word yet on who was killed or how it happened.

No bias here. After a Louisiana bike rider was injured in a collision, police bent over backward to blame the victim, while the story fails to mention that the pickup that hit him even had a driver.

No surprise here, as data from around the world shows that bikeshare usage goes up with warmer temperatures until it gets too hot, and wet weather discourages people from riding. In other news, water is wet, the pope is Catholic, and bears defecate in wooded areas.

The LAPD is looking for a hit-and-run driver who left-crossed a man on an e-scooter in Huntington Park, then fled the scene dragging the dangling rear bumper of her car behind her.

As always, there is a $25,000 standing reward in the City of Los Angeles for any hit-and-run resulting in serious injury.

But be warned before you click on the video.

It clearly shows the crash from multiple angles, and could be very hard to watch.

And you can’t unsee it if you do.

The war on cars may be a myth, but the war on bikes just keeps going on.

No bias here. A proposal before the Massachusetts legislature would “improve” bike safety by fining bike riders as much as motorists for traffic violations, even though bicycles pose a fraction of the risk to others.

No bias here, either. DC’s conservative newspaper suggests the bike lobby is running the city, and forcing anti-car tactics on the unsuspecting driving public by reducing speed limits and improving safety on high risk corridors. And insists some crashes are caused by medical emergencies rather than reckless drivers, and sometimes bike riders might even be at fault. But unlike drivers, reckless bike riders hardly ever kill anyone.

A road-raging farmer in the UK was convicted of attacking a bike rider who followed him home to confront him after a punishment pass, because the man on the bike was riding in the roadway instead of on a separated bike path next to it; he was fined the equivalent of a whopping $146. I know as well as anyone how tempting it is to follow a driver who threatens your safety. But seriously, don’t. Just let it go and get on with your life.

But sometimes, it’s the people on two wheels behaving badly. 

London bike riders are caught on dashcam video “recklessly” jumping a red light, even though there wasn’t any cross street, and after waiting for pedestrians to cross.

Arrest made in fatal Vista Del Mar hit-and-run, PCH shoulder closing near Point Mugu, and feds cut ebike tax rebate

It looks like the LAPD got their man.

Police arrested 39-year old Darwin Dantzler for the hit-and-run death of a mother as she carried her three-year old son across Vista Del Mar last weekend.

Wendy Galdamez Palma was attempting to make her way from the beach to her car parked on the other side of the deadly roadway. She reportedly turned away from the onrushing car, sacrificing herself to save her child.

Palma would not have had to cross the street if city leaders had the courage to keep a road diet in place that shifted parking to the west side of the street to protect beachgoers, after a 16-year old girl was killed crossing the street several years ago.

The city settled a lawsuit over that crash for $9.5 million.

Palma’s death will likely cost Los Angeles a lot more, after city leaders caved in to demands from angry pass-through drivers used to using the street as a free-flowing  freeway bypass, ripping out the road diet and returning Vista Del Mar to its previous dangerous state.

And making another death virtually inevitable.

Authorities showed just how seriously they don’t take traffic crime in California, releasing Dantzler on a remarkably low $50,000 bail, given the seriousness of his crime.

Then again, he faces a maximum of just four years behind bars for felony hit-and-run. And if he’s convicted, he’ll likely serve less than half of that with good behavior.

Meanwhile, Wendy Galdamez Palma was — allegedly — given the death penalty at Dantzler’s hands.

And her husband and kids will have to somehow find a way to go on without her.

Caltrans will be closing a section of shoulder on southbound PCH in Ventura County for several months to repair damaged retaining walls.

If you ride through that area, you can expect to share the right lane with motorists.

But at least they’ll be dramatically lowering the speed limit through the construction zone. Let’s just hope drivers obey it.

Especially when someone on a bike is in front of them.

PeopleForBikes is urging everyone to voice your support for a proposed federal ebike tax credit and bike commuter benefit.

Although Treehugger argues, correctly, that ebike incentives are laughable compared to those for electric cars — especially after the House Ways and Means Committee cut the proposed benefit in half to just 15% of the purchase price, with a max of a lousy $750.

But at least that’s $750 we wouldn’t get otherwise.

Meanwhile, Calbike wants you to email Governor Newsom and urge him to sign AB 122, aka the Bicycle Safety Stop Bill, which will allow bike riders to treat stop signs as yields. Which most of us already do anyway.

AAA and the CHP had an outsized influence on our last governor. Hopefully they won’t oppose this bill. Or if they do, let’s hope Newsom listens to more enlightened voices and signs it anyway

And congratulate him on keeping his job while you’re at it.

Malibu meeting on PCH widening tonight, LAPD whiffs on crosswalk law, and warning about scam bike websites

If you ride PCH — or want to — clear your schedule for tonight.

The Malibu Planning Commission will hold a virtual meeting this evening to consider a proposal to improve the median and widen the shoulders on a two-mile section of PCH, between Webb Way and Puerco Canyon Road.

As you may recall, we sounded the alarm about this proposal last month, which is described as a plan to improve safety for people on bicycles by providing more space to ride on the shoulder, while also providing additional curbside parking.

Put another way, the proposal appears to put bikes in the door zone, instead of providing protected bike lanes.

Or maybe not.

Someone who claimed to be involved in what he described as a decade-long process to develop the plan insisted I’d gotten it all wrong and the plan wouldn’t add a single parking spot — even though it said just the opposite.

And that it would be a big safety improvement for the deadly highway, especially for people on bicycles.

Although what PCH really needs is narrower traffic lanes and far slower speeds.

Admittedly, while I used to be involved with the PCH Task Force, I haven’t been able to keep up with it since the one-two punch of diabetes and neuropathy knocked me on my ass half decade ago.

So I can’t speak to just what this plan does or doesn’t do, other than what was in the description.

But if you ride PCH, you owe it to yourself to voice your concerns and tune into the meeting to see whether it would help tame LA County’s killer highway and keep you — and everyone else — safer as you ride through the ‘Bu.

Or if this one needs to go back to the drawing board.

Nothing like cops doing the right thing, but getting the law wrong.

They’re right that drivers are required to stop for pedestrians in painted crosswalks.

But drivers are also required to yield to pedestrians at any unmarked crosswalk at an intersection, per CVC 21950. And every intersection is presumed to have a crosswalk, whether marked or not, unless signage prohibits crossing.

So bottom line, drivers have to yield to pedestrians at any crosswalk, painted or otherwise.

And don’t get me started on whether people on bikes are allowed to use the crosswalk.

But like I said, at least they’re doing the right thing.

Road.cc is warning about a sudden proliferation of fake websites designed to take advantage of the bike boom to scam you out of your money.

Or rather, the website is real. But the deals and companies offering them aren’t.

With bikes currently being in such strong demand globally, it has become increasingly difficult to get the bike you want when you want it, with lead times often running into several months – and in response, we’re hearing more reports of fake websites trying to part people from their cash for bicycles that don’t exist, apparently offering deals that seem to good to be true, because they are.

While that alone may set alarm bells ringing among many prospective purchasers who will quickly realise that they risk being scammed, what the operators of such sites are banking on is that human nature being what it is, others will place an order and never see the bike, or their money, again.

They also include this sage advice from Trek’s British website on how to spot scammers.

The deal is too good to be true

If an advertisement is telling you that the bike you want is now 70%-90% off, they are lying to you. Do not click on the ad. Do not give them your money or any personal information.

The contact information is suspicious

Trek and our retailers hold ourselves to a very high standard of customer service. If you cannot reach the person you are buying from, do not buy from them.

The site is relatively new

You can check to see how long a website has existed by entering it into archive.org. If the site is brand new and offering steep discounts, do not purchase anything from them.

The site does not ask you to pick a preferred retailer

All current model Trek bikes ordered online must be delivered to an authorised Trek retailer for assembly. If you are not asked to select a retailer to dispatch a bike to, do not buy from the site. Previous model year Trek bikes can be delivered directly to consumers, but only through an authorised retailer’s website or BikeExchange.com.

In other words, stick with sites you know. Or better yet, check with your local bike shop before you buy anything online.

And caveat emptor.

A new report on the economic benefits of bicycling investments recommends investing billions into bike projects to generate thousands of jobs while greening transportation in the US.

Another new study suggest bicycling can be a literal backbreaker, with a full 81% of sports-related spinal injuries among U.S. adults due to bicycle falls and crashes.

Popular Mechanics offers their picks for the best hitch-mounted bike racks. Just remember, any rack that obscures the license plate is illegal, although it’s one of those things where you’ll probably get away with it, until you don’t.

Have guitar, will travel. Colorado singer-songwriter Shanna In A Dress is touring the US by bicycle for a series of shows from Oregon to Massachusetts, while raising funds for the Pangea World Foundation.

A Salt Lake City woman with a long criminal record faces murder and gun charges for fatally shooting her girlfriend as she tried to get away, following an argument while they were riding their bikes together.

Life is cheap in South Dakota, where you can run down and kill an innocent person walking on the side of the roadway while driving home after drinking at a fundraiser, then just tell the police you thought it was a deer when they knock on your door, and end up walking away with a plea deal for a lousy misdemeanor traffic violation. Or at least you can if you’re the state attorney general.

That’s more like it. A new Illinois law requires the state to conduct a traffic study anytime a pedestrian is killed on a state roadway, including recommendations for possible design improvements, with the results to be publicly posted. Add people on bicycles to that, and that’s what should happen whenever someone is killed on any roadway.

A Rhode Island bike rider unexpectedly discovers signs for a useful, but forgotten, cross-city bike route that no one seems to know about anymore. Or care about, which could be worse.

A North Carolina paper looks back to three teenagers’ life-changing, five day, 425-mile ride through the state’s Outer Banks, which led one to devote his life to researching the region’s maritime history.

You could get a belt-drive urban ebike for just $1,300 — but only if you move fast.

CyclingTips considers that $28,000 Louis Vuitton bike with the bizarre backward suicide handbrakes. Which is a lot of money for something that will probably get you killed the first time you have to make a panic stop. Then again, if you can afford the bike, you can probably afford to pay someone to ride it for you. 

Take a tour of Colombia’s Boyacá region with native son Miguel Angel Lopez of the Movistar cycling team. Bonus points if you spell it “Colombia,” rather than “Columbia,” which I inevitably do before correcting myself.

Glasgow, Scotland has adopted a Vision Zero plan, with the goal of ending traffic fatalities and serious injuries on the roads by 2030. Although as we’ve learned the hard way here in Los Angeles, it’s meaningless without the political will to make the hard choices, which we clearly lack.

Life is still cheap in the UK. Earlier this week, we mentioned the English driver who was sentenced to three years and four months behind bars for the hit-and-run death of a 15-year old boy riding a bike. But what was missing from the the original story was that the driver abandoned the borrowed car he was using, and calmly took a cab home without bothering to even mention the crash to anyone. No wonder people are calling the sentence a joke.

Industry insiders say God only knows when the Great Britain’s bike shortage will finally end.

A new German-made, four-wheeled, self-propelled bike trailer promises you won’t have to work any harder to pull it, and it will easily follow your bike wherever you go, at speeds up to 19 mph. It might be just a bit pricy, though, available for rent for a tad under $600 a month.

Why let a little bad weather stop you, even if it means floating your mountain bike through neck-high Singapore flood waters.
